CHAPTER NEWS JULY 2012 On June 12, 2012, Broward County authorized its County Attorney to draft a wage theft ordinance for consideration by the County Commission. Indications are that Broward’s ordinance will likely be patterned after the wage theft ordinance adopted by Miami-Dade in 2010. The Miami-Dade ordinance makes it a “wage theft” for an employer to “fail to pay any portion of wages due to an employee, according to the wage rate applicable to that employee, within a reasonable time from the date on which that employee performed the work for which those wages were compensation.” The ordinance applies to the underpayment or nonpayment of wages earned by persons working in the County. It defines an “employer” without regard to size or gross revenues and includes “any person, who, acting either individually or as an officer, agent, or employee of another person, acts directly or indirectly in the interest of a person or entity employing an employee,” but excluding the U.S. Government, the state of Florida, and other sovereign entities. An employee may make a complaint for a wage theft violation for any amount greater than $60.00. The ordinance sets up a local administrative claims process and creates a private right of action for which the employee can file a lawsuit. A hearing examiner is authorized to make a finding that an employer has committed a wage theft and to issue an order to pay wage restitution to the employee in an amount three times the back wages and liquidated damages. The employer also can be ordered to pay the County’s actual administrative processing costs of the hearing, as well as fines of up to $500 and/or up to 60 days’ imprisonment for willfully “failing to produce records or attend and testify or to answer any lawful inquiry.” At least one other Florida county is considering a similar ordinance. In April of this year, Palm Beach County authorized its staff to move forward with establishing a procedure for victims of wage theft to recover back wages. These developments are significant to the extent they mark the beginning of a trend that could lead to other such ordinances being passed locally and in more counties where our SHRMA member organizations have locations that could be affected. Rising Stars! Niya Case and Nadejda Ruckman were both recipients of our annual scholarship award during our June Chapter meeting. They each received a $500.00 scholarship award that they can use towards their education. We are thankful to Grow Financial for their sponsorship of this award. Niya Case Expected Date of Graduation: 7/2012 Degree: Business Management with a minor in Human Development Niya Case is currently a student at Eckerd College and is expected to graduate July 2012. Her current total institution GPA is a 3.57. In addition to submitting her official transcripts she included a letter of reference from the Director of Human Resources for the City of Largo and the Assistant Human Resources Director for the City of Largo. Niya has been employed in the Human Resources Department for the City of Largo since 2008 and she is currently the Office Administrator for the Director of HR. On a personal note she is a wife and a mother of three young children; 5, 2, and 16 months old. Nadejda Ruckman Expected Date of Graduation: 8/2012 Degree: Business Management Nadejda Ruckman is currently a student at the University of South Florida and is expected to graduate August 2012. Her current total institution GPA is a 3.58. In addition to submitting her official transcripts she included a letter of reference from her professor Dr. Zheng Chen who is her current professor for her Human Resource Management course. Her second letter of reference is from the Director of Human Resources at USF. Nadejda interned with the Human Resources Office at USF, St. Petersburg last fall. In addition she is a VA Student and previously studied from 2000 – 2004 at Tashkent State Pedagog University in Tashkent, Uzbekistan.

Condoleezza Rice talks Human Capital Strategies in Opening SHRM Keynote By Andrea Davis June 25, 2012

Former Secretary of State Condoleezza Rice brought the crowd to its feet in a standing ovation at the opening keynote session of this year’s Society for Human Resource Management conference being held in Atlanta this week

Rice, who now works as a political science professor at Stanford, covered everything from immigration to education to politics in her address, which was followed by a Q&A session with CNN reporter Soledad O’Brien.

Of particular note to HR/benefits professionals, Rice said “these are very consequential and tumultuous times. We’re going to have to fully tap our human potential — all human potential. [And] the core essence of human potential is to give people access to education.”

Rice also spoke about the importance of mentoring as a way to bridge skills and knowledge gaps, and effectively prepare the next generation of talent. “It’s great if you can find a role model who looks like you, but had I been waiting for a black Soviet-specialist role model I’d still be waiting,” she said. “My mentors were old white males because those were the people who dominated my field.”

Whether through corporate mentoring or enhanced educational opportunities, Rice said that, “This is the country that’s been most able to mobilize human potential. In the 21st century, when human potential is key to greatness in the world, we are in danger of losing that. But I’m an optimist. I believe we’ll get it right. Free markets and free people hold the key to the future.”

