NEW ORDINANCEB.A.LL.B.(Hons) 5 YEAR COURSE SEMESTER SYSTEM, 2009

1. The duration of the course leading to the B.A.LL.B.(Hons) Degree shall be of fiveacademic years. Each year shall be divided into two semesters i.e. July to

November/December and January to April/May. The examination shall ordinarily beheld in the month of December and April/May on such dates as may be approved bythe Vice-Chancellor.

2. The schedule of dates fixed in accordance with Clause-1 shall be notified by theController of Examinations.

3. The last date by which the examination forms and fee must reach the Controller ofExaminations shall be approved by the Vice-Chancellor.

4. A candidate, who fulfils the following conditions shall be eligible to seek admissionin the First Semester of B.A.LL.B.(Hons) 5 Year Course:

i) has passed an examination in 10+2 course of a school recognized by the

educational authority of Central or State Government with 45% (40% forSC/ST) marks in aggregate.

ORii) Possesses any other equivalent academic qualifications recognized by this

University. Those who have done graduation or Post-graduation shall notbe eligible for B.A.LL.B.(Hons) 5 Year Course.

EXPLANATION:Further, a candidate seeking admission in B.A.LL.B.(Hons) 5 Year Course shall not be

more than 20 years of age (as on 31st July of the concerned session). However, in case of SC/STcandidates the age should not be more than 22 years.

5. A person who has passed the Semester I or II or III or IV or V or VI or VII or VII I orIX shall be eligible to join the Semester II or III or IV or V or VI or VII or VIII or IXor X respectively of the B.A.LL.B.(Hons) 5-Year Course. This is, however, subjectto Clauses-12 and 13 below.

6. The examination of Semester I/II/III/IV/V/VI/VII/VIII /IX/X shall be open to astudent who:-

i) has passed the requisite examination as laid down above in Clause 4 and 5, asthe case may be, or is covered under Clause-13 below; and

ii) has his name submitted to the controller of Examinations by the

HOD/Director and produces the following certificates signed by him:

a) of having good characterb) of having remained on the rolls of the Law College for the semester

concerned proceedings the examination;c) of having satisfactorily performed the work of his class.

-2-d) of having attended not less than 75% of the lectures in each semester as

also in practical training (to be counted upto the last day when theclasses break up for the preparatory holidays).

7. A candidate on the rolls of the Law College or an Ex-student shall submit hisapplication for admission to an examination on the prescribed form with the requisitecertificate duly countersigned by HOD/Director or a senior member of the teachingstaff nominated by him.

8. The amount of admission fee to be paid by a candidate for each Semester shall be asprescribed by the University from time to time.

9. The medium of instructions shall be English. However the medium of examinationshall be English/Hindi. Question paper, however, will be supplied in English only.

10. Candidates shall be examined according to the scheme of examination and syllabus asapproved by the Academic Council from time to time.

11. The minimum number of marks required to pass in each paper of B.A.LL.B.

I,II,III,IV,V,VI,VII,VIII,IX and X semester Examination shall be 45% in theorypapers and internal assessment and 50% in aggregate of Semester examination.12. A candidate who has failed in a semester examination, or having been eligible fails to

appear therein, may be allowed on the recommendation of HOD/Director toappear/re-appear in the examination/paper(s), as the case may be, in accordance withclause-II. Such a candidate may be exempted from appearing in the paper(s) in whichhe obtains at least 50% marks.

Provided that a candidate for the B.A.LL.B.(Hons) 5 Year Degree must pass thewhole examination (Semester I,II,III,IV,V,VI,VII,VIII,IX and X within Seven yearsof his admission to the B.A.LL.B. first Semester class, failing which he will bedeemed to be unfit for the course and shall not be allowed to appear in the same eitherby attending classes again as a regular student or as an ex-student.Note: The candidate admitted to B.A.LL.B.(Hons) 5 Year Course shall not be

allowed to switch over to any other course, otherwise his candidature forB.A.LL.B.(Hons) 5 Years Course shall be cancelled forthwith.

13.1 A candidate who has appeared and failed in a semester Examination shall be promotedfrom I to II,III, to IV and V to VI,VII to VIII, IX to X Semester, subject to theprovision of Clause 13.2 below:The Vice-Chancellor may, in very exceptional cases and where he is satisfied thatthere were unavoidable circumstances e.g. serious illness, serious calamity like deathof father or mother etc. allow a candidate who having been otherwise eligible, failedto appear in the I/III/V/VII/IX Semester Examination or to study for theII/IV/VI/VIII/X Semester Examination, as the case may be, provided that anintimation to this effect accompanied by a documentary proof

thereof is received in the office of the Controller of Examinations through theH.O.D./Director within 10 days of the expiry of the concerned examination.

