    ANNEX

    THE LAKE VICTORIA TRANSPORT (FEES) REGULATIONS 2010

    IN EXERCISE of the powers conferred by section 246 of the Lake Victoria Transport Act 2007, the Council of Ministers makes these regulations this . day of

    . 2010.

    PART I

    PRELIMINARY

    1. Citation and commencement

    (1) These Regulations may be cited as the Lake Victoria Transport (Fees) Regulations, 2010 and shall come into operation upon such date as the Council may, by notice in the Gazette, appoint.

    (2) The Council may, pursuant to subregulation (1) appoint different dates for coming into operation of different provisions of these Regulations.

    2. Interpretation

    In these Regulations unless the context otherwise requires - Act means the Lake Victoria Transport Act, 2007;

    authorized officer means a person designated under this Act as such, by the Executive Secretary for purposes of this Act;

    BCH Code means the Code for the Construction and Equipment of Ships Carrying Dangerous Chemicals in Bulk;

    crew agreement means the agreement in section 114 of the Act;

    dead weight means the total mass of cargo, fuel, fresh water, and other stores that a vessel can carry when she is floating on the Lake with her load line at the water surface;

    DWT means dead weight;

    dry dock means excavated dock fitted with watertight entrance, from which water can be pumped to allow work to be done on the under water portion of a docked vessel;

    GT means gross tonnage;

    IBC Code Certificate means the International Bulk Carrier Code for the construction and equipment of vessels carrying dangerous chemicals in bulk, for vessels built after 1986;

    IGC Code Certificate means International Code for Construction and Equipment of Ships Carrying Liquefied gases in Bulk;

    INLS Certificate means an International Pollution Prevention Certificate for the carriage of Noxious Liquid Substances in Bulk issued in conformity with Annex II to MARPOL 73/78;

    IOPP Certificate means International Oil Pollution Prevention Certificate issued in conformity with Annex I to MARPOL 73/78;

    livestock includes wild animals;

    maritime administration unit means a unit responsible for maritime safety and security administration in a Partner State;

    MARPOL 73/78 means the International Convention for the Prevention of Pollution from Ships, 1973, as modified by the Protocol of 1978 relating to it;

    noxious liquid substance means any substance referred in Appendix II to Annex II of MARPOL 73/78;

    rating means a member of the crew other than a master or an officer;

    small vessel means a vessel of less than 24 meters in length or of less than 50 gross registered tonnage;

    SOLAS means the International Convention for the Safety of life at Sea 1974 as amended from time to time;

    survey means a detailed examination, inspection or investigation to determine the validity of the relevant certificates

    and other documents, and the condition of the hull, equipment and machinery of the vessel and the members of the crew of the vessel;

    tonnage convention means the International Convention on Tonnage Measurement of Ships, 1969;

    tons means the gross tons, and the tonnage of a vessel with alternative gross tonnages shall be taken to be the larger of those tonnages;

    vessel includes any vessel, boat, sailing vessel, or other vessel of any description used in navigation.PART II

    CERTIFICATES

    3. Issuance of certificates

    The fees for the issuance of certificates to members of the crew, the master and other persons working on the vessel shall be as specified in Schedule 1.

    4. Manning

    The fees for manning shall be as specified in Schedule 2.

    5. Registration and licensing

    The fees payable for registration services and licensing of vessels shall be as specified in Schedule 3.

    6. Surveys and tonnage measurement

    The fees payable for surveying and tonnage measurement of vessels shall be as specified in Part A of Schedule 4.

    7. Survey of passenger vessel safety certificate

    The fees payable for the survey of a passenger vessel for the issuance of a safety certificate shall be as specified in Part B of Schedule 4.

    8. Survey of cargo vessel for issuance of a safety certificate

    The fees payable for the survey of a cargo vessel for the issuance of a safety certificate ,with or without an exemption certificate, shall be as specified in Part C of Schedule 4.

    9. Survey of vessel for local safety certificate

    The fees payable for the survey of a vessel for the issuance of a safety certificate, with or without a safety exemption certificate, and for the issuance of a record of safety equipment shall be as specified in Part D of Schedule 4.

