Kaiser San Diego and CSC Ratify New Two Year Agreement T he National Agreement reached in late May and recommended by the National Delegate’s Conference in mid June has been ratified by Local 30 mem- bers in a unanimous vote. The packages voted on by members in both the KP San Diego and California Service Center (CSC) units included local contract exten- sions for two years as well as the terms of the new National Agreement. Voting took place June 29th for CSC and July 1st for Kaiser San Diego. The contract includes 3% across the board wage increases for each of the two years of the agreement, funding for the educational funds, PSP, and the LMP, and language changes to enhance and strengthen accountability, continue to build high performing Unit Based Teams, and further support the work of Partnership. This agreement also pro- tects all health care and pension benefits throughout this contract with no reduc- tions in any benefits for Local 30 mem- bers. The parties have agreed to meet and discuss ways to reduce benefit costs going forward in order to prepare for 2012 bargaining. “Our members at KP and the CSC were very clear about their priority for this round of negotiations with their employer; please protect our benefits above all else,” stated Local 30 Executive Director Walter Allen. “I am pleased to report that we did just that, and managed to get pay raises as well. These are difficult times for everyone and KP is in the same boat as their competitors. But while other employers are cutting ben- efits, shifting costs to employees, and lim- iting wage increases if not reducing wages, KP continues to lead the way and live up to the promises of Partnership. I am very pleased with this outcome and now we know our members are too.” Included in the terms of the settlement was an agreement to include any local bargain- ing issues which would be economic in nature. Between the National bargaining for the KP and CSC units, the USC and City of Hope bargaining, the contracts being negotiated in Arizona, and the International Union convention, our officers and staff have been at it day and night. I would like to recognize them all for their dedication and commitment to all of our causes and to our members’ needs. You will read more about the progress of these negotiations in the Executive Director’s Report in this edition but I would like to mention that, once again, Local 30 members at KP and CSC have done very well at the bargaining table. As a member of the Common Issues Committee (CIC), the committee of leaders at the bargaining table in National Bargaining, I was once again proud of Local 30 for the leadership role our Union played in these talks. The National Agreement reached inlate May and recommended by the

National Delegate’s Conference in midJune has been ratified by Local 30 mem-bers in a unanimous vote. Finally, summer!These past few

of the Coalition ofKaiser PermanenteUnions (CKPU), tolddelegates that OPEIUis an extremely influ-ential union. “OPEIUdefinitely impacts thelabor movement, wellbeyond its size,” saidAugust. “Your influ-

ence in the labor movement is known every-

where, and you have greatly influenced mylife and everyone that I work with, so thankyou for your dedication.”

August then spoke about the Kaiser model, avery different model of health care deliveryin the United States. “What separates it fromother models is its working relationship withmember unions through the CKPU,” saidAugust. OPEIU is a founding member ofCKPU and represents Kaiser employees inLocal Unions 2,17,29,30 and the new affili-ate, HNA/OPEIU Local 50. “The union rolein health care is to be part of the solution, not

part of the problem,” said August. “It’s timefor us to lead a new labor-managementapproach. Unionized workers, and no oneelse, will lead the implementation of healthcare reform. We provide a beacon of hope toall because we know you cannot have thebest health care in the world without the bestworkers in the world.”

It’s Time For Us To Lead, Says August

The OPEIU International UnionConvention was held June 21st thru

25th in Washington, DC to conduct the busi-ness of the union. The every three year eventincludes delegates from all the local unionsof the International union including ofcourse our own Local 30. The work of theconvention included the passing of constitu-tional amendments, resolutions, and state-ments and policies that will govern the union in the coming three years. In addi-tion, election of officers were held for the President, Secretary-Treasurer, andInternational Vice Presidents from the vari-ous regions of the country.

President Mike Goodwin was re-elected toanother three year term as President andMary Mahoney was re-elected as Secretary-Treasurer. And, Walter Allen was re-electedto serve as Vice President from Region Valong with Local 29 President and BusinessManager Tamara Rubyn from the Bay Area.Re-elected as Diversity Vice President wasChristine Paige for Local 174 in Los Angeles.

Local 30 congratulates the officers ofOPEIU and appreciates the ongoing effort ofthe International Union to support our localsand provide for our members.

OPEIU Holds Triennial Convention

from across the country were assembled tobe a part of these historic negotiations.

