    Supreme Court declined toreconsider its 2010 CitizensUnited ruling lifting restrictionson corporate and union politicalc o n t r i b u t i o n s , s u m m a r i l yoverturning the Montana SupremeCourt in a case involving aMontana state law limitingcorporate political spending.In an unsigned decision, the court

    said "there can be no seriousdoubt" that the holding in CitizensUnited v. FEC applies to theMontana state law. "Montana'sarguments in support" of the statecourt ruling "either were alreadyrejected in Citizens United, or failto meaningfully distinguish thatcase," the decision said.Four liberal justices dissented

    from the decision. Justice StephenBreyer, writing for the dissenters,said he would have preferred to

    reconsider Citizens United or atleast i ts application to the

    Montana case. He said Montana'sexperience "casts grave doubt onthe Court's supposition thatindependent expenditures" bycorporations and unions "do notcorrupt or appear to do so."The majority turned away pleas

    from the court's liberal justices togive a full hearing to the casebecause massive campaignspending since the January 2010ruling has called into questionsome of its underpinnings.

    The same five justices said in2010 that corporations have aconstitutional right to be heard inelection campaigns. The decisionpaved the way for unlimitedspending by corporations andlabor unions in elections forCongress and the president, asl o n g a s t h e d o l l a r s a r eindependent of the campaignsthey are intended to help. Thedecision, grounded in the freedomof speech, appeared to apply

    equally to state contests.But Montana aggressively

    defended its 1912 law against achallenge from corporationsseeking to be free of spendinglimits, and the state SupremeCourt sided with the state. Thestate court said a history ofcorruption showed the need forthe limits, even as JusticeAnthony Kennedy declared in hisCitizens United opinion thatindependent expenditures bycorporations "do not give rise tocorruption or the appearance of

    corruption."Twenty-two states and the

    District of Columbia, as well asSen. John McCain and othercongressional champions ofstricter regulations on campaignmoney, joined with Montana.Two liberal justices who were in

    dissent in Citizens UnitedRuthBader Ginsburg and StephenBreyeralready had challengedJustice Kennedy's view that theindependent campaign spending

    could not be corrupting by virtueof the absence of links to a

    campaign.When the court blocked theMontana ruling in February,Justice Ginsburg issued a briefstatement for herself and JusticeBreyer saying that campaignspending since the decision makes"it exceedingly difficult tomainta in tha t independentexpenditures by corporations 'donot give rise to corruption or theappearance of corruption.'"Justice Ginsburg appeared to be

    referring to the rise of unregulatedsuper PACs that have injectedmillions of dollars into thepresidential and other campaigns.She said the case "will give thecourt an opportunity to considerwhether, in light of the huge sumscurrent ly deployed to buycandidates' allegiance, CitizensUnited should continue to holdsway."The corporations that sued over

    the law said it could not remain

    on the books after the CitizensUnited decision.

    Montana urged the high court tore jec t the appea l , or holdarguments and not issue what thecourt calls a summary reversal.The prevailing side in the lowercourt almost always strives toavoid high court review.     Court struck down much ofArizona's effort to crack down onillegal immigrants but left one keypart intact in a ruling that gaveb o th s id es o f t h e d eb a t e

    Arizona in effect had tried to setup a parallel enforcement systemthat punished illegal immigrantsmore harshly and interfered withcongressional authority over thenation's borders. The courtrejected parts of the state lawknown as SB1070 that made it acrime for illegal immigrants toseek work and that authorizedwarrantless arrests of people

    suspected by state and local policeo f co m m i t t i n g d ep o r t ab l eo f fen ses .But the court upheld for now the

    law's directive that state and localpolice check the immigrationstatus of people they stop whenthey suspect them of lackingauthorization to be in the U.S. Thejustices observed that federal lawalready requires immigrationofficials to respond to statuschecks from local authorities.The impact of the ruling was

    unclear Monday, as immigrantsand advocates scrambled foranswers from legal analysts andlaw enforcement. Most opponentsof the law reacted with relief atthe ruling, but some immigrantadvocates said implementation ofthe law could still pose problemsfor immigrants."There's still going to be a lot ofuncertainty until it's clear howpolice will approach this," said

