I/We have read the Tender Documents and related matters carefully and diligently and also visited the site and all the proposed Security points where the Private Civil security personnel are to be deployed that I/we have submitted the tender having studied, understood the tender stipulations and understood site conditions of the proposed security points and accepted the full implications of the agreement. FORM – 1

Tenders should be submitted electronically (online through Internet) through the GOK e-procurement platform www.eproc.karnataka.gov.in only, within the date and time published in the portal for the following work. 1. NAME OF WORK: Providing Security services of Ex-servicemen / Civil security

guards without arms for KPCL project located at Ghataprabha Dam Power House, Hidkal, Belgaum Dist.

Note: 1. After the award of contract to the Agency, the EMD will be converted as security deposit and further the agency will pay 7.5% of the contract value including EMD as performance security which shall be recovered from their RA bills proportionately.

i) Tenders must be electronically submitted (Online through Internet) before

the time and date published in e-procurement portal. ii) Tenders will be opened by the Chief Security Officer(CSO) as stipulated

in the calendar of events iii) First cover of tenders will be opened at prescribed time and date in the e-

procurement portal. If it is made by a firm it should be signed by the Co-partnership name by a member of the firm who shall also sign his own name, if it is made by a Company it should be signed by a duly authorized officer with satisfactory evidence of corporate existence.

iv) Each Agency should give clearly in the tender, place of residence and postal address. The delivery at the above name, place or posting in the post box regularly maintained by the Post Office or sending by letter registered for acknowledgement or other communications shall be deemed sufficient service thereof.

Each Agency shall pay the Earnest Money Deposit Online through e- procurement portal using any of the following payment through any Nationalised / Multi National banks.

a) Credit Card / b) Direct Debit / c) National Electronic Fund Transfer (NEFT) / d) Over the Counter (OTC)

v) The Earnest Money of the rejected tender shall normally be returned within three months after the receipt of tender or a week after the acceptance of the tender whichever is earlier. The earnest money deposited shall not bear interest.

vi) The accepted tenderer shall attend the office of the Chief Security Officer on the date as specified in LOA for executing agreement etc.

vii) Failure on the part of the successful tenderer to execute the contract

agreement would entail forfeiture of EMD.

viii) The rates should be indicated by the Agency both in words and figures and the unit in words. In case of discrepancy between the prices quoted in words and in figures, lower of the two shall be considered

ix) The tender for works shall be valid for a period of 180 days from the date

of opening of tenders. Under no circumstances, withdrawal of tender will not be permitted.

x) Final acceptance of tender rests with CSO who reserves the right to

accept or reject any or all tender without assigning any reason thereof.

xi) The submission of tender by an agency implies that the agency has read these notices and conditions of contract and made themself aware of the scope of the work to be done and availability of the number of security guards to be deployed.

xii) Tenders not submitted in the prescribed form in due time will be rejected.

Tenders which propose any alterations in the work specified in the said form or in the time allowed for carrying out work or containing other conditions of any sort will be void and be rejected.

xiii) The agency shall pay compensation to workmen working under them for

any death or injury caused during the execution of work as per “Employees Compensation Act” in force, failing which the amount will be deducted from their bills and paid to the injured workman or the family as the case may be.

xiv) Successful agency must produce latest Income Tax Clearance Certificate

before the work is entrusted to them.

xv) The agency shall furnish a Certificate of Liabilities from a Scheduled Bank, if required by the Corporation before execution of the agreement.

xvi) Income Tax as per prevailing norms of Government of India or as modified by the Government from time to time will be deducted on the gross amount from each bill.

xvii) Agency shall abide by the provisions of Employees Provident Fund Act & rules thereon and enroll eligible employees working with them and remit the P.F. Contribution to the Authorities regularly and furnish the information as per Annexure –II (b) enclosed along with the copy of the documents for having remitted.

TENDER FOR WORKS

I/We M/s.___________________, do hereby tender for execution for the KARNATAKA

POWER CORPORATION LIMITED, the works specified in the memorandum within the time

specified in such memorandum as per quoted rates and in all respects in accordance with

conditions so far applicable.

MEMORANDUM

a) Name of work: Providing Security services of Ex-servicemen / Civil security

guards without arms for KPCL project located at GDPH, Hidkal, Belguam Dist.

b). EMD/Security Deposit: `. 50,000/- I/We paid `50,000/- EMD Online through e-procurement portal using payment mode of

Credit Card / Debit Card / National Electronic Fund Transfer (NEFT) / over the counter

(OTC) through any Nationalised / Multi National banks as indicated above. The Earnest

money bears no interest.

Should my/our tender be accepted I/We agree to pay 7.5% of contract value including EMD

towards security deposit for the due fulfillment of the contract.

If this tender be accepted, I/We agree to abide by and fulfil all the terms and provisions of

the said conditions of contract annexed or in default thereof forfeit and pay to the

Corporation the sum of money mentioned in the said condition without prejudice to any other

right of the Corporation.

I/We hereby distinctly and expressly declare and acknowledge that before the submission of

this tender, I/We have carefully followed the instructions and I/We have made examination of

contract documents and locations where such work is to be done.

I/We distinctly agree that I/We would hereafter make no claim or demand upon the

Corporation based upon or arising out of any alleged misunderstanding or misconceptions or

mistake on my/our part of the said contract, agreements, stipulations, restrictions and

conditions.

If upon written information to me/us by the Chief Security Officer, if we fail to attend the

office on the date there-in fixed and if upon intimation being given to me/us by the Chief \

Chief Security Officer of the acceptance of the tender or fail to enter into agreement, I/We

agree to the forfeiture of the Earnest Money Deposit for the above work.

Any notice required to be served on me/us shall be served well in advance by post

(registered or ordinary) or left at my/our address given.

I/we fully understand the terms and agreements of the contract to be entered into between

me/us and the Corporation and the written agreement shall be foundation of the rights of

both the parties and the contract shall not be deemed to be complete until an agreement has

been signed by me/us and authorized by the proper office authorized to enter into contract

by the Corporation.

01. The Chief Engineer (Electrical Construction) / Chief Security Officer [CSO] invites providing security services tenders from eligible Security Agencies registered in Karnataka State, who have got adequate financial resources, experienced security personnel and should have past experience in providing security services of Ex-servicemen / Civil Security Guards[50% Ex-servicemen & 50% Civil security guards of the total numbers required] for a minimum period of two years and also having valid license issued by the Controlling Authority, GOK, as per GOK Gazette Notfn. No.698 Dt. 11.8.09 for the following works at GDPH, Hidkal, Belgaum Dist. as detailed in the table given below:-

02. Instructions regarding e-procurement:

(i) Tender documents may be downloaded from Govt. of Karnataka e-procurement website https://eproc:karnataka.gov.in under login for contractors.

