SECTION 1 - DEFINITION OF TERMS

Certain tenns used generally throughout this tariff for Communications Service of this Company aredefined below.

Advance Payment: Part or all of a payment required before the start of service.

Authorized User: A person, finn or corporation which is authorized by the Customer orJoint User to be connected to the service of the Customer or Joint User, respectively.

llit The smallest unit ofinfonnation in the binary system of notation.

Commission: Ohio Public Utilities Commission

Comoany: Level 3 Communications. LLC, the issuer of this tariff.

Customer: The person, ftrrn or corporation which purchases service and is responsiblefor the payment of charges and compliance with the Company's regulations.

Dedicated: A facility or equipment system or subsystem set aside for the sole use of aspecific Customer.

End Office: The tenn "end office" denotes the switching system office or serving wireeenter where Customer station loops are terminated for purppses of interconnection toeach other and/or to trunks.

End User: A non-carrier customer of an intrastate telecommunications service. Jf aeErricr uses teJecommunications service for administrative purposes, it shall be deemed tobt: an End User.

Individual Case Basis ([CBl: A service arrangement in which the regulations, rates andcharges are developed based on the specific circumstances of the case.

Interconnect Carrier: Any carrier that connects to Company's network for exchange ofcommunications traffic.

Joint User: A person, finn or corporation which is designated by the Customer as a userof services furnished to the Customer by the Company and to whom a portion of thecharges for the service will be billed under a Joint User arrangement as specified in theCompany's tariff.

!.ATA: A Local Access and Transport Area established pursuant to the Modification ofFinal Judgment entered by the United States District Court for the District ofColumbia inCivil Action No. 82-0192; or any other geographic area designated as a LATA in theNational Exchange Carrier Association, Inc. Tariff r.c.c. No.4.

Major Service IntemlOtion: An interruption ofCustomer service due to the Company'sn"gligence or due to its noncompliance with the provisions oftbis tariff.

PIU: Percent Interstate Usage

Premises: The space occupied by a Customer, Authorized User or Joint User in abuilding or buildings or contiguous property (except railroad rights-of-way, etc.) notseparated by a highway.

Recurring Charges: The monthly charges to the Customer for services, facilities andeo~uipment, which continue for the duration of the service.

Service Commencement Date: The first day following the date on which the Companynotifies the Customer that the requested service or facility is available for use, unlesse>:tended by the Customer's refusal to accept service which does not conform to standardsset forth in the Service Order or the tariffs of the Company, in which case the ServiceCommencement Date is the date of the Customer's acceptance. The Company andCustomer may mutually agree on a substitute Service Commencement Date. In the caseof Tandem Connect service ordered under option (2) of Section 12.1. 1.2, the ServiceCDmmencement Date is the date On which the Customer first sends Switched AccessService traffic to the Company or accepts Switched Access Service traffic from theCompany.

Service Order: A written request for Company Services that may be submitted by theCustomer in the format devised by the Company. The signing of a Service Order by theCustomer and acceptance by the Company will initiate the respective obligations of theparties as set forth herein, but the duration of the service is calculated from the ServiceCommencement Date.

~hared: A facility or equipment system or subsystem that can be used simultaneously bys(~veral Customers.

Switched Access Service: Access to the switched network of an Exchange Carrier for thepurpose of originating or terminating communications. Switched Access service includesLocal Switching, Local Transport. and Cal1'ier Common Line.

Tall Free: The terms "Toll Free" or "Toll Free Servit:e" refer to an inboundtelecommunications service whkb permits calls to he completed to the customer'slocation without charge to the calling party. Access t(1 the service is gained bY' dialing aten-digit telephone number which terminates at the customer's location or a locationdesignaled by that customer. Toll Free Services lypically originate via normal sbared usefacilities and are terminated via the customer's local exchange service access lme.

Transmission: The sending of electrical or optical signals over a line to a destination.

!Jser: A Customer, Joint User, or any other person authorized by a Customer to useS1,rvice provided to the Customer under a Level 3 Communications, LLC tariff.

SECTION 3 - OBLIGATIONS OF THE CUSTOMER ICONT'Dl

3.4.1 Originating Access: Originating access minutes may be based on traffic originating atthe State, LATA or local Switching Center level, provided that the traffic being measuredis only traffic originating from the Company Local Switching Center(s). The Customermust provide the Company with a projected PIU factor on a quarterly basis as specifiedbelow. Originating access minutes will be measured as follows, based on type of access:

3.4.1.1 For Feature group D Switched Access Services, as defined in Section14.2.1, where the Company can detenninejurisdiction by its call detail, theprojected PIU will be developed by the Company on a quarterly basis by dividingthe measured interstate originating minutes by the total originating accessminutes.

