1. Applied for grant of Consent to Operate on 19/10/2010 at Regional Office, Pune.

2. R.O. (Pune) has issued show cause notice on 12/07/2011 for operating hotel without obtaining Consent to Operate from the Board, for not providing ozonisation / UV Treatment in place of chlorination for the treatment of sewage, and for not submitting B.G. of Rs. 5.0 Lakhs as per Consent to Establish condition No. (13).

3. RO, Pune forwarded the application to A.S. (T) Section on 7/10/2011 and recommended to grant Consent to Operate.

4. Application received at A.S. (Tech.) Section on 18/10/2011. 5. Member Secretary has ordered to call explanation on 3/02/2012 from R.O.

(Pune) for wrongly processing and forwarding consent application to HQ. 6. R.O. (Pune) was instructed on 29/02/2012 to submit their explanation for non

taking action against Hotel authority for submitting wrong information in the Board and for wrongly processing and forwarding consent application to HQ.

7. R.O. (Pune) has submitted explanation that Hotel Authority has informed vide letter dtd. 23/01/2012 that they have converted water body meant for beautification purpose into swimming pool. Also, he has issued proposed directions on 2/03/2012 for operating hotel without obtaining Consent to Operate from the Board and for submitting wrong information in the Board.

8. RO, Pune has recommended to initiate stringent action against the Hotel Authority.

9. Case was discussed in the CAC meeting on 20/03/2012 and it was decided to issue SCN for refusal of Consent as the Industry has not submitted B.G. of Rs. 5.0 Lakhs within stipulated time and not mentioning swimming pool activity in the application for Consent to 1st Operate.

10. Show cause notice was issued on 29/03/2012 to which hotel authority has replied vide letter dtd. 11/04/2012 and submitted B.G. of Rs. 5.0 Lakhs on 28/04/2012.

11. Consent to 1st Operate may be granted for the period upto 31/10/2013 after the receipt of additional payment of Rs. 4,08,320/- as per Env. Dept’s revised Consent Fee G.R. dtd. 25/08/2011.

CAC Item No. 02 Name of the Industry: M/s. The Leela Kempinski Sahar,

Plot No. 1407(pt), 1405(pt), 1404(pt),

Sahar, Andheri(E), Mumbai. HOD Remarks:

a. Applied for grant of Renewal of consent for hotel activity including 395 rooms

including lodging activity.

b. Application received at SRO on 21.10.2011 and at HQ on 07.01.2012.

c. Previous consent was valid upto 31.08.2011.

d. The case was discussed during CAC meeting held on 23.01.2012 and during

the meeting, it was decided to issue SCN for refusal of consent as industry has

not replied to letter issued by the SRO on 11.11.2011. SCN issued on

06.02.2012 and industry has submitted the reply on 27.02.2012 & 03.04.2012,

wherein mentioned that C.I. mentioned is found reduced to previous year is due

to fluctuation of the foreign exchange rate of the assets purchased under foreign

loans. They are ready to pay the requisite consent fees. Current year C.I. is Rs.

318.34 Crs. Therefore, File was referred to CAO for verification of point no. (a)

& (b) and he remarked that C.I. shown in schedule of fixed assets of balance

sheet do not match with total gross block of fixed asset shown in CA-certificate.

e. Further, it was discussed during CAC meeting held on 16.04.2012 and decided

to grant consent after CI verification by CAO. f. Accordingly, file was again referred to CAO on 20.04.2012 and he asked to call

Balance Sheet from industry to verify Gross Block of Fixed Assets. After

verification of CA certificate of Multiple unit, it is reflect that C.I. in fixed assets in

particularly building, land and furniture fixture got reduced. Gross block of fixed

assets never reduce in value in normal course of business. Hence, said details

were called from industry on 27.04.2012 and 03.05.2012, but they have not

submitted the reply till date.

g. Consent may be refused due to non-submission of Balance Sheet details.

CAC Item No. 03 Name of the Industry: M/s. Wardha Power Company Ltd.,

Phase II of 270 MW, MIDC Warora, Dist-Chandrapur.

HOD Remarks:

• Applied for renewal of consent for phase II of 270 MW capacities (i.e 2 x 135 MW) with no increase in capacity.

• Gross block investment is increased from Rs 1211.15 crore to Rs 1339 crore &

submitted additional consent of Rs 255700/- as consent to establish fee and renewal

fees of Rs. 26,78,000/- as per new GR dated 25.8.2011 for the consent period up to

31.1.2013.

