We have a jam-packed July! In this issue, Living in America, we have, in the

interest of our commitment to education, included the Declaration of

Independence (Page 5) and The Bill of Rights (Page 3). Though many adults and

kids may have been exposed to these documents, I wonder how many adults have

read it since childhood.

We have some great contributors this month. Ken Roberts, CEO of Fat Trail

Trading provides a Second Quarter Earnings Preview (Page 12); Dave Costa, Flying

for Liberty, wrote Independent or Dependent? (Page 7) In these trying times, a

very good question. And don’t miss Sean Savoy’s take on Religion in America (Page

6). You might be surprised at his perspective. Eddie Floyd shares why he is happy

to be in America (Page 12).

Charles Palmore is retiring after a very successful music career (Page 10). We wish

him well! Sparks Museum has a great exhibit (Page 15) and we love Jennifer

Brewster’s reviews (Page 15) whether books, music or movies.

The New Constitution: Requiring a Quorum

T he Federal Convention convened in the State House (Independence Hall) in Philadelphia on May 14, 1787, to revise the Articles of Confederation. Because the delegations from only two states were at first present, the members adjourned from day to day until a quorum of

seven states was obtained on May 25. Through discussion and debate it became clear by mid-June that, rather than amend the existing Articles, the Convention would draft an entirely new frame of government. All through the summer, in closed sessions, the delegates debated, and redrafted the articles of the new Constitution. Among the chief points at issue were how much power to allow the central government, how many representatives in Congress to allow each state, and how these representatives should be elected--directly by the people or by the state legislators. The work of many minds, the Constitution stands as a model of cooperative statesmanship and the art of compromise.

D uring the debates on the adoption of the Constitution, its opponents repeatedly charged that the Constitution as drafted would open the way to tyranny by the central government. Fresh in their minds was the memory of the British violation of civil rights before and during the

Revolution. They demanded a "bill of rights" that would spell out the immunities of individual citizens. Several state conventions in their formal ratification of the Constitution asked for such amendments; others ratified the Constitution with the understanding that the amendments would be offered. On September 25, 1789, the First Congress of the United States therefore proposed to the state legislatures 12 amendments to the Constitution that met arguments most frequently advanced against it. The first two proposed amendments, which concerned the number of constituents for each Representative and the compensation of Congressmen, were not ratified. Articles 3 to 12, however, ratified by three-fourths of the state legislatures, constitute the first 10 amendments of the Constitution, known as the Bill of Rights. http://www.archives.gov/exhibits/charters/bill_of_rights.html

The Bill of Rights: A Transcription

T he Preamble to The Bill of Rights Congress of the United States begun and held at the City of New-York, on Wednesday the fourth of March, one thousand seven hundred and

eighty nine. THE Conventions of a number of the States, having at the time of their adopting the Constitution, expressed a desire, in order to prevent misconstruction or abuse of its powers, that further declaratory and restrictive clauses should be added: And as extending the ground of public confidence in the Government, will best ensure the beneficent ends of its institution. RESOLVED by the Senate and House of Representatives of the United States of America, in Congress assembled, two thirds of both Houses concurring, that the following Articles be proposed to the Legislatures of the several States, as amendments to the Constitution of the United States, all, or any of which Articles, when ratified by three fourths of the said Legislatures, to be valid to all intents and purposes, as part of the said Constitution; viz. ARTICLES in addition to, and Amendment of the Constitution of the United States of America, proposed by Congress, and ratified by the Legislatures of the several States, pursuant to the fifth Article of the original Constitution. Note: The following text is a transcription of the first ten amendments to the Constitution in their original form. These amendments were ratified December 15, 1791, and form what is known as the "Bill of Rights."

I N CONGRESS, July 4, 1776. The unanimous Declaration of the thirteen united States of America, When in the Course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume among the

powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.--That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, --That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed.

But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.--Such has been the patient sufferance of these Colonies; and such is now the necessity which constrains them to alter their former Systems of Government. The history of the present King of Great Britain is a history of repeated injuries and usurpations, all having in direct object the establishment of an absolute Tyranny over these States. To prove this, let Facts be submitted to a candid world. He has refused his Assent to Laws, the most wholesome and necessary for the public good.

