1. 1 In the event of any jurisdictional or similar dispute between Union and any other

union or bargaining unit which Employer is bound to, Union agrees to cooperate with Employer

and such other union or bargaining unit to expeditiously and efficiently resolve such

jurisdictional or similar dispute. Union will utilize its best efforts to work with Employer and/ or

the other union or bargaining unit to have any such jurisdictional or similar disputes resolved by

the permanent arbitrator(s) specified in Section 6. 6 of this Agreement. In resolving a

jurisdictional dispute, the Arbitrator shall use the following criteria: if the work is within the

scope of any work described in Section 2. 1 b, c, m, n, or o, the work shall be awarded to the

Union; if the work in dispute is within the scope of work described in Section 2. 1 a, d, e, f, g, h,

i, j, k or 1 and the Employer is not signatory to another union at the time of execution of this

Agreement between the Union and the Primary Employer, the work shall be awarded to the

Union; if the work in dispute is within the scope of work described in Section 2. 1 a, d, e, f, g, h,

i, j, k or 1 and the Employer is signed to an agreement with another union at the time of

execution of this Agreement by the Union and the Primary Employer, or work not described in

Section 2. 1 regardless of the signatory status of the Employer, the criteria for the resolution of

such disputes used by the National Labor Relations Board shall apply. If the other union or

bargaining unit does not so agree, Union shall act in good faith to attempt to promptly otherwise

resolve the jurisdictional dispute. If Employer believes that it becomes necessary to have

agreements with unions other than the Union, the Union agrees to cooperate with the Employer

to resolve any jurisdictional disputes regarding Covered Work.

There will be no strikes, work stoppages, picketing,sympathy strikes, siow dowus or other interferences with the wo k because of jurisd'zctionaldisputes betvveen Unions. The assignment of wark will be solely the responsibility of theContractor performitig the work involved; and such work assigrunents v ili be in acco dance withthe Plan for Setttement of Jurisdictional Disputes in the Constiuction Industry (the" Plan") or any

successor Plan.

Section $. 2 Resolution vf 3urisdictional Disputes. In the event of a jurisdictional

dispute, it is agreed tl at the dispute sha11 be resolved through the implementation of the

fatlo« ting proceciures:

MANAGElVIENT RIGHTS

Sectiou 9. 1 Contractor and Disfrict Rights. The Contractors and the Dist ict have the

sale and exclusive right and authority to oversee and manage consttuction operations on ProjectWork wzthout any Iimitations unless expressly limited by a specific provision of this Agreement.Iu addition to the following and other rights of the Contractot s enuir erated in this Agreement,the Contractors expressly reserve their managennent rights and all the rights confei red upon fhenlby lav. The Contractor' s righ#s include, 6ut are not limited to, the r ght to:

a) Plan, direct and control operations of ail uo k;

b) Tire, promote, transfer and layoff their oti m emplo ees, respectively, as deemedappropriate to satisfy work an.dlor skill requirements;

c} Promu gate and t•eyuire all empioyees to obser ve reasonable job rules and securityand safefy regulations;

d} Discharge, suspend or discipline their ov i employees for just cause;

e) Utilize, in aecordance with District approval, any work methods, procedures ortechniques, and select, use a id instal any types or kinds af materials, apparatus or equipment,regardless of source of manufacture ar consti uction; assign and schedule work at their discretion;

and

Assign overtime, determine when it wi11 be worked and the number and identityof employees engaged in such work, subject to such pro zsions in the applicable Schedule A(s)

requiring such assignmen#s be equalized or otherrwise made in a nondiscriminator} manner.

Section 9.2 Specific Disf• ict Ri } zts. Tn addition to the following and other rights of theDistrict enumerated in this Agreement, the District expressly reserves its management rights and
