Introduction

Life insurance, unlike general insurance, involves a longer policy period. You will

normally suffer losses if you surrender an existing life insurance policy, particularly

during the early years of the policy period. To protect your interests, you should

carefully compare your existing and the new insurance policies and assess whether

the replacement of policy is in your best interests before making a decision.

This leaflet provides you with some useful guidance when you are approached for

replacing your life insurance policies.

Dos

1. Ask yourself the following questions before making a decision for replacing

your existing life insurance policy:

Why are you asked to replace your existing policy? Is it solely for your own

benefits?

Will the protection be continuous without interruption? A new policy usually

has a waiting period before its full benefits apply (e.g. suicide is covered

normally after a waiting period of one year from the issue date of the policy).

Are you also sure that the application for your replacement policy will be

accepted?

Is the sum insured under the new policy not less than that under the existing

policy?

Are the returns and cash value offered by the new policy guaranteed or just

projected non-guaranteed amounts? Projected high rates of returns are

usually associated with high investment risks.

When can the new policy offer bonus or dividend? Your existing policy may

already have been operative for several years and may soon be distributing

bonus or dividend.

When will the “Incontestability Clause” be operative under the new policy?

The “Incontestability Clause” under your existing policy may already have

taken effect to protect your interests. That means the validity of the existing

policy is incontestable unless there is fraud or non-payment of premiums.

Is the type of the new policy the same as your existing one? If you intend to

replace a traditional life insurance policy with an investment-linked life

insurance policy (these two types of policies have different features to suit the

needs of policy holders and the latter normally involves higher risks),

particular consideration is necessary.

Will you obtain any cash value upon surrendering your existing policy? In the

first few years of a life insurance policy, the cash value is usually very small or

insignificant compared to the premium paid.

Will you be subject to a higher premium rate or a longer premium payment

period under the new policy as a result of your older age and changes in your

health condition? Replacing policy involves the application for a new policy,

which will need to go through the underwriting process.

Do you have an updated understanding of your existing policy? If not, you

should contact the insurer or insurance intermediary of the existing policy to

review it before considering replacing it.

2. You should consider adding a rider or taking out a new policy in addition to your existing policy if your intention is merely to increase the sum insured or

extend the scope of your insurance coverage, and not to replace an existing

policy.

3. You should carefully examine the Customer Protection Declaration (“CPD”) form before signing it. A CPD form must be completed in the course of policy

replacement. This is to ensure that the insurance intermediary has clearly

explained to the policy holder the real and potential disadvantages of replacing

an existing policy.

If the CPD form indicates that no disadvantage is associated with the

replacement, you should carefully assess whether your insurance intermediary’s

comments are justified. In case of doubts, make enquiry to the insurer of your

existing policy.

4. You should thoroughly examine the new policy after receiving it. If you

eventually consider the policy not suitable, you have the right to cancel it within

the “cooling-off period” and obtain a full refund of the insurance premium (less a

market value adjustment where applicable). With effect from 1 February 2010,

“cooling-off period” has been amended to define as 21 days after the delivery of

the policy or issue of a Notice to the policy holder or the policy holder’s

representative, whichever is the earlier.

Note: “Cooling-off period” is a self-regulatory measure of the insurance industry

promulgated in July 1996 by The Hong Kong Federation of Insurers (“HKFI”).

Where there is any discrepancy between the version of “cooling-off period”

published on this leaflet and that of the HKFI, the version of the HKFI should

prevail.

5. You should beware that your insurance intermediary may have a conflict of interests in persuading you to replace your existing policy. You should,

apart from listening to the advice of your insurance intermediary, approach the

insurer of your existing policy for a balanced view.

Don’ts 1. Don’t just look at the premium amount in deciding to replace your

insurance policy. The difference in premiums normally reflects the difference in

policy coverage and terms.

