INFORMATIONThe undersigned City Prosecutor accuses Luxanna Dewitt of the

crime of Violation of Batas Pambansa Blng. 22, committed as follows:

That on October 31, 2007 in the Villa Kananga, Butuan City, Philippines, and within the jurisdiction of the Honorable Court, accused Luxanna Dewitt did then and there willfulling, unlawfully and feloniously issue and deliver BPI Check No. 7777 post dated December 5, 2015 in the amount of Five Thousand Pesos (P5,000.00), Philippine Currency, to secure payment of his obligation to Booker Dewitt, but when the said check was presented for payment with the drawee bank on its due date, the same bounced for the reason that the account of Luxanna Dewitt was already closed, and that withstanding repeated demands made on the accused to pay and/or change the check to cash, accused failed and still fails and refuses to redeem the check, to the damage and prejudice of Booker Dewitt, in the aforestated amount.