(ii) After login to contractors, please scroll down to the right side bottom to see list of tenders, please click there to find the details of NIT and down load copy of tender. The tender can be downloaded in the portal as per prescribed date and time published in the portal. Only interested agencies who wish to participate should remit on line transaction fee for tender after registering in the portal. The transaction fee is non-refundable. The blank tender documents can be obtained through e-procurement portal web site www.eproc.karantaka.gov.in

(iii) Tenders must be accompanied by Earnest Money Deposit, which should be paid

on line through e-procurement portal using any of the following payment modes through Nationalized / Multi National Banks. a) Credit card b) Direct debit c) National Electronic Fund Transfer ( NEFT) d) Over the counter (OTC)

(iv) Whenever required, Agency shall furnish the original certificates as mentioned in

Para (03) below to the KPCL authorities, failing which their tenders will be disqualified / rejected.

03 Cover – I (Pre-qualifying Requirements)

a) Valid license which is valid for Uttara Kannada District Issued by the

Controlling Authority, GOK, as per Gazette Notification No.698 dated 11.8.09.

b) Past experience certificate in providing security services of Private Civil

Security Guards / Ex-Servicemen for a minimum period of preceding 2 years with a certificate of satisfactory service rendered.

c) Registration Certificate of Establishment from Govt. of Karnataka,

Department of Labour.

d) Registration Certificate of Employees State Insurance Corporation. (ESIC)

e) PF Registration Certificate issued by the Regional PF commissioner

f) Certificate of Registration under Sec.69 of Finance Act, 1994 (32 of 1994) i.e.

Service Tax Registration Certificate.

g) Income tax Return filed for the preceding two years (FY 2011-12 & 2012-13).

h) Professional Tax Registration Certificate issued by the commercial Tax Officer, GOK.

i) Annual turnover statement during the preceding two years along with P & L

A/c certified by Auditors / Chartered Accountants (Average Turnover for the last two years should not be less than Rs 50 Lakhs).

l) I/We have read the Tender Documents and related matters carefully and diligently and also visited the site and all the proposed Security points where the Ex-servicemen / Private Civil security personnel are to be deployed that I/we have submitted the tender having studied, understood the tender stipulations and understood site conditions of the proposed security points and accept the full implications of the agreement.

The requirements of the tender agreement as stated above will be fulfilled by me/us to the satisfaction of the Corporation.

m) The agency should thoroughly survey regarding the availability of the Ex-servicemen [ESM] at different locations and then quote their rates and the successful agency has to give a declaration that the required number of ESM will be provided as stipulated in the tender. If the agency fails to fulfill this condition, action will be taken as per the General terms and conditions of the contract.

n) EMD for `. 50,000/-

o) E-payment shall be made by direct debit, credit card, NEFT or OTC only

through Nationalized / Multi National Banks. 04 Bids duly filled in shall be submitted through e-procurement portal only.

07 The tender is of two cover system.

The Bidder should upload scanned copies of all the documents pertaining to the pre-

qualification as mentioned under “pre-qualifying requirements clause”. Whenever

required Bidder shall furnish the original certificates to the KPCL authorities, failing

which their tenders will be disqualified / rejected.

a) The Agencies who do not meet the Cover - I qualifying requirement are not eligible

for participation b) The first cover will be opened on as per calendar of events.

c) The Chief Engineer (Electrical Construction)/Chief Security Officer shall cause the

first cover to be opened and evaluate the tenderer capacity on the basis of criteria

specified in the tender notification / tender document and on this basis prepare a list

of qualified tenderers within 15 days from the date of opening of first cover and

intimate to all the Agencies about the outcome.

The second cover containing financial bid of all those tenderers found qualified as

per the above pre-qualifying requirement shall be opened by the Chief Vigilance

officer/Chief Security Officer, on the date which will be intimated to the Agencies in

advance.

08 General information & other conditions

1. The Bidder may download from the GOK e-procurement website https:e-proc.karnataka.gov.in under login for contractors.

2. Completed tenders received (two covers) after the due date and time shall not be considered.

3. No extension of tender due date shall be considered on any occasion

4. Tender validity shall be 180 days from the date of opening of second cover (Financial bid).

5. Alternate tender shall not be considered.

6. Conditional tenders are not accepted.

7. Tenders without EMD shall be rejected

8. The successful agencies shall enter into a contract agreement on a non-judicial stamp paper of Rs.200/- (Rupees two hundred only).

9. Income Tax, service charges, etc., as per rules will be deducted from the bills

payable to the agency.

10. Agency shall make payment of contribution towards PF & ESI (both

employees and employer) to the authorities concerned at the notified rates. The Agency shall also submit every month to the KPCL for verification about the payment of PF, ESI, EDLI, Service tax to the relevant authority and the particulars thereof shall be submitted as per the format enclosed under Annexure II (a, b & c) every month without fail.

11. Security deposit as prescribed in the contract document will be deducted from the bills payable to the agency.

12. Intending tenderers can have detailed information from the above office during

working hours.

13. The right to reject any or all tenders without assigning any reasons is reserved by the Chief Engineer (Electrical Construction)/ Chief Security officer.

14. Ex-servicemen / Civil security guards means a person, who has undergone

security training for a minimum period of 100 hours of class room instructions and 60 hours of field training spread over at least 20 working days as per the syllabus & modules indicated in the GOK Gazette Notification No. 698 dt. 11.8.09 aged not more than 60 years for Civil Guards & 65 years for Ex-Servicemen (ESM) and has a verified report obtained by the Police in respect of their character and antecedents at the cost of the Security Agency as per the format indicated in the GOK Gazette Notification No. 698 dt. 11.8.09. The Agency has to submit the Character /Antecedent (C/A) report issued by the Police authority for all security personnel proposed to be deployed within 90 days from the date of issue of letter of Award as per Annexure-VII enclosed. If the Ex-servicemen / Civil Security Guards have stayed in more than one District during the last five years, the No. of forms will be as many as Districts. The Character & Antecedent Certificate of the Ex-servicemen / Civil Security Guards have to be obtained from the respective District SP. (validity of character & antecedent certificate is three years from the date of issue) at the cost of the Security Agency.

15. The Agency has to submit the particulars of all the Ex-servicemen / Civil Security

Guards proposed to be deployed at GDPH, Hidkal, Belguam Dist., as per the format indicated in GOK Gazette Notification No.698 dt. 11.8.09 along with passport size photo. (As per Annexure-IV enclosed) within 15 days from the date of issue of Letter of Award (LOA), at the cost of the Security Agency. If the Ex-servicemen / Civil Security Guard have stayed in more than one Dist., during the last five years, the No.of Forms is as many as Districts.

