The Cambodian Center for Human Rights (CCHR)welcomes the decision by Judge Sin Visal of thePhnom Penh Court of First Instance to dismiss thecharge of defamation against Sam Rainsy Partylawmaker Ho Vann, arising from a complaint madeby 22 officers of the Royal Cambodian ArmedForces.
In his verdict on 22 September 2009 Judge SinVisal stated that there was insufficient evidence toconvict Ho Vann of the defamation charge. TheCCHR commends this decision which can perhapsbe viewed as the green shoots of judicialindependence in Cambodia. Such progress is verywelcome.
The CCHR recalls that Cambodia Law providesthat Ho Vann’s parliamentary immunity will beautomatically restored.
The CCHR is concerned with the fines imposedagainst Neou Vannarin and Kevin Doyle of theCambodia Daily, and urges the Cambodian judiciaryto respect freedom of expression. Nevertheless, theCCHR commends Judge Sin Visal for his decision toacquit Ho Vann, and hopes that this represents anew departure on the part of the Cambodianjudiciary whereby independence and impartialitywill be guaranteed.

There is no doubt that whenever the Court foundnot guilty or dropped the charge against any SRPMP, the SRP will applause to the Court's verdict,but if the same Court found guilty of any SRP MP,the SRP will condemn to the Court. That is thepattern of SRP, the party always been a loser.

I would like to say thank you to Prime MinisterHun Sen whom is very kind at heart and is willingto forgive those who made mistakes against him. Ialso believe the court is doing the right thing by notcharging our diplomat without sufficent evident toprove it otherwise. We khmer people must worktogether as a team to promote our intelligents aswell as focusing on skilled migrants intakes becausethey are the foundation to rebuilding the countrymore effectively. We also need to be more focusedon adding new infrastures to meet our people'sneed such; hospital, school, university andproviding quality education to all of our khmercitizen...

Those MPs should have not been charged in thefirst place. Thanking Hun Sen means thathe's incharge of the court. There is no real justice inCambodia. The decision made by the judge toacquit Ho Vann is all political. Let see if Mu Sochuacan be acquitted. We should realize that Cambodiais ruled by one man, one branch of the governent.

The fact that the Cambodian court withdrewcharges against MP, don't mean that the court isindependent. I believe that international reactionthat make Hun Sen ordered the court to drop thecharges. Hun Sen don't want to hear the publicoutcry which could irritate the donor countries.

Sochua Mu is our hero and she has done a great joband I want to see her back as an MP, again. If notthis country will need urgent support from variouscommitties abroad. If possible, I would like ourconstitution be reformed. Working base on humanright approach, by having a law and order toprotect civilians, as well as the freedom to dowhatever people want to do in term of rebuildingthe country. I would to see Hun Sen works inpartnership with the opposition leader rather thenagainst them. This is the only way for him to bemore success in whatever he wants to do.