    10. Survey for International Code for construction and equipment of vessels liquefied gases in bulk

    The fees payable in respect of the issuance of certificates for the construction of vessels for carrying liquefied gases in bulk shall be as specified in Part E of Schedule 4.

    11. Survey for cargo vessel safety equipment certificate

    The fee for the issuance of a cargo safety equipment certificate shall be

    (a) for vessels of less than 500 GRT, US $ 500; (b) for vessels of more than 500 GRT, US $ 500 and an

    additional US $ 0.2, for every extra tonne above 500.

    12. Survey for cargo vessel safety radio certificate.

    The fees for the issuance of a cargo vessel safety radio certificate shall be

    (a) for vessels of less than 500 GRT, US $ 50; (c) for vessels of more than 500 GRT, US $ 50 and an additional

    US $ 0.2, for every extra tonne above 500.

    13. Survey for cargo vessel safety construction certificate. The fees for the issuance of a cargo vessel safety construction certificate shall be

    (a) for vessels of less than 500 GRT, US $ 500; (d) for vessels of more than 500 GRT, US $ 500 and an

    additional US $ 0.2, for every extra tonne above 500.

    14. Load Line Certificate The fees payable for the issuance of a load line certificate, with or without a load line exemption certificate, shall be as specified in Schedule 5.

    15. Safe manning certificate

    Thefee payable for the issuance of a minimum safe manning survey certificate shall be US $ 50.

    16. Safe management

    (1) The fee payable for the issuance of a safety managementcertificate shall be US $ 500

    (2) The fee payable for the issuance of a Document Compliance certificate shall be US $ 500.

    17. General and miscellaneous fees

    The fees payable for general and miscellaneous mattersshall be as specified in Schedule 6.

    18. Penalty

    (1)Interest at a rate of 20% per annum, compounded monthly, shall be payable in respect of the outstanding balance of any fee after the due date. (2)Offences committed to obstruct a proper officer or surveyor to perform his duties, shall be punishable under the Act.

    19. Payment of fees

    (1) All fees shall be paid to the maritime administration unit of the Partner State.

    (2) Fees shall be paid within the time stated in the relevant invoice.

    (3) Fees shall be paid in the equivalent in a Partner States currency of the United States dollars.

    (4) All fees are non-refundable

    SCHEDULE 6 Regulation 17

    GENERAL AND MISCELLENEOUS FEES

    1. Inspection of life-saving appliances and life-raft service stations

    (1) A fee of US $ 30 per surveyor-hour or part thereof shall be payable for - (a) the examination of the design of a life-saving appliance; (b) the inspection of the first appliance manufactured to that design; (c) if required, the issuance of a certificate of approval; (d) the inspection during construction, for the certification or re-certification of a boat or buoyant apparatus, and for the issuance of a report of inspection.

    (2) The following fees shall be payable for the inspection and stamping of life-jackets at the premises of the manufacturer or the maritime administration unit -

    (a) a prototype testing life-jacket - US$ 75 per sample; (b) stamp only, per life-jacket - US$ 0.5; (c) certificate of approval US$ 500.

    (3) A fee of US$ 30 shall be payable per attendance at a life-raft service station at the request of the service station or the master or owner of the vessel to which the life raft belongs.

    (4)A fee of US$ 10 shall be payable for the issuance of a certificate of approval based on the approval of another competent authority.

    (5)A fee of US$ 50 shall be payable for every two visits by a surveyor for the inspection and approval of a life raft service station, with an additional fee of US$ 30 per surveyor-hour or part thereof, for every additional visit.

    (6) In this paragraph boat, means a lifeboat, rescue boat, life raft, survival craft or other boat carried in a vessel and intended for use as a life-saving appliance.

    2. Inspection of fire appliances service station

    (1) A fee of US$ 30 per surveyor-hour or part thereof shall be payable for

    (a) the examination of the design of a fire appliance; (b) the inspection of the first appliance manufactured to

    that design; (c) if required, the issuance of a certificate of approval,

    for the witnessing of tests of fire extinguishers, fire detecting apparatus, smoke helmets and breathing apparatus, fire pump units, spray nozzles and similar appliances, and for the issuance of a report of inspection.