• Domestic effluent generation is 48 m3/day. STP provided. Industrial effluent generation

is 1800 m3/day. ETP consists of neutralization tank, aeration tank, RO system, guard

point. This treated effluent is used for cooling makeup. RO reject taken in evaporation

pond for further use in dust suppression.

• Coal consumption -3600 MT/day. ESP Followed by bag house provided to boiler. Bag

house provided to coal crusher and transfer point.

• Regional Officer, Chandrapur has issued interim direction on dtd 25/05/2011

• Analysis results of ambient air quality monitoring and stack monitoring are exceeding the standards.

Earlier the case was discussed in CAC meeting held on 20.03.2012 and it was decided

to issue Show cause notice for refusal of consent. Accordingly Board has issued SCN vide letter

dated 2.4.2012. R.O. Chandrapur has submitted the compliance report vide letter dated

17.04.2012.

In view of the above we may grant renewal of Consent up to 31.1.2013 with condition of

Encashment of Bank Guarantee of Rs.10/- Lakhs against exceeding norms and fresh Bank

Guarantee of Rs.20/-Lakhs to achieve the standards.

CAC Item No. 04 Name of the Industry: M/s. Thyssenkrupp Engine Components India Pvt. Ltd., G.No.392, A/p Gonde, Vill: Wadivarhe, Tal: Igatpuri, Dist: Nashik. HOD Remarks:

1. Applied for 1st consent to operate Consent to established obtained for production of

crank shafts – 1,00,000 Nos./Year.

2. Gross block investment is increased from Rs 102.78 crores to Rs 155.52 crore. Consent

fee paid by the industry Rs.2,08,251 & required to submit difference in Consent fee of

Rs.2,02,789/- as per new GR dated 25.8.2011 for the consent period up to 31.1.2013

3. SRO, Nashik reported that industry has not provided STP, ETP and coolant treatment

plant and industry has started production activity since November, 2011 without valid

consent to operate.

4. Warning notice issued by SRO, Nashik. Show cause notice issued by R.O. Nashik vide

letter dated 22.02.2012 .

Earlier the case was discussed in CAC held on 20.03.2012 and it was decided to issue

show cause notice for refusal of consent. Accordingly Board has issued Show Case Notice vide

letter dated 02.04.2012. Industry has submitted the reply of SCN vide letter dated 10.04.2012.

R.O. Nashik submitted the compliance report vide letter dated 24.04.2012.

We may grant 1st Consent to operate for the period up to 30.09.2012 with the operation

Bank Guarantee of Rs.5/- Lakhs each for ETP operation and STP operation.

CAC Item No. 05 Name of the Industry: M/s. Western Coalfields Ltd.,

Umred Open Cast Project, Tal: Umred, Dist: Nagpur.

HOD Remarks:

1. Applied for plain renewal of Consent.

2. Earlier consent for mining of coal 3.5 MTPA was valid up to 31.12.2011.

3. Capital Investment of the Industry is Rs.168.43. The investment was in earlier consent

was 201.44 cores. Justification required for decrease in capital investment. Capital

investment Certificate of C.A. is not furnished.

4. Industry required to submit difference in Consent Fee of Rs.8,26,266/- for the consent

validity period up to 31.12.2012 as per new GR dated 25.08.2011.

5. Mobile Water tanker provided for water sprinkling on road. 7 Nos. rain guns provided at

CHP.

6. Analysis results of AAQM are not submitted.

7. Analysis results of effluent sample from ETP outlet collected on 5.10.2010 and

22.2.2011 shows all the parameters are within the limit.

Earlier the case was discussed in CAC meeting held on 23.01.2012 and it was decided

to issue refusal order. Accordingly refusal order was issued on 08.02.2012. The unit vide letter

dated 29.02.2012 has requested for revocation of refusal order. The work of STP require two

years. Strengthening of water sprinkler by June, 13, 2012.

In view of above work, we may consider the proposal for withdrawal of refusal order and forfeit the Bank Guarantee of Rs.10 Lakhs. Also grant conditional consent to complete all the works related to pollution control within 1 year.

