The Ross County Board of Commissioners met on this day, June 22, 2020 in regular session.

Mr. Corcoran opened the meeting by leading the Pledge of Allegiance.

Douglas Corcoran, approve theYield Update for the Price Loss Coverage (PLC) Program form, to be submitted to the United States Department of Agriculture (USDA), certifying yields from 2013-2017 for corn, wheat, or soybeans, planted on the farmland owned by the Board, located behind the Ross CountyFairground, and lease to Terry and Trevor Downs.

CONTRACT AWARD – WATER POLLUTION CONTROL LOAN FUND

Mr. Garrett moved, Mr. Neal seconded, that a contract be awarded to Duncan and Daniels Enterprises, in the amount of $31,407.00, for two2) repair/replacement systems, to be acquired under the Ross County Water Pollution Control Fund, according to a bid proposal submitted

June 8, 2020, and recommendation of the Ross County Health District Environmental Division.

RESOLUTION ADOPTED – EXPRESSING INTENT TO AUTHORIZE THE ISSUANCE OFCOUNTY CREIDT CARDS

Mr. Neal moved the adoption of the following resolution:

RESOLUTION NO. 20-124

WHEREAS, the Ross County Board of Commissioners will follow the provisions of Ohio Revised Code Section 301.27, authorizing andregulating the use of county credit cards; and

WHEREAS, a county appointing authority may apply to the board of county commissioners for authorization upon application stating whetherthe card is to be issued in the name of the office of the appointing authority or whether it is also to include the name(s) of specific employee(s) who may use the card; and

WHEREAS, a credit card held by a board of county commissioners or the office of any other county appointing authority shall be limited tothe following types of work-related expenditures:

FoodLodgingTelephoneGasoline and oil expenses for owned or leased vehiclesMinor motor vehicle maintenance for county owned or leased vehiclesEmergency motor vehicle repair for county owned or leased vehicles. TransportationInternet service providerWebinarPurchases of automatic or electronic data process or record-keeping equipment, software or servicesTemporary emergency care for children services for purchases for children in the temporary or permanent custody of the agency

IT IS NOTED THAT THESE ARE THE ONLY PURPOSES FOR WHICH A COUNTY CREDIT CARD MAY BE USED. CREDITCARD EXPENDITURES FOR OFFICE SUPPLIES OR HARDWARE ITEMS ARE CLEARLY NOT LEGAL, AND ANYONEWHO USES A CARD FOR SUCH PURPOSES IS SUBJECT TO CRIMINAL PENALTIES.

IN ADDITION, COUNTY CREDIT CARDS MAY NOT BE USED FOR GENERIC "TRAVEL" EXPENSES SUCH AS AIRLINEFLIGHTS. BLANKET PURCHASE ORDERS MUST BE ISSUED DIRECTLY TO A TRAVEL AGENT, AIRLINE OR OTHERVENDOR SUPPLYING TRAVEL SERVICES.

Ohio Revised Code (ORC) 301.27(E)(1) requires the Board of Commissioners to give advance approval of estimates of monthly ormulti -month expenses. HOWEVER, DIVISION (E)(2) PROVIDES THAT THE BOARD OF COMMISSIONERS MAY ADOPTA RESOLUTION TO EXEMPT ALL ELIGIBLE EXPENSES FROM THE ADVANCE ESTIMATE REQUIREMENT BY:

1. Allowing the estimate to be submitted annually or semiannually, with certification be given by the county auditor prior toapproval of the request.

2. By exempting all classes of expenses, all individuals authorized to use a credit card and all specific credit cards from the advanceestimate requirement. Then, in order to meet the statutory requirement that the card be used for no more than the amount in aline item appropriation and be encumbered, the commissioners can require a blanket purchase order for a period of up to thefull fiscal year. ( Under the provisions of ORC 5705.41, a blanket purchase order can now be issued for amounts in excess of5,000 and may be for a period of time longer than three months, provided they do not extend into a new fiscal, year.) In the

event that the county eliminate the requirement for a monthly or multi -month estimate, then the appointing authority mayrequest the commissioners to approve a supplemental appropriation or a transfer to cover any amount charged that was in excessof the amount originally appropriated. IT IS NOTED, HOWEVER, THAT SUCH SHORTAGES SHOULD NOT OCCUR IFTHE " ENCUMBRANCE" REQUIREMENT OF ORC 301. 27(E)(2) HAS BEEN MET .

In lieu of criminal penalties for exceeding the amount of the credit card authorization, the new law makes the individualpersonally liable for such overspending by requiring the person to repay the county within 30 days for any amount over whatthe person was authorized to spend on the credit card. If payment is not received within 30 days, the county prosecutor mustrecover the amount due by civil action. IT IS NOTED THAT ANY USE OF A COUNTY CREDIT CARD OTHER THANTHOSE PURPOSES SPECIFICALLY AUTHORIZED BY THE STATUTE IS A VIOLATION OF THE LAW AND ISSUBJECT TO THE CRIMINAL PENALTIES FOR MISUSE OF CREDIT CARDS AS PROVIDED FOR IN ORC 2913. 21.

