• Una infracción que ha sido despenalizado, como algunas condenas por canabis.

• Un arresto que no haya resultado en una condena (con la excepción de arrestos no resueltos).

La Ordenanza de Oportunidades Equitativas de San Francisco limita el uso por parte de empleadores de los expedientes de arrestos y condenas en el empleo. Los empleadores con 5 o más empleados están cubiertos por esta ley.

Lungsod at County ng San FrancsicoOrdinansa para sa Pantay na Pagkakataon

(Fair Chance Ordinance)

• Ang paghatol ng pagkakasala na mahigit sa 7 taon (maliban sa posisyon ng mga superbisor para sa mga menor de edad, nakatatanda, o dependiyenteng nasa hustong gulang).

• Ang napawalang-saysay o binura na paghatol ng pagkakasala.

• Paglahok sa isang programa ng paglilihis o pagpapaliban ng paghatol.

• Ang paghatol ng pagkakasala sa ilalim ng sistema ng katarungang pangkabataan (Juvenile Justice System).

• Ang pagkakasala maliban sa isang krimen o hindi mabigat na kasalanan, gaya ng maliit na kasalanan (infraction).

• Ang pagkakasala na hindi na itinuturing na krimen, katulad ng ilang pagkakasala na kaugnay sa cannabis.

• Ang pag-aresto na hindi nauwi sa isang paghatol ng pagkakasala (maliban para sa hindi pa nalutas na mga pag-aresto).

Limitado ang mga employer na humiling ng mga tala ng pag-aresto at paghatol (arrest and conviction records) sa mga aplikante ng trabaho sa ilalim ng Ordinansa ng Pantay na Pagkakataon (Fair Chance Ordinance). Kasali sa batas na ito ang mga employer na may lima at higit pang empleyado.

Kung mayroon kayong mga katanungan tungkol sa inyong mga karapatan o gusto ninyong mag-ulat ng paglabag sa batas, tumawag sa San Francisco Office of Labor Standards Enforcement sa 415-554-5192 o magpadala ng email [email protected].

Bawal itanong ng mga employer ang tungkol sa tala ng pag-aresto o paghatol ng pagkakasala sa isang aplikasyon para sa trabaho.

Bawal magsagawa ng mga pagsusuri sa karanasan (background check) ang mga employer hanggang hindi pa tapos ang may-kondisyong alok ng trabaho (conditional offer of employment).