2. Don’t take the information contained in the promotional brochures as the terms and conditions of an insurance policy. The promotional materials only

generally summarize the provisions of an insurance policy. Wherever there is a

discrepancy, the policy will prevail.

3. Don’t sign on a blank/incomplete form, for instance the CPD form or the proposal/application form. You will be held responsible for the content of the

document once you sign on it.

4. Don’t give the insurance intermediaries cash or unnamed payee cheques; or deposit money into their personal bank accounts for premium settlement. After payment of premiums, you should ask for a receipt.

5. Don’t blindly rely on the insurance intermediaries. You should personally

check the policy details and enquire of the insurer concerned should you have

any doubts.

引言

人壽保險有別於㇐般保險, 涉及年期較⾧。如果投保人中途退保, 特別是在保單生效

後首數年, 通常會蒙受損失。為保障本身的利益, 投保人在決定轉保前, 應仔細比

較現有保單與新保單的條款, 衡量轉保是否符合本身的最佳利益。

本資料單張旨在提供㇐些指引, 供投保人在被人游說轉保時作參考之用。

應做的事項

1 . 決定轉換原有的人壽保險保單前, 投保人應先考慮以下問題:

為何會被人游說轉保? 是否純粹以投保人的利益為依歸?

保險保障會否因轉保而中斷? ㇐般而言, 新保單要在“ 等待期” 屆滿後, 才會

提供全面保障。( 例如: 為自殺提供的保障通常於保單發出後㇐年才告生效。)

此外, 投保人是否肯定新保險公司會接受其轉保申請?

新保單的投保額是否不少於原有保單?

