From a recruitment point of view, predictions of a continuing skills-shortage across the legal services sector continue to characterise the Australian market. The growing number of overseas firms, combined with range of opportunities around the world for Australian lawyers in other key markets, means domestic firms are facing a shortage of quality candidates in a tight labour market. The result has been a surge in demand at all levels, even those with low levels of seniority.

The corporate sector in Australia remains extremely active and highly competitive across all industries. The war for legal talent has meant that corporate counsel opportunities are arising at around the 2-6 year experience mark, marking a rare opportunity for those seeking to move in-house earlier in their profes-sional careers. In addition to competitive pay schemes and non-financial benefits such as technological tools and career development and study opportunities, organisations are also more open to recruiting part-time employees, and offering job-sharing arrangements or work from home incentives to meet lawyers’ demands for more work/life balance.

The talent shortage in the legal industry is affect-ing recruitment of internal counsel as a whole, however skills and areas of expertise presently most in demand in relation to in-house roles are corporate/commercial, industry, IT/IP and financial services. Recruitment agen-cies have also noticed an increase in the number of positions opening up for senior lawyers and head of legal/general counsel opportunities in the market.

Private practice opportunities continue to be strong, the recurring theme being plenty of jobs. Skills and experience most in demand in the private practice arena include: corporate and finance, M&A, construction and infrastructure, energy and resources, taxation, private equity, property and trade practices, with more recent demand in litigation based areas including employment insolvency and insurance work (professional indemnity). In addition to excellent academics, strong drafting, analytical and communi-cation skills are essential for those seeking positions with top-tier firms.

Similar to their corporate counterparts, firms are also realising the benefits of offering flexible work arrangements to accommodate the needs of their lawyers. Moreover, in recognition of the large numbers of Australia lawyers lost to overseas positions, firms are concentrating on secondments and interstate/overseas work/travel programs and subsidised study to bolster job satisfaction and ensure a steady trickle of qualified personnel back into the home market.

Recruiters report that private practice and in-house clients are taking a different approach to recruitment in the face of rising salaries. Both are looking at each recruitment space very seriously prior to committing to a candidate, or even to the recruitment process itself where the role in question can be filled internally, by rotating counsel between practice areas for example. Regardless of the employee driven market, certain roles will demand exceptional candidates and nothing less.

Opportunities continue to grow in mainland China for quality legal talent, and thanks to the continuing development of the Chinese economy, there is little anticipation of a major downturn. While IPO activity has slowed in the region, it is expected that the demand for counsel will merely shift to other corporate practice areas. The rush to develop and open offices in the pre-ceding year is likewise expected to continue.

Compared to same period last year, however, recruit-ers are noticing a slight decline in in-house opportunities. The focus has shifted from financial positions to more general corporate counsel roles as companies seek to maximise human resource investments. In addition, with private practice seeing a similar moderate drop in recruitment opportunities, the market has become tighter for those seeking corporate roles.

But for those with the right skill set, namely, fluency in Mandarin, opportunities are still in abundance. Local lawyers with a foreign and native law degrees and sub-stantial experience gained abroad for example, continue to be rare and are highly sought after. The Chinese economy has largely succeeded in decoupling itself from

the economic downturn facing major western countries, and therefore many corporations are capitalising on the nation’s economy to expand their share in these emerg-ing markets.

Some larger firms have reported that they are fully staffed as a result of the booming market of the past 3 years, and thus pickier in their recruitment process. With the collapse of the credit markets due to sub-prime issues, there has been a general global downward trend in capital markets, and activity levels have dropped in this practice area. This is likely to impact the recruitment of junior lawyers as opposed to mid and senior staff.

As with in-house counsel, private practitioners are finding that Mandarin is now an essential requirement as opposed to a desirable skill set. Counsel with China practice experience, fund and corporate lawyers, com-pliance counsel and those with experience dealing with Chinese regulators will be particularly sought after. Private equity, venture capital, banking, finance, securi-ties, capital markets, IP and real estate make up the class of candidates most in demand.