16. Ex-servicemen / Civil Security Guards shall have to undergo Security Training

of minimum 100 hours of class room Instructions and 60 hours of field training spread over at least 20 working days on the syllabus / subjects indicated in GOK Gazette Notification No.698 dt. 11.8.09 or as prescribed / modified by the Competent Authority of GOK at the cost of Security Agency. The Security Agency has to submit the copies of Training Certificate of all Ex-servicemen / Civil Security Guard as per the format indicated in the GOK Gazette Notification No.698 dt. 11.8.09 before deploying them for Security duty (as per Annexure-V enclosed).

17. The details of physical standards and other requirements, issue of photo identity

cards, uniform (dress code) are prescribed in detail in the tender document.

18. The rates quoted should be net i.e. including wages of Ex-servicemen / Civil Security Guards as per the prevalent minimum wages prescribed by the Government of Karnataka / DGR, Ministry of Defence, GOI , for Security Guard, service tax, professional tax, house rent, washing allowance, cost of providing security training, transportation, Gratuity, PF, ESI, Bonus, EDLI , cost of getting Character & Antecedent certificate from the Police Authority, cost of issue of photo identity cards & other statutory requirements, Administration &

service charges, provision for weekly off and GOK Notified Holidays and Overheads etc. complete (for Sl.No. 1 of Financial / Price Bid).

19. Duration of the contract is 24 months from the Date of L.O.A

20. The successful agency shall produce police verification report in respect of

each of the Ex-servicemen / Civil Security Guard proposed to be deployed as per the terms of contract.

21. The successful agency shall deploy full contingent of guards as per

contract within 15 days from the date of receipt of LOA failing which penalty at `.100(Rupees One hundred) will be levied per day per guard not deployed during the first thirty (30) days. Thereafter, the penalty will be levied @ `.150(Rupees One hundred & fifty) per day per guard. If the agency does not deploy the full contingent within 90 days EMD will be forfeited and the contract will be terminated without any further notice.

22. Any increase in the minimum wages by Government of Karnataka (For civil

guards) / DGR, Ministry of Defence, GOI (For Ex-Servicemen [ESM]) during the currency of contract (after the date of issue of L.O.A) would be paid by the Corporation along with the proportionate increase in wage, PF and Service Tax only. If there is any decrease in minimum wages by government of Karnataka/ DGR, Ministry of Defence, GOI the recovery will be effective accordingly on proportionate basis along with the corresponding decrease in amount of PF and service Tax only. In both the cases the tender premium will also be considered for arriving at the derived rate.

23. The Agency which is quoting below the prescribed (for Sl.No. 1 of Financial/Price bid) rate will be rejected (prescribed rate means Minimum wages fixed by Government of Karnataka/ DGR, Ministry of Defence, GOI for Security Guard including provisions for ESI, PF, Gratuity, EDLI, Washing allowance, Provision for Weekly off / GOK notified Holiday / Other Holidays, Service Tax etc.). `.10343 (zone-II) per Civil guard & `.20194 (Area - A) / `.12501 (Area - C) per Ex-servicemen Guard per month of eight hour shift].

24. a) The Agency has to quote separate net rate in Financial/Price bid (under

Sl.No.2 of Financial/Price bid) for providing the following to each Civil Security Guard only proposed to be deployed.

a. Two pairs of uniform along with armed badge, chest badge, and

whistle attached to the whistle chord. b. One pair boots ( i.e. shoes with eye lit) c. Two pairs of socks d. Cap e. Belt f. Muffler & Sweater g. Battery & torch h. Ceremonial dress i. Baton

b) The quoted rate for providing the items indicated above will be paid to the Security Agency after executing the agreement with KPCL against the Bank Guarantee to the said quoted amount for Sl.No.2 of Financial/Price bid) as per the proforma enclosed (Annexure-VIII). The Bank guarantee should be valid for

a minimum period of one year & the validity of this Bank guarantee should be got extended in case of extension of tenure of contract. c) If any Civil Security Guards leaves the service or removed from service unfit to perform the duties diligently, then under such circumstances the payment under Sl.No.2 of Financial/Price bid will not be paid to the new security guards (i.e. cost of providing uniform, boots, socks etc. to the new security guards). However, in case the number of Civil Guards has been increased more than that specified in the tender notification during the tenure of the contract, the payment will be made as per the rates quoted for Sl. No.(2) of tender of Financial/Price bid to the extent of number of Security Guards(Civil) so increased. This amount is only paid at the end of tenure of contract.

25. The Agency shall make monthly wage payment along with washing

allowance by way of A/c. payee cheque/RTGS to each guard engaged for KPCL before 10th of every month without waiting for KPCL payments & produce the information relating thereto in the prescribed proforma shown in Annexure-1 every month without fail. If it is through NEFT, certificates may be produced.

26. The Agency should not sublet the contract. If the Agency found to have sublet

the contract, the above contract will be terminated at the risk and cost of the contractor concerned.

27. The Agency shall pay Gross minimum wages to their security Guards deployed

under this contract at the rate not less than the minimum wages fixed including washing allowance by GOK for civil guards & as per DGR rates, Ministry of Defence, GOI for Ex-Servicemen and as modified by GOK / DGR, Ministry of Defence, GOI from time to time

28. The Ex-servicemen & Private civil Security Guards proposed to be deployed is to be medically checked by the KPCL Medical officer or by the Medical officer nominated by the Chief Engineer (Electrical Construction)/Chief Security Officer. The certificate to this effect has to be obtained by the jurisdictional KPCL Medical officer/ Medical officer nominated by the Chief Engineer (Electrical Construction)/Chief Security Officer. (Medically checked once in every 12 months).

29. Before changing the Ex-servicemen / Civil Security Guards, the Agency has to

get the permission of Chief Security Officer or Other Officers nominated by Chief Security Officer for deployment at Project locations. The Agency has to get the antecedents of the new Ex-servicemen / Civil Security Guard verified. In this regard, a verification report obtained by the Police in respect of their character and antecedents has to be submitted to Chief security officer & the officers nominated by Chief Security officer, at the cost of the Security Agency along with the copy of Training Certificate of the Security Guards & other requirements. The Security personnel have to undergo Medical checkup as stipulated above.

30. The turnout of the Agencies security personnel should be good and KPCL shall

reserve the right to carry out inspection by way of parade to assess the alertness, commitment & discipline of the personnel before being engaged on KPCL duty. MD, KPCL, CVO, Chief Engineer (Electrical Construction)/ Chief security officer & an Officer nominated by the Managing Director, KPCL, shall have the right to examine any security guard deployed in KPCL in respect of their commitment, physical and mental health and performance of his duties any time without advance notice. GENERAL TERMS AND CONDITIONS TO THE CONTRACT FOR PROVIDING SECURITY SERVICES OF EX-SERVICEMEN / CIVIL SECURITY GUARDS WITHOUT ARMS FOR KPCL PROJECTS LOCATED AT GDPH, HIDKAL, BELGAUM DIST. 1. The expression “work”, “job” or “duty” where used in these conditions shall

unless there be something either in the subject or context represent to such of Security Arrangements in KPCL Offices located at BANGALORE.