新保單提供的回報及現金價值, 是否有保證抑或只是毫無保證的估計金額? 估

計取得高回報率的投資, 通常會涉及較高風險。

新保單何時才會發放紅利? 原有保單可能已生效多年, 並會於短期內發放紅

利。

新保單的 “ 不可爭議條款” 何時生效? 原有保單的 “ 不可爭議條款” 可能已經

生效, 保障投保人的權益: 除非投保人詐騙或欠交保費, 否則保險公司不可對

原有保單的有效性提出爭議。

原有保單與新保單是否屬同㇐種類? 如投保人打算用與投資相連的壽險保單取

代傳統壽險保單 ( 兩者性質有別, 迎合投保人的不同需要, 但前者的風險通常

較高) , 在作出決定前, 應謹慎考慮。

投保人在退保時可否取回任何現金價值? 人壽保險保單生效後首數年, 投保人

可取回的現金價值通常不多, 與付出的保費相比, 實在微不足道。

投保人轉換新保單時會否因現時年紀較大或健康狀況有變而需要繳付較高保費

或延⾧供款年期? 轉保時需要重新申請㇐份新保單, 並要經保險公司審批。

投保人是否充分了解原有保單的內容? 若否, 應向原有保單的保險公司或保險

中介人查詢原有保單的內容, 才考慮是否轉保。

2 . 假若轉保的目的只是為了加大保額或增加保障範圍, 投保人應考慮在原有保單附加

額外保障條款,或考慮在保留原有保單之餘,另外購買㇐份保險,而非轉換原有保

單。

3 . 在簽署《客戶保障聲明書》前,應細閱其內容 。 投保人在轉保時必須填寫《客戶

保障聲明書》, 確保保險中介人已向投保人詳細解釋轉保會帶來的實質及潛在損

失。

若《客戶保障聲明書》指出轉保不會為投保人帶來任何損失, 投保人便應衡量保

險中介人提供的意見是否中肯。如有疑問, 應向原有保單的保險公司查詢。

4 . 收到新保單後,應仔細審閱保單內容。若最終認為保單不適合,投保人有權在“ 冷

靜期” 內取消保單, 並獲發還所有保費( 在適用情況下須扣除市值調整)。由2010年

2月1 日開始, “冷靜期”的時段修訂為將保單交付保單持有人或其代表後或將《通知

書》發予保單持有人或其代表後, 起計的21 天, 以較先者為準。

註釋: “ 冷靜期” 乃香港保險業聯會( 以下簡稱“ 保聯” ) 於1996年7 月發出的保

險業自律監管措施。如本資料單張所載的“ 冷靜期”版本與保聯的有差異, 則以保

聯的版本為準。

5 . 如被游說轉保,投保人應留意該中介人是否有利益衝突。在聽取其意見之餘, 應向

原有保單的保險公司查詢, 平衡雙方的意見。

不應做的事項

1 . 不應只着眼於保費多寡而決定轉保。保費的差別往往反映保單的保障範圍及條款有

異。

2 . 不應把宣傳單張內的資料視為保單條款。㇐般來說 ,宣傳資料只扼要介紹保單的條

文。兩者如有差異, 當以保單的條文為準。

3 . 不應在空白/未完全填妥的表格上簽署,例如《客戶保障聲明書》或投保書/申請

表格。否則,㇐經簽署, 便必須為文件上填報的內容負責。

4 . 不應把現金或沒有抬頭人的支票交給保險中介人,或把款項存入中介人的私人戶口

以支付保費。繳交保費後, 謹記取回收據 。

5 . 不應盲目依賴保險中介人。如有任何疑問, 應親自翻查保單內容及向保險公司查

詢。

Explanatory Notes to Customer Protection Declaration Form

(A) The agent/broker must help the applicant/proposer complete a Customer Protection Declaration Form (“Form”) for each new individual life insurance policy applied for/proposed by an applicant/proposer. The agent/broker must inform the applicant/proposer that according to the Code of Practice for Life Insurance Replacement (“Code”) the insurer of the new life insurance policy (i) will send to the applicant/proposer a copy of the Form together with the policy when it is issued and (ii) will send a further copy to the insurer(s) of the life insurance policy(ies) which has been replaced/to be replaced. For the purpose of the Form, any reference to insurance agent/broker shall include its responsible officer/chief executive(s) and technical representatives.

To enable the insurer of the new life insurance policy to process the insurance application of the applicant/proposer, the applicant/proposer should work with the agent/broker to complete the Form which will be used for regulatory purposes as stated in the Code and the Minimum Requirements for insurance brokers as specified by the Insurance Authority under the Insurance Ordinance and a copy of the Form may be transferred to the parties as stipulated in the “Declaration by the Applicant/Proposer” of the Form. Requests for access to and/or correction of the information (if appropriate) in the Form can be made to the same contact point as for the data in the insurance application.

(B) For identification purpose, the agent/broker must help the applicant/proposer fill in the full name of the Insurer issuing the new life insurance policy (the Insurer may pre-print its name on the Form), the relevant application/proposal number, the name of applicant/proposer of the new life insurance policy and the Hong Kong Identity Card/Passport number of applicant/proposer.

(C) Any transaction involving the purchase of life insurance is construed as a Replacement if (i) any existing life insurance policy(ies) or a substantial part of the sum insured of its/their basic life coverage has been/have been/will be terminated or (ii) a substantial part of the guaranteed cash value of the existing life insurance policy(ies) was reduced/will be reduced including where a policy loan was/will be taken out against a substantial part of the guaranteed cash value. Existing life insurance policy(ies) include(s) all types of traditional life, annuity and other non-traditional policies of the applicant/proposer, which has/have been terminated within 12 months before or will be terminated within 12 months after the new life insurance policy’s issue date. Termination includes lapse, surrender, converted to reduced paid-up or extended-term insurance under the non-forfeiture provision of the existing life insurance policy(ies). “A substantial part” means “50% or above”. However, converting term life insurance to whole life insurance (or some forms of permanent life insurance) under policy provisions of the existing life insurance policy(ies) is not construed as a Replacement.

(D) If the applicant/proposer answers “No” to both items 1(a) and 1(b) of Section A, he/she shall read carefully and simply sign the Declaration in Section A only and ignore the rest.