CAC Item No. 06 Name of the Industry: M/s. WCL Mungoli Opencast Mine, Po-Sakhara(Kolgaon),Mungoli Sub Area, Dist-Yavatmal. HOD Remarks: 1. Applied for renewal of consent with expansion from 1.5 Million ton per year to 4.0 Million ton per year. 2. Obtained Environmental Clearance for coal production 2.5 MTPA to 4.0 MTPA from

MoEF GOI vide letter dated 30th March 2011, copy is enclosed. 3. Earlier consent was valid up to 31/12/2010, for coal production of 1.55 Million ton

per year. 4. Regional Office Chandrapur vide letter dated 21/01/2012 demanded additional consent

fee of Rs. 34,80,938/- including delay charges and balanced consent fee. Mine authority vide their letter dated 03/02/2012 has submitted that they are in process of depositing additional fee.

5. Coal Production for last three years is enclosed herewith. The Production for the year 2010-11 was 3.058 Million Ton.

6. The Board vide letterMPC/CRO/1366/2010 dated 05/08/2010 has issued interim directions to the mine. But said mine authority is non-complied with respect to these points.

a. Active O.B is about 50 meter away from notified Wardha river. The OB was slide in part and spread up to bank of river.

b. Operation & maintenance of existing air pollution control system, sewage treatment plant is very poor and thus affecting surrounding environment.

8. From the Ambient Air Monitoring Results carried in Jan/March/Oct, 2011 observed that results are exceeding.

9. Mine Lease boundary is adjacent to notified A-II class Wardha river ( 0.2 Km) and within two km from Notified A-II Class Penganga river. RRZ not satisfied for expansion of mine near the notified A-II class river.

10. Earlier the case was discussed in CAC meeting dt 16/04/2012 decided to refuse the consent for expansion and SCN for refusal of renewal of consent of existing unit. Accordingly, Board has issued SCN for refusal on dt 23/04/2012 and refusal order for expansion is issued on 25/04/2012. Industry has submitted the reply of SCN vide letter dt 30/04/2012 received on 05/05/2012.

We may grant the renewal of consent for 2.5 Million Ton/Yr capacity by forfeting the existing BG of Rs.5 Lakhs due to non compliance of consent conditions and by taking operation BG of Rs.5 Lakhs towards pollution control system.

CAC Item No. 07 Name of the Industry: Mahindra and Mahindra Ltd., F-1 & 7, MIDC Hingna, Nagpur. HOD Remarks :

• Applied for first consent to operate for expansion. • Consent to establish for expansion obtained vide letter dated 26.8.2011. • Consent of existing unit is valid up to 28.2.2014. • Total Gross block investment of the industry is Rs 274 crore (CI of existing unit is Rs.

160/- crore and CI of expansion is Rs. 114/- crore). Consent fee of Rs.5, 60,000/- paid for the period up to 31.01.2014 as per new GR.

• Domestic effluent generation is 4.34 m3/day. STP provided. Industrial effluent 130 CMD. Existing ETP of 300 m3 capacity will be utilized & addl. 150m3 proposed. Treated effluent will be recycled partly and remaining disposed on land for gardening.

• Paint booth with water scrubbing provided. • Industry has installed plant and machinery for phosphate and spray painting and also

provided air pollution control system i.e water scrubbing system with exhaust stack for the same.

• Industry has provided stack for hot water generator and backing oven. • Industry has provided pipeline for carrying effluent from new plant to existing effluent

treatment plant having capacity 300m3. • Installation of machineries in transmission line section found in progress and factory

representative reported that, they have completed work within the month. • Earlier the case was discussed in CAC meeting held on 20.03.2012 and it was decided

to keep the case in abeyance till the completion of the work and compliance of consent conditions.

• R.O. Nagpur vide letter dated 21.04.2012 has submitted the compliance report of the industry. As reported by R.O. Nagpur, now the unit has completed the remaining works of

pollution control system and is ready for use. In view of the above, we may grant consent to

operate amalgamating to the existing one for period up to 31.01.2014.

CAC Item No. 08 Name of the Industry: M/s. Gupta Energy Ltd., (Formerly known as M/s Gupta Thermal Power Plant) Khasara No.89, Usgaon-Shengaon, Chandrapur

HOD Remarks :

1. RED/LSI Unit, Applied for first consent to operate for the power plant coal based 2 x 60

MW.

