Welcome to Lighten the Load

There is a lot more to a property transaction than simply signing a deal. From preparing a property for sale, understanding the process, ensuring that the certification is in order, organising finance registering or cancelling bonds, moving in or out, fixing major or minor stuff – the list is endless! We have tried to identify many of these processes and eventualities and we hope this guide will assist and remind you of what to do.

Lighten the Load is a collection of suggested suppliers and businesses, some of which you will need – many of which you won’t. Most have offered their services at discount rates to assist you in your move. So, from attorneys to waterproofers; from architects to plumbers, this collection of special offers and discounts should go some way in helping you to make your move as cost efficient as possible. If you aren’t moving, this is also a handy collection of services which could help you enjoy your property cost-effectively.

Most of our featured services will offer unique insight and advice regarding their services. Each business has either been referred to us or we know clients who have dealt successfully with them. We would also like to hear of any experiences you may have had so that we can provide a guide which contains service providers who can deliver quality and value for money.

This is a quarterly guide, so your input is important. Also, the services and businesses featured here have paid to be part of this guide. A brief guide to buying your home in the Southern SuburbsDETERMINING WHAT YOU WANT

So often, one has a vision of what the perfect home will look like; where it will be; what it will have and how little one needs to pay for it. I once met a real analytical buyer who had a book in which he had recorded the 194 properties he had viewed over the last 12 months in Plumstead. He admitted that he should have bought the 5th one he saw. I think he is still looking for the perfect home! I hope I can provide some insights which may help you to make a decision, whatever that decision will be.

First Question: Why don’t you stay where you are?

Consider the following:

• It is not inexpensive to move home. You need to consider the following:• Removal costs• Relocation costs (new school uniforms, etc)• Transfer costs (transfer duty, attorney fees, bond cancellation costs, bond registration costs• Commission on the sale of your home• Re-vamp of the home you buy• Are you moving for the right reason?• When you make the decision to move, then move – if you make the decision to stay, then stay.

Second Question: Why are you buying?

• Purchase decisions are most influenced by whether the property is to be purchased as:• A home• An investment• Obviously, the purchase of a home will also be an investment in property, but the factors in arriving at a purchase position will be different.

Remember: when considering the cost of your home as an investment only, you must factor into your thinking that there is a basic cost of accommodation – if you did not own the property, you would need to rent.

IF YOU HAVE MADE THE DECISION TO BUY A HOME, HERE ARE SOME TIPS TO ASSIST YOU IN YOUR DECISION MAKING:

• Location - You can change the house, but you can’t change where it is. • You can fill in a pool (or put one in)• How happy are you to renovate?• Will the property suit a growing family and if your nest is getting emptier, is it able to cope?• Access to where you want to go (work, entertainment, schools)• How much will you regret missing the right home if someone else buys it?• Have you taken in to account the costs of maintaining the property?• Have you considered the costs to transfer the property into your name?• Look past the current owner’s occupation of the property. Some people like to live in an eclectic environment; some people like to be minimalistic. Some people like their lawns longer than others do!• Do your homework on the area you have chosen but don’t rule out adjacent areas.• The homework you need to do would be as follows:• How quickly are the properties selling there?

• What is the average price for a property with your requirements?• How is the capital growth in that area?• Are the neighbouring properties being upgraded?• Does this agent know what she is talking about?

HOW TO MAKE SURE THAT YOU ARE IN THE FRONT OF THE QUEUE 1. The market is so overheated at the moment that you need to be as fast as you can to be offered the new release properties.2. Make sure you are dealing with an agency which automatically informs you of all new listings as they come on the market. Seeff automatically links your requirements to any new listings within your areas of interest and within your price parameters. If you provide maximum and minimum prices, and the suburbs which interest you, you will be sent links to properties within 20% of your maximum price. You would need to provide your e-mail address to receive these instant alerts.3. Check the web portals regularly – the most active portal is www.property24.com Most agencies list their properties on this portal.4. Agree to receive SMS alerts for new listings.5. When advised of a Seeff Open Hour (the agents hold these during the week for new release properties) please attend or send a representative to attend. Most new release properties are often sold within 7 days of listing and very few make it as far as the traditional Sunday showhouse times.