    (2) A fee of US$ 10 shall be payable for the issuance of a certificate of approval based on the approval of another competent authority.

    (3)A fee of US$ 50 shall be payable for every two visits by a surveyor for the inspection and approval of fire appliances service station, with an additional fee of US$ 30 per surveyor-hour or part thereof, for every additional visit.

    3. Inspection of crew accommodation

    (1) A fee of US$ 3 per compartment shall be payable for the issuance of a certificate under the provisions of the Regulations on the accommodation of members of the crew.

    (2) A fee of US$ 12 per inspection is payable for the inspection of accommodation for members of the crew, as a result of a complaint about such accommodation, but no fee shall be payable if, in the opinion of the officer making the inspection, there were no reasonable grounds for the complaint.

    4. Dangerous cargoes

    The following fees shall be payable for the services respectively referred to, in accordance with the provisions of the Regulations regarding the carriage of dangerous goods -

    (a) granting of an exemption - US$ 15 (b) inspection of a vessel in which explosives or other

    dangerous goods are proposed to be carried, to determine

    (i) before loading, whether the vessel is equipped and in all other respects suitable to carry such goods - US$ 30, per visit;

    (ii) whether the proposed stowage complies with the applicable requirements - US$ 30, per visit;

    (iii) during loading and upon completion of loading, whether the goods have been handled and stowed in accordance with the applicable requirements US$ 30, per visit;

    (c) inspection of a magazine or container (i) the travel and subsistence expenses of the officer concerned and US$ 30 per inspection of not more than five magazines or containers; or (ii) if more than five magazines or containers are to be inspected- US$ 30, and US $ 30 per surveyor-hour or part thereof;

    (d) inspection of a vessel for a document of compliance - US$ 55 for two visits to the vessel by a surveyor, and US$ 30 per surveyor-hour or part thereof, for every additional visit.

    5. Grain cargoes The following fees shall be payable for the services respectively referred to, provided in terms of the Lake Victoria (Maritime Safety) Regulations -

    6. Timber deck cargoes

    A fee of US$ 30 per surveyor-hour or part thereof shall be payable for the inspection of the stowage plans, fittings, stowage and securing of timber deck cargoes, subject to a minimum fee of US$ 60 per vessel.

    7. Livestock cargo

    A fee of US$.50 per surveyor hour or part thereof shall be payable for the inspection of the stowage plans, fittings, stowage and securing of livestock cargoes subject to a minimum fee of US$.60 per vessel.

    8. Partial inspections

    (1) In the case of a vessel required to hold a safety certificate, the following fees shall be payable for a partial inspection, and for the issuance, where applicable, of a certificate of inspection or for the endorsement of a record of safety equipment -

    (2)Where a vessel is inspected to determine whether minor defects that were found in the course of a routine inspection have been remedied, the fees specified in subparagraph (1) shall be payable.

    (3) Where a vessel is inspected in order to obtain an extension of a safety certificate or of a load line certificate, a fee equal to 50% of the fee payable in terms of the various applicable provisions of this Part for the full survey required for the issue of such safety certificate or load line certificate or for the extension of an annual hull survey, shall be payable.

    (4) Where plans or drawings, in respect of construction or alterations, not otherwise covered by the Regulations are presented for scrutiny or approval, a fee of US$30 per surveyor-hour or part thereof shall be payable.

    (5) The following fees shall be payable on the inspection and approval of the stability book or stability statement of a vessel -

    (6) The fees specified cover the original submission and inspection of the book or statement and one re-submission and inspection and where further re-submissions and inspections are required before approval, an additional fee of US$30 per re-submission and inspection shall be payable.

    (7) A fees of US$30 per surveyor-hour or part thereof, shall be payable for the services of a surveyor to witness and verify an inclining experiment.

    (8) The following fees shall be payable for the issuance of the respective certificates -

    (a) a fee of US$ 25 for a certificate of high speed craft safety certificate;

    (b) a fee of US$ 25 for a permit to operate a high speed craft;

    (c) a fee of US$ 25 for a special purpose vessel safety certificate; a fee of US$ 50 for a diving system safety certificate.