(E) How to complete the Form

(1) If the applicant/proposer answers “No” to both items (a) and (b), the agent/broker must explain the Declaration before he/she asks the applicant/proposer to sign in Section A. There is no need to fill in Section B.

If the applicant/proposer answers “Yes” to either item (a) or (b), the agent/broker must help the applicant/proposer complete items 2 to 5 and must explain and discuss with the applicant/proposer the full implications of replacing any or a substantial part of his/her existing life insurance policy(ies) with the new life insurance policy in relation to financial implications, insurability implications and claims eligibility implications of the replacement and other considerations. The applicant/proposer may consult the insurer(s) of his/her existing life insurance policy(ies) for further information. There is no need to sign in Section A.

《客戶保障聲明書》註釋

(A) 申請人╱投保人申請╱投保每一份新個人壽險保單時,保險代理╱經紀必須協助申請人╱

投保人填寫《客戶保障聲明書》(下稱《聲明書》)。保險代理╱經紀必須告知申請人╱投保

人,根據《壽險轉保守則》(下稱《守則》),新壽險保單的保險公司 (i)會於保單獲簽發後,將

《聲明書》的副本隨保單文件送交申請人╱投保人,(ii)並會將《聲明書》的副本送交所有已

被取代或將會被取代的現有壽險保單的保險公司。《聲明書》所指的保險代理╱經紀,均包

括其負責人╱行政總裁及業務代表。

為使新壽險保單的保險公司能處理申請人╱投保人的投保申請,申請人╱投保人應與保險

代理╱經紀合作填寫《聲明書》;《聲明書》將根據《守則》及保險業監管局根據《保險業條例》

指明的適用於保險經紀的「最低限度規定」條文作為監管之用,而《聲明書》的副本或會被

轉交予《聲明書》內「申請人╱投保人聲明」下指定的機構。如欲查閱及╱或更正《聲明書》

內資料(如適用者),申請人╱投保人可向查閱及╱或更正投保申請書內資料的同一單位提

出。

(B) 保險代理╱經紀必須協助申請人╱投保人填寫新壽險保單的保險公司的全名(保險公司可

以於《聲明書》上預先印備商號)、有關投保申請書╱建議書編號、新壽險保單申請人╱投

保人姓名、以及新壽險保單申請人╱投保人的香港身分證╱護照號碼,以資識別。

(C) 任何購買壽險的交易,如涉及 (i)任何現有壽險保單或其基本壽險保障的大部分保額已被

終止或將被終止,或 (ii)現有壽險保單內大部分的保證現金價值已被減少╱將被減少,包

括:大部分的保證現金價值已被提取╱將被提取作為保單借貸,均會被視為「轉保」。現有

壽險保單包括在新購壽險保單生效日前後的12個月內,申請人╱投保人已經終止或將會

終止的任何壽險保單。壽險保單包括所有類型的傳統壽險、年金及其他非傳統壽險保單。

終止保單包括:讓保單失效、退保、或根據現有壽險保單的不能作廢條款,將保單轉為減

額繳清╱展期保單。「大部分」指「50%或以上」。若根據現有壽險保單的保單條款,將定

期壽險保單轉為終身壽險保單(或某些形式的長期壽險保單),則不會被視為「轉保」。

(D) 如果申請人╱投保人回答A部第1(a)及1(b)項時都選擇「否」,則只須詳閱A部的「聲明」並

簽署,而毋須填寫其餘部分。

(E) 如何填寫《聲明書》

(1) 如果申請人╱投保人回答 (a)及 (b)項時都選擇「否」,在申請人╱投保人簽署A部之前,保

險代理╱經紀必須向申請人╱投保人解釋「聲明」的內容。申請人╱投保人毋須填寫B部。

如果申請人╱投保人回答 (a)或 (b)項時選擇「是」,保險代理╱經紀則必須協助申請人╱投

保人填妥第2至5項,並必須向申請人╱投保人解釋和商討以新壽險保單取代任何現有壽

險保單,或取代任何現有壽險保單內大部分的壽險成分,對申請人╱投保人在財務、受保

資格及索償資格產生的所有影響,以及其他考慮因素。申請人╱投保人或需向其現有壽險

保單的保險公司查詢進一步資料。申請人╱投保人毋須簽署A部。

(2a) The agent/broker must help the applicant/proposer fill in the estimated loss for the replacement by referencing that the set-up cost is usually two years premiums or 10% of single premium of the basic life insurance policy replaced/to be replaced. No reason is required if the estimated loss stated is equal to or higher than this reference. The agent/broker may use other reference for the estimated loss provided he/she could reasonably justify the estimation, and must give reason and the justification if there is no loss or if estimated loss is less than two years premiums or 10% of single premium.

(2b) The agent/broker must help the applicant/proposer compare the annualized premiums of the existing life insurance policy(ies) and the new life insurance policy by using the same sum insured, and give reason if the annualized premiums will not be higher under the new life insurance policy for the same sum insured.