10 SUGGESTIONS ON HOW TO MAKE SURE THAT YOU HAVE THE BEST CHANCE OF SECURING THE PROPERTY YOU WANT

1. Offer your best and final price – do not try to be clever with your negotiation tactics as you will often be competing with other offers.2. If you need a bond, arrange for a pre-qualification from a mortgage originator (we work with Ooba who offer this at no cost). This will really strengthen your offer. You would be surprised how many cash buyers there are out there.3. Try and have as few conditions in your offer

as possible. 4. Agree to the seller’s occupation and transfer stipulations as far as you can. Sellers will often accept a lower offer if the dates suit him better.5. Always offer an occupational rental. It is impossible to predict a date for transfer of ownership but a removal date needs to be booked (for both seller and buyer). There will often be a time when the non- owner is in occupation and this needs to be paid for.6. If there are competing offers, ask how the process will work with presenting multiple offers to the seller. Make sure that if the agent has a partner, that they are working together and not against one another. Generally, you should be asked if this is your ‘best and final’ offer – and your competition will be asked the same. At no stage should a buyer be told what the other buyers have offered. Remember, though, that the seller has the right to choose the buyer for his property – and there is nothing the agents or buyers can do about this right.7. Make sure your offer to purchase is watertight – that it is unambiguous and signed properly. This applies also to your accepted agreement.8. Be prepared to negotiate upwards (even though you offered high) if there is competition.9. Unless you are viewing the property in purely investment terms, be prepared to accept that you might have to pay more than you think the ‘bricks and mortar’ are worth. If you live in the property for a long time, the extra you pay now will be insignificant in the long term. 10. Avoid the adhering to the cliché: ‘if it’s meant to be, it’s meant to be’. If Raymond Ackerman lived by that philosophy, we would all still be shopping at the grocers! If you want it, go and get it!

Examine your motivation for selling. If your main objective is “if I get the right price, I will sell” then perhaps you should not be selling. If your price does not match what the market is prepared to pay (not what the agent tells you – she could have another agenda) then re-consider your decision. If you really want to sell, then be prepared to sell for market value.

WHAT IS MARKET VALUE?

Market value is the price that a willing and able buyer is prepared to pay a willing and able seller at a given time. The value can often conflict with: seller expectations, agent ‘valuation’, municipal valuation, bank valuation or any other kind of value one can think of. Buyers buy by comparison – your property will be compared to other properties seen by the buyers at that time. Agents will introduce you to a Comparative Market Value – this is based on the premise that similar properties will sell at similar prices. The problem with this method of assessing value, though, is that each property is unique. You could test drive 2 new white A4 Audis – but one will feel different from the other.

Agents are not valuers! An agent cannot possibly give you a ‘valuation’ of your property. An agent can suggest a list price or estimate a sale price but she cannot guarantee a price unless she wants to buy it herself! Beware of falling into the trap of awarding a sole mandate to an agent who quotes the highest price. I have seen this backfire many times!

10 QUESTIONS TO ASK THE AGENT:

1. Are you registered with the Estate Agency Affairs Board (her license to trade) and if so, what is your 2014 Fidelity Certificate number?2. How do you get to the figure you have quoted on this property – please substantiate

your price suggestion?3. How long have you been selling in this area?4. Give me a list of the last 10 sales you have done this year.5. What is the difference you have achieved between the list prices and sale prices on average?6. How many days do you have your properties on the market before you sell them?7. Please give me client references with contact numbers.8. What other properties do you have on the market?9. How many buyers do you have who would look at this property now?10. Are you prepared to do Sunday showhouses or do you use someone else to do this?