3.4.1.2 For Feature Group D with 950 Access as defined in Section 14.2.1, the Customermust provide the Company with a projected PIU factor by supplying theCompany with an interstate percentage oforiginating access minutes.

3.4.1.3 For 500, 700, WlJ.-Toll Free ,YY, calling card and operator service access, theCustomer must provide the Company with a projected PIU factor for each type ofaccess. The Customer who provides a PIU factor shall supply the Compaoy withan interstate percentage oforiginating access minutes. The PIU factor will beused to detennine the jurisdiction for billing purposes of 500,700,800-Toll Free8Yy, calling card and operator service access. Originating Access charges willnot apply to a tollll'ee call that utilizes ToU Free Inter-Exchange DeliveryService as described in Section 14.2.8(A}

3.4.1.4 Ifno PIU for originating minutes is submitted as specified herein, then theprojected PIU will be set on a default basis of 50 percent interstate traffic and 50percent intrastate traffic.

3.4.2 Tenninating Access: For Feature Group D Switched Access Services, the Customermust provide the Company with a projected PIU factor by supplying the Companywith an interstate percentage of terminating access minutes on a quarterly basis, asdescribed in Section 3.4.4 below. Ifno projected PIU factor is submitted by theCustomer, then the projected PlU will be set on a default basis at the same percentageas the originating PIU.

3.4.3 Except where the Company measured access minutes are used as set forth in 3.4.1above, the Customer reported projected PIU factor as set forth above will be used untilthe Customer reports a different projected PIU factor, as set forth below. The revisedreport will serve as the basis for future billing and will be effective on the next billdate.

SECTION 13 - CARRIER COMMON LINE SERVICE

The Company will provide Carrier Common Line Access Service (Carrier Common Line Access) tocustomers in conjunction with Switched Access Service provided in Section 14 of this Tariff. CarrierCommon Line ACl..:ess Service will not apPly where the ComralJ.Y..p'uvid~s Toll Free rnter-E.xchu..o.m:Delivery Service.

13.1 General Description

Carrier Common Line Access provides for the use of end users~, Company provided common lineby eustomers for access to such end users to furnish Communications Services.

13.2 Limitations

13.2.1 hclusions

Neither a telephone number nor detail billing are provided witb Carrier Common LineAecess. Additionally, directory listings and intereept arrangements are not included inth~~ rates and charges for Carrier Common Line Access.

13.2.2 Access Groups

All trunk side connections provided in the same access group will be limited to the samefeatures and operating characteristics.

13.3 Undertaking of the Company

13.3.1 Provision of Service

Where the customer is provided Switched Access Service under other sections of thisTariff, the Company will provide the use of Company common lines by a customer foraccess to end users at rates and charges as set forth in 15.1.3 following.'

13.3.2 Interstate and Intrasl<lte Use

The Switched Access Service provided by the Company includes the Switched AccessService provided for both interstate and intrastate communications. The Carrier CommonLine Access rates and charges as set forth in 15.1.3.4.2 following apply to intrastateSwitched Access Service access minutes when the Commmv provides common lineservice with other Switched Access Services.

Wilen the 10XXX Access Code is used, FGD switching also provides for dialing the digitofor access to the Customer's operator, 9] ] for access to the Company's emergencyservice, or the end-of-dialing digit (#) for cut-through access to the Customer's Premises.

In addition, End Users may originate calls by dialing the 950-XXXX Access Codespecific to a particular Interexchange Carrier, provided that the Interexchange Carrier hassubscribed to the Company's Feature Group D with 950 Access Common SwitchingOptional Feature. If the End User is presubscribed to that lnterexchange Carrier, noAccess Code is necessary,

14.2.2 M,nner of Provision

Trunks used for Switched Access Service may be configured for one-way (eitheronginating only or terminating only) or for two-way directionality. It is the Customer'sresponsibility to order a sufficient number of trunks of each type in order to meet itsdesired grade of serviee objective. At the Customer's reques~ the Company will assist theCustomer in sizing Switched Access Trunk groups.