    Joe Rubio, lead organizer forArizona Interfaith Network-Industrial Areas Foundation, anetwork of community organizinggroups. "The state is going tohave to moni tor th is verycare fu l l y " t o av o id r ac i a lp ro f i l i n g , h e sa id .The court left open the possibility

    that the surviving provision couldbe challenged depending on howit is applied. It acknowledgedconcerns that the provision could

    lead to abuses, such as prolongeddetention of arrestees while theirstatus was being checked.Under the law, immigrants can be

    questioned about their status whenthey are stopped for other reasons.S i n c e m u c h i s l e f t t ointerpretation by local officers,t h e a p p r o a c h b y p o l i c edepartments to enforcement of thelaw may vary widely, immigrantadvocates said."The government of the UnitedStates has broad, undoubted

    power over the subject o f immigration and the status ofaliens," Justice Anthony Kennedywrote for a majority includingChief Justice John Roberts andJustices Ruth Bader Ginsburg,Stephen Breyer and SoniaSotomayor. "Immigration policycan affect trade, investment,tourism and diplomatic relationsfor the entire nation, as well as theperceptions and expectations of

    aliens in this country who seek thefull protection of the laws," thecourt said.While "the problems posed to the

    State by illegal immigration mustnot be underestimated," JusticeKennedy wrote that Congress hadestablished a "careful framework"for immigration intended tobalance in terests involv inge m p l o y e r s , f a m i l i e s a n ddiplomatic relations as well as lawenforcement.

    T h e c o u r t ' s t h r e e m o s tconservative members, JusticesAntonin Scalia, Clarence Thomasand Samuel Alito, each filedseparate dissents saying theywould have upheld the entireArizona lawor, in JusticeAlito's case, all but one provision.None joined the dissent of theother, suggesting disagreementover the basis for upholding thestate law.The majority "deprives States of

    major issue in the Novemberelection, the survival of the status-

    check provision was a consolationprize for backers of the Arizonacrackdown, giving them as well asthe Obama administration a wayto claim victory.President Barack Obama said hewas pleased that the court struckdown the three provisions andsa id t h e d ec i s io n "m ak esu n m i s t a k a b l y c l e a r t h a tC o n g r e s s m u s t a c t o ncomprehensive immigrationreform." He called on Arizona not

    to enforce the surviving provision"in a manner that undermines thecivil rights of Americans."Arizona Gov. Jan Brewer, a

    Republican who signed themeasure in 2010, called the rulinga "legal victory." Ms. Brewer saidshe recently issued a new order totrain officers to enforce the lawwithout racial profiling. "I amconfident our off icers areprepared to carry out this lawresponsibly and lawfully," shesaid in a statement.

    Joe Arpaio, the controversialsheriff of Arizona's MaricopaCounty, said Monday that themost important part of the state'simmigration law had been upheld."It shows cops can ask someone ifthey're here illegally when youstop them for another crime," Mr.Arpaio said. He added, however,that "you like to get everything."The law's opponents also said

    they were pleased with the ruling.

    "God answered our prayers. Thisis a big victory," said MagdalenaSchwartz, the pastor of a Hispanicevangelical church in Mesa whoopposed the law. Many families inher church are in the U.S.illegally. "My families are sohappy, so relieved. They havepeace. They can live their lives.They can stay in Arizona."For undocumented immigrants,

    the high court's ruling could makeit easier to look for a job in

    Arizona and reduce the risk theycould be arrested by local policesimply for lack ing papers .However, if they were stopped foranother reason, police in Arizonawould be more likely to checktheir immigration status in caseswhere police in other states mightnot bother."This was a good decision on thepart of the court and really helpsthe country dodge a pretty