As before, Walter Allen led bargaining forLocal 30 along with Vice President CathyYoung and I. After many very long sessionsand much discussion, a deal was reached. Thehigh point of this contract was clearly no ben-efit changes, especially no reductions. I wantto thank Walter for standing by us as we resis-ted any effort to roll back the clock on us, andfor making sure that at the end of the processwe also received wage increases that will helpus to take care of our families in the years ofthis agreement.

Our International Union convention washeld in late June in Washington, DC. Thebusiness of the convention included resolu-tions and statements about organizing, polit-ical action, jobs, wage and benefit protec-tions, and many more issues of importanceto all union members. We heard from greatspeakers such as Clayola Brown of the A.Phillip Randolph Institute, Stephanie Millerof the ‘Stephanie Miller Show’ on satelliteradio, Arturo Rodriguez, President of theUnited Farm Workers Union, and JohnAugust of the Coalition of KaiserPermanente Unions to name a few.

One of the most important events of the con-vention was certainly the election of officersand I am happy to report that President MikeGoodwin was re-elected without opposition.Mike has always been a great friend of Local30 and we are pleased that he will continue tolead our International Union for the nextthree years. I am also very pleased toannounce that our own Walter Allen was re-elected to his position of International VicePresident for Region V. Walter has been ourRegional VP for OPEIU since 2002 and willalso continue in that role for the next threeyears. Congratulations to Walter and to Mike.

There is always more to do, but for now atleast, I hope our team will enjoy the successwe have had this year, rest up, and be readyfor the next challenge. Enjoy your summer.

On Saturday, May 29, 2010 over 30thousand people of all races and from

all over the United States came to Phoenixto rally opposing the SB 1070 bill. SarahiUribe who is a representative of theNational Day Laborer OrganizingNetwork, which is based in California,helped organize the event. There was aMedicine Man from the North DakotaIndian Tribe who stated, “Today the eaglesaid it is a good day to protest.” There wasan Indian Ceremonial Dance to bless thepeople who were at the rally.

Richard Trumka from the AFL-CIO spokeabout the climate of fear Arizona’s immi-gration enforcement has created and thatthe immigrants are not the cause ofAmerica’s problems. I met people from alldifferent Unions from all over the UnitedStates such as Teamsters, Pipe Fitters,IBEW, CWA and Carpenters. I also proud-ly wore my Union Colors and thanked myUnion brothers and sisters for coming toPhoenix for this cause.

This law is not good for anyone. It discrim-inates against all Hispanic people, it hurtsbusinesses, and it does not solve the immi-gration problem in the U.S.

In closing, as the Reverend Warren Stewartof the First Institutional Baptist Churchdirected his comments to President Obamawhen he said, “God put you in the WhiteHouse. You are a person of color. Standwith us.”

Phoenix Rally Opposingthe SB 1070 Bill

Linda WintersWhen the supervisory employees at

Veolia Transportation Company inTempe, Arizona decided to join a Union,they chose OPEIU. Local 30 Business AgentMark Bailey received the call and immedi-ately followed up. Their issues included theusual; wages, benefits, and hours of work,but the most important concerns the grouphad were around job duties, safety, andrespect on the job.

After several meetings with the workers Local30 filed a petition with the NLRB, an agree-ment was reached, and the election was sched-uled. On April 4, 2010 the election was heldand when the ballots were counted OPEIU,Local 30 had won the unit overwhelmingly.

“These workers provide support and someoversight for the bus drivers in the Tempeunit,” reported Bailey, “Until now, they werethe only workers who were not unionizedand as a result are paid less, have fewer ben-efits, and faced numerous issues with theirmanagers with no right to contest any deci-sions made.”

“We had a united vote that made the compa-ny take notice,” said bargaining unit memberVernon VanPatten. “Nothing is impossiblewhen you are persistent,” stated committeemember Evelyn Brown.

Members of the Bargaining Committee areFranklyn Robertson, Vernon VanPatten,Perren Roberts and Markus Hines. OtherCommittee Members are Evelyn Brown andRobert Bean to name a few.

“We are delighted that these employees havechosen Local 30 to help them improve theirsituation and look forward to having thembe part of our union,” said ExecutiveDirector Walter Allen.

The process of collective bargaining is nowunderway and the parties are at the table dis-cussing the terms of a first agreement.

