NIGEL PLEMING qc (Call 1971, Silk 1992)

Nigel has been advising and representing central and local government for over 30 years. Recently he has been advising a group of local authorities on a

challenge to a 3rd runway at Heathrow, and most of the local authorities in England and Wales on charging for environmental information. He continues to advise on a wide range of issues relating to local authorities’ powers.

 

JOHN STEEL qc (Call 1978, Silk 1993)

John advises private clients and local authorities concerning regulatory, planning, major and infrastructure projects including airports and

HS2, and is a recognised leader in a number of these areas. He has recently advised the LGA and Councils concerning Ecotowns, upon joint economic regeneration by groups of authorities, and JR challenges concerning government airports.

 

PETER VILLAGE qc (Call 1983, Silk 2002)

Peter has over 30 years experience in advising local authorities and landowners in relation to local government related issues, particularly but

not exclusively, in the context of development, and in particular highways, compulsory purchase, drainage, commons registration, footpath registration, local taxation (rating, CIL), procurement and general vires issues.

TIMOTHY LYONS qc (Call 1980, Silk 2003)

Timothy is regularly instructed by local authorities and handles disputes in relation to all direct taxes, and indirect taxes such as national

insurance and VAT. His background has also ensured that his opinions on the Community Infrastructure Levy are much sought after, not least in relation to the impact of EU state aid law. He also works in the areas of public procurement and EU environmental law.

STEPHEN TROMANS qc (Call 1999, Silk 2009)

Stephen has acted both for and against local authorities on numerous major matters in the areas of environmental and planning law. Recent work

has included appearing for a local authority at a major planning inquiry into proposed urban extensions; disputes over contaminated land and waste management contracts.

RICHARD HARWOODobe qc (Call 1993, Silk 2013)

Richard specialises in planning, environmental and public law. His local authority work also includes vires, standards,

compulsory purchase, countryside and highways matters. He is the author of Historic Environment Law,Planning Permission, Planning Enforcement and co-author of Planning Policy. Richard also practises from the Bar Library, Belfast.

LISA GIOVANNETTI qc (Call 1990, Silk 2011)

Lisa specialises in public law and judicial review, with a particular interest in human rights issues. She has extensive experience of local authority work,

including Court of Protection matters, housing and social care and has provided specialist advice to local authorities on issues relating to the immigration status of looked after children.

ELEANOR GREY qc (Call 1990, Silk 2011)

Eleanor has extensive experience in public and administrative law generally, and in Freedom of Information and Data Protection law specifically.

Eleanor has a highly regarded investigations and public inquiry practice and she is recommended for public inquiries and data protection law in both Chambers & Partners and the Legal 500. She also has extensive knowledge of the health and social care sector, including of the interrelationship between local government and the NHS. range of areas. She appeared in the long-running litigation concerning the Ricoh arena in Coventry, and has acted in leading cases concerning the division of responsibility between local authorities and the NHS and the duties of local authorities to children. CHRISTIAAN ZWART (Call 1997)

Christiaan regularly advises and acts for local authorities on all planning, CPO, and finance matters including CIL, rating, VAT and direct tax. He has undertaken

numerous planning inquiries of all scales on behalf of planning authorities, acted in DCO hearings, and promoted compulsory purchase orders, undertaken various rating appeals for local authorities and acted in judicial reviews.

 

ADAM FULLWOOD (Call 1996)

Adam specialises in adult social care, asylum support, care homes, charging assessment disputes, ordinary residence disputes, education, Equality Act

2010, mental capacity and health and social housing (especially homelessness law). He is recommended in the current Legal 500 and Chambers & Partners for public law, court of protection, social housing and civil liberties and provides training for local authorities on request.