2. Consent to establish granted by Board vide letter dated 29.2.2008 up to COU and

amendment in consent for change in name from M/s Gupta Thermal Power Plant to

M/s Gupta Energy Ltd., granted vide letter dated 27.3.2008. 3. Environment Clearance granted by MoEF,GoI vide letter dated 4.9.2008 under the name

M/s Gupta Coalfields & Washeries Ltd.,. Change in the name in EC required. 4. Capital Investment of the industry is Rs.520.87 Crore. Since project cost shown during

the consent to establish was Rs. 364 crore and now shown as Rs.520.67 crore,

Difference in consent fee of Rs.3,13,740 /- for increased in capital investment of Rs.156.87 crore shall be submitted by the industry.

5. I/c SRO Chandrapur recommended consent to operate subject to following compliances

• Industry is located in CEPI

• Standard for TPM shall be 50 mg/Nm3

• Bottom ash shall be disposed as per consent condition.

• Permission to carry out bottom ash in container & dump at ash pond may

be reviewed.

• Industry shall achieve zero discharge

• Industry shall install three CAAQMS & on line stack monitoring system.

• Industry shall provide conveyor belts for transportation of raw material

/waste so as to minimize internal truck movement

• Industry shall complete all the balance environmental works before

commission of the power plant.

6. Earlier the case was discussed in CAC meeting held on 23.1.2012 & decided to issue

SCN Accordingly SCN issued to industry vide letter dated 3.2.2012

7. Industry has submitted the reply of SCN received on 6.2.2012 & verification report

received from RO/SRO on 14.2.2012.

Earlier the case was discussed in CAC held on 20.03.2012 and it was decided to keep the case in abeyance. Regional Officer, Chandrapur has submitted the compliance report dated 03.05.2012 and stated that the unit has completed the work of requisite pollution control

system. In view of above, we may grant Consent up to 31.03.2013 with conditional operational Bank guarantee of Rs.5/- Lakhs.

CAC Item No. 09 Name of the Industry : M/s. POSCO Maharashtra Steel Pvt. Ltd.,

Plot No. C-1, MIDC Bhagad, Tal: Mangaon, Dist –Raigad.

. HOD Remarks :

1. Applied for grant of 1st consent to operate.

2. This case was discussed in the CAC meeting held on 16.04.2012.

3. Industry has submitted reply to the SCN on 26.04.2012.

4. SRO-Mahad has submitted report 03.05.2012.

5. Industry has obtained Environmental Clearance from GoM for the same

Product.

6. Industry has paid consent fees Rs. 35, 76,738 /-as per revised

G.R.25.08.2011.

7. RO- Raigad has recommended case for grant of consent to operate subject to,

industry shall provide full-fledged ETP and STP for treatment of industrial and

domestic effluent.

8. Industry has provided ETP to treat the domestic and industrial effluent.

9. Recommended case for grant of consent to operate for the period up to

28.02.2014 subject to following conditions

I. Industry shall install STP of adequate capacity for domestic

effluent.

II. Industry shall achieve BOD- 5 mg/l standard for treated industrial

effluent .

III. Industry shall provide 3 CAQMS within next 4 months with the B.G.

of Rs.5 Lacs.

CAC Item No. 10

Name of the Industry : M/s. POSCO Maharashtra Steel Pvt. Ltd., CRC plant, Plot No. C-1, MIDC Vile Bhagad,

Tal: Mangaon, Dist –Raigad.

HOD Remarks:

1. Applied for amendment in Consent to Establish for manufacturing of Full Hard Coil

and Cold Rolled Coils.

2. This case was discussed in the CAC meeting held on 16.04.2012.

3. Industry has submitted reply letter on 26.04.2012 requested for consideration of BOD

limit -30 mg/l

4. Industry has obtained consent to establish for the production of Galvanized coils in

the same premises.

5. They have obtained Environmental Clearance for manufacturing Galvanizing coils.

6. Industry has informed that they have applied for environmental clearance to GoM

[SEAC] on 27.06.2011.

7. Industry has paid consent fees Rs.9,49,580/-.+ Rs.9, 49,580/- as per new GR dated

25.8.2011. 8. Consent to establish may amend with the condition that industry shall achieve

BOD- 30 mg/l with the incorporation of other parameters like Arsenic, Mercury, Lead, Cadmium etc.

HOD Remarks:

• Applied for f consent to establish for expansion

• Application received at SRO-Tarapur on dtd 30/11/2011 and at HQ on 03/03/2012.

• Existing plant consent was valid up to 31/12/2011

• Industrial Effluent Generation will be NIL (Existing 200 CMD) for which industry has provided effluent treatment plant .