Appoint the agent you believe can do the job and award her a sole mandate based on the above. I would advise you not to appoint an agent based on ‘highest valuation’ or on lowest commission rate. You will get what you pay for!

SOME HOME TRUTHS

• More than 65% of buyers use showhouses to find property. • More than 70% of buyers check web sites to shortlist properties of interest.• More property is sold through Sole Mandate than through open mandates.• Sole mandate sales have a lower list price to sale price ratio• Overpriced properties more often than not sell for lower than the original anticipated sale price.• Often the first offer presented to the seller is the best one.• A well presented property will sell more quickly and at a better price than a sloppy one.• An agent who cannot negotiate with you a reasonable commission rate is less likely to negotiate a good offer from the buyer.• There is more to an offer than the price. The opportunity cost of an early transfer can far outweigh the wait for a higher price.

Make sure that your property presents well and follow the advice of the agent who should be able to assist in ensuring that your property is presented in the best possible light.

1. Clear your property of clutter: Be ruthless in clearing items out of view, whether its old letters stacked up on a windowsill or multiple pairs of shoes gathered under a desk. Less clutter is important as it allows buyers to envisage how their furniture and belongings would fit into your property.

2. Give your home a Spring clean: Use some of the cold and dark winter evenings to give your home a thorough dusting and vacuum. Not only is it more appealing to potential buyers, but shiny surfaces can help to bounce light around, making your home seem brighter and bigger in the low-light months.

3. Make it smell nice: Bad smells can be off-putting to potential buyers, who may be deterred from staying too long if the smell is particularly unattractive. It means avoid cooking a meal the night before a viewing that may have a smell that will linger. Using flowers and pots of herbs can not only look attractive, but can also help introduce pleasant fragrances.

4. Remove all traces of your pets: This is particularly important in kitchens where some buyers may not like the idea of food and pets mixing. Elsewhere, vacuum sofas and make sure dog or cat hairs are not lingering on any surfaces. If possible, try to confine pets to one room while viewings are taking place.

5. Finally, stage your home: Imagine your property is about to be in a magazine shoot when your agent takes the photographs that will be used in the sales particulars. Freshly baked cakes and a dining table set ready for a party are just a few ideas that can help to create the right impression of a desirable place to live.

Preparing your home for a saleFrom ensuring children’s toys are kept hidden in storage boxes, to removing pet smells, there are some relatively quick and inexpensive steps that can help you to present your property in the best possible light to a buyer.

STep 6 lodgement of deeds at deeds office

n��upon receipt of transfer duty receipt, rates and/or levy clearance certificate and original Title Deed, arrange with linked bond cancellation and bond attorneys for simultaneous lodgement (can also be linked to attorneys attending to purchaser’s transfer of property).

n���Deeds lodged at the Deeds Office and allocated a barcode for tracking purposes. Deeds examined.

n��examination process takes seven to ten working days.

n���On about the seventh or tenth working day, the deeds appear in the prep Room and are ‘up for registration’. The conveyancer has five working days to finalise any outstandings and hand in for registration the next day.

STep 7 registration

n��Once handed in, the deeds appear in the execution Room. Conveyancer registers the deeds at 10h00.

n��Ownership passes from seller to purchaser. purchaser’s new bond (if applicable) is registered. Seller’s existing bond (if applicable) is cancelled.

n���Final accounts drawn for the seller and purchaser. Seller paid out net proceeds. Agent’s commission paid.

n���Once registered, the deeds are numbered and microfilmed. it can take up to three months for the Deeds Office to deliver original Title Deed and Mortgage Bond back to the conveyancer. Once delivered, the conveyancer will send original Title Deed to the relevant bank (if the property is bonded) or purchaser (if unbonded).

In terms of Regulation 7(5) of the Electrical Installation Regulations, a change of ownership cannot take place unless there is a valid certificate of compliance, not older than 2 years.