DUNCAN SINCLAIR (Call 1996)

Duncan is a public and EU law specialist who has acted for local authorities in respect of public procurement matters including energy supply

COLIN THOMANN (Call 1999)

KATIE SCOTT (Call 2000)

Katie has a busy local government practice which focuses in the main on mental health, mental capacity, community care and costs. She regularly

appears in the Administrative Court in judicial review proceedings and in the Court of Protection in a range of health, welfare and property and affairs cases. In addition she advises and represents a range of local government clients in a wide range of costs disputes.

SIAN DAVIES (Call 1999)

Sian has experience in advocacy, advice, and drafting in public law matters, across the full range of legal issues encountered by adult

social services, children’s services and housing departments. She also has a background in immigration, asylum and EU law as well as a strong Court of Protection practice.

NEIL ALLEN (Call 1999)

Neil regularly undertakes work for Local Authorities, typically in the Court of Protection but also in respect of matters arising under the Mental Health Act

1983, including displacement of nearest relatives and the provision of after-care services. He has experience in defending applications for judicial review and dealing with issues arising from NHS continuing health care assessments.

 

ALEX RUCK KEENE (Call 2002)

Alex is a noted expert in mental capacity and mental health law, is recommended for Administrative and Public Law and Court of Protection work in

Chambers & Partners and the Legal 500. He also lectures, trains and writes extensively in the area, including co-editing the Chambers Mental Capacity Law Reports. MUNGO WENBAN-SMITH (Call 2004)

Mungo’s local government practice focuses on community care, mental health and capacity, and homelessness. He appears on behalf of public bodies

and individuals in the high court in judicial review proceedings; before specialist tribunals; the county court on statutory appeal; and frequently in best interests proceedings before the Court of Protection.

FIONA PATERSON (Call 2003)

Described as “an absolute star” by Chambers & Partners, Fiona has been ranked by the directories as a leading junior in the fields of Administrative and

Public Law, Court of Protection and Regulatory Law. A member of the Attorney General’s B Panel, Fiona has a broad public law practice involving cases both for and against the state, involving fundamental human rights. She has acted in two of the three appeals to the Supreme Court under the Mental Capacity Act 2005; namely N v A CCG and Y v An NHS Trust and Ors and for one of the most restricted patients in Broadmoor Hospital in Djaba v West London Mental Health Trust in which the Court of Appeal examined the applicability of the Human Rights Act 1998 to the powers of Mental Health Tribunals. Before coming to the Bar, Fiona practised for 9 years as a solicitor, specialising in all aspects of healthcare law and acting both for claimants and defendants. She also worked as a research assistant for the mediation provider, CEDR examining the possible use of mediation in clinical disputes and training as a mediator. Fiona has participated in a wide variety of mediations, both as a lead and assistant mediator, often involving multiple nationalities and cultures.

ANDREW DEAKIN (Call 2006)

Andrew has a busy public law and human rights practice. In local government context he has particular experience of judicial review in the

areas of community care, immigration and mental health. Andrew advises the government on freedom of information and data protection issues. He also acts in complex inquests, particular those raising Article 2 ECHR.

CAROLINE ALLEN (Call 2005)

Caroline regularly appears at inquiries and hearings on behalf of local authorities. She has considerable experience of enforcement proceedings at Magistrates’

and Crown Court level. She undertakes a broad range of related advisory work and spent a year on part-time secondment to New Forest District Council dealing with a wide range of local authority matters.

 

ALEXIS HEARNDEN (Call 2005)

Alexis’ local government practice has a strong emphasis on mental health and social care. She appears in the High Court and County Court and has

acted for local authorities settling disputes (eg. section 117) via ADR. Alexis has considerable experience in the Court of Protection involving a wide range of issues such as consent to medical treatment, marriage, sex, as well as residence and contact disputes. PETER MANT (Call 2006)

Peter local government practice focuses, in particular, on mental capacity and community care. He regularly appears in the Administrative Court

in judicial review proceedings and in the Court of Protection in a range of welfare and finance cases.