Manufacturers Want to Hire, But Can't Find Skilled Workers By Steve Bruce June 25, 2012 Seventy-five percent of manufacturers are actively hiring, but 2/3rds of those are having trouble finding the types of workers they need, according to research released 6/24 by SHRM at its Annual Conference and Exhibition, in progress this week in Atlanta, Georgia At a special session covering the hiring challenges faced by manufacturers, SHRM released the results of its research. Key findings:

About two-thirds of manufacturers who are currently hiring are having difficulty recruiting

for specific jobs.

The majority of organizations are having difficulty recruiting for high-skilled technical

positions (91%), scientists (89%), engineers (87%), mangers and executives (83%), and skilled trades (79%).

The most prevalent basic skills/knowledge gaps are mathematics (52%), writing in English

(43%), English reading comprehension (39%), spoken English (32%), science (22%), and technical skills (10%).

How are organizations dealing with the skills gaps? Among potential solutions: Hiring of US Veterans.

Social Media Networks Called Future of Recruiting By News Reports June 26, 2012 Nearly 60% of HR and recruiting executives, directors and managers in a nationwide survey consider social media networks like LinkedIn and Facebook the next big wave in reaching a greater number of qualified candidates.

More than half (57%) of the industry practitioners polled online by Research Now for Jobscience Inc. expect to use LinkedIn for recruiting more than job boards, email marketing and employee-referral programs. In addition, 36% of the respondents plan to use Facebook more for recruiting this year than last.

“Using social networks to find candidates for current job openings has become a common strategy for recruiters,” says Ted Elliott, CEO and founder of Jobscience. “But the real value of social recruiting is when companies continually engage with people through social networking — so, when an appropriate job opens up the person is familiar with the company and has a propensity to want to work there. It’s about social sourcing and building pipelines of talent so your talent pool never runs dry.”

Social networks are not just important tools for recruiters; candidates are using them to research companies. Fifty-two percent of those polled believe that social networks are an important venue for businesses to attract candidates.

“As Facebook becomes the most relevant place on the Web, it is also putting a face on the ‘employment brand’ of companies,” adds Elliott. “Information about a company is no longer solely controlled by recruiters. Candidates and employees are using social media to gather information about companies. If companies want to attract top talent, they need a strategy for their employment brand — which includes monitoring how their brand is perceived on social networks, facilitating a social dialog and giving compelling reasons for people to work at their company.”

Within the survey, LinkedIn was cited as the social network that matters most with 86% of respondents giving it top bill, followed by Facebook at 51% and Google+ at 27%. Respondents find Twitter to be the least important social network for recruiting, at only 16%. But the gap between Facebook and LinkedIn could shrink, as 36% of companies plan to use Facebook for recruiting more this year than last year.

More than one hundred scholarships totaling over $100,000 will be awarded to SHRM members in 2012. The awards program is designed to assist HR professionals in meeting their professional development goals. Individuals may apply for either a $2,000 education scholarship or a $750 certification scholarship.

MEMBER SPOTLIGHT: M. Kristen Allman Of Counsel By Elizabeth Bailey-Newman Was it always your intention to pursue law as a career? Actually no it wasn’t. I went to the testing center and it kept telling me lawyer, lawyer, lawyer. It’s so funny how life turns out sometimes. I come from a long line of teachers and engineers and the day I graduated from law school my father told me that he had wanted to become an attorney and he had never told anyone else that before. I have a fabulous 7 year old and I can already see the legal genes shining through even though I secretly hope that he will become a teacher or an engineer. What is it about Employment Law that makes it such an interesting field for you? I found that one of the greatest things with employment law is that you have to try and relate to the people you are working with no matter who they are, or where they have come from, what their backgrounds are, what their experiences are and that is one of the great things about employment law. I am getting ready to give a presentation at the HR Florida Conference entitled “Who needs reality TV when you’ve got employees?” It’s not just about taking on the rank and file it’s about taking on all of them all the way up the line, executives too. There are stories there but there are also things to be learned. Employers have to be very careful about the choices that they make because litigation can be fairly expensive and it doesn’t necessarily satisfy anybody in the end. How did you get involved with SHRMA? Over the years depending on where I have been working I have been involved with different SHRM chapters. I had just come back from working in health, which was a great experience and I thought I needed to join up with a SHRM chapter and get involved. I like staying on the cutting edge of what’s going on in the HR World because I think it allows me to better help the clients I work with. I chose SHRMA because I have had previous contact with them in the past and had been impressed with the cutting edge knowledge that they do display. How long have you been a member? About two years.