Linda Long Retiring

On April 17, 2010 at IBEW Local Union266’s Annual Picnic, Office Manager

Linda Long was honored for her thirty (30)years of service to Local 266. Linda was hiredon January 21, 1980 as an AdministrativeAssistant and became Office Manager onMay 1, 1998. Linda’s last day was April 29,2010 and will be available for end of fiscalyear assistance and training as well as trainingon the Labor Management Report, L/M 2.

As an OPEIU Local 56 member, Linda heldnumerous officer positions and served Local56 without pay for over 18 years negotiatingnumerous contracts and assisting members.After the merger of Local 56 with Local 30she continued to serve as a steward.

As Linda told the officers, members andstewards at the IBEW Local 266 picnic;“Serving the members and stewards hastaught me a lot about unions and their many,many benefits and I have enjoyed assistingand working with you all.” She further stat-ed “With union wages, paid healthcare, apension and a 401(k) plan, you can not beata union job.”

For those with an existing plan, the consultation can be used as a time to review your existing planto see if it is up to date. There is no estate tax in 2010 due to the inaction of our federal government,so you may want to review your trust to make sure you have the right language in your funding claus-es in light of this change. In 2010 there is also no step-up in basis as of date of death for assets withmore than a 1.3 million in gain or 3 million for community property of a surviving spouse. Unless therules change in 2011, many beneficiaries will inherit the basis of the decedent and will have to pay acapital gains tax on the sale of the asset. These rules are likely to change in 2011, so it is imperative youstay tuned to what happens in 2010. Further, the consultation can be used to make sure you have prop-erly funded your trust and that your beneficiary designated accounts are in order. If you have acquirednew assets or have set up a new business entity, such as a limited liability company or corporation, thenyou should make sure these assets are properly coordinated with your estate plan as well as proposition13. Maintaining your trust or upgrading from a will to a trust is extremely important as time goes byand changes occur in life.

If a loved one has passed away and they had a trust, it is important to have an attorney review thetrust and give advice on trust administration matters. The consultation can be used for initial trustadministration matters. Also, if you are a beneficiary of a trust and the trustee is not following his orher fiduciary duties, then you should consult with an attorney to see what your rights are.

Finally, if a loved one has passed away and they only had a will, no estate planning or had assetsthat were not titled in the trust, there may be a probate proceeding or some other court proceeding totransfer the assets to the beneficiaries, heirs or trust. Meeting with an attorney early on in this processis critical to avoid unnecessary delays, costs, taxes, litigation and other problems associated with pro-bate.Legal Update Reminder:

This fall we will once again hold our ‘DayAt The Races’ event at Santa Anita RaceTrack in Los Angeles. The date of this year’sevent will be October 23rd. This is a greatevent and always has a good turnout. If youhave never been, this is your chance toattend the races at the track made famous by

Seabiscuit. So make plans now to join yourLocal 30 sisters and brothers as they enjoyanother great day together, and a chance tobe a big winner too. Watch for the flyer forthis event coming soon.

Also coming soon we will be calling onLocal 30 members to help with anotherappeal from our Charity Fund. The UnitedFarm Workers Union (UFW) which Local30 has helped before is in dire need of sup-port from all union members. As you knowthese low wage workers who provide thefood we eat every day work under some ofthe most extreme conditions and for few

benefits. The UFW has been organizingthese workers and providing them withbetter wages and benefits for many years.But the UFW has very little money andalways struggles to take care of their mem-bers. This year Local 30 will bring to ourmembers a plan for support of this greatorganization through a fundraising effort.Watch for the announcement coming soonand please be as generous as you can as weonce again reach out to those workers lessfortunate than us.

Finally, I too would like to add my congrat-ulations to our KP and CSC bargaining com-mittees for their work on the National andlocal agreements just ratified by our mem-bers. Once again we enjoy the benefit ofgreat representation and committed mem-bers. And I wish our bargaining committeesat the City of Hope and the University ofSouthern California, and our Arizona units aspeedy completion, and a great outcome totheir negotiations too.

On the organizing front, I am very pleased toannounce that Local 30 has won an NLRBelection to represent transportation workersin Tempe, Arizona. These supervisory levelemployees working for VeoliaTransportation Company have just begunthe process of bargaining for their first con-tract. Congratulations to Local 30 BusinessAgent Mark Bailey for all his hard work tobring this unit into Local 30.