2. The “Company” means KARNATAKA POWER CORPORATION LIMITED. 3. The “Agency” means the Security Agency to whom this work is awarded on

successful Bidding. 4. “C.V.O” means Chief Vigilance Officer of Karnataka Power Corporation

Limited, No.116/2, Trade Centre Building, RC Road, Bangalore – 560 001. 5. “C.S.O” means Chief Security Officer means Chief Engineer, KPC Ltd., of the

jurisdictional Project

6. “Security personnel of the Agency” means employees of the Agency and also should be Ex-servicemen / Civil Security Guards

7. “Security Officer” means the Asst. General Manager (Security) of the Project

or any Security Officer working in the Project area during the shift till a full time Security Officer is appointed by the Company.

8. “Notice in Writing” or “Written Notice” shall mean a notice written, typed or

printed characters sent (unless delivered personally or otherwise proved to have been received) by registered post to the last known private or business address or registered office of the ordinary course of post it would have been delivered.

9. “Premises of Company” means, its Offices at Bangalore/ various Project

complexes and all Power Houses & components of KPCL situated all over Karnataka. Whenever in this contract the words “Directed”, “Required”, “Ordered”, “Desired” “considered” “Necessary”, or like words are used, it shall understood that the directions, requirements, permissions, orders, desiring etc., of the

10. CSO or other authorised Officers, words “Approved”, “Acceptable”, satisfactory to the CSO or his authorised officers approved by or acceptable or satisfactory to the CSO unless any other meaning is otherwise intended.

10. The Agency shall arrange to safeguard the place, premises, goods and materials and / or any other property in and around the premises of the Company by posting the Security Staff in such manner and at such points and patrol the required areas at all times, check cars, lorries, trespassers and other vehicles and articles as may be considered necessary by the Company. The equipment’s like Torch, Whistles, Baton, Jerseys, Raincoats, Uniforms and other articles relating to Security will be provided to the Staff by the Agency at its cost.

11. The Security Personnel deployed by the Agency shall be the employees of

Security Agency, should be Ex-servicemen / Civil Security Guards and they should not have any connections with the employees of the Company. Nor will

they become the members of the Trade Union of the Employees of the Company. The Company will not be responsible for any of the unauthorized acts and / or liable for any damage/injury sustained by security guards or other employees of the security agency in the course of their work /duty in and around the office and plant premises.

12 The Agency shall make the payment of wages/salaries and other statutory

benefits to Security personnel through crossed cheque in the presence of nominated Company Officer / RTGS (The details of wages to be paid is furnished as per Annexure-I enclosed) and arrange to pay all statutory deductions like ESI/PF from the said payments, to the designated authorities along with the Agency’s contribution as per law, wherever applicable. Copy of the Registration Certificate indicating code Nos. of PF/ESI shall be produced by the contractor. The agency shall also produce the documents for having paid PF / ESI contribution of his employees along with the Agency’s contribution to the designated Authorities, from time to time. If the places mentioned in the tender (Project area) comes under non-implemented area under ESI, in such areas, the Agency has to obtain Personal Accident Policy for `.1 lakh for any liability arising under Employees Compensation Act, 1923 for their Security Guards so deployed. The details of PF & EDLI, ESI, Personal Accident Policy, Service tax have to be submitted as per following Annexure enclosed.

Annexure II (a) : PF & EDLI Annexure II (b) : Personal Accident Insurance (where there is no ESI facility) Annexure II (c) : Details of ESI Remittance Annexure II (d) : Service tax 13. The Company shall permit the agency and his Security Personnel to use the

telephone, first-aid kit, fire fighting equipment and any other equipment required for the purpose.

14. The Agency shall pay wages to their security Guards deployed under this

contract at the rate not less than the minimum wages fixed including washing allowance by GOK for civil guards & as per DGR rates, Ministry of Defence, GOI for Ex-Servicemen and as modified by GOK /DGR, Ministry of Defence, GOI from time to time. Any increase in the Minimum wages payable to the Security Guards, effective by the Govt. of Karnataka / DGR, Ministry of Defence, GOI after the issue of LOA and during the currency of the contract would be paid to the agency by the Corporation along with the proportionate increase in PF & Service Tax only. If the Government of Karnataka / DGR, Ministry of defence, GOI reduces the Minimum wages payable to the Security Guards the recovery will be effective accordingly, on proportionate basis along with corresponding reduction in PF & Service tax only. In both these cases the Tender premium will also be considered for arriving at the derived rate. The benefit of increase in Minimum wages shall be passed on to the Security guards by the Security Agency including arrears if any and this should be paid through crossed cheque / RTGS only ( The details of cheque No / RTGS arrears paid to each Security Guards, etc. are to be furnished after receipt of arrears by the Security Agency ).

The agency shall further agree that he would affect timely payment of wages to his employees along with monthly washing allowance fixed by GOK without unauthorised deductions, shall also be responsible and fulfil all statutory obligations under the statutory provisions such as ESI/PF etc., in respect of his Security Personnel posted under this contract. The detail of wages paid to their security personnel has to be furnished as per Annexure-I enclosed every month.

15. The rates agreed to is for the complete work and inclusive of all labour,

materials, equipment, transport and accommodation of the guards etc. 16. The agency shall submit within seven days from the date of agreement,

details of personnel employed and any other details necessary for carrying out the security satisfactorily. In addition, the agency shall furnish the details of men posted daily for the different works entrusted to them and actually engage such person and complete the work satisfactorily. The agency shall also maintain proper records and present to the concerned officers whenever called for.

17. Whenever the agency fails to comply with the instructions of Chief Vigilance

officer/Chief Security Officer. it shall be lawful for the Chief Engineer (Electrical Construction) / CSO to have the work done through other agencies or departmentally or otherwise and the cost incurred thereto shall be deducted from any amounts due to the agency (i.e. from EMD, Security Deposit, monthly bills payable, arrears if any payable from KPCL subject to a maximum of 7.5% of the contract amount). In addition the agency will be black-listed and their tender will not be entertained in any works of the Corporation in future.

18. The agency shall have educated / qualified supervisors to ensure that the

works are done in accordance with the provisions agreed to. If any guard or any other person employed by the agency is considered undesirable by CSO, it shall be the responsibility of the agency to remove the said person or persons from the work. Such persons cannot be re-employed by the Agency on any works of the Company, without the specific permission of CSO.