He has forbidden his Governors to pass Laws of immediate and pressing importance, unless suspended in their operation till his Assent should be obtained; and when so suspended, he has utterly neglected to attend to them.

He has refused to pass other Laws for the accommodation of large districts of people, unless those people would relinquish the right of

Representation in the Legislature, a right inestimable to them and formidable to tyrants only.

He has called together legislative bodies at places unusual, uncomfortable, and distant from the depository of their public Records, for the sole purpose of fatiguing them into compliance with his measures.

He has dissolved Representative Houses repeatedly, for opposing with manly firmness his invasions on the rights of the people.

He has refused for a long time, after such dissolutions, to cause others to be elected; whereby the Legislative powers, incapable of Annihilation, have returned to the People at large for their exercise; the State remaining in the mean time exposed to all the dangers of invasion from without, and convulsions within.

He has endeavoured to prevent the population of these States; for that purpose obstructing the Laws for Naturalization of Foreigners; refusing to pass others to encourage their migrations hither, and raising the conditions of new Appropriations of Lands.

He has obstructed the Administration of Justice, by refusing his Assent to Laws for establishing Judiciary powers. He has made Judges dependent on his Will alone, for the tenure of their offices, and the amount and payment of their salaries.

He has erected a multitude of New Offices, and sent hither swarms of Officers to harrass our people, and eat out their substance.

He has kept among us, in times of peace, Standing Armies without the Consent of our legislatures.

He has affected to render the Military independent of and superior to the Civil power.

He has combined with others to subject us to a jurisdiction foreign to our constitution, and unacknowledged by our laws; giving his Assent to their Acts of pretended Legislation:

For Quartering large bodies of armed troops among us: For protecting them, by a mock Trial, from punishment for any Murders which they should commit on the Inhabitants of these States: For cutting off our Trade with all parts of the world: For imposing Taxes on us without our Consent: For depriving us in many cases, of the benefits of Trial by Jury: For transporting us beyond Seas

A merica is a nation established by people of deep religious conviction. It is like a patchwork quilt woven with threads of faith rooted in our multi-cultural immigrant heritage and

the beliefs that sprung up organically from within our borders — making us the most

religiously diverse country in the world. In Colonial times, religious groups like the Puritans and Quakers came to build religious settlements free from the persecutions they had experienced in Britain. Many of the colonies were established by settlers who wished to practice a particular faith within a community of like-minded people: Virginia by the Anglicans, Massachusetts by English Puritans, Maryland by English Catholics and Pennsylvania by the Quakers. By the time of the Revolution, the philosophies of the European Enlightenment were greatly influencing the formation of America as an independent nation, one forged on the principles of freedom of thought and the emancipation of human consciousness. The founders, including Washington, Franklin and Jefferson, were deists, who applied reason to religion, thereby questioning Christian dogma and the hold of theology over faith. They rejected miracle, prophecy, and revelation in favor of a more natural religion. It is a great misconception that America was founded solely on Judaeo-Christian principles. In fact, God is not once mentioned in the U.S. Constitution and only in the Declaration of Independence in deistic terms. Thus the Founders were free thinkers. As such, they were compelled to include the freedom of religion clauses in the First Amendment, guaranteeing the free exercise of