  KELLY STRICKLIN-COUTINHO (Call 2006)

Kelly acts for and against local government, specialising in cases involving commercialisation and regeneration. Her

recent lead cases include R (Sky Blues) v Coventry City Council (in proceedings up to the Supreme Court) in respect of alleged aid to Wasps rugby team, and Amey Highways Limited v West Sussex County Council [2019] EWHC 1291 (TCC) in respect of damages on abandonment of a procurement, and she is currently junior counsel to the Grenfell Inquiry. She acts on State aid matters involving all aspects of the GBER and particularly in relation to regeneration. She has acted on challenges to Community Infrastructure Levy by High Net Worth Individuals. She acted in the Royal Mail GLO, one of the Lawyer’s top 20 cases for 2017, which concerned VAT and which involved the majority of local authorities in the UK. She is currently acting on a substantial challenge to grant funding brought on the basis of EU law and public law principles. She is recognised in the directories as a leading practitioner in EU law and tax law, in International Tax Review as a leader in tax disputes, and she is a visiting lecturer at King’s College London where she teaches EU law.

JENNIFER THELEN (Call 2007)

Jennifer was instructed in the case of Davis v London Borough of Brent, a seven-week trial in the Chancery Division, on behalf of the local authority,

in a fraudulent conspiracy claim involving a maintained school, which resulted in High Court findings of breach of fiduciary duty in respect of the head master and two ex-governors, as well as a finding of misfeasance in public office against the two ex-governors. The case was notable for its finding that section 49(5) of the School Standards and Framework Act 1998 gave rise to a fiduciary relationship between the head and governors, and the local authority. Jennifer regularly advises local authorities regarding education matters, including special educational needs, and appears on their behalf at First-tier Tribunals, Upper Tribunals and in judicial review challenges, including a recent challenge to special school reorganisations. She is also regularly instructed by local authorities in employment and freedom of information/data protection matters.

 

THOMAS AMRAOUI (Call 2007)

Thomas brings particular expertise in education law, community care, housing and child welfare law. Tom has made numerous appearances for local

authorities in special educational needs cases, and regularly advises and represents local authorities in the fields of community care, age assessments, human rights and support under the Children Act 1989.

 

JACK HOLBORN (Call 2008)

Jack has a wide public law and Court of Protection practice. In the Court of Protection he regularly appears for local authorities, family members and the

Official Solicitor. He has particular experience in community care, immigration and constitutional law, as well as commercial public law issues having previously worked at Allen & Overy.

KATHERINE APPS (Call 2006)

Katherine’s practice spans local government and public law, human rights, EU law, equality law, employment, pensions, education, procurement, contracting,

social welfare, safeguarding and ordinary residence. Described as “incredibly bright,” “very good with clients” and a “pleasure to deal with” who “gives solid advice,” Katherine has been appointed to the Attorney General’s A Panel of Counsel and the EHRC B Panel of Counsel. She is an arbitrator for Sports Resolutions panels on Commercial Disputes, Integrity and Discipline, Discrimination and the National Safeguarding Panel. Her reported local government cases include Isle of Wight Council v HMRC [2017] 2 All E.R. 105.

ANNABEL LEE (Call 2010)

Annabel has a broad practice in local government law including the areas of education, community care, mental health, freedom of information and human

rights. She has previously undertaken a part-time secondment at a local authority working with the in-house legal department.

 

ROSE GROGAN (Call 2010)

Rose specialises in public law, environmental law and planning law. She has particular experience in procurement, public sector contracting and healthcare

and regularly represents and advises NHS bodies and local government. She also regularly acts for and advises local authorities on environmental issues. She has particular experience in contaminated land, statutory nuisance and air quality. Rose is on the Attorney General’s B panel of counsel and is ranked in Chambers and Partners for her local government practice.

 

BENJAMIN TANKEL (Call 2009)

Benjamin’s practice includes community care, education, Children Act, housing, procurement, information rights, employment and compliance. Benjamin co-

wrote the most recent Atkins title on Education. He has appeared in all types of tribunal, in particular in the Administrative Court.