Expectations are rising sharply in the legal market in Hong Kong, with recent reports indicating that 73 percent of firms plan to increase hiring to meet with growing demand in China. The city is considered the most popular Asian destination for lawyers, as less emphasis is placed on Chinese language skills in transactional practice areas such as finance, litigation, corporate and commercial law. Language skills are increasingly considered an asset that might set a can-didate apart, but are less stringently required as on the Chinese mainland.

Recruitment agencies remain cautious on the in-house front however, predicting the pace of hiring to remain relatively stable. The modest appraisal of the legal market stems from a likely decrease in internal investment banking positions with US entities, but increases in regulatory, hedge fund and private equity roles in China-based companies. The focus in demand as a whole has shifted from financial positions to more general corporate counsel roles.

Those seeking financial positions will find that the regional financial service players however, remain in growth mode. A significant amount of hiring is still going on within the private and commercial non-US based banking institutes, within investment manage-ment and the insurance sector. Vacancies remain for

lawyers with legal skills in credit and equity derivatives, syndicated lending, private equity, M&A, private wealth management, insurance and funds and compliance. Opportunities have also arisen within the commercial property, telecommunications, retail, IT/IP, logistics and utilities sectors.

In the private practice market, the pace of active recruitment in the city remains brisk. While some recruiters have noticed that firms appear to be pursuing recruitment with an air of caution, as opposed to the aggressive expansion in the previous year, the candidate short market acts as an effective buffer.

As on the mainland, IPO work has slowed in Hong Kong and demand has shifted to other areas of the cor-porate arena. Demand for skills and expertise in funds and corporate practice areas, M&As (especially in rela-tion to PRC market), private equity, hedge funds, asset management, and regulatory matters are all up. Some recruiters have noted their clients are mainly interested in corporate lawyer candidates with Cantonese or Mandarin speaking skills.

Counsel seeking positions in Hong Kong should also note that one side-effect of the US credit crunch is that Asia as a whole has become an attractive jurisdiction for lawyers. Recruiters have thus predicted an increase in the quantity of good candidates.

Despite amendments to the Foreign Lawyers Law in 2005, the Japanese legal market remains riddled with cumbersome and discriminatory requirements in the regime governing foreign firms. Firms have rallied of late to press the Ministry of Justice and Federation of Bar Associations to remove impediments, such as the lengthy and demanding registration process for foreign lawyers and the confusing requirement that foreign firms operate under the name of the resident managing partner, which disproportionately effect foreign practitioners.

Ironically, a major reason for the rally for reforms has been the increasing number of foreign firms which entered the market in the previous year. Several top-tier firms have made inroads in the local market in their quest for growth and representation in the region. These firms are not pursuing ‘growth for growth’s sake’, but are looking to strengthen specific areas within the firm in response to the current conditions facing the global economy.

Recruiters report that the skills most in demand are those with strong experience in M&A as well as real estate, while capital markets practice has declined. Some firms, they report, however, have remained determined to establish themselves as capital markets players despite the decline in overall activity. Unlike the North American market however, and previous downturns in the Japanese market, the economic slow-down has not yet been accompanied by upturns in litigation, bankruptcy or reorganisation work related to the downturn itself.

One important factor working in favour of global firms is the US dollar’s weakness against currencies such as the British pound, the euro and the Japanese yen. As most US-based international firms bill their clients in local currencies, and then exchange them to dollars when they report profit. The net effect is that the appreciation of overseas currencies is a boon once those fees are converted to greenbacks. The caveat for US attorneys or attorneys seeking to practice in US firms in Japan is obvious, while for the firms, it is great incentive to take the opportunity to build up their headcount growth in non-US markets.

In-house counsel opportunities are up in Japan as a whole. As expected however there is little opportunity in the investment banking world in the current economic climate. Not only does the nation face a serious shortage of qualified lawyers, but those in practice are hampered by their English language abilities, and all too often unable to provide the type of business-oriented advice typical of Anglo- Saxon lawyers.

