The policy required an annual compliance report to be presented to the City Council at a public meeting at least annually by the Economic and Community Development Department staff at the second meeting in July each year or soon thereafter. In addition, staff is required to provide City Council with a written status report on Sub- recipient compliance mid-year for the periods of January 1 st through June 30 th , and July 1 st through December 31 st of each calendar year. Attached is the sub-recipient compliance status report for the period of July 1, 2015 through December 31, 2015. Each listed above have various compliance requirements described in their corresponding regulatory agreements. Sub-recipient Agency & Activity Monitoring consists of site visits to the location where the activity is conducted. Listed below are the agencies visited. These monitoring site visits were conducted during the month of October 2015 for agencies funded with fiscal year 2015-16 Community Development Block Grant and Human Services Funds. In addition to Community Development Division staff attending, Human Services Commissioners attended the site visits as well. The site visit has two components, one is the agency’s fiscal management, and the second is the program compliance with the Federal, State and local requirements as described in the Funding Agreement.

The 2015-16 Subrecipient Monitoring Report submitted to the Human Services Commission during the November meeting is attached. There is one agency that has an unresolved finding; that agency is the Santa Barbara County District Attorney’s Office and the finding is due to lack of submission of a quarterly beneficiary data report and request for reimbursement which was due in October 2015. Multi-Family Affordable Housing Monitoring begins in February – April of each year typically, but due to the Department of Housing and Urban Development’s (HUD) late release of the 2015 Income Limits this process was delayed until the revised income limits were released in May. Notices of upcoming inspections were sent to Property Management Companies and Property Owners the first week of May and site inspections began May 21, 2015. Eighteen multi-family properties were included in the Housing Quality Standards (HQS) component of the monitoring review.

Community Development Division Staff selected at random a minimum of twenty-five percent of the occupied units and all of the vacant units from the Occupancy Summary Report to conduct HQS inspections on and notified the Property Manager and Property Owner a minimum of 72-hours in advance of the inspection date. If the results of the review of the vacant units or of the 25% of project units indicated there were repeated violations of housing quality standards, 100% of the units would be inspected. One property on the Multi-Family Property Monitoring Report does not have the requirement for HQS inspections nor does the regulatory agreement recorded against such property allow for the inspections of the units. The “Physical” inspections consist only of ensuring the property is free of debris.

Unit inspections (as applicable) were completed June 16, 2015. Property owners were then allowed 30-days to complete necessary corrective action, and City staff re-inspections were conducted in August 2015. During the 2015 Affordable Housing Monitoring, Community Development Division staff completed inspections of 78 units of the total 313 units under regulatory agreement and all units inspected are in compliance as of August 2015. Single-Family Affordable Housing Monitoring consists of annual confirmation and verification of the owner-occupancy requirements described in the regulatory agreements recorded against Single Family homes either through Inclusionary policy requirements, Redevelopment Agency, Community Development Block Grant, HOME Investment Partnership or Lompoc Affordable Housing Trust Fund assistance provided to the developer or homeowner. This includes those homes that receive assistance under the Single Family Rehabilitation Loan Program. Forty-one homes were monitored during the 2015-16 Affordable Housing Compliance Monitoring. The Single-Family Properties Monitoring Report is attached detailing the Project Name, Property Address, Owner, Type of Regulatory Agreement including the date of maturity, the date the owner-occupancy was confirmed and the date of expiration of the insurance policy for the property. Commercial Loan Monitoring regulatory agreements have maintenance requirements. Typically the regulatory agreement requires the borrower “Maintain the Property in a manner reasonably satisfactory to Agency.” For the one property currently under regulatory agreement a drive-by inspection was conducted to verify the property is in good physical appearance. Fiscal Impact:

While there is no direct fiscal impact apparent through accepting this monitoring compliance report, there is a fiscal component related to the cost of staff time to conduct such monitoring. This process is ongoing throughout the year with the various components described above. Conclusion: Combined, the attached spreadsheets provide a comprehensive reporting of the monitoring compliance requirements as described in the Sub-recipient Financial, Programmatic and Monitoring Report Requirement Policy, Section B, Number 6.