19 The agency shall depute supervisor having experience of approximate 5

years in the field of supervision to deploy their staff in the respective shifts to the assigned posts and will supervise the staff both during day and more during night shifts and will submit daily occurrence report to the duty officer/supervisor in security control room for taking routine instructions and also to provide relief / replacement to their staff in case of leave, sickness and absence, etc.

20 The agency shall not assign or sub-let the contract without the written

permission of CSO and if the agency assigns or sub-let the contract, or attempts to do so, the company may there upon, by notice in writing, rescind the contract and the security deposit shall there upon stand forfeited. In addition, the agency shall not be entitled to recover or be paid for any work actually performed under the contract. Payment of month salary of the said supervisor is also the responsibility of the agency.

21 In case of ambiguity or any doubts, clarifications should be sought, in writing,

before continuing the work, failing which the decision of CSO in all such matters shall be final and binding on the Contractor.

22. The company shall not be held responsible or called upon to make good any

losses/costs incurred by agency, on account of factors beyond their control such as rain, earthquake, lightening, other natural phenomena, legal implications, etc., or for any reason whatsoever.

23. The Schedule of work is liable to alteration by way of deletions or additions at

the discretion of the company.

24. The CSO or by his authorised Officers of the Company shall have the power, from time to time, in the supervision of the security services, to issue notice in writing and to instruct/direct the agency to make improvements in the security services. The difference in cost of such variation shall be added to or deducted from the contract amount as the case may be in accordance with the schedule of rates applicable and shall be binding on the agency.

25. The agency shall comply with all relevant acts, rules by-laws, regulations and

all other statutory requirements of local or other authorities, having jurisdiction over the areas and shall be responsible for the payment of all fees and other charges and giving and receiving of all necessary notices and keep the CSO informed of the said compliance with such acts, rules, bye-laws, regulations, statutory requirements, payments made, notice issued and received.

26. The agency shall obey all relevant central, local and state regulations and

enactments pertaining to contract workmen and labour and the CSO shall have the right to inquire into and decide all complaints on such matters.

27. All compensations or other sums of money payable by the agency to the

company under the terms of this contract may be deducted from his security deposit or from any sums that may be due, or may become due to the agency by the company on any account whatsoever and in the event of security deposit being reduced by reason of any such deduction, the agency shall, within 10 days thereafter make good the shortfall in the security deposit referred to above.

28 If the agency fails to carry out the assigned contract satisfactorily during the

currency of the Contract, the company shall have the power to enter upon and take possession of the security services and to engage any other person, firm or agency to complete the contract.

Any extra cost incurred by the company due to such failure on the part of the agency shall be recovered from any amount due to the contractor { i.e. from EMD, SD, Monthly bills payable, arrears if any payable by KPCL subject to a maximum of 7.5%(seven & half percent) of the contract amount}.

29. The agency shall keep all persons under his control and within the boundaries

of the various places in project area of KPCL / Offices of KPCL and he will be held responsible for the acts on all the works until their completion with all risks arising from carelessness, negligence or operative damage or loss by thefts, etc.

30. The agency shall remain liable for the payment of all wages or other money due to his employees or labourers under the Payment of Wages Act 1936, Employees Compensation Act 1923. The Minimum Wages payable to Security personnel deployed shall not be less than minimum fixed by the Govt. of Karnataka for Security Guards from time to time along with washing allowance prescribed by GOK from time to time or any other enactments and rules made applicable from time to time. If the agency fails to do so, the failure will be a breach of the contract and the CSO at his discretion can cancel the contract. The agency shall also be liable for any pecuniary liability arising on account of any violation of the provisions of the relevant laws by him.

31. a) Penalty of two hours wage cut will be effected to the Security staff if they are

missing from work-spot/area of work. Similarly 4 hours wages cut will be effected if found sleeping on the duty posts and full day’s wage cut will be

effected if the security staff found absent for more than 4 hours from their duty posts. The hourly charges shall be worked out on pro-rata basis on the gross wages payable to the agency.

b) Payment to the Security Guards deployed by the agency shall be made by

way of A/c payee cheque / RTGS to each guard engaged for KPCL and produce the information relating thereto in the prescribed proforma shown in Annexure-1 every monthly without fail.

c) If the agency does not deploy Security staff for one shift in a day during the

period of contract, then the penalty of two shift wages will be effected per Guard. The shift wages / charges shall be worked out on pro-rata basis on the gross wages payable to the Agency (this clause will be applicable if the agency does not inform in writing regarding non-deployment of Security personnel well in advance about the absent). However, penalty will be imposed as per Sl.No.67 of the Agreement.

32. The agency should ensure that one of their representatives/supervisors is available at all the office Complexes/ Project Areas, so that they can be contacted in case of need at any time especially in night shift, they should be in touch with Duty Security Officer during I/II shift to take the briefing for the day. The Security staff should be provided with proper set of uniforms with monogram of the agency. The staff should have good personality as stipulated in the brochure and should be presentable and pleasant in their manners. They should be able to identify the important officers of the Company and should give proper respect to them. The age of Security Guard posted by the Agency shall not exceed 60 years for Civil Guards & 65 years for Ex-Servicemen [ESM] subject to the condition that a medical certificate issued by the competent medical officer that security guard so employed is physically and mentally fit and to the satisfaction of the Chief Engineer (Electrical Construction) / Chief security officer of the project

33 The agency as well as its supervisors should also have general information

about the activities of the Company, Trade Unions and their leaders and other social/cultural organisations, so that it will be useful for the agency / supervisors to brief the security staff, so that they perform their duties effectively. The security staff be properly briefed by their supervisors, and also periodically checking if need be, occasional visits by the Senior Officers of the Agency/Company could be conducted for effective functioning.

34. The antecedents of the staff engaged by the agency for deployment in KPCL Offices, as well as in any Project Complexes should be verified as per the tender stipulations and only suitable persons with clean record should be deployed. The agency shall be responsible for the good conduct of his staff while on duty as well as off duty in Company premises and the staff shall present themselves as responsible persons at all times. The staff also should not be found developing familiarity with the employees of various Departments in the Project Complexes/Offices. The details of Ex-servicemen / Civil Security Guards / Training Certificate / Photo Identity Card / C & A certificate is to be furnished in the prescribed proforma (Annexure enclosed) furnished below:

Character & Antecedent Certificate : As per Annexure- VII Issued by Police authority 35. (a) Physical Standards and other Requirement of Ex-Servicemen

/ Civil Security Guards: Ex-Servicemen / Private civil Security Guards proposed to be deployed should have the following minimum physical fitness standards.