Despite the increased demand for internal counsel, Japanese companies may be forced to restructure their management, products and operations as well as human resources, to stay competitive in the current economic uncertainty. In previous recessions, firms have sought to reduce the time needed to build a competitive and dedicated freshmen and to rotate more frequently within the firm or within corporate groups middle-aged and senior workers, who are capable of hitting the ground running on issues.

As with Hong Kong, the fall-out from the credit crunch has brought an increase in applicants to the Singapore legal market, not the least because language skills are not required in the island nation. Buffered from the effects of the US credit woes, the market remains consistent in Singapore for both in-house counsel and private practitioners.

Asia continues to be the focus of their business development for many corporations, and recruiters report plenty of junior to mid level in-house positions, but less senior roles this year. Apart from this distinc-tion, the market remains strong. Banks in particular are actively looking for candidates with experience in derivatives, private banking and asset management. While financial institutions in general prefer more senior applicants, exceptions are being made as the

market tightens. IT, telecommunications, and financial markets sectors are also seeing higher levels of activity than usual.

The general consensus amongst recruiters is that private practice opportunities remain at approximately the same level as last year. As international firms in Singapore can only practice off-shore law, firms are smaller than their Hong Kong counterparts, thus candi-dates with enough experience to hit the ground running are preferred. International law firms in Singapore typi-cally seeks junior to mid-level lawyers from 3 to 6 years PQE, with good academic backgrounds and strong transactional experience, preferably with magic circle or top-tier firms. Local law firms are also active in hiring foreign lawyers to join their banking and finance and corporate finance teams.

Linked to an uncertain economic forecast, they conjure the best of times for some practice areas and a darker outlook for others; as a result most professionals are taking a wait-and-see attitude on how the credit crunch will carry over into various practices.

With cost control being the name of the game for most firms and corporate entities, two key developments in the private practice realm have been the reconsidera-tion of high cost summer associate programmes and/or implementation of a two-tiered system, while both private firms and in-house counsel will find an increased use of outsourcing low-end legal work to offshore emerging legal markets may be necessary.

There are reports that some firms will go with smaller summer associate classes, while others con-template dropping them altogether in favour of lateral hires, a move that will bode well for counsel consider-ing relocation. Lateral hires are largely seen as having a running start on their trainee counterparts, as well as bringing new experience, energy and ideas to their practice groups.

Another cost saving option firms are beginning to embrace is the implementation of a two-tier associate system. Under this approach, partnership track associates put in high billable hours and are compensated com-mensurately, while non-partnership bound associates can opt for fewer hours at a lower level of payment. Firms

who have embraced this experiment in stratification have done so in recognition of the growing importance of work/life balance cited by job-seekers as influencing their decisions to accept offers.

In-house counsel and private practitioners will increasingly avail themselves of well-educated, English speaking overseas counsel in emerging markets such as Sri Lanka and India. Heeding predictions of a 5.4 percent rise in starting salaries in 2008, both groups see the benefits of taking advantage of cost effective out-sourcing to bring down costs.

Vacillations in the stock markets and the subprime crises have naturally led to speculation as to whether lay-offs will hit corporate finance and real estate groups, in particular in the area of financings, securitisations and leveraged buyouts. The general feeling is that while some positions will be lost in these areas, they will not amount to massive lay-offs. Indeed, the flip side of the coin in this regard is that bankruptcy, intellectual property, employment and litigation should heat up, while energy and health care practices will not be affected.

Recruitment in North America is now increas-ingly viewed as part of a firm’s comprehensive growth strategies, as firms look to what they need in the long term. And while impossible to predict hiring trends with certainty, the effects of the economy, cost savings initiatives and globalisation will all play an important role in shaping the legal recruitment market in the year to come.