We continue to settle in to our new SanDiego offices at 6136 Mission Gorge Road,the building that we purchased last January.Our improvement plans continue to move

forward including the new conference spacethat will provide us accommodations formeetings and trainings that used to be heldoff property in rented spaces in the area.Other improvements include refreshing rest-rooms, painting, and general maintenanceand updating of the facilities.

At our International Union convention lastmonth Delegates re-elected our InternationalPresident Mike Goodwin and Secretary-Treasurer Mary Mahoney to new three yearterms. Local 30 congratulates them both andlooks forward to continuing the progress wehave made together.

In addition to the elections the Delegatesapproved a number of resolutions, policy,and constitutional changes. One very signif-icant highlight of the convention was thepresentation of a charter to the HawaiiNurses Association (HNA) making themOPEIU, Local 50. The HNA, already a partof the Coalition of Kaiser PermanenteUnions decided to affiliate with OPEIU to

be a part of an International organizationand the AFL-CIO. Local 30 members wel-come their sisters and brothers of the HNAand look forward to having them be a part ofour OPEIU family.

Lastly, I would like to urge all of our mem-bers to remember our Local 30 ScholarshipFund awards. Once again this year we willpresent 6, $1,250 scholarships to Local 30members and their families as we attempt tohelp them with the high cost of a collegeeducation. All members are eligible and theawards are selected by drawing. There areno tests to take or assays to write. Simply fillout the short application and attach proof ofenrollment in the Fall semester, and you or afamily member will be in the drawing. Donot miss this opportunity to get a little extrahelp with college costs in 2010!

Protecting everythingwe have now and getting a raise were themain goals for this committee.”

2010 Local 30 Scholarship Fund

Purpose:To generate funds to be distributed to Local 30 members and dependents for assistance with the high costs of higher education.

Eligibility:Any member-in-good-standing in OPEIU, Local 30, or members of the Local 30 member’s immediate family including domesticpartner, children, stepchildren, spouse, grandchildren, siblings, or stepsiblings who are accepted to and attending any accredit-ed College or University the next fall.

Process:In July of each year a notification letter, accompanied by an application will be sent by mail to each member in-good-standing inLocal 30. All members of Local 30 are invited to submit an application for each eligible family member by the due date noted onthe notification letter. All applications must be returned to the Local 30 office at the address listed on the notification letter.

Applications will be kept in separate pools by San Diego membership and Los Angeles/Arizona memberships. A lottery style draw-ing will be conducted at the regular membership meetings in October. Two (2) winners will be drawn from the San Diego areapool and one (1) from the Los Angeles/Arizona area pool. Upon completion of the initial drawings, remaining applications will becombined and three (3) additional winners will be drawn. Each award will be in the amount of $1,250 and will be paid directlyto the student to cover school related expenses.

Winners need not be present to win, notice will be sent to all winners, and the information including the list of winners, will alsobe posted in the following edition of the Local 30 Newsletter. The Local 30 Scholarship Committee will report the results at the fol-lowing meeting of the Executive Board.

Rules:1. Each award is a one-time, annual award and may be applied for each year while attending College.

2. All award checks will be drawn on the Local 30 Scholarship Fund and be made payable to the winner of the award.

3. Local 30 reserves the right to settle any disputes, which may arise out of the process through its Scholarship Committee.

4. Applications will be reviewed to assure member-in-good-standing status for the Local 30 member submitting the application.In the event that the member is not in good standing they will be notified and given the opportunity to correct any issues. Proofof attendance/acceptance at an accredited College or University shall be required with applications.

5. Local 30 members may submit as many applications as they have eligible family members. Each applicant shall be entitled toone (1) application each year. Duplicate applications will be eliminated from the drawing.

6. The drawing will be conducted by members of the Scholarship Committee in the presence of the members at the Octobermeeting.

7. The drawing will consist of rank-in-file members of the union being asked to reach into the box of applications and random-ly removing a single application. This process will be repeated six (6) times, one for each award.

8. Winners will be informed by the Scholarship Committee by letter within ten (10) days of the drawing. Arrangements will thenbe made to present the check to the winner and the eligible Local 30 member.

9. All records of the Local 30 Scholarship Fund will be kept in accordance with the US Department of Labor regulations and beincluded in the financial reports of the Chief Financial Officer of the union.

Members are encouraged to apply on behalf of themselves or an eligible family member and return the application to the Local30 office no later than September 30, 2010.