a) Height : 160 Cm. b) Weight : According to standard table of height & Weight c) Chest : 80 Cm. d) They should be well built, physically fit, should have good mental health

and should be mentally alert. e) Chest should be well developed having 4 cm expansion. f) Should have normal hearing and speech, free from defects, should be able

to hear and respond to the spoken voice and the alarms generated by the Security equipment.

g) Eye Sight : > Far sight vision 6/6 with or without correction. > Near vision 0.6/0.6 with or without correction

> Free from colour blindness and should be able to Identity and distinguish colour display in security

Equipment’s read and understands display in English Alphabets and Arabic numerals. h) The candidate should be free from any contagious or Infectious disease,

which is likely to render him unfit for service or endanger the health of public like deformity of bones, Hydrocele, Varicocele or piles, Myopia, night blindness, Anaemia, Asthma, TB and other such diseases.

i) Security personnel deployed shall be well built, physically fit and mentally

alert. It must be ensured that Ex-Servicemen / Civil Security Guards are not alcoholic or habitual drunkard and shall be of sound mind.

j) Free from knock knee and flat foot and should be able to run one Km in six minutes.

k) The candidate should have dexterity and strength to perform searches, handle objects and use force for restraining the individuals in case of need.

l) Ex-Servicemen / Civil Security Guards proposed to be deployed are to be medically checked by the KPCL Medical Officer nominated by the CSO. The certificate to this effect has to be obtained from the concerned Medical Officer for all the Ex-Servicemen / Private Security Guards proposed to be deployed (Medically checked once in every twelve months).

36. (b) Security Training: All the Ex-Servicemen / Private civil Security Guards shall have to successfully undergo the training prescribed by GOK Gazette Notification No. 698 Dt. 11.8.09 or as modified from time to time by GOK and furnish the training certificate (as per Annexure-V enclosed) of all the Ex-Servicemen / Civil Security Guards before deploying.

(c) The subjects for Security Training as per GOK Notification No. GOK Gazette Notification No. 698 Dt. 11.8.09 is furnished below.

i) Conduct in public and correct wearing of uniform ii) Physical fitness training iii) Physical security, Security of the Assets, security of the building

or apartment personnel security, household security.

iv) Fire Fighting v) Crowd Control vi) Examining, identification of papers, including identity card,

Passports and smart cards. vii) Ability to read and understand English alphabets and Arabic numerals

as normally encountered in the identification of documents, arms licence, travel documents and security inspection sheet.

viii) Identification of improvised explosive devices ix) First Aid x) Crisis response & Disaster management

xi) Defensive driving ( compulsory for the driver of Armed vehicles and optional for others )

xii) Handling and operation of non-prohibited weapons and fire arms (optional) xiii) Rudimentary knowledge of Indian Penal code, right to private

Defence, procedure for lodging first information report in the Police Station, arms Act (only operative Section) Explosive Act (Operative Sections)

36. The agency should submit the copy of the valid license issued by the Designated Office of the GOK.

37. The agency has to submit a copy of the valid character and antecedent’s report

of all the Ex-Servicemen / Private civil Security Guards issued by the Police authority as per GOK Gazette Notification. No.698 Dt. 11.8.09 within 90 days from the date of Issue of letter of Award (Validity of the above certificate is 3 years from the date of issue).

38. The copy of Form II in respect of particulars of all Ex-Servicemen / Private civil

Security Guards (as per the format indicated in the GOK Gazette Notification. No.698 Dt. 11.8.09) must be submitted to the CSO within 15 days from the date of issue of Letter of Award (Form II means Form for verification of character and antecedents of Security Guards, inclusive of passport size photo) at the cost of the Security Agency. Particulars of all Ex-Servicemen / Private civil Security Guards are to be furnished as per Annexure IV enclosed & C/A certificate as per annexure- VII enclosed.

39. UNIFORMS:

i) a) Uniforms including shoes, cap, badges, Belts, Batons, torch & Battery, Ceremonial dress etc., shall be provided to the Security Guards by the Security Agency at the cost of Security Agency. In this regard the Agency has to quote the rates for each Civil Security Guards proposed to be deployed, which is onetime payment to the Security Agency. This amount will be paid to the Security Agency after executing the agreement with KPCL against furnishing Bank guarantee, equivalent to this amount. The Bank guarantee should be valid for a minimum period of two year and the validity of this Bank Guarantee should be got extended in case of extension of tenure of contract.

b) The quoted rate for providing the items indicated above will be paid to the

Agency after executing the agreement with KPCL against the Bank

Guarantee to the said quoted amount (for Sl.No.2 of Financial bid / Price bid) as per the proforma enclosed (Annexure-VIII). The Bank guarantee should be valid for a minimum period of two year & the validity of this Bank guarantee should be got extended in case of extension of tenure of contract.

c) If any Civil Security Guards leaves the service or removed from service unfit

to perform the duties diligently, under such circumstances the payment under Sl.No.2 of Financial bid / Price bid will not be paid to the new security guards ( i.e. cost of providing uniform, boots, socks etc.) to the new security guards). However, in case the number of Guards (Civil) has been increased more than that specified in the tender notification during the tenure of the contract, the payment will be made as per the rates quoted for Sl. No (2) of Financial bid / Price bid to the extent of number of Security Guards so increased. This amount is only paid at the end of tenure of contract.

ii) Private Security Agency shall issue and make it obligatory for the Ex- Servicemen /Civil Security Guards to wear the following.

a) An arm badge distinguishing the agency b) Shoulder or chest badge to indicate his position in the Organisation. c) Whistle attached to the whistle cord to be kept in the left pocket d) Shoes with eyelet and laces e) A head gear which may also carry the distinguishing mark of the Agency.

iii) Washing allowance of Rs.250) per month should be paid to all Security Guards

(for Civil guards only) deployed and as modified by GOK from time to time. iv) The agency has to issue the following to each Security Guard at the Cost of agency.

a) One pair Boots and two pair socks every year b) Muffler and Sweater for every two years for night time working Guard c) Two pair of Uniform, Belt and cap for every two years. d) Battery and torch for Night Guards.

v) The Uniform worn by the Ex-Servicemen / Civil Security Guards should not have

been any resemblance to the Uniform or clothes worn by the Armed Forces of the Union, Police and Para-military, CISF, KPCL etc.

vi) Every Ex-Servicemen/Civil Security Guards shall carry a note book and writing

instrument with him. vii) Every Ex-Servicemen/Civil Security Guards while on duty shall wear and display

photo identity card issued (as per the proforma indicated in the GOK Gazette Notification No.698 Dt. 11.8.09) on the outer most garment above waist on his person in a conspicuous manner. The photo identity card issued to their Security Guards should be as per the format indicated in Annexure-VI enclosed.