• Domestic effluent generation will be Nil (existing 11 CMD)

• Industry has provided scrubber to pickling section

• Industry has provided air pollution control system to pickling section, galvanizing section, steam boiler & patenting line

• SRO Tarapur-I has recommended for grant of consent to establish after assessment of pollution load by education institute IIT/ICT (UDCT)/BATU

• The case was discussed in CAC held on 20/03/2012. it was decided to resubmit the case before CAC after assessment of no increase in pollution Load

• The unit has submitted the certificate from IIT Mumbai regarding No Increase in pollution load due to establish of above plant.

• We may grant consent to establish for expansion

• We may place the consent application before CAC for further consideration

CAC Item No. 12

Name of the Industry : M/s. Maharashtra State Power Generation Co. Ltd., Nashik Thermal Power Station, P.O. Eklahare, Dist: Nashik.

HOD Remarks : 1. Applied for renewal of consent for electricity generation (125 MW x 2 & 210 MW x 3). SRO,

Nashik reported that Unit No.1 & 2 of 125 MW each are decommissioned and only unit

no.3,4,5 of 210 Mw each are in operation .

2. Earlier consent for electricity generation- 880 MW was valid up to 31.12.2011.

3. Capital investment of the industry is increased from Rs.613.09 Crores to Rs.700.89 Crores

(i.e. Rs.87.80 Crores.). Industry has paid Consent fee of Rs.28,03,575/- along with

application. However, industry required to submit Consent to Establish fee of

Rs.1,25,000/- for increase in capital investment of Rs.87.80 crores.

4. Domestic Effluent – 2500 CMD. Industry has provided STP. Industrial Effluent – 37285

CMD. ETP provided. 20% effluent is used for gardening & 80% effluent is used for ash

slurry.

5. ESP provided to Unit no.3,4,5. The unit No.1 & 2 are closed.

6. Augmentation of ESP is completed for unit no.3 and augmentation of ESTP for unit no.4 & 5

is not done.

7. CAAQM Station is not yet installed.

8. Analysis results of Stack monitoring are exceeding the standards. 9. Regional Officer, Nashik reported that Board had issued directions vide letter No.

MPCB/APAE/TB-2/B-1884 dated 29.03.2011 and directed the industry to comply with these

directions in stipulated period and submit the Bank Guarantee of Rs.1.0 Crore towards

compliance of these directions (detail report is enclosed herewith). But Industry has failed to

submit the said Bank Guarantee. In view of above the application is submitted herewith for

the consideration and further disposal, please.

10. Earlier the case was discussed in 16/04/2012 and it was decided to issue SCN for refusal

of consent. Accordingly Board has issued SCN dt 23/04/2012. The industry has submitted

the reply of SCN vide letter dated 30/04/2012 received on 10/05/2012.

The unit has not completed most of the pollution control works also CAAQMS also not yet installed.

In view of above as decided in interim direction we may grant renewal for one year i.e 31/12/2012 with BG of Rs.1/- Cr for compliance of above directions dated 29/03/2011.

CAC Item No. 13

Name of Industry: M/s. Balaji Amines Ltd (Chemical & Captive power plant), Gat No-194 to 197 Vill:Tamalwadi, Tq-Tuljapur Dist- Osmanabad HOD Remarks :

1) Application for renewal of Consent.(Amalgamation of Two Consents) 2) This is Chemical industry with captive power plant. 3) Application received for renewal of Captive power plant & Chemical plant. 4) Application received at SRO on 14/01/2011, 16/04/2012 and at HQ on

24/05/2011, 03/05/2012 for Captive power plant & Chemical Plant respectively. 5) Total Industrial effluent generation- 182.43 CMD. 6) Parent Industry is engaged in manufacturing of 20 different chemicals for which

the consent is valid upto 30/04/2012 7) The captive power plant consent was valid upto -31/01/2011. 8) The application received from APC section on 06/03/2012. 9) The case was placed in CAC meeting dtd-20/03/2012 and decided to resubmit the case

in next CAC after obtaining report from RO/SRO and required consent fee from industry. 10) Report received from SRO Latur with details of fee paid by the industry. 11) Meanwhile the application of Chemical plant received from RO for renewal of

Consent. 12) Hence it was decided to pace the case before CAC for Combine Renewal of

Consent with amalgamation of two consents (i.e-Chemical plant and Captive plant).

13) RO Aurangabad had issued direction dtd-07/10/2012 and its Compliance is reported (Attached). Combine renewal of Consent may be approved.