religion while at the same time preventing the government from establishing a state religion. As a reaction against rational Christianity, deism and skepticism, the Protestant revival movement of the late 18th century and early 19th century enrolled millions of new members in evangelical denominations such as the Baptists, Methodists and Presbyterians. The Afro-Christian churches have their roots in this movement as well. Side by side with evangelicalism came new waves of immigrants and a flourishing of religion, with many new movements becoming denominations in their own right. Religion was constantly reinvigorated over the decades with the ongoing influx of settlers, which included large scale Jewish immigrations. By the late 19th and early 20th centuries, a restorationist movement of Protestantism sought to restore Christianity to its New Testament roots, thus establishing a single church with members known simply as Christian. At this time we saw the emergence of distinct, purely American religious groups such as the Jehovah’s Witness Movement, the Church of Jesus of Christ of Latter-day Saints (Mormons), and the Church of Christ, Scientist under Mary Baker Eddy. With the introduction of the various Christian and non-Christian traditions by immigrants, the revival of Protestant Christianity, and the founding of new religious movements such as Pentecostalism, Adventism, Unitarian-Universalist, and the Episcopal Church as an offshoot of the Church of England, America avoided the trend of secularization that has become popular in Europe, making us the most religious of all nations in the world, such that many religiously based moral issues continue to occupy a major role in American politics. In the first half of the 20th century, mainstream Christianity continued to be challenged, primarily in the 1920s by the literary elite. By the end of World War II, however, Americans were streaming back to church in record numbers. But this trend could not stave off the rumblings of a new type of revolution: the liberation movements of the 1960s. Along with the Vietnam War, the Civil Rights movement, Women’s Liberation and the “Sexual Revolution,” many new alternative religions

I ndependence Day, the start of America’s great experiment, “Can man rule himself?”

Our Declaration Of Independence reminds us that We, the people, have the responsibility to alter or abolish a

government that removes liberty. We must remain independent of the need for government control, or we become controlled and dependent on the same. Our rights are given to us by our Creator, and no man may give or take away our rights. The idea of independence, is the liberty to be free from the control of another. Liberty is to live one’s life as we choose, so long as no harm is imposed on another. Are we independently ruling our own lives, or have we become dependent upon our Government to “protect us from ourselves”? It is easy to point a finger at “those people”, but we must look at ourselves first. How dependent have you become on the Government and what are you going to do to change that? Are we still a nation of independence or are we being led like sheep to dependence? Consider the following points: More than 91 million Americans are dependent upon Government, not including those employed by the Government. One in five Americans are dependent upon Government to live their lives. Welfare and low income assistance is surging out of control. There was a 39% increase from 2008-2010 alone. Medicare and Medicaid costs are exponentially expanding, with an 86% increase between 1999 and 2010. Today, more than 70% of Federal spending goes to dependence programs. We expect a safety net from the government for food, retirement, healthcare and more. Independent adults should not have hands out and expect to be taken care of as children. We expect the government to make decisions for us regarding the food that we eat. Do we really require a government official to tell us what food is safe to eat? Have we become dependent upon their decision, or are we able to make an independent decision for ourselves? Our Constitution is genius. This document specifically limits the size and scope of government. In the words of Thomas Jefferson, “A bill of rights [will] guard against the legislative as well as the executive branches of government.” Read today’s news and you will see evidence of our Bill of Rights coming under attack from our own Government. You may blame “them”, but unless you stand

and practices became popular, from yoga to transcendental meditation to the Eastern Dharmic religions of Hinduism and Buddhism. This was a turning point for religion in America. Religion itself was not so much being rejected as the establishment was being challenged. The Protestant-Catholic-Jewish triumvirate no longer represented the scope of religious options in America. The fabric of American religion was growing even more diverse and complex with a burgeoning baby boomer generation leading the way as a group of New Age spiritual seekers. According to Joanne Beckman: “For seekers, spirituality is a means of individual expression, self-discovery, inner healing, and personal growth. Religion is valued according to one's subjective experience. Thus seekers feel free to incorporate elements of different traditions according to their own liking. They shop around, compare, and select religious ‘truths’ and experiences with what one historian calls their ‘à

la carte’ spirituality.” As the baby boomer generation — nearly one third of the population — has matured, many have sought a return to their roots in traditional Christian denominations. Conservative Christianity, in particular, has seen a prominent revitalization. On the other hand, there has been growth in atheism,

agnosticism and humanism. Yet new spiritual thought continues to be sustained in America with more and more of the population calling themselves “spiritual” but affiliating with no particular religion. What will be the future of religion in America as the post-baby boomer generations mature into the 21st century? Based on our history, the possibilities are many. One thing is certain: as long as America is free, religion will continue to profoundly influence American life. It is my opinion that advancements in science, technology, communications, and energy will lead the way for a new type of religion — an applicable, provable living theology in which people, regardless of faith, will be able to find God in the substance of matter and in the pre-existent electro-magnetic energy fields that envelope it. It seems that one must simply look to the sun and the stars to, as our Founding Fathers might say, find reason in our faith. M att Bayan, comedian, author and Co-President of High Sierra Writers gave this advice in his latest book, The Firecracker King. Bayan, with the dubious distinction of being revived 72 times from a massive heart attack, made the best of his bad situation. In his first book, Eat Fat, Be Health originally

