    The !3th month pay re0uired by Presidential >ecree $! is additional income based on #age but

    Article G$+ of the Babor Code on Regular and Casual Employment specifies that the

    provisions of a #ritten agreement to the contrary not#ithstanding and regardless of the oral

    agreement of the parties1 an employment shall be deemed to be regular #here the employee

    has been engaged to perform activities #hich are usually necessary or desirable in the usual