By most accounts, Dubai and the Middle East are set to remain buoyant legal markets in 2008. The rapidly growing economies of the region have bolstered demand for good foreign lawyers working both in-house and in private practice. With its vast financial resources, some of the world’s biggest construction projects are ongoing in the region, and the need for highly-qualified and capable legal minds is paramount as a result.

In-house practitioners will find abundant oppor-tunity in the Middle East, with a recent surge being attributed to regional and multi-national offices estab-lishing new offices. The fact that companies do not have to set up costly partnerships with local companies or distributors as they do in most other places in the Middle East means that they are attracted to Dubai in particular as an access point to the region at large. In addition, more established companies are appreciating the need to introduce legal support functions to their current operations.

Companies are going to great lengths to find and recruit the right kind of individuals to meet their needs. An individual must not only be highly educated and well-trained, but also be capable of expanding outside their areas of familiarity into multiple practice areas encompassing banking, finance, Islamic finance, com-mercial contracts and more. In addition to having the chance to work in different areas of law, internal counsel will be attracted to the opportunities to work with dif-ferent areas around the globe on contracts.

As with demand for internal counsel, demand for international private practice lawyers across all major areas including commercial, banking and finance, energy, projects, oil and gas and construction/real estate remains high in Dubai and the Middle East. The steady growth for private practitioners is in part a result of the recent trend of major firms setting up second or third Middle East office in cities like Abu Dhabi and Doha.

Dubai and the Middle East have emerged largely unscathed from the economic slowdown associated with the credit crunch, thus firms will usually only consider hiring lawyers with more than 2 years experience who are currently working with top-tier firms in regions such as Australasia and UK. While exposure to and experience in Islamic finance and fluency in Arabic are not essential for employment, they are highly regarded. Islamic finance schemes have seen a fifteen percent rise over the past three years, creating huge demand for practitioners with expertise in how Islamic compliant financings function.

Whether in private practice or corporate, all Dubai and Middle East lawyers can expect to work on multi-jurisdictional assignments, receive excellent training and fast-tracked opportunities to partnership. Recruitment levels in London proceeded at a pace up to the global economic downturn at the turn of the year. High levels of work, demand for quality inter-national lawyers and record salaries, set, in part, in response to pressure by high paying US firms in the City, left many confident that the recruitment market would continue to thrive in 2008.

But the recent downturn in corporate M&A activity and increasing caution under which banks are willing to extend loans is likely to effect UK hiring demands. The impact of the credit crunch is particularly notable in core transactional areas such as corporate law, with the property market also declining in tandem with the recent drop in property values. US firms in particu-lar have been hit by market changes, and have seen a reduction in roles and become increasingly selective as a result.

As with other jurisdictions, however, a downturn in one practice area necessarily leads to an upturn in another. Tight economic forecasts often lead organisa-tions to pursue payment aggressively, which in turn will lead to an increase in arbitration, litigation and insol-vency actions. In-house counsel are predicted to see a similar increase in demand, in particular on the public sector side.

The end result of these factors will not play out into a significant downturn in the number of opportunities for lawyers in the UK, but rather a shift in their base

and focus. US firms will see particular demand for pro-fessionals with experience in ‘downturn’ areas, while UK firms remain positive and persist with growth plans emphasising winning work. On the in-house front, demand will rise for commercial counsel with experi-ence working in charities and associations.

With the corporate and banking markets slowing in the UK, European countries continue to offer exciting alternatives. Patent law is currently a booming field, with Munich, home to both the European Patent Office and the German Patent and Trademark Office, serving as the continent’s ‘patent capital’.

Leading international firms have also embraced Eastern European jurisdictions, with many of the top US and UK firms having offices in most, if not all, of the centres. Their principal areas of practice are: banking and finance; corporate; resources (particularly oil and gas); and commercial property.

The market for legal services also continues to grow in Russia, parallel with growth in the nation’s economy. Russian transactions are marked by their international nature, and often governed by UK law, effectively thwarting domestic firms capacities in this regard.