    9. Examination of Certificate of Competency

    (1) The following fees shall be payable for the issuance of the respective certificates of competency -

    (a) rating forming part of a navigational watch - US$ 10; (b) rating forming part of an engineering watch - US$ 10; (c) able bodied members of the crew - US$ 15; (d) motorman - US$ 15.

    (2) A fee of US$10 shall be payable for the issuance of a certified copy of a lost, mutilated or damaged certificate of competency, except in cases where the certificate is lost, mutilated or damaged due to a wreck of the vessel or fire on board the vessel.

    10. Certificates of competency for engineer officer

    (1) The following fees shall be payable for the issuance of the respective certificates of competency -

    (a) Marine Engineer Officer Class 4 or endorsement - (i) whole examination for the certificate (steam, motor

    or combined steam and motor) - US$ 25; (ii) part of the examination - US$ 15; (iii) endorsement (steam or motor) examination - US$

    (b) officer in charge of an engineering watch or endorsement -

    (i) whole examination for the certificate (steam, motor or combined steam and

    motor) - US$ 30; (ii) part of the examination - US$ 20; (iii)

    ndorsement (steam or motor) examination - US$ 20; (iv) oral examination - US$.20;

    (c) Second Engineer or endorsement - (i) whole examination for the certificate (steam,

    motor or combined steam and motor) - US$ 45;

    (ii) endorsement (steam or motor) examination - US$ 25;

    (d) Chief Engineer Officer or endorsement - (i) whole examination for the certificate (steam, motor of combined steam and motor) - US$ 55; (ii) endorsement (steam or motor) examination - US$

    65;

    (e) Chief Engineer Officer (Special Grade)- US$ 65.

    (2) A candidate holding an exempting qualification for part of the examination shall pay the full fee at the first attempt for part of such examination but where it becomes necessary to resist such examination, the candidate hall be required to pay for only part of the examination.

    (3) For examination for credit subjects, re-examination in the oral examination, or

    examination in a deferred subject - 50% of the specified fee.

    (4) A fee of US$ 10 shall be payable for a dangerous cargo endorsement on a certificate of competency.

    (5) A fee of US$ 10 shall be payable for the revalidation of a certificate of competency.

    (6) A fee of US$ 10 shall be payable for the issue of a certified copy of a lost, mutilated or damaged certificate of competency or service, except in cases where the certificate was lost, mutilated or damaged due to a wreck of the vessel or fire on board vessel.

    11. Certificates of competency for deck officer

    (1) The following fees shall be payable for examinations for the certificates of competency respectively specified -

    (a) Deck Officer Class 5: Whole examination - US$ 25; (b) Deck Officer Class 4: Whole examination - US$ 25; (c) Officer in charge of a navigational watch: Whole examination - US$ 30; (d) Master near coastal: Whole examination - US$ 30; (e) Chief mate: Whole examination - US$ 45; (f) Master: Whole examination - US$ 60;

    (g) Master up to 3000 GT - US$ 30.

    (2) A fee of US$.10 shall be payable for a dangerous cargo endorsement on a certificate of competency.

    (3) A fee of US$.10 shall be payable for the revalidation of a certificate of competency.

    (4) A fee of US$.10 shall be payable for the issuance of a certified copy of a lost, mutilated or damaged certificate of competency or service, except in cases where the certificate was lost, mutilated or damaged due to a wreck of the vessel or fire on board the vessel.

    12. Certificate of competence for small vessel

    The following fees shall be payable for examinations for a certificate of competency for small

    vessels- (a) for examination for a certificate of competency as a skipper of

    a small vessel - US$ 10;

    (b) for the issue of a certified copy of a lost, mutilated or damaged certificate of competence - US$ 5.

    qualification respectively specified - (a) proficiency in survival craft - US$ 10; (b) rating forming part of navigation watch or ordinary sailor US$.10 (c) rating forming part of an engineering watch or Greaser US$.10 (d) efficient deck cook - US$.5 (e) able bodied member of the crew - US$.15 (f) oiler - US$.15 (g) for an endorsement of an additional qualification - US$ 5.