13.2. A candidate who has failed in the Semester I & II or III & IV or V & VI or VII & VIII

shall be promoted to the III,V,VII,IX Semesters, as the case may be, only if he hasgot exemption in the papers as mentioned below:

From Semester I & II to If he has passed at least six papers ofSemester III Semester I & II

From Semester III & IV to If he has passed at least 13 papers ofSemester V Semester I to IV including six

papers of Semester I & II and sixpapers of Semesters III & IV

From Semester V & VI to If he has passed all the papers ofSemester VII Semester - I & II, 13 papers of Semester III to VI including sixpapers of Semesters III & IV and sixpapers of Semester V & VI

From Semester VII and If he has passed all the papers ofVIII to Semester IX Semester -I to IV, 13 papers of

Semester V to VIII including sixpapers of Semesters V & VI and sixpapers of Semesters VII & VIII

Every student of Semester I,II,III,IV,V,VI,VII,VIII and IX who is entitled to bepromoted to B.A.LL.B.(Hons) 5 Year Semester II,III,IV,V,VI,VII,VIII,IX and Xrespectively, shall submit an application on the prescribed form for fresh admission tothe Semester II,III,IV,V,VI,VII,VIII,IX and X. Any such admission may be refusedby the HOD/Director on reasonable grounds.

14. The details of the practical training (Moot Court etc.) to be imparted as per syllabusand the dates will be notified by the HOD/Director from time to time.

15. Four weeks after the termination of examination or as so thereafter as is possible, theController of Examinations shall publish the result and issue Detailed Marks Cards.

16. The candidate who successfully completes the five years (Semester 1 to X) ofB.A.LL.B.(Hons) 5 Year Course will be awarded B.A.LL.B.(Hons) 5 Year Degree.

A list of successful candidates shall be prepared on the aggregate marks obtained inSemester V, VI, VII, VIII, IX and X examination and shall be

-4-arranged in division as under:(a) Those who obtain 60% or more mark First Division(b) Those who obtain 50% marks or Second Division

more marks but less than 60% marks

17. Notwithstanding the integrated nature of this course, which is spread over more thanone academic year, the ordinance in force at the time a student joins the course shallhold good only for the examination held during or at the end of the academic year andnothing in this ordinance shall be deemed to debar the University from amending theordinance and the amended ordinance, if any, shall unless specified otherwise, applyto all students whether old or new.

NOTE:

1. The internal assessment of 20 marks in each paper shall be as under:i) Assignment and Presentation 5 Marksii) One Class Test 10 Marksiii) Discipline/conduct/Attendance/etc. 5 MarksThe schedule of class tests and presentation of the assignments etc. will be finalized bythe Head of the Deptt./College/Institute in consultation with the teacher concerned andshall be notified to the students accordingly. 2. The question paper of each course will be divided into Five sections, each of the FirstFour Sections of the Question Paper will contain 2 questions respectively from Unit-1 toUnit-4 of the syllabus. The students will be required to attempt one question from eachsection. Section 5 of the question paper shall contain 8 short answer type questions of 3marks each(without any choice) covering the entire syllabus. As such Section 5 will becompulsory. The examiner will be free to set the questions in problem forms based oncase law. However, the scheme of examination in respect of Paper Code 1004,B.A.LL.B.(Hons) Tenth Semester, Moots and Internship will be different , as there is notheory examination and the paper is totally practical based. Concerned Class Teachershall conduct this examination and maintain a comprehension record of the evaluation ofstudents. The students shall also prepare in writing a complete record of the various

activities carried out by them in connection with this paper in the ClassRoom/Examination/Court/Lawyers office/Legal Aid office etc. and the same shall beproduced by them at the time of viva-voce examination. The viva-voce examination ofthis paper in case of affiliated colleges as well as ILMS, Gurgaon shall be conducted byan examiner from the Department of Law duly appointed by the Head of the Departmentof Law in this behalf. He will also finalize the award list in consultation with theinternal examiner.

3. Every student will have to obtain minimum pass marks in theory paper and internalassessment separately and he will be declared successful on the basis of aggregate oftheory and internal assessment.

