Katarungang Pambarangay Law

THE Katarungang Pambarangay or Barangay Justice System is a community-based

dispute settlement mechanism administered by the barangay. t co!ers disputes

between members o" the same community #generally$ same city%municipality& and

in!ol!es the Punong Barangay and other members o" the communities #the Luponmembers& as intermediaries #mediators$ conciliators$ and$ sometimes$ arbitrators&.

-designed primarily based on the 'ilipino !alues o" pa(i(isama #cooperation$

comradeship& and pa(i(ipag-(apwa #sympathy&$ !irtues which help maintain smooth

interpersonal relationships and preser!e peace and harmony within the "amily and

the people in the community.

The barangays are gi!en mandate to help in the administration o" )ustice*

+. ,onduct conciliation proceedings in ci!il cases and in criminal cases where

penalty is less than + year imprisonment or ne o" less than P///$ be"ore the same

They regularly meet once a month to discuss their e>periences in aDecting

speedy resolutions o" disputes$ somewhat li(e a "orum o" e>change on

matters in!ol!ing dispute resolutions and settlements.

4 Pangkat Tagapagkasundo on the other hand$ comprises o" three #9&

members coming "rom the Lupon$ and chosen by the parties concerned. ow$

i" the parties "ail to agree on the members o" the Pang(at$ then a draw lots

will be done by the Lupon Tagapamayapa ,hairman to determine the

8hat does a Pangkat Tagapagkasundo doG Primarily$ it is the Pang(at which

conducts barangay mediation a"ter mediation eDorts by the lupon chairman

second attempt to arbitrate parties. The composition o" Pang(at

Tagapag(asundo diDers on a case-to-case basis.