What does the electrical certificate cover? Ÿ Distribution boards and all wiringŸ Socket outlets light switches and isolators for fixed appliancesŸ Earthing and bonding of all metal components, including antennae’s and satellite dishes

The electrical certificate does not cover fixed appliances such as: Geysers, stoves, motors, fans, underfloor heating etc.

Helpful tips to save you costs?

The best advice we can give is to have the inspection done early, before a potential buyer is introduced to the property. This will help you to make cost-saving decisions such as:

Ÿ Removing incorrectly installed extension leads, temporary lighting or garden lights. Ÿ Removing TV antennae that have been replaced by satellite dishesŸ Removing incorrectly installed supplies to Wendy houses, water features, etc

Is a beetle certificate of clearance required by law?No, there is no law that obligates a seller to provide a Beetle Free Certificate.

Then why are properties being inspected for beetle when they are sold?

This dates back to the 1940’s when wood destroying insects were infesting properties on an epidemic scale. Financial institutions would not issue a bond to a buyer unless the property to be mortgaged was declared free of wood-destroying insects.

And so the need was established for suitably qualified people to carry out inspections, and where infestation was identified, recommend remedial measures to eradicate such infestation. This requirement was written into the Offer to Purchase and it became the seller’s obligation to provide the Beetle Free Certificate.

WATER INSTALLATION COC

The City of Cape Town introduced a new water by-law in 2010. It stipulates that before a property can be transferred, a COC must be issued for the water installation. It is a local by-law and only applies to properties sold where the City of Cape Town is the municipal authority. A new certificate needs to be issued each time a property is transferred.

In terms of Regulation 17(3) of the Pressure Equipment Regulations (OHS ACT of 1993), a gas Certificate of Conformity must be issued when there is a change of ownership. This came into effect on the 1st October 2009. The certificate is valid for 5 years.

What does the gas certificate cover?Ÿ There are no leaks and the components are in a safe condition - i.e. not corroded

Ÿ Emergency shut off valves have been installed in the correct positions

Ÿ Outside cylinder are the required distances from doors, drains, windows & electrical apparatus.

Does the Water installation certificate cover all of the plumbing?

No, this certificate IS NOT a plumbing certificate. It is limited to the by-law and is not as comprehensive as a plumbing certificate. Some buyers will assume that this COC addresses all plumbing defects. However, our mandate is to inspect to the required standards only. This is to ensure compliance with the by-law, while incurring the minimal cost to the seller.

In terms of the Electrical Installation Regulations, every user or lessor of an installation must be in possession of a Certificate of Compliance and Test Report issued by a registered person who is registered as an electrical contractor with the Department of Labour. The Certificate of Compliance must be provided every time a house changes ownership.

A Certificate of Compliance and Test Report is only transferable if it is not older than two years, so if you are selling your property and the Certificate of Compliance and Test Report is older than two years you must have the electrical

installation re-tested and a new Certificate of Compliance / Test Report must issued.

Ensure that the electrical contractor you use is registered with the Department of Labour and secondly, use an electrical contractor who is a member of the Electrical Contractors Association (SA) – ECA (SA) as the ECA (SA) offers a Guarantee of Work Scheme whereby it guarantees the work of its members up to an amount of R15 000 against inferior workmanship.

PARTNER TIPS 1. NEVER install a small retrofit pumped solar water heating (SWH) system! This is very inefficient (±40% saving) and needs a lot of maintenance. Also your electric geyser is not designed to hold extremely hot water. 2. Never install two small SWH systems. One large system is more efficient even though pipe runs may be longer. Electricity is more expensive than water.3. Never use evacuated tubes unless you need high temperature water over 100C. Flat plate will last longer.4. Thermo-syphon, close-coupled, indirect SWH systems are the best as there are no moving parts to service and hot water can be made when electricity is not available.5. Only use SWH systems that are made in one factory. They will be matched and will last you longer.6. Only use tanks with double ceramic lining (vitreous coating), this is stable at high temperature and tanks will last longer. Copper, stainless and single ceramic lining tanks will not last as long!