NEW ORDINANCEBACHELOR OF LAWS (LL.B. (HONS) 3 YEAR COURSE

SEMESTER SYSTEM, 2009

1. The duration of the course leading to the degree of Bachelor of Laws (LL.B.) Honsshall be of three academic years (six Semesters). Each year shall be divided into twosemesters i.e. July to November/December and January to April/May. Theexamination shall ordinarily be held in the month of December and April/May onsuch dates as may be approved by the Vice-Chancellor.

2. The schedule of dates fixed in accordance with Clause-1 shall be notified by theController of Examinations.

3. The last date by which the examination forms and fee must reach the Controller ofExaminations shall be approved by the Vice-Chancellor.

4. A candidate, who fulfils the following conditions shall be eligible to seek admissionin the First Semester of LL.B.(Hons) 3-Year Course:

a. has passed an examination in B.A. (3-year) Degree Course of a recognizedUniversity with 45% (40% for SC/ST) marks in aggregate.

ORb. Possesses any other equivalent academic qualifications recognized by this

University.

5. A person who has passed the Semester I or II or III or IV or V shall be eligible to jointhe Semester II or II I or IV or V or VI respectively of the LL.B. (Hons) 3-yearCourse. This is, however, subject to Clauses-12 and 13 below.

6. The examination of Semester I/II/III/IV/V/VI shall be open to a student who:-

a. has passed the requisite examination as laid down above in Clause 4 and 5, asthe case may be, or is covered under Clause-13 below; and

b. has his name submitted to the controller of Examinations by theHOD/Director and produces the following certificates signed by him:

7. A candidate on the rolls of the Law College or an Ex-student shall submit hisapplication for admission to an examination on the prescribed form with the requisite

certificate duly countersigned by HOD/Director or a senior member of the teachingstaff nominated by him.8. The amount of admission fee to be paid by a candidate for each Semester shall be as

prescribed by the University from time to time.9. The medium of instructions shall be English. The medium of examination shall be

English/Hindi. The question paper, however, will be supplied only in English.10.Candidates shall be examined according to the scheme of examination and syllabus as

12.A candidate, who has failed in a semester examination, or having been eligible fails toappear therein, may be allowed on the recommendation of HOD/Director toappear/re-appear in the examination/paper(s), as the case may be, in accordance withclause-II. Such a candidate may be exempted from appearing in the paper(s) in whichhe obtains at least 50% marks.

Provided that a candidate for the LL.B.(Hons) 3-year Course Degree must pass thewhole examination (Semester I,II,III,IV,V and VI) within five years of his admissionto the LL.B. first Semester class, failing which he will be deemed to be unfit for thecourse and shall not be allowed to appear in the same either by attending classesagain as a regular student or as an ex-student.

Note: The candidate admitted to LL.B.(Hons) 3-year Course shall not be allowedto switch over to any other course, otherwise his/her candidature forLL.B.(Hons) 3-year Course shall be cancelled forthwith.

13.1 A candidate who has appeared and failed in a semester Examination shall be promotedfrom I to II, III to IV and V to VI Semester, subject to the provision of Clause 13.2below:

The Vice-Chancellor may, in very exceptional cases and where he is satisfied thatthere are unavoidable circumstances e.g. serious illness, serious calamity like death offather or mother etc. allow a candidate who having been otherwise eligible, failed toappear in the I/III/V Semester Examination or to study for the II/IV/VI SemesterExamination, as the case may be, provided that an intimation to this effectaccompanied by a documentary proof thereof is received in the office of theController of Examinations through the H.O.D./Director within 10 days of the expiryof the concerned examination.

13.2. A candidate who has failed in the Semester I & II or I II & IV or V & VI shall bepromoted to the III or V Semesters, as the case may be, only if he has got exemption

in the papers as mentioned below:

The examiner will be free to set the questions in problem forms based oncase law. However, the scheme of examination in respect of Paper Code 1004,B.A.LL.B.(Hons) Tenth Semester, Moots and Internship will be different , as there is notheory examination and the paper is totally practical based. Concerned Class Teachershall conduct this examination and maintain a comprehension record of the evaluation ofstudents. The students shall also prepare in writing a complete record of the various

activities carried out by them in connection with this paper in the ClassRoom/Examination/Court/Lawyers office/Legal Aid office etc. and the same shall beproduced by them at the time of viva-voce examination. The viva-voce examination ofthis paper in case of affiliated colleges as well as ILMS, Gurgaon shall be conducted byan examiner from the Department of Law duly appointed by the Head of the Departmentof Law in this behalf. He will also finalize the award list in consultation with theinternal examiner.

3. Every student will have to obtain minimum pass marks in theory paper as well as internalassessment separately and he will be declared successful on the basis of aggregate oftheory and internal assessment.