published by Simon & Schuster, he sought answers to his heart problem. After substantial research and consultation with medical professionals, Bayan

is proof that using his methods saved his life and could save yours too. Bayan is also the Co-President of High Sierra Writers a group that is a combination of the former Unnamed Writers Group and Writers of the Purple Sage. Now one group, they offer membership which includes the opportunity for writers to obtain critiques from their peers and attend workshops to help writers “hone their craft and work toward success in publishing”. Bayan appeared on The Book Hound Show, an America Matters Media presentation on 101.3 FM, Renegade Radio on Wednesday, May 1, 2013. Matt, in his comedian’s style, gave some insight to the creation of Firecracker King when he shared that 2/3 of the book is autobiographical. “Did you really find a dead body?” asked co-host Dennis DuPerault. “I’m from Jersey,” Bayan responded. I guess he’s not telling. From the back of the book The Firecracker King: "Have you ever found a dead body? If you do, it's a good idea to run. Gage’s New Friend: A Boy’s Wish for a Diabetic Alert Dog By Gage Bunsness with Kimberly Bunsness

G age, a ten year old boy, was diagnosed with Type I diabetes. In the story, Gage shares his desire to have a new dog. But not just any dog, a dog that will help alert him and his parents when his blood sugar is too low or too high.

Gage’s New Friend, written by Gage on a manual typewriter he received from his parents, is co-authored by Gage and his mom, Kimberly. Kimberly shares her perspective of living with

diabetes and taking care of Gage. She also included healthy dog biscuit recipes as a bonus! As a recipient of some of the dog biscuits, I can tell you, my dog loved them. The story is both fact and fiction: Gage does have Type I diabetes, but he does not have his Diabetic Alert Dog (D.A.D. )...yet. Gage & Kimberly use the funds earned from their book toward his new D.A.D. so Gage’s story in the book can come true. My six year old granddaughter saw the book on my dining room table and picked it up to read it.

Second Quarter Earnings Preview By Ken Roberts

T he stock market is a forward looking mechanism. That means that the current market price is always looking forward several months and basically predicting how the economy will be. There are many economic reports that are released on a regular basis that market participants

follow very closely. In order of importance they are, GDP, M2 Money Supply, CPI, PPI, Consumer Confidence Survey, Current Employment Statistics, Retail Sales and Food Services Sales, Housing Starts, Manufacturing and Trade Inventories and Sales, S&P 500 Stock Index The number one drive of stock market performance is corporate earnings. Corporate earnings are dependent on the health of the economy to some extent, but there can be periods where the economy is sluggish, but corporate profits remain strong. Earnings reports are released on a quarterly basis and can have a big impact on stock prices. One of the mostly widely used tools that stock analysts use is known as the PE or price to earnings ratio. The PE ratio is simply the price of the stock divided by the companies’ earnings per share. The PE ratio can also be calculated for the market as a whole. For the S&P 500 that is done by getting the PE for all 500 stocks that make up the index. Currently the PE ratio of the market is about 17.60 which means that is takes $17.60 to buy $1.00 of earnings. Historically this is not a very high level. Earnings season traditionally kicks off with a report from Alcoa on July 8th. Even though Alcoa is considered to start the earnings season, by the time Alcoa reports, several other S&P 500 companies will have already reported. Currently the bar is set pretty low for earnings, many companies have made earnings pre-announcements and the pre-announcements have been mostly negative with a ratio of about 6.5 to 1. The overall forecast is for earnings growth of about 3% and that number has come down from 7% on April 1st of this year. The sectors with the strongest earnings growth are projected to be financial stocks and the homebuilders. Financials are projected to show a 16% increase and the homebuilders are forecast to be up by 12%. Sectors that are forecast to decline

When she was done, she looked at my daughter and said, “Those are good illustrations!” My daughter said she had a little trouble with some of the words but seemed to like the story too. It is a great book for kids to learn from another child and parents to learn more about Type I diabetes which is very different from Type 2. Oh, and don’t forget, there are great dog biscuit recipes too.