    (2) A fee of US$ 10 shall be payable for the issuance of a certified copy of a lost, mutilated or damaged certificate of qualification, except in cases where the certificate was lost, mutilated or damaged due to a wreck of the vessel or fire on board the vessel.

    14. Licensing of compass adjuster

    (1) The following fees shall be payable for the examination and licensing of compass adjusters - (a) compass adjuster (restricted) - US$ 15; (b) compass adjuster (unrestricted) US$.15; (c) for the written and oral parts of the examination if

    attempted concurrently - US$ 15; (d) for the practical part of the examination - US$ 15;

    (e) for re-examination in the oral examination - US$ 15.

    (2) A fee of US$ 5 shall be payable for the issuance of a certified copy of a lost, mutilated or damaged license, except in cases where the license was lost, mutilated or damaged due to a wreck of the vessel or fire on board the vessel.

    15. Dispensations and evaluation of foreign certificate of competency

    The following fees shall be payable for dispensations granted in accordance with the Act or Regulations made under the Act - (a) where the foreign certificate is recognized - US$ 25; (b) where the foreign certificate has to be evaluated before

    dispensation can be granted - US$.50.

    MARINE POLLUTION FEES

    16. Survey of vessel for IOPP certificate

    (1) The following fees shall be payable for the survey of a vessel for an IOPP certificate-

    (a) initial or renewal survey where the period of validity of the certificate is five years -

    (i) fishing vessel US$ 30; (ii) vessel (other than an oil tanker) of over 400 tons- US$ 255;

    (iii) oil tanker of over 150 tons, up to 4 000 DWT- US$ 255; (iv) oil tanker of over 4 000 DWT - US$ 400.

    (b) annual survey- US$ 70; (c) intermediate or additional survey - US$ 120

    17. Survey of vessel for INLS certificate

    The following fees shall be payable for the survey of a vessel for an INLS certificate -

    (a) initial or renewal survey where the period of validity of the certificate is five years - (i) chemical tanker (all vessel types)- US$ 514; (ii) oil tanker capable of carrying specified noxious liquid substances in bulk in designated cargo tanks, per tank -US$ 35;

    (b) annual survey - (i) chemical tanker- US$ .500; (ii) oil tanker capable of carrying specified noxious liquid substances in bulk in designated cargo tanks, per tank - US$ 15;

    (c) intermediate or additional survey - (i) chemical tanker- US$ 255; (ii) oil tanker capable of carrying specified noxious liquid substances in bulk in

    designated cargo tanks, per tank US$ 20.

    18. Survey of vessel for IBC Code certificate

    The following fees shall be payable for the survey of a vessel for an IBC Code certificate -

    (a) initial or renewal survey where the period of validity of the certificate is

    five years- US$ 600; (b) intermediate, annual or additional survey-US$ 30 per

    surveyor-hour or part thereof.

    19. Survey of vessel for BCH Code certificate

    The following fees shall be payable for the survey of a vessel for a BCH Code certificate -

    (a) initial or renewal survey where the period of validity of the certificate is five years - US$ 600;

    (b) intermediate, annual or additional survey - US$ 30 per surveyor-hour or part thereof.

    20. Survey of vessels for IGC Code

    The following fees shall be payable for the survey of a vessel for a IGC Code certificate-

    (a) initial or renewal survey where the period of validity of the certificate is five years - US$ 600;

    (b) intermediate, annual or additional survey - US$ 30 per surveyor-hour or part thereof.

    21. Survey of offshore installation for pollution safety certificate

    A fee of US$ 700 and the travel and subsistence expenses of the surveyor concerned shall be payable in respect of the survey of an offshore installation for the issuance of a pollution safety certificate.

    22. Certificates of marine pollution liability

    A fee of US$ 145 shall be payable for the issuance of a certificate of insurance or other financial security referred to in the Civil Liability for Oil Pollution Damage 1969.

    23. Survey or inspection of equipment and documents

    (1) Where a surveyor carries out a survey or inspection to determine whether

    certain equipment or documents comply with the prescribed specifications, a

    fee of US$ 30 per surveyor-hour or part thereof shall be payable.

    (2) Where a certificate of inspection is required, an additional fee of US$ 30 shall be payable.