DANIEL STEDMAN JONES (Call 2011)

Daniel is developing a wide practice in local government law. Since becoming a tenant he has focused on planning and judicial

review and his clients have included various local authorities as well as developers and commercial organisations. He has appeared in many different courts and tribunals including the county courts and the High Court.

 

CATHERINE DOBSON (Call 2009)

Catherine is regularly instructed by local authorities in judicial review claims concerning mental health, care home fees, the public sector equality duty

and planning matters. She also practices in the Court of Protection. She teaches human rights and information law as part of the constitutional law course at Cambridge University, where she is a bye-fellow at St Edmund’s College.

PHILIPPA JACKSON (Call 2008)

Philippa has an extensive local government practice, and regularly advises and acts for local authorities in matters relating to planning and environmental law,

education law, community care and mental health, data protection, and employment law. She has also previously undertaken secondments to both a County and a District Council.

JONATHAN DARBY (Call 2012)

Jon regularly advises local authorities on a range of planning and environmental matters, including as they relate and interact with freedom of information

legislation. He is ranked by Chambers & Partners as a leading junior for planning law (Band 5) and is listed as one of the top planning juniors in the Planning Magazine’s annual survey. Jon’s wider public law practice provides him with a particular expertise in statutory challenges and applications for judicial review, in relation to which he has acted for claimants, defendants and interested parties. Nicola has acted for local authorities in a wide range of cases from deprivation of liberty to public highway claims. She is also a contributor to the Local

Government Bulletin. She accepts instructions in all areas of chambers work with a particular emphasis on public and administrative law and general common law. She frequently appears in both the county court and the High Court.

 

VICTORIA HUTTON (Call 2011)

Victoria regularly acts for and against local government authorities in all areas of public law. Her main interest is planning and environmental law and

she has recently been voted one of the top 10 barristers under 35 (Planning Magazine 2015). She regularly appears at planning inquiries, judicial review hearings and section 288 challenges and advises a variety of clients on public law issues.

MELISSA SHIPLEY (Call 2011)

Melissa joined Chambers in 2014 after the successful completion of her pupillage. Since then she has completed a secondment at a local authority where

she advised on a wide range of local government matters. Recent advices have included: the applicability of the Freedom of Information Act; potential alteration of tenancy agreements for housing schemes; and the applicability of the Transport Act 2000.

 

TOM TABORI (Call 2011)

Tom accepts instructions in all areas of local government law, including electoral law, the ECHR and the Charter, the Equality Act (PSED, EIA

and discrimination), education law, community care law, mental health law, employment law, constitutional law, and local government finance. He is regularly instructed in judicial review claims and in statutory appeals.

SARAH BOUSFIELD (Call 2013)

Sarah has a broad practice which includes public and education law. In addition to working on various high profile judicial review cases as part of a team, Sarah

has recently represented local authorities in civil law disputes and been instructed in respect of a case concerning a ‘statement’ of SEN before the Special Educational Needs and Disability Tribunal.

 

ADAM BOUKRAA (Call 2013)

Adam has a broad public, regulatory and environmental law practice. A significant amount of his work relates to local government, including

appearing in the Court of Protection and SEND Tribunal, as well as acting in age assessment claims in the Administrative Court and Upper Tribunal. Adam has particular experience of consultation challenges, and recently represented a local authority in a judicial review following the closure of a day centre for adults with learning disabilities (led by Jenni Richards QC). He also has a growing environmental law practice, with a particular interest in contaminated land issues.

  KATHERINE BARNES (Call 2014)

Katherine is a public law specialist whose work spans planning, education and community care matters. In the planning field she acts for local authorities

at inquiries and in High Court challenges. She is currently listed as one of the ‘Highest Rated Planning Juniors under 35’. Her broader public law practice includes bringing and defending claims for judicial review (for example, she recently acted in a successful challenge to cuts to special educational needs funding), Court of Protection work and specialist education tribunal work. Much of Katherine’s work has a human rights or equalities element.