How do you achieve a work life balance? What do you do for fun? How do you balance the work life and the family life? (She laughs). I had to learn the hard way but I think one of the factors that helped me is that I have a son that I had later in life. It really was hard to continue to work long crazy hours and not spend the time that I needed to spend with him and so I became better about it. Everybody has something that they can inspire you with. I remember Jackie Kennedy Onassis saying that “If you bungle raising your children, I don't think whatever else you do well matters very much.” What is your favorite quote? I like the Serenity Prayer…”God grant me the courage to accept the things I cannot change”…I have a tendency to fight the things I cannot change…”and grant me the courage to change the things I can”…sometimes that is very difficult. I think that is what I consider the quote of my life. There are a world of things that we need to accept so that we can get on to our real pur-pose. I certainly don’t want to get to the other side and be told that I didn’t use well the gifts that were given me. What advice do you have for other HR Professionals? My best advice is to always listen to that 6

sense that you get because usually it isn’t wrong. What is something that nobody would guess about you? Hmmmm that I had a nick name

growing up…my nickname was Missy. Also anyone who knows me knows that I am terribly uncoordinated. However for someone who is terribly uncoordinated I like adventures. I have been down the Grand Canyon on a mule, white water rafted through the Grand Canyon, I went on Safari in Africa and have been on more whale watching cruises than I care to count. And my bucket list is not yet complete.

Thinking of Becoming Certified?

Have you been thinking of getting your PHR or SPHR designation? If so, SHRMA is here to help! We can offer you a way to get that certification and now is the time!! Our next certification prep class begins on Thursday, August 29th and goes through to Thursday, November 15th. Sessions run from 6:00 to 8:30 pm and will be held at Webster University located at 11201 Corporate Circle North, St Petersburg, Florida 33716. At each session, we will review the prep materials, take practice tests, and review discussion questions. Certified instructors will assist you with any questions you have concerning the test. There will also be a library of additional resources available to you during the 12 week program and a cram session, which will be held on Saturday November 17th (includes breakfast and lunch). Cost to SHRMA Members for the entire program is $450.00 which includes the purchase of the study guides; class handouts and the full day cram session. Certification is a voluntary action by a professional group to establish a system to grant recognition to professionals who have met a stated level of training and work experience. Certified individuals are usually issued a certificate attesting that they have met the standards of the credentialing organization and are entitled to make the public aware of their credentialed status, usually through the use of initials (i.e., PHR or SPHR) after their names. Certifications differ from certificate programs because certifications include an experience component. Certificate programs, on the other hand, award certificates once a course of study has been completed and do not require previous work experience. Why should I become certified? SHRMA Members in Transition take Note

What is a transitioning membership?

The Suncoast Human Resource Management Association (SHRMA) provides active members who are

unemployed at the time of the membership renewal a one-time opportunity to extend their membership for up to

one year—at no cost! SHRMA believes this continued affiliation to our loyal members will help transitioning

members stay current on the issues impacting the HR profession and provide them with the needed resources to

assist them in their job search.

Who qualifies for transitioning membership?

Any active SHRMA member who is unemployed at the time of his or her membership expiration date or becomes

unemployed up to 90 days after the membership lapses. Additionally, the member must be unemployed at the time

he or she applies for a transitioning membership.

Before activating a transitioning membership, the requestor must communicate his or her unemployment status to

SHRMA using the form provided.

What benefits are included with a transitioning membership?

SHRMA members in transitioning membership status will continue to receive all SHRMA member benefits for up to

one year. The only benefits not included are voting privileges and the ability to hold office on the SHRMA board.

Benefits Include:

What happens when I find a new job?

Members in transitioning membership status may reinstate their professional membership at any time during their

transitioning membership period by paying the annual renewal fee of $50.00, but must reinstate upon employment.

Important notice about SHRMA transitioning membership:

Transitioning membership is available to members ONE TIME ONLY and will not begin until the VP of Membership

receives and processes the application form. Members will be notified when the membership has been approved

and reactivated. Membership identification numbers and passwords will remain the same.

Transitioning Members may also take advantage of HR Connections – the source on the HR Florida website

(www.hrflorida.org) hosted by Right Management.

Benefits of transitioning membership are subject to change or cancellation without notice.