    (3) A fee of US$ 10 shall be payable for the issuance of a certificate of approval based

    on the approval of another competent authority.

    24. Survey or inspection under Annex II to MAR POL 1973/78

    (1) Where a surveyor carries out a survey or inspection to determine whether the provisions of Annex II to MARPOL 1973/78 have been complied with, a fee of US$ 30 per cargo tank surveyed or inspected shall be payable.

    (2) Where a certificate of inspection is required, an additional fee of US$ 30 shall be payable.

    25. Provisional assessment of noxious liquid substances

    A fee of US$ 130 shall be payable for each noxious liquid substance provisionally assessed in terms of regulation 3(4) of Annex II to MAR POL 1973/78.

    26. Transshipment of oil

    A fee of US$.145 per day, or US$ 10 per hour if it is not a full day, and the officer's travel and subsistence expense shall be payable for the attendance of a representing officer.

    27. Detention fee

    A fee of US$.150 shall be payable where a vessel is detained under the Act.

    MISCELLANEOUS FEES

    28. Discharge book and official logbook

    (1) A fee of US$.25 shall be payable for the official logbook, whether the application is made at a place where there is an authorized officer or not or to replace a lost, mutilated or damaged discharge book, unless the discharge book is been lost, mutilated or damaged due to a wreck of the vessel or fire on board the vessel.

    (2) A fee of US$.10 shall be payable for any other logbook.

    29. Engagement and discharge of a member of the crew

    (1) Subject to sub-regulations (2) and (3), where a member of the crew is engaged or discharged before a authorized officer under the Act, a fee of US$.2 shall be payable by the master

    or owner of the vessel from which the member of the crew is engaged or discharged.

    (2) Where the engagement or discharge of a member of the crew is effected on board a vessel at a port in a Partner State, the fee payable in terms of subparagraph (1) is subject to an additional fee of US$ 20 for each visit that the authorized officer is required to make to the vessel in order to complete the discharge.

    (3) Where the engagement or discharge of a member of the crew is effected on board a vessel at a port outside a Partner State at the request of the master or owner of the vessel, the authorized officer's travel and subsistence expenses shall be payable in addition to the applicable fees on normal working hours and US$ 30 outside the normal working hours of the maritime administration unit of the Partner State.

    30. Extra and special attendance

    A fee of US$ 30 per hour or part thereof and the travel and subsistence expenses of the surveyor or authorized officer shall be payable for the attendance of a surveyor or proper officer on a Saturday, a Sunday, a public holiday or at any other time outside the normal working hours of the maritime administration unit of the Partner State.

    31. Surveys in other Partner States

    Where the attendance of a surveyor or an authorized officer is required in another Partner State the travel and subsistence expenses

    of the surveyor or authorized officer shall be payable in addition to any applicable fee.

    32. Inland attendance and extraordinary attendance

    Where the attendance of an authorized officer is required at any place on the Lake outside the normal working hours the authorized officers travel and subsistence expenses shall be payable in addition to any applicable fee.

    33. Consultative services

    (1) Where a person requests a consultative service, the fee prescribed for that service shall be payable.

    (2) If the service requested is not fully specified in this determination, a fee of US$ 30 per surveyor-hour or part thereof shall be payable.

    (3) Where an officer is requested to interpret any requirement applicable to a particular class or category of vessel, a fee of US$ 30 per surveyor-hour or part thereof shall be payable.

    34. Exemption certificate.

    A fee of US$ 100 shall be payable when an exemption Certificate is granted to a vessel under and in accordance with the provisions of the SOLAS 1974.

    35. Fees and expenses of the receiver of wrecks.

    The receiver of wrecks shall be reimbursed the expenses incurred by him in performing his duties

    36. Travel and subsistence expenses

    Unless otherwise stated, travel and subsistence expenses shall be calculated in accordance with the tariffs approved by the Administration.

    37. Copies of documents

    Where a person requests a copy of a document belonging to the Administration for commercial purposes, a fee of US$ 20 shall be payable.

    38. Extension of validity of certificate

    There shall be a fee at the rate of 25% of the annual fee paid for the extension of validity of certificates.