3. All credit card purchases should be documented by an original receipt or an itemized statement detailing the purchase. Witho utsuch documentation, the cardholder may be held liable for the amount.

Whenever any officer or employee authorized to use a county credit card suspects the loss, theft or possibility of unauthoriz eduse of the credit card he is authorized to use, he shall so notify his appointing authority or the board immediately and in writ ing.

WHEREAS, by memo, the Board of Commissioners requested that each office that has a credit card notify its office in writing by June 29, 2020, of the credit card company and the name of the individual( s) who will be using the card; now, therefore be it

RESOLVED, that the Ross County Board of Commissioners hereby indicates its intent to adopt separate resolutions authorizing the issuanceof credit cards for each appointing authority who has responded affirmatively to the above- stated memo, and, as far as possible, to specify theemployees or officials who are authorized to use such cards; and , be it further

RESOLVED, that the Ross County Board of Commissioners hereby indicates its intent, by the same resolutions, to exempt all classes ofexpenses, all individuals authorized to use a credit card and all specific credit cards from the advance monthly or multi- month estimaterequirement, while noting that blanket purchase orders for projected credit card expenses should be issued for a period of up to the full fiscalyear for no more than the amount in a certain line item appropriation; and, be it further

RESOLVED, that a copy of this resolution be furnished to each county officeholder and department head, and to the Auditor of Ross Cou nty, to serve as official notice of the Board' s intent to exempt all county credit cards from the advance estimate requirement.

SUBJECTS BROUGHT BEFORE THE BOARD

Lori Baldrige, liaison Frank LaRose, Secretary of State, met with the commissioners to update the Board upcoming November election andother valuable information.

Ms. Baldrige said that she is liaison for fifteen (15) counties including Ross. Let me express how much I enjoy working with your Board ofElections (BOE). All our BOE are hard at work preparing for November. We heard at our last “ Ready in November” task force meeting, weheard from Sherry Poland, Director, about some of the ways they are ensuring the safety of their poll workers. We are making sure our cybersecurity is up to date with the BOE. This is a lot more technical and we are asking for the commissioner’ s support. All BOE employees willhave additional training and this can become very time consuming. The will know come November election what is needed for the electionto run smoothly. We have ask for an extension for absentee and early in house voting.

Businesses are increasing. In response to the COVID-19 pandemic, certain aspects of our office have changed that we encourage customersto wear a facial covering and follow social distancing guidelines. Business spotlight highlight monthly themes and we welcome yourrecommendations from your county.

Mr. Corcoran ask if House Bill 680 flexibility for polling locations and poll workers.

Ms. Baldrige said that large areas less people. Trying to get younger folks to help. Personnel Protective Equipment ( PPE), cleaning & sanitizing supplies will be purchased. The mission is to provide updates on challenges and needs of the county’s BOE to administer a safe, secure and accessible election and how the state can help support their efforts. We will try to get back to you before the elections with moreupdates and changes to make the November Election as smooth as we can.

Phillip Dysard & Kirk Mizerek, Palmer Energy Company, met with the commissioners to update the Board on the CCAO Solar Program.

Mr. Mizerek said that we are looking to put out a Request for Proposals (RFP) for the Solar Program, in late August. We still think the numbersare strong for Ross County. When we were here in February, you were to have the Letter of Intent for Potential Purchase of Solar reviewedby your prosecutor.

Mr. Corcoran said that we are not sure if the prosecutor has reviewed. With this agreement, will the term be set?

Mr. Mizerek said absolutely. We are working with the Ohio Prosecutor’ s Association to come up with one agreement. We will take all therequested changes and roll of them into one agreement .

Mr. Corcoran said that may be very difficult. We will get back to you once our prosecutor has reviewed.

OTHER BUSINESS

Brad Cosenza, county administrator, reported that the shelter house at the Camp Sherman site, the shelter house roof needs replaced. I haveone quote in the amount of $13,000. I will get a couple more.

Michael Sandman, owner of Land Inc., was the sub-contractor for HVAC for Palmetto, send pay applications for purchasing the equipmentand was asking if this equipment may be purchased by county to complete the work for the Ross County-Chillicothe Law EnforcementComplex and Jail Upgrade and Renovation Project. I told him that we needed to check with the attorney’ s but didn’t seem to think this wouldbe possible.

The commissioners noted receipt of Notice of Public Hearing for property located at 62/64 North Paint Street, regarding maximum squarefootage of signage.

The commissioners noted receipt of the Annual Meeting of the Friends of Lucy, scheduled for June 27, 2020 at 12:00 p.m., at the Lucy House, located at 90 West Sixth Street, Chillicothe, Ohio.