(2c) The agent/broker must help the applicant/proposer fill in the guaranteed cash values of the existing life insurance policy(ies) and the new life insurance policy using the values on the policy anniversary dates immediately after the applicant/proposer reaches age 65, or if one of the policies or all policies mature(s) before age 65, fill in the guaranteed cash values on the policy anniversary dates of each policy in the earliest maturity year. The agent/broker has to obtain the value(s) of the existing life insurance policy(ies) from the applicant/proposer unless the applicant/proposer declares in writing in the space provided for “Guaranteed Cash Value(s) of the existing life insurance policy(ies)” that he/she does not want to disclose such information.

(3) The agent/broker must explain the implications of the changes of health conditions, occupation, lifestyle/habit and recreational activities in this replacement to the applicant/proposer before the latter ticks the boxes.

(4a) The agent/broker must help the applicant/proposer fill in the expiry dates of the period in the “suicide clause” for both the existing life insurance policy(ies) and the new life insurance policy. The expiry date of the latter will be the number of months from its issue date. The agent/broker has to obtain the expiry date(s) of the existing life insurance policy(ies) from the applicant/proposer unless the applicant/proposer declares in writing in the space provided for “Existing life insurance policy(ies)” that he/she does not want to disclose such information.

(4b) The agent/broker must help the applicant/proposer fil l in the expiry dates of the “contestability period” for both the existing life insurance policy(ies) and the new life insurance policy. The expiry date of the latter will be the number of months from its issue date. The agent/broker has to obtain the expiry date(s) of the existing life insurance policy(ies) from the applicant/proposer unless the applicant/proposer declares in writing in the space provided for “Existing life insurance policy(ies)” that he/she does not want to disclose such information.

(4c) The agent/broker must explain to the applicant/proposer that to the scenario where twisting of life policy has occurred and the policyholder opted for reinstatement of his policy by the Non-selling office, the insurer(s) of the existing life insurance policy(ies) will NOT be responsible for any payment of claims that occurred during the period that the existing life insurance policy(ies) is/are surrendered or lapsed as a result of policy replacement. The insurer of the new life insurance policy will be responsible for the claim subject to the terms and conditions of the new life insurance policy.

(5a) The agent/broker must help the applicant/proposer list out the riders/supplementary benefits under the existing life insurance policy(ies) that will not have under the new life insurance policy for the applicant/proposer. Detailed benefits under each rider/supplementary benefit are not required to be listed. The agent/broker has to obtain the riders/supplementary benefits under the existing life insurance policy(ies) from the applicant/proposer unless the applicant/proposer declares in writing in the space provided that he/she does not want to disclose such information.

(5b) The agent/broker must help the applicant/proposer list out the reasons why the new life insurance policy is more suitable for the applicant/proposer unless the applicant/proposer declares in writing in the space provided that he/she does not mind whether the new life insurance policy is more suitable or not.

