Sub: Request for issuing order for granting Grade Pay of Rs.4600/-
to the AssistanUHead Clerk of AIR Doordarshan in the light
of PB,CAT, New Delhi Decision dated 5.12.2014 in OA2206 2013
Sir,
You are kindly aware that Head Clerks/ Assistants working in AIR
and DOORDARSHAN are the first level supervisors and drawing
equal pay with Assistants of CSS Cadre with effect from 1.1.1996.
The Accountants /Assistants / Head Clerks
of
AIR DD have
been granted pay scale
of
Pre-revised 1640-2900) Rs.5500-
90001-
with effect from 1.1.1996 in accordance with the
recommendation on point No.46.10
to 6 Cmay
confirm the
points of the repor t pl . pr ior to ci rculate/i ssue) of V CPC at par
with the CSS cadre.
As per AIR manual Vol. I, Part I
II (page No. 173), the duties of
these post
as
under:
Accountant
a) The Accountant is responsible for the correct maintenance of
all accounts, e.g. Cash Book, Contingent registered etc. and for the
correct preparation and filling of all vouchers.
He funct ions as a
Financial Adviser and also as a primary auditor. He is also
responsible for the cor rect maintenance of various expenditure
registers and preparation of expenditure statement, Budget
Rev ised Estimates etc. To enable him to perform these functions
effectively he should be appraised of al/ others, sanctions etc. and
that he is treated as the Senior member of the office
est blishment
He should keep a watch on the control of
expenditure and advise Sr. Admn. Officer or Admn. Officer/ Head of
Office in respect of all important proposals.
b) He should see that all orders, sanctions etc. affecting
expenditure are entered in sanction Register and payments noted
against relevant sanctions as and when they are made.
c) The Accountant is also responsible for prompt and correct
preparation of commercial Performa accounts and main tenance of
connected records and registers.

d) Reconciliation of cheques issued and encashed and
reconciliation of expenditure/ receipts is also the responsibility of the
Accounts.
e) The Accountant should not be required to receive or payout
cash but, in exceptional cases, a Station Director may, on his own
responsibility, authorize him to do so for a short period. The
Accountant should not be authorized to issue final receipts over his
own signature.
HeadClerk
He is the first Supervisory member of the staff who functions
as
Sectional head in the Sections dealing with personnel and
general administration.
His functions are to assist the Head of the
Office/SAO/AO or any other officer entrusted with the duties of a
Branch Officer.
He will be responsible for all administrative
matters othen than Accounts such as service books and leave
account of non-gazetted Government Servants. Staff Artists,
maintenance of Statistical Registers and books. Inventories etc.
Where there are two Head Clerks the distribution of work between
them will be on the basis of Sections divided into two separate
sections dealing with personnel and General Administration
separately.
( Note: On occasions when the Accountant or Head Clerk is away on leave or one
of the posts is unfilled, all the duties attached to both the posts should be
performed by the Accountant or Head Clerk as the case may be.)
It may not be irrelevant to mention that while extending the pay
scale of Rs.5500-9000/-, to Head C/erks/ Accountants/ Sr. Store
keepers, the. MIS has clarified that the designation of Head
Clerk/Accountants/Sr. Store keeper will be known
as
Assistants
/Head Clerks on that ground that the duties of erstwhile
HCs/ACTTs/SSKs are Presently designated
as
Assistants/Head
Clerk of AIR/DD are Supervisory in nature and eligible for grant
of
pay scale
of
Pre-revised
1640-2900
Rs.5500-9000/-. The MIS Ir

The Prasar Bharti has also appointed Assistant on deputation
from the UDCs of AIR and DD. They are neither supervisory nor
CSS cadre even though in the Gr~de Pay 4600 infact, the
Assistant/Head Clerk of AIR DD are better qualified and have
more onerous duties
to
perform that 1heAssistant appointed on
deputation by Prasar Bharti.
it is undisputed that Assistant/Head Clerk of AIR
DD were drawing
the pay scale of Rs.5500-
90001
on par with Assistants of CSS
Cadre with effect from 1.1.1996 and are holding the posts of
Supervisory nature. This parity is maintained without any interruption
till 31.12.2005. In the eye of Law, it is a clear-cut injustice that pay
parity once allowed a cadre at par with other cadre based on type of
job responsibility in accordance with the Government Instruction as
well as Eye of Law, that can't be di~continued by any Department in
his own perception. I

But surprisingly, it has been observed that at the time of
implementing the 6th CPC recommendations, the allowed parity as
per Law, was disturbed. Though, the Government of India had
upgraded the Pay Scale(pre-revised) of Assistants/Head Clerks in
field offices as per 6th CPC's recommendation to maintain parity with
CSS cadre, so, the same has not been extended to Assistants/Head
Clerks working in AIR DD, is beyond justice. Here, it is unjustified to
ignore that the Assistants/Head Clerks working in AIR
have
been fulfilled all the criteria/conditions for granting the Grade pay of
Rs.4600 as per the recommendations of 6th CPC. Since the
recommendations of 6th CPC are applicable to all central
Government employees without any reservation, as such, the same
may be extended to Head Clerk /Accountant Assistant working in AIR
DO.
It is also relevant to mention that the Hon'ble Central
.
Administrative Tribunal in several judgments have directed the
departments to extend the benefit of grade pay of Rs.4600/- to
Assistants working in various Departments (field offices) at par with
the Assistants of CSS in accordance with the 6th CPC
recommendation. For ready reference, enclosed the copy of the
judgment of Hon'ble CAT Principal Bench vide OA No.2206/2013
dt.5.12.2014 where directed the Respondents to grant Grade Pay of
Rs.4600/- to Accountants working in Oept. of legal Affairs, Ministry of
Law even taken into account that their Accountants are not treated
as CSS Cadre and copy of the implementation/fixation order of
Ministry of Law
Justice vide No.A-24011/39/2009-Admn.CAS-78
dated 8
th
September, 2015.
The following merits are placing before you for concluding the
decision to grant the Grade Pay of Rs.4600/- to the Accountant
Assistant Head Clerk of AIR
1. There is historical parity in the pay scales of
Accountant/Assistant/Head Clerk and that of CSS Cadre.
2. The Assistant Head Clerk of AIR DO are first level
supervisors.
3. The Head Clerk /Assistants of AIR DO have fulfilled all the
criteria/conditions to grant Grade Pay of Rs.4600/- w.e.f. 01/01/2006.
4. The Assistant/Head Clerk of AIR DO are on the same
footing with that be granted Assistants of CSS Cadre, Assistants and
Accountants of other field Offices who are drawing the Grade pay of
Rs.4600/.
It will not be out of place to mention here that Ministry of Law
Justice, Department of Legal Affairs, vide its DO No.29(9)/2014-
Judl dated 7.8.2014(Copy Enclosed) had requested all Ministries and
Departments by try to reduce Government litigation in courts so that
valuable court time is spent in resolving other pending cases.

In view of the above, it is earnestly requested to grant Grade
Pay of Rs.4600/- to Assistant/Head (Old designation Accountant)
Clerk working in All India Radio/Doordarshan which is also in line
with accepted recommendations of 6th Central Pay Commission.