• The application was discussed in CAC dt.20.03.2012 and it was decided to keep the case in abeyance till obtaining No Increase in Pollution Load report of the plant and put up the case in next CAC.

3. The industry has submitted their representation to Board on 21.03.2012 and justified that

from expansion no effluent generated except occasional washings of floor

4. Case was placed in CAC dated 16.04.2012 and decided to call report of RO, Raigad in

person on 17.04.201

5. RO, Raigad submitted report on 17.04.2012and finding are as below:- a. The ETP of existing production was upgraded b. Seepage from storage tank of ETP finding is way to Patalganga River. c. The upgraded ETP is not yet commissioned. d. The results of treated effluent are exceeding the prescribed standards. e. The production in C to E was equal to C to O valid consent (i.e. doubled) f. H.W. quantities are increased g. Air Pollution / Emission also increased.

6. Grant C to O with amalgamation and obtain B.G. of Rs. 10 lakh for Nill effluent generation.

Also we may obtain assurance / put condition in C to O that there should not be increase in effluent quantity from expansion.

HOD Remarks :

• Applied for Consent to Operate (Renewal). • Application received at SRO on 20.03.2012 and at HQ on 02.04.2012. • Industrial effluent generation is 580 CMD and D.E is 80 CMD. • ETP provided with secondary treatment and SDB. • Dust collector is provided to 5 nos. of Boilers. • The application was discussed in the CAC meeting dt. 16.04.2012. • As per the decision of the CAC meeting SCN for the refusal of the consent was issued

vide letter dt. 27.04.2012 for discharging the effluent into Bhima River, JVS results are exceeding the norms and non compliance of the directions issued by the Board

• Industry has replied vide letter dt. 06.05.2012 that Industries sugar ETP was old and aeration tank drain valve failed and hence the effluent went out side the factory premises, Stopped the discharge of the effluent immediately and replaced the drain valve, Industry has stopped the production on 04.04.2012, The proposal of the up gradation of ETP is received from Vasantdada Sugar Institute, Upgradation of the ETP will be done in this off-season.

• Closure was issued on 26.03.2012 and Industry has stopped production on 04.04.2012. • Sugar ETP was too old and valve was failed and untreated effluent went outside the

premises. • Industry is regular defaulter. • We may refuse the Consent.

CAC Item No. 23

Name of the industry : M/s. B.S. ISPAT LTD.,(sponge Iron Plant) Vill-Salori Yensa,Tal-Warora, Dist.- Chandrapur.

HOD Remarks : 1. M/s B.S.Ispat Ltd,Salori Yensa, Ta warora, dist Chandrapur, is engaged in

manufacturing of sponge iron. 2. Earlier application for first consent to operate was refused by the Head

office vide letter dated 01/02/2012 due to non compliance of consent to establish conditions and accordingly Regional Office vide letter dated 29/02/2012 has issued directions not to operate industry unless obtaining valid consent to operate from the Board.

3. Now, the said industry has made fresh application for first consent to operate for sponge iron plant for production of 60,000 TPA (Phase-I).

4. Capital Investment of the Sponge iron plant is Rs. 65.24 crore. Total Capital Investment of integrated project including sponge iron plant as per the consent to establish granted earlier is Rs.158.5/- crore.

5. Consent Fees of Rs.2,00,000/- had been submitted with earlier consent application which was refused. Hence we may forfeit one term consent fees of Rs.1,00,000/- and consider Rs.1,00,000/- for this consent to operate.

6. Obtained Environmental Clearance from the MoEF, GOI, vide letter dated 5th May 2009 for sponge iron unit with captive power plant , for sponge iron of production of 64000 TPA & further obtained EC vide letter dated 23 rd November 2010 for production of sponge iron of 64000 TPA to 184000 TPA, copy is enclosed.

Now unit has installed necessary pollution control system including installation of CAAQMS & Opacity meter. The compliance is submitted by RO /SRO. We may grant consent to operate up to 30.4.2013 with operational bank guarantee of Rs.5/- Lakhs towards pollution control system.