(2a) 保險代理╱經紀必須協助申請人╱投保人填寫轉保構成的估計損失,可用開立保單費用

一般為已被取代或將會被取代的基本壽險保單的兩年保費或整付保費的10%作為參考。

如果保險代理╱經紀填寫的估計損失等同或高於參考金額,則保險代理╱經紀毋須交代原

因。保險代理╱經紀可用其他方法計算財務損失,但必須有合理理據支持其估計損失。假

如保險代理╱經紀認為轉保對申請人╱投保人不會造成任何財務損失或估計損失少於兩年

保費或整付保費的10%,則必須交代原因及理據。

(2b) 保險代理╱經紀必須協助申請人╱投保人以相同的保額來比較現有壽險保單和新壽險保單

的年付保費;假如保險代理╱經紀認為新壽險保單的年付保費不會較現有壽險保單為高,

則必須交代原因。

(2c) 保險代理╱經紀必須協助申請人╱投保人填寫現有壽險保單和新壽險保單於申請人╱投保

人剛年滿65歲的保單周年日時的保證現金價值,或如果上述其中一份保單╱所有保單於

65歲前期滿,則以最先期滿的保單的期滿年度為準,填寫各保單於該年度的周年日之保

證現金價值。除非申請人╱投保人在「現有壽險保單的保證現金價值」下預留的空格上書

面聲明他╱她不願意披露該等資料,否則保險代理╱經紀必須向申請人╱投保人索取該等

資料。

(3) 在申請人╱投保人回答此問題之前,保險代理╱經紀必須向申請人╱投保人解釋健康狀

況、職業、生活習慣╱嗜好及參與的康樂活動的改變對是次轉保的影響。

(4a) 保險代理╱經紀必須協助申請人╱投保人填寫現有壽險保單和新壽險保單的「自殺條款」

期限的屆滿日期。新壽險保單的「自殺條款」期限的屆滿日期會是新壽險保單簽發日後的

月數。除非申請人╱投保人在「現有壽險保單」下預留的空格上書面聲明他╱她不願意披

露該等資料,否則保險代理╱經紀必須向申請人╱投保人索取該等資料。

(4b) 保險代理╱經紀必須協助申請人╱投保人填寫現有壽險保單和新壽險保單的「可爭議期」

的屆滿日期。新壽險保單的「可爭議期」期限的屆滿日期會是新壽險保單簽發日後的月

數。除非申請人╱投保人在「現有壽險保單」下預留的空格上書面聲明他╱她不願意披露

該等資料,否則保險代理╱經紀必須向申請人╱投保人索取該等資料。

(4c) 保險代理╱經紀必須向申請人╱投保人解釋,當保單持有人被誘導轉保後,並選擇由非銷

售保單的保險公司恢復原有保單的效力,現有壽險保單的保險公司毋須負責因轉保而引致

現有壽險保單失效或被退保期間出現的任何索償。而銷售新壽險保單的保險公司應按照新

壽險保單之條款負責有關賠償。

(5a) 保險代理╱經紀必須協助申請人╱投保人詳列在現有壽險保單下享有而新壽險保單卻沒有

提供的附加保障利益,但毋須填寫每項附加保障利益的細節。除非申請人╱投保人在預留

的空格上書面聲明他╱她不願意披露該等資料,否則保險代理╱經紀必須向申請人╱投保

人索取該等資料。

(5b) 除非申請人╱投保人在預留的空格上書面聲明他╱她不介意新壽險保單是否較為切合他╱

她,否則保險代理╱經紀必須協助申請人╱投保人詳列新壽險保單較為切合申請人╱投保

人之原因。

(Notes: Additional papers may be used wherever the spaces provided in the Form are insufficient. However, both agent/broker and applicant/proposer must sign on all the papers that are used.)