T hey say you judge a man's character after he has gained everything, yet you judge a woman's character after her man has lost everything. No truer words were ever spoken. I feel as if I am the luckiest man in the world because of the woman I married, as well as the Nation in which we live. Where else in the World, besides America, can a person be knocked down economically as well as socially

and yet be given the opportunity to rise up again. These freedoms are afforded us as Americans because of the willingness of past generations to put everything on the line, in front of personal security and well-being, to fight, and in

some cases, die for these freedoms now afforded us. I once owned a successful real estate company, manufactured home dealership, insurance and mortgage company here, in the State of Nevada, as well as lived on and owned a 650 plus acre horse and cattle ranch North of Reno. All of this was lost when I made decisions in the best interest of my family. But that decision also caused me to lose everything I had acquired and worked for during a period of almost 4 decades of business. I realize just how fortunate I have been to live in this Nation. We live in America, and I thank GOD for all failures and successes as I enjoy what is truly success, which is LIFE with family and friends.

Living in America to be tried for pretended offences

on your own, “you” have become a part of the problem. Patriots remain vigilant in the protection of liberty. The NDAA, Gun Control, Affordable Care Act, IRS, Federal Reserve, Patriot Act, SOPA and even the United Nations stand in direct opposition to independence and limit protections under the Bill of Rights. We depend on the Government to keep us safe, while at the same time we stand to lose our very right to defend ourselves independently. “The right to keep and bear arms, shall NOT be infringed”. An independent person understands that they are the first responder in their own defense. Welfare as we know it began in the 1930’s and solidified in the 1960’s. American survived for over 139 years without welfare. Medicare did not begin until 1965. America survived for 174 years without Medicare. For over 210 years Americans lived in relative safety compared to the rest of the world, without the need for a Department of Homeland Security. Americans enjoyed some of the best education in the world for more than 188 years before the Department of Education was started in 1979. Now in 2013 we face Common Core where most local and parental control of education is being moved to the Federal government, just 34 years later. Perhaps George Washington said it best. “What a triumph for our enemies.....to find that we are incapable of governing ourselves.” Make no mistake, man has always sought to control other men, as monarchs, tyrants and rulers. I prefer a more positive assertion. America, the great experiment, works. The proof is a part of American history. It is up to us, to remind each other that we are independent. Life, liberty, and property are the promise of liberty. Government or those who believe they know better than you, are not the answer. This responsibility is ours and ours alone. We are dependent upon our Creator, not on a human being. Take the opportunity reflect on our great gift of independence. while you celebrate this July 4th!

This review will be probably the most challenging I’ve had yet]reason being? I haven’t exactly seen the movie. I am a busy mom of 4, so my free-time-o-meter ranges somewhere between little and none on any given day. However, like anyone with children will know, when you run out of time, you get resourceful. This will be the first review done by proxy, for DeMarcus Brewster, age 5, Treyvonne Brewster, age 4, and Kaitlyn Chacon, age 11. DeMarcus: What was your favorite part of the movie? “My favorite part was the whole thing” Treyvonne: What was your favorite part of the movie? ”My favorite part was when the Iron Man heads were attacking the bad guys” “Also, at the end, the girl and the Iron Man guy get married” Kaitlyn,: This is actually just Pepper and Tony kissing somewhere toward the end of the movie] Hopefully this isn’t a spoiler for anyone who has been watching movies for any length of time. Plus, it’s a Marvel comic, how can the hero not come out on top?! DeMarcus also agreed later that the part where the “Iron Man heads were attacking the bad guys” was pretty cool. Overall, I think this movie will be great for kids and teenagers, or anyone who has enjoyed the Marvel comic movies so far. As a parent, it appears that this movie was full of action packed scenes that kept younger viewers attention – in a theater, no less. There only appeared to be one death scene that may have been a little much for some viewers, but as a parent, I think that this movie was fun, exciting, and full of adventure! Rated: PG-13