    (Reuters) - The U.S. SupremeCourt upheld a key part ofArizona's crackdown on illegalimmigrants on Monday but struckdown three other parts of the statelaw, delivering a mixed ruling forthe Obama administration onfed era l p o wer t o en fo rceimmigration statutes in the UnitedStates.In an opinion by Justice Anthony

    Kennedy, the country's highestcourt by an 8-0 vote upheld the

    Arizona law's most controversialaspect, requiring police officers tocheck the immigration status ofpeople they stop for any reason.But in a split verdict, the justices

    also ruled that the three otherprovisions of the Western state's2010 law that were challenged inc o u r t b y t h e O b a m aadministration went too far. Thevotes on those provisions wereeither 5-3 or 6-2, with the moreconservative justices in dissent.These three provisions required

    immigrants to carry immigrationpapers at all times, banned illegalimmigrants from soliciting workin public places, and allowedpolice arrest of immigrantswithout warrants if officersbelieved they committed crimesthat would make them deportable." A r i z o n a m a y h a v eunderstandable frustrations withthe problems caused by illegalimmigration ... but the state may

    not pursue policies that underminefederal law," Justice Kennedywrote for the majority in a 25-page opinion.The decision in part was an

    e l e c t i o n - y e a r s e t b a c k f o rPresident Barack Obama, but wasless of a defeat than had beenenvisioned after oral argumentsbefore the justices in April. Themajority opinion's sweepingrhetoric could cloud state effortsto try to curb illegal immigration.

    Justice Kennedy stressed that thefederal government has "broad,u n d o u b t e d p o w e r " o v e rimmigration, pointing to howfederal policy could affect trade,i n v e s t m e n t , t o u r i s m a n dd i p l o m a t i c r e l a t i o n s .The majority that struck down

    three challenged parts of theArizona law also included ChiefJustice John Roberts, as well asthe more liberal justices RuthBader Ginsburg, Stephen Breyerand Sonia Sotomayor, the nation's

    first Hispanic justice."I am pleased that the SupremeCourt has struck down keyp r o v i s i o n s o f A r i z o n a ' simmigration law. What thisdecision makes unmistakablyclear is that Congress must act oncomprehensive immigrationreform. A patchwork of state lawsis not a solution to our brokenimmigration system - it's part ofthe problem," Obama said in a

    statement.CIVIL RIGHTSObama said he remained

    concerned about the practicalimpact of the remaining provisionof the Arizona law. "Goingforward, we must ensure thatArizona law enforcement officialsdo not enforce this law in amanner that undermines the civilrights of Americans, as the court'sdecision recognizes," Obama said.In upholding the police checks,

    Kennedy said their mandatorynature did not interfere with thefederal immigration scheme, andfound unpersuasive the Obamaadministration argument thatfederal law preempted this part ofthe law at this stage.He said it was improper to block

    that provision before state courtshad an opportunity to review it,and without some showing that itsenforcement conflicted withfederal immigration law.

    Kennedy also left open the

    possibility for constitutional orother challenges to the law once itgoes into effect.Opponents of the Arizona law

    also have sued on other groundsthat it was unconstitutional andcould lead to ethnic and racialprofiling of the fast-growingHispanic population, whichrepresents 16 percent of allAmericans.The ruling went to the heart of a

    fierce national debate betweenDemocrats and Republicans overt h e 1 1 . 5 m i l l i o n i l l e g a limmigrants the U.S. governmentestimates to be in the country.The ruling upholding the police

    checks was a win for ArizonaRepublican Governor Jan Brewer,who championed the measure andcalled the decision a "victory forthe rule of law."Republican presidential candidate