40. Issue of photo identity Card to the Ex-Servicemen / Civil Security Guards i) The agency has to issue photo identity Card as per the format indicated in

Annexure-VI enclosed to the Ex-Servicemen / Civil Security Guards proposed to be deployed for Bangalore based Offices / KPCL project areas as

per the format indicated in the GOK Gazette Notification No.698 Dt. 11.8.09 (as

per Form IX) at his own cost and should be ensured that they wear the photo Identity Card during their duty hours.

ii) The photo Identity Card shall indicate a full face image in colour, full name of the

Ex-Servicemen / Civil Security Guards, Name of the agency and the Identification number of the individual to whom the photo identity card is issued.

iii) The photo Identity Card shall clearly indicate the Individual’s position in the

agency and the date up to which the photo identity card is valid (validity of photo Identity card should not be beyond the date of validity of character and antecedents verification report issued by the jurisdictional Police authority).

iv) The photo Identity Card shall be maintained up to date and any change in the particulars shall be entered therein and separate photo identity card shall be issued to this effect.

v) Any loss or theft of photo Identity card held by Ex-Servicemen / Civil Security

Guards shall be immediately brought the notice of CSO and separate Identity card should be issued immediately.

41. REPLACEMENT/ CHANGING OF SECURITY PERSONNEL:

Security Agency will provide replacement for the person, in event of his sickness absence or availing leave, National holidays, Weekly off and this provision is provided in the scope of contract.

Before changing the Security Guard the Agency has to get the permission of CSO & furnish C/A report from the Police Authority, particulars of new Security Guards, Medical certificate etc., as per tender stipulation, in respect of the proposed new Security Guards.

42. LOSS/LIABILITY:

In case of a proven theft, the agency will depute its Investigators at its cost to conduct inquiry and will submit the report accordingly and similarly investigation will be initiated from the Company & if required the matter will be reported to Police and other Authorities. If it is proved that the theft is directly due to negligence of the Security staff, the cost of the loss to the Company will be recovered from the agency.

43. DURATION AND TERMINATION OF CONTRACT:

Engagement of the Security Agency is for a minimum period of TWO years, which may be extended at the discretion of the CSO. However, the contract can be terminated by the Company on one month’s notice to the agency.

44. PREMATURE TERMINATION OF THE CONTRACT:

If the services of the employee deployed by the agency for security services in KPCL found not satisfactory and if any one of the conditions of the contract agreement is violated, the CVO / CSO reserves the right to terminate the contract prematurely without assigning any reason thereof.

45. EXTENT OF SECURITY SERVICE:

The agency will provide Security cover at the various places of Project area/ Offices of KPCL all days including general holidays, public holidays in the places required as specified in the tender Notification. The agency shall arrange to ensure and safeguard the place, premises, goods and materials and any other

properties in and around the premises of all the Project Complexes of the Company by posting staff in such a manner and at such points and patrol the required area at all times, check cars, lorries and other vehicles and articles and making entries in all registers of all entries and exits of personnel by personnel search of employees as may be considered necessary by the Company. Necessary accessories required by the security guards, like Baton, torches, rain coats, uniforms and other articles / accessories required from security angle shall be supplied by the agency at his cost. The security guards so posted shall be provided with 1 set of uniforms along with other requirement which goes with uniforms. Worn out, untidy and un-presentable uniforms shall be replaced forthwith.

A performance register shall be maintained by the contractor at all essential spots and shall be produced to the Security Officer of the Company and obtain the signature with remarks if any which shall be duly accepted by the agency and corrective measures taken to set right the lacuna/short comings. The supervisor shall take regular rounds to ensure proper security and especially so, during the night shifts.

46. PERIOD OF CONTRACT:

The Contract shall be in force for a period of Two years from the date of issue of Letter of Award to the successful agency. The numbers of Security Guards and Security supervisor can be Increased / Decreased at the discretion of CSO at any point of time during the period of contract. The rate payable/deducted on such increase/decrease shall be at the same rate as per the contract. It is Mandatory on the part of security agency to either to increase / decrease immediately the numbers of security guards/supervisors as and when directed.

47. MINIMUM WAGES PAYABLE:

Minimum wages payable to security personnel employed are as given below:

“ The wages paid by the Agency to the Ex-Servicemen / Civil Security Guards deployed on Private Security should not be less than the minimum wages fixed by the Government of Karnataka / DGR, Ministry of Defence, GOI from time to time”. Minimum wages act 1948 & Karnataka Minimum wages Rules 1958 should be followed by the successful agency. The agency shall arrange to deposit the contribution towards the PF & ESI (both employees and employers) to the Authorities concerned at the notified rates promptly. The Agency shall cover the security personnel under personal risk Insurance Scheme if the areas covered under the contract are non- implemented area under ESI Act. The copy of the Policy should be produced, as a proof for having insured. The deductions towards ESI and PF shall be at the rate as prescribed by the Government from time to time. The above details are to be furnished in the prescribed format indicated in the Annexure enclosed.

48. SECURITY DEPOSIT/PERFORMANCE SECURITY:

The agency shall deposit an amount 7.5% of contract amount (including EMD) as security deposit/performance security in the form of Bank Guarantee/Fixed Deposit receipt at the time of entering into agreement or opt for recovery of

balance deducting EMD shall be recoverable from their Service Bills proportionately. The same shall be refunded to the agency after successful completion of the contract.

49. TIMELY PAYMENT OF WAGES AND OVERTIME:

The wages payable by the Agency to the Civil Security / Ex-Servicemen

Guards deployed on Private Security should not be less than the Minimum Wages fixed by the Government of Karnataka for Security Guards (Civil)/ DGR, Ministry of Defence, GOI (ESM) without any unauthorised deductions & shall grant Weekly off, fix proper working hours and shall make payment of overtime at the cost of agency. A guard must be engaged for only single duty in a day. The details of wages paid to their Security Guards are to be furnished as per Annexure-I enclosed.

50. The Company agrees to make payment to the Agency against monthly

service bill within 15 days from the date of submission of bill by the agency. 51. In case any dispute or difference arises between the Company or its

representative and the agency on any matter within the scope of this contract, then either party shall forthwith give to the other side written notice of such dispute or difference and such dispute or difference shall be referred to the CSO whose decision will be final.

52. To prevent disputes and litigations, it shall be accepted as an inseparable part

of this contract that in matters regarding work, interpretation of contract, mode of procedure and carrying out the work, the decision of CSO shall be final and binding on the agency.

53. The Company reserves the right to extend or short close the contract

depending upon the satisfactory security services or otherwise by the agency, as the case may be, and the agency shall carry out services on the same terms and conditions of the contract during the extended period in the event of any extension given.

54. If any loss or damages caused to the Company by non-compliance of the

obligations under this agreement by the agency, the agency is liable to make good such losses and the Company shall be entitled to recover the same from the agency.