CAC Item No. 24

Name of the Industry: M/s. Wokhardt Hospitals Pvt. Ltd.,

Dr. Anand Rao Nair Marg,

Byculla, Mumbai. HOD Remarks:

a. Applied for grant of consent to Establish for construction of Hospital (320 No. of Beds and Cafeteria/canteen).

b. Application received at SRO on 3.11.2011 and at HQ on 17.03.2012. c. The total built-up area 25,015.26 sq.m. and total plot area is 3586.98 sq.m.

d. Applicant requires to obtain Environmental Clearance as per EIA Notification,

2006 and obtained the same.

e. Applicant have started construction activity without obtaining consent as

previously they had approved plan for 7,868.06 sq.m. BUA and said does not

require Environmental Clearance. SRO reported that they have completed 21

storey building of hospital with partly plumbing/ flooring. And SRO recommended

to issue SCN for the same.

f. The effluent generated from the said activity will be sewage – 242 CMD and

proposed to provide STP (capacity-325 CMD) and treated effluent will be reused

for flushing, cooling purpose and remaining treated effluent is disposed off into

the sewer line.

g. The bio-degradable waste generated will be segregated and disposed to MCGM.

And non-biodegradable waste will be send to authorized vendor. They have

proposed to provide vermin-composting pits for biodegradable waste.

h. RO reported that applicant have proposed rain water harvesting.

i. The C.I. of project mentioned in EC is Rs. 100 Crs. and in the application it is

mentioned as Rs. 208 Crs. Applicant have submitted the clarification as earlier

medical equipment cost did not included in C.I. and escalation in project cost is

due to the time lapsed between 2008 and now and paid consent fees

accordingly.

j. As this is the construction of Hospital with canteen, category of consent and

consent granting authority needs to be defined. As per CPCB revised product

category, Hospital comes under RED category. There are similar activities in

Hospital & Hotel such as laundry activity, canteen, sewage waste, biodegradable

waste. So, we may consider hospital in Red category and Hotel.

k. The case was discussed in CAC dtd. 16.04.2012 and it was decided to keep the

case in abeyance. It was decided to cover the Hospital activity under purview of

Water Act, Air Act, etc. to grant consent, a separate note shall be moved for

discussion in CAC and then a decision be taken in this case.

l. Consent may be granted upto commissioning of the unit.

a. Applied for grant of Renewal of consent for hotel activity (Five Star) includes

Lodging & Boarding, Restaurants, Banquates Halls, Club, Lounge Bar Rooms &

Suites, etc.(270 Rooms).

b. Application received at SRO on 21.03.2012 and at HQ on 19.04.2012.

c. The effluent generated (388.5 CMD) is treated in combine STP and the treated

effluent is used for flushing, cooling purpose. JVS Results of dtd. 21.02.2012 and

20.03.2012 are within the norms.

d. RO/SRO reported that industry has provided ozonation treatment to one of the

swimming pool and remaining work of the same is in progress, which need

further period of three months for completion.

e. The bio-degradable waste generated is being sent to PMC site for treatment and

disposal.

f. RO-Pune recommended the case for grant of consent upto 31.03.2017 with the

condition of obtaining BG towards the installation of ozonation treatment within

next three month period.

g. Consent may be granted with the condition of obtaining BG for providing

ozonation treatment within three months period.

2. Application received at SRO on 21.03.2012 and at HQ on 19.04.2012. 3. The total built-up area 94,475.74 sq.m. and total plot area is 81,692.15 sq.m.

4. Applicant requires to obtain Environmental Clearance as per EIA Notification, 2006

and obtained the same. 5. Applicant have started construction work and completed the RCC work of

Commercial building upto 4th floor and foundation work of three service core area is

under progress.

6. Applicant have obtained CC on 03.01.2007 and IOD on 10.08.2006 for commercial

mall.

7. Applicant have handed over the building no. 1 & 2 to society as per the approved

plan (CC).

8. The effluent generated from the said activity will be sewage – 681 CMD and

proposed to provided STP (capacity-600 CMD) for Hotel and STP (Capacity-450

CMD) for commercial building. Treated effluent will be reused for flushing, cooling

purpose, etc.

9. The bio-degradable waste generated will be segregated and disposed to MCGM.

And non-biodegradable waste will be send to authorized vendor.

10. RO-Mumbai issued SCN to the applicant on 09.03.2012 for starting construction

without obtaining consent, reply not received.

11. Consent may be granted in RED category after receipt of reply to SCN issued.

Name of the Industry: M/s Radisson Blu (5 Star Hotel), Unit of Bestech Hospitalities Pvt. Ltd., KH. No. 32/2-3, 37/1-C of Mauja-Somalwada, Nagpur.

HOD Remarks:

1. Applied for grant of Consent to 1st Operate for 5 star hotel having 214 nos. of rooms on 10/04/2012 at Sub-Regional Office, Nagpur-I.