    Mitt Romney, who challenges

    Obama in the November 6 U.S.election, had opposed the federalgovernment's challenge to thelaw."Today's decision underscores theneed for a president who will leadon this critical issue and work in abipartisan fashion to pursue anational immigration strategy,"Romney said in a statement.SCALIA ANGRILY DISSENTSJustice Antonin Scalia read an

    angry dissent from the bench,saying he would have upheld the

    entire Arizona law. It "boggles themind" that the president mightdecl ine to enforce federalimmigration law, Scalia said inapparent reference to Obama'sJune 15 executive order stoppingdeportation for certain youngpeople in the United Statesil legally.Obama has vowed to push for

    comprehensive immigrationlegislation if re-elected on

    TIGHT SHIPThe data did little to supportshares of U.S. homebuilders,which were sharply lower onMonday along with the broaderstock market.In the face of the foreclosure

    wave, builders are carefullymanaging their stocks, which ishelping to lift new home pricesoff the bottom. The median priceof a new home rose 5.6 percent inMay from a year ago to $234,500.

    While the inventory of newhomes on the market edged up 0.7percent to 145,000 units lastmonth, it remained near recordlows."There is very little speculation inresidential real estate. Houses are

    being built and sold only in thefew places where there is cleardemand," said Chris Low, chiefeconomist at FTN Financial inNew York. "As a result, sales arelikely to continue to improvesome time to come."At May's sales pace it would take

    4.7 months to clear the housesfrom the market, the lowest sinceOctober 2005 and down from 5.0months in April.

    New home sales last month werebuoyed by a 36.7 percent jump inthe Northeast to the highest levelsince July 2009, and a 12.7percent rise in the South to a two-year high.     out Americans' ability to sendchildren to prison for the rest oftheir lives with no chance of evergetting out. The 5-4 decision is inline with others the court hasmade, including ruling out the

    death penalty for juveniles andlife without parole for youngpeople whose crimes did notinvolve killing.The decision came in the robbery

    and murder cases of Evan Millerand Kuntrell Jackson.Miller was convicted in 2006 of

    capital murder for beating a manwith a baseball bat and leavinghim to die in a burning trailerafter stealing his baseball cardcollection and $350. The killing

    occurred in 2003.

    Miller's co-defendant testifiedagainst him in exchange for alighter sentence for his ownmurder , robbery and arsoncharges .Colby A. Smith testified that he

    and Miller, who was 14 at thetime of the murder, decided to killCannon for money, according toreports from the sentencing.Smith testified that after he hitCannon with a bat, Miller began

    bashing the victim with the bat

    and said: Cole, I'm God and I'vecome to take your life." They laterset fire to his trailer, where theman's remains were discovered.The Alabama Court of Criminal

    Appeals upheld the sentence onthe grounds that Miller's sentencewas not overly harsh whencompared to his crime, a rulingthe Supreme Court disagreedwith."No one can doubt that (Miller)

    and Smith committed a vicious

    murder, Justice Elena Kagan saidin the court's ruling. But they didit when high on drugs and alcoholconsumed with the adult victim.And if ever a pathologicalb a c k g r o u n d m i g h t h a v econtributed to a 14-year-old'scommission of a crime, it is here.That Miller deserved severepunishment for killing ColeCannon is beyond question. Butonce again, a sentencer needed to

    Moscow has been rankedRussia's worst city for doingbusiness, according to a recentWorld Bank survey.The survey evaluated businessconditions in four areas: starting abusiness, obtaining planningpermission, registering property,and connecting to the electricitygrid.

    There are two areas whereMoscow particularly stands outcompared to other cities acrossRussia: issuing permits forconstruction and the huge cost ofconnection to the grid.In Moscow the cost exceeds even

    the notoriously expensive prices

    in Vietnam and Nigeria.As for construction permits,according to the Deputy Mayor of

    Moscow Andrey Sharonov, it iscaused by objective reasons."This is a serious negative signalfor us to change the situation, andthat's what we are trying to do,"Sharonov said in an interview onthe sidelines of the St. Petersburgeconomic forum.

    The other reason is strongcompetition among businessmenfor resources.However, Sharonov said progress

    has been made in certain areas.And since the survey wasconducted, Moscow has improvedby cutting down the time it takesto issue construction permits. Theultimate goal is creating a one-stop-shop system where peoplecan apply at one office instead ofvisiting different institutions to