55. The guards provided should have good knowledge of the local language both

for conversation as well as for writing/reporting purpose. 56. The agency will meet the Chief Vigilance Officer/Chief Security officer once a

month and obtain instructions/short comings of their performance. 57. The agency will keep point books at strategic/sensitive points and various

places in Project area / Offices of KPCL in consultation with Chief Security officer and feedback will be given to him.

58. The agency if required shall visit the Project area before submitting the

tender. 59. The agency shall take immediate action to replace any person deployed for

the work, If found not suitable / desirable.

60. The Duty hours for the shifts shall be as follows:

i) Morning Shift : 6 AM to 2 PM ii) Evening Shift : 2 PM to 10 PM iii) Night Shift : 10 PM to 6 AM 61. The Security services will have to be rendered round the clock and on all

days.

62. All the Ex-Servicemen / Civil Security Guards should be produced before the CSO Officer along with the following documents / particulars for their inspection and verification of documents. (In case of award of work to the Agency).

a) The Ex-Servicemen / Civil Security Guards should not be more than 65 years of age/60 years of age subject to the condition that a medical certificate issued by the competent medical officer that security guard so employed is physically and mentally fit and to the satisfaction of the Chief security officer.

b) The Ex-Servicemen / Civil Security Guards should be physically fit.

c) Recent Police verification report regarding the antecedents of Ex-Servicemen / Private civil Security Guards.

d) Copy of the valid license issued by the Controlling Authority, GOK, as per tender stipulations.

e) Medical Certificate issued by the jurisdictional KPCL Medical Officer / Medical Officer nominated by the CVO in respect of all Security personnel proposed to be deployed.

63. The Security Agency has to obtain license under Sec. 12 of Contract Labour (Regulation & Abolition ) Act 1970 from the authority notified for the purpose immediately on executing the agreement for the services and produce it for the verification of CSO or Officer nominated by CSO before commencing the work. For this purpose, CSO or Officer nominated by CSO will give a certificate to the Agency in Form V under Rule 21 of CL (R A) (Kar) Rules.

64. Agency has to produce the latest Income tax clearance certificate before the execution of contract, as per the terms and conditions of the tender / agreement.

65. Payment Procedure and Paying authority

The paying authority for this contract shall be Assistant General Manager (Finance) Ganeshgudi, KPCL, Uttara Kannada district, Karnataka.

On the first day of every month, the agency should prepare the service bills, of

providing security services of Ex-servicemen/Civil security guards for GDPH, Hidkal, Belguam Dist., along with the details as per the Annexures - I, II (a) (b) (d) regarding monthly wages paid to each guard, PF and EDLI particulars, personnel accident Policy, Service tax remittance etc., and submit the same to the. The bills will be checked by Assistant Security Officer, GDPH and submit the same to Executive Engineer(GDPH) for counter signature. After counter signature of the bills along with Annexures and connected documents as per the criteria indicated in the above tender/agreement, the same will be sent to Assistant General Manager (Finance) Ganeshgudi, by the above designated officer before 6th of every month for payment. A copy of the above document may please be made available to the concerned officers.

The present prevailing rate of service tax is 12.36%. Actual Service tax at the time of invoicing as notified by Government of India will be applicable after the issue of work order and during the currency of the contract.

66. The agency shall also be responsible and fulfil all the statutory obligations

under the statutory provisions such as ESI / PF etc. in respect of his Security Guards posted under this contract. If the places mentioned in the tender (KPCL Offices / Project area) comes under non- implemented area under ESI, in such cases the Agency has to obtain Personal Accident Policy for `.1

lakh for their Security Guards so deployed. Furnish the copy of the Policy along with other details as indicated in Annexure II (b).

67. If the agency fails to deploy the full contingent of Security personnel as per the contract stipulations, within the 15 days from the date of receipt of LOA/Work Order, penalty @ `.100/-(Rupees One hundred) per day will be levied per guard not deployed during first 30 days, thereafter the penalty will be levied at `.150/-(Rupees One hundred and fifty) per day per Guard. If the agency does

not deploy the full contingent within 90 days, EMD will be forfeited and the contract will be terminated without any further notice after 90 days.

68. The Security Agency has to implement the guidelines / instructions issued by the Controlling Authority, GOK, to the Private Security Agencies from time to time.

69. The Agency shall pay Gross minimum wages to their security Guards deployed under this contract at the rate not less than the minimum wages fixed including washing allowance by GOK for civil guards & as per DGR rates, Ministry of Defence, GOI for Ex-Servicemen and as modified by GOK / DGR, Ministry of Defence, GOI from time to time

70. The turnout of the agencies security personnel should be good and KPCL shall reserve the right to carry out the inspection by way of parade to assess the alertness and commitment and discipline of the personnel before being engaged on KCPL duty. The MD, KPCL, Jurisdictional CSO, CVO and an officer nominated by MD shall have the right to examine any security guards deployed in KPCL in respect of their commitment, physical and mental health and performance of his duties any time without advance notice. They also have the right to discontinue the services of such Security guards employed by the agency, if they are not found fit to perform their duties diligently.

71. The successful agency has to strictly adhere to Minimum wages Act 1948 & Karnataka Minimum wages Rules 1958 and DGR, Ministry of Defence, GOI and maintain the following register / books i.e. as per “The contract labour(Regulation & Abolition) Central Rules 1971

72. Workmen Compensation:

The agency shall pay compensation to workmen working under them for any death or injury caused during the execution of work as per “Employees Compensation Act” in force, failing which the amount will be deducted from their bills and paid to the injured workman or the family as the case may be. Contractor is solely responsible for any sort of compensation payable to the security guards working under him during any untoward incidents/accidents/death while on duty/while travelling to the work sites. The Karnataka Power Corporation limited will not be responsible for any of the unauthorized acts and/or liable for any damage/injury sustained by security guards or other employees of the security agency in the course of their work /duty or during travel in and around the office and plant premises. All the medical expenditures must be paid by the agency only. The Karnataka Power Corporation Limited (company) shall not be held responsible or called upon to make good any losses/costs incurred by agency, on account of factors beyond their control such as rain, earthquake, lightening, and other natural phenomena, legal implications, etc., or for any reason whatsoever. Under the contract the contractor/agency shall be totally responsible for all loss/damage to the Ex-servicemen/Civil Security guards. The personnel Accidental policy shall cover the contactor against claims for injury, disability, deceases or death of his employees (also refer Sl. No. 11 & 12).

73. The Agency should make their own arrangements for providing

accommodation to their security guards. However, at the project locations, based on the availability of Quarters, KPCL will allot Quarters to the Agency at its request and rent there on will be charged as per the KPCL rules in force. But KPCL has no binding/obligation for providing quarters to the Agency, for the accommodation of Guards.