2. SRO, Nagpur-I forwarded the application to A.S. (Tech.) Section on

21.04.2012.

3. Board has granted Consent to Establish to the Hotel vide Consent No. BO/AS(T)/EIC-NG-6312-12/AMND/CAC-365 dtd. 29/03/2012 for 214 Nos. of Rooms with Swimming Pool & Laundry having total built-up area is 27,667.16 sq. mtrs.

4. Applicant has obtained Environmental Clearance for construction of the Hotel

Building from the Env. Dept., GoM vide Letter No. SEAC-2011/CR.892/TC.2 dtd. 13/03/2012.

5. SRO, Nagpur-I has recommended grant of Consent to 1st Operate.

6. Consent to 1st Operate may be granted after receipt of additional Consent

Fee of Rs. 13,400 /- as per Env. Dept., GoM’s revised Consent Fee G.R. dtd. 25/08/2011.

Name of the Industry : M/s. Western Coalfields Ltd., Ukni (Deep) Opencast Mine, Village: Ukni, PO: Bhallar,

Tal: Wani, Dist: Yavatmal. HOD Remarks: 1. Applied for consent to Establish for expansion in coal production from 2.20 Million

Ton/Annum to 3.50 Million Ton/Annum.

2. Board has granted consent for Existing Coal Mine for production of 2.20 Million

Ton/Annum which is valid up to 31.10.2014.

3. Sub-Regional Officer, Chandrapur reported that mine lease boundary is about 0.544 km

from notified river Wardha (A-II Class), thus not satisfying RRZ Policy.

4. Public hearing for expansion for 2.20 MTPA to 3.5 MTPA was conducted on 10.08.2011.

5. Capital Investment of the proposed expansion unit is Rs.319.96 Crores. Consent fee of

Rs.6,39,940/- is paid by the industry. However, industry required to submit the Consent to

Establish fee for increase in production of mineral 1.3 MTPA Rs. 5,2,000/- as per new GR

dated 25.08.2011.

6. Domestic Effluent-489.67 CMD. STP proposed to be provided. Treated effluent will be

disposed in river. Industrial Effluent-17186 CMD. Mine water will be discharged in to river.

7. Fixed water sprinklers will be provided to coal handling plant and haul roads.

Notified Wardha river (A-II Class) is about 0.544 km away from the proposed expansion

unit, hence is not satisfying the RRZ Policy. Consent to Establish for expansion of coal mine

may be refused.

Dist: Chandrapur. HOD Remarks: 1. Industry is having two consent in the same premises. First is for 4 x 100 TPD Kiln which is

valid up to 18.10.2011. Second one is for 500 TPD Kiln, Coal Washery and 25 MW Power

generation which is valid u to 28.2.2012. Plain renewal with amalgamation of both consents.

2. Total Capital investment of the industry is Rs.498.55 Crores. Consent fee of Rs.9,97,109/-

is paid for one year period as per new G.R. dated 25.08.2011.

3. Regional Officer, Chandrapur reported that the industry has complied majority of directions

except point no.4 & 7 i.e. installation of Ash Silo and disposal of solid waste. Hence, R.O.

has forfeited the bank guarantee of Rs.5.0 Lakhs in the month of December, 2011.

4. Regional Officer, Chandrapur reported that;

i) Industry has installation one CAAQM station within premises in January, 2008.

ii) Continuous Monitoring Station (CMS) is also provided Sponge Iron stack and 25 MW

Power Plant.

iii) Construction of new ash silo is expected to complete by March, 2012.

iv) Industry has improved housekeeping since previous visit.

v) Industry has paid Cess payment of Rs.22,856/- on 17.1.2012 and Cess Return filed up

to 31.1.2012.

vi) Online environment statement for the year 2010-11 submitted by the industry.

vii) From the analysis reports stack emission and ambient air quality levels are fluctuating

and some time on higher side and hence industry shall improve operation and

maintenance of pollution control system.

viii) Char beneficiation plant is commissioned on January, 2011 and it is used as

secondary fuel in AFBC boiler and hence conditions regarding use of char as fule may

be incorporated.

ix) Industry shall submit proposal for one additional CAAQMS as per consent condition.

5. Legal Action: Writ Petition No.3501/2006 in Mumbai High Court, Nagpur Bench. The writ

petition is pending for hearing.

We may consider renewal of consent to operate with amalgamation of both consent for

the period upto 31/10/2012.