14.2.3 Rate Categories

The following rate categories apply to Switched Access Service:

Direct Connect: As. a CuslOIncr selected option. flne Company winprovide Direct connects, between the Customer's Premises and theCompany's Local Switching Center switch(es). This transmission path isdedicated to the use of a single Customer. DS3 facilities are available forDirect Connect Serviee. A DS3 facility is capable of transmittingelectrical signals at a nominal 44.736 Mbps, with the capability tochannelize up to 672 voice-frequency transmission paths. For DSfacilities, if the Company is required to install additional fiber opticequipment for the benefit of the Customer, then the Customer has theoption to choose either an optical or electrical interface. This Directconnect rate category is comprised of a monthly Entrance Facilitiescharge and a per minute of use End Office switching charge as specifiedin 15.1.3.4. Cuslomcrs who select the Direcl Conneci option will nol bebilled S\vilchcd Transport. Switcheu Termination. Tandem TransP0l1 orTandem Tenninution.

Tandem Connect: Tandem Connect consists of circuits from the point ofinterconnection with Customer's tandem provider to the Company'sLocal Switching Center. 14.2.4 Design Layout Report:

At the request of the Customer, the Company will provide to lhe Customer the makeup ofth., facilities and services provided from the Customer's Premises to the first point ofswitching. This information will be provided in the form ofa Design Layout Report. TheD"sign Layout Report will be provided to the Customer at no charge.

14.2.5 Acceptance Testing:

AI no additional charge, the Company will, at the Customer's request, cooperatively test,al the time of installation, the following parameters: loss, C-notched noise, C-messagenc.ise, 3-t005 slope, d.c. continuity and operational signaling.

14.2.6 Ordering Options and Conditions:

Switched Access Servic" is ordered under the Access Order provisions set forth inS"ction 12. Also included in that section are other charges which may be associated withordering Switched Access Service.

14.3 Obligations of Company

In addition to the obligations of the Company set forth in other sections of this tariff. TheCompany has certain other obligations concerning the provision of Switched Access Service.These obligations are as foHows:

14.3.1 Network Management

The Company will administer its Network to ensure the provision of acceptable servicelevels to all telecommunications users of the Company's Network Services.

Selvice levels are considered acceptable only when both End Users and Customers areable to establish connections with little or no delay encountered within the CompanyNetwork. Company reserves the right to apply protective controls, (i.e., those actions,such as call gapping, which selectively cancel the completion of tramc), over any trafficcanied over its Network, including that associated with a Customer's Switched AccessService. Generally, such protective measures would only be taken as a result ofoccurrences such as failure or overload of Company or Customer facilities, naturaldisasters, mass calling or national securi ty demands. Customer will notify Company ofanticipated peaked services as stated below. Based on the information provided Companywill work cooperatively with Customer to determine the appropriate level of control. Inthe event that the protective controls applied by Company result in the complete loss ofservice by Customer, Customer wiH be granted a credit allowance for service interruptionas set forth in Section 9.

SECTION 15 - R<\TES AND CHARGES

15.1 Rates for Switched Access Services

There are three types of rates and charges that apply to Switched Access Service. These are

Monthly Recurring Charges, usage rates and Non-Recurring Charges.

Monthly Recurring Charges: Monthly Recurring Charges are flat rates for facilities that applyeach month or fraction thereof that a specific rate element is provided.

Usage Rates: Usage rates are rates that are applied on a per access minute or per query basis.Usage rates are accumulated over a monthly period.

Non-Recurring Charges: Non-Recurring charges are one time charges that apply for a specificwork activity (i.e., installation of new service or change to an existing service).

(a) Installation of Service: Non-Recurring charges apply to each Switched Access Serviceinstalled. The charge is applied per line or trunk.

Direct Connect:

The Direct Connect rate is ossessed based on the tolal of the monthlyEntrance Facilities charge and per minute of usc End-Office switchingcharge. The monthly Entrance Facilities charge consists of a fixed ratebased on the type of the facilities, i.e., DS3, and may include a per milerate. Entrance Facilities charges are contained in Section J2 ofCompany's Missouri P.S.C. Tariff No. 2. The Switched Transport usagerclte does not apply in the Direct Connect appliculioD.

Tandem Connect:

The Tandem Connect rate is assessed based on the montbly usagecharges for End-Office switching, Carrier Common Line, and SwitchedTransport usage.
