what is franchising’s competitive advantage?The decision to become a small business owner can be both an exciting and a daunting one. On one hand, there is the anticipation of being your own boss and all the independence that entails. On the other, you will need to have – or quickly develop – the management, technical and administrative skills required to run the business.

Franchising is a method of business that provides independent small business owners with the strategy, training and support, systems and processes, brand development, group purchasing and marketing power that if adhered to can lead to small business success.

As a franchisee you are running your own business, but you are not alone – you

have the knowledge and resources of your franchisor behind you.

Think of it like learning to dive. If you’re poised to enter the water for a first time, even as a seasoned swimmer or lifelong beach-goer, you want an experienced instructor with you – to have worked with you to build knowledge of the technology and systems, to alert you to what to watch out for, to help guide and develop of your own competence and to help identify and make your own positive new opportunities. That’s what franchising is. It’s a business model where two independent businesses – one run by the franchisor, and one operated by the franchisee – work separately but collaboratively for both their mutual and individual benefits.

It is this relationship, where both franchisors and franchisees have ‘skin in the game’, that enables franchised businesses to compete effectively against major corporations. Indeed the best of the franchise model with a shared purpose and mutually supportive and respectful relationship is probably the most

dependable, proven and durable business model that provides an ongoing competitive advantage to franchisors and franchisees alike.

Realising the rewards of the franchise relationshipI was lucky enough during April to attend the FCA’s NSW/ACT Excellence in Franchising Awards and hear the success stories of franchisees who had benefited from being a part of a franchise network.

For Soul Origin’s Westfield Parramatta franchisee, Sherwin Djamil - who won the NSW/ACT Franchisee Community Responsibility and Contribution Award for 2016 - the support offered by a franchise system was a key attraction when deciding to become a small business owner.

“At first it (becoming a Soul Origin franchisee) seemed like an obstacle, because I’d never been a business owner before,” said Sherwin. “But I realised that it was an opportunity and I wasn’t alone. Soul Origin had a support system and that support system has taken me to where I am today.”

Sherwin’s sentiments were echoed by 2016 NSW/ACT Single Unit Franchisee of the

“We thought our degrees will always be there so why don’t we have a crack at something ourselves,” said Sam. “And what better industry than franchising where you’re given a proven business model to follow.”

the importance of due diligencePurchasing a franchise is likely to be one of the biggest financial investments you will make. It’s an investment in your future livelihood and not one to be taken lightly. So, if you’re thinking about investing in a franchise business, the most important thing you can do is research. Proper due diligence is the most important part of any business decision.

Consider the brand you are looking at, and ensure you have a proper understanding of the franchise business model itself, along with your own financial situation and lifestyle needs. Most importantly, remember to seek independent, specialist legal and financial advice before signing any binding documents.

It’s also worth highlighting here that franchisees like Sherwin, Shaun and Sam all recognised the benefits and have been prepared to follow the established systems of their franchisor.

Franchising is not for everyone. And if you are a more entrepreneurial personality who prefers to do things their own way, realistically, you may not be ideally suited to be a franchisee. For while there are no guarantees of success in any small business, the franchisees who obtain the best results are those who work with and fully embrace the proven model of the franchise system.

Bruce was appointed as the Executive Chairman of the Franchise Council of Australia in March 2016. Bruce brings with him to the role nearly two decades of experience in public life, having been the Federal Member for Dunkley from 1996 to 2016. As a Parliamentarian, he held numerous portfolios in government and opposition, including most recently as Minister for Small Business from September 2013 to September 2015 and previously as Shadow Cabinet Minister for Small Business, Competition Policy and Consumer Affairs from December 2009 September 2013.

The Franchise Council of Australia Limited (FCA) is the peak body for the $144 billion franchise sector in Australia, representing franchisees, franchisors and service providers to the sector. A Work Availability Guarantee of $1500 per week, including GST, net of stock is available to all new Jim’s Antennas franchisees. This means that should you request and not receive work to this value, your Regional Franchisor will make up the difference in work or in exchange for you providing free promotional services designed to promote and build your business. A Franchise Management System (FMS) computer program has been specially developed by Jim’s IT team and allows franchisees flexibility and control over their business. Territory rights are nonexclusive, meaning that if a franchisee is not requesting work within their territory on a particular day, it will be allocated to an operator who wants the work. You are also able to provide

personal referrals in any area you wish and these do not attract fees.

Franchise fees consist of a monthly base fee, plus a lead fee. The lead fee is charged once only on each new lead requested by, and sent to you. This is a ‘user pays’ system, with those taking more leads paying higher fees. This encourages all operators to contact clients as soon as the lead is received, and to log off for work when busy, leading to a higher level of customer service. “This means that our new franchisees are literally working on the tools and learning on the job, all whilst being paid a training rebate,” says Andrew.

Every meeting, of which there is a minimum of eight a year, regular training will keep you up to date with new technology and industry changes. Alongside preferred suppliers - invited to complete specific training for their products - Jim’s Antennas also utilise the existing ‘on-the-job’ skills of their existing franchisees to educate others within the group. Jim’s Antennas host an annual national conference, to be held in Queenstown in 2016, which all the national franchisees are invited along to. As well as the conference there are annual training camps where the franchisees will get away for two days and two nights so they can immerse themselves in training.

Recent advances in battery technology, coupled with the emergence of reliable and affordable RtF (ready-to-fly) systems, has seen a number of industries embrace the technology commonly known as ‘drones’, as a way to cut costs, deliver efficiencies and save time when compared to traditional methods of capturing aerial photography and videography and conducting aerial spotting and aerial surveillance works (namely, the use of helicopters).

Furthermore, applications that simply wouldn’t have been economical to perform using a helicopter, can now be performed using an ‘unmanned aerial vehicle’ (UAV), or ‘remotely piloted aircraft system’ (RPAS) as they are becoming more widely referred to, to conduct low-noise, low-altitude, low-risk flight operations at an increasingly affordable rate.

Analysts predict that the market for drones (including services), currently valued US$9.1bn is set to grow ten-fold over the next decade. Whilst military spending accounts for a significant proportion of this, consumer and industrial markets are tipped to have decades of growth ahead of them, according to the September 8, 2015 report Drones: A Rising Market co-authored by Sean Peasgood (President & CEO) and Marcel Valentin (Vice President) of Sophic Capital.

Pre-entry education and professional advice is a worthy investment in your franchising future.

New research into due diligence published by Griffith University and the University of New South Wales found that more than half of the franchisees surveyed had no (or almost no) idea about where to get franchise training. This lack of awareness is a concern, since a bit of information and training can help franchisees get off to the best possible start and avoid problems down the track.

Pre-entry educationThe Australian Competition and Consumer Commission (ACCC) has long recognised the benefits of pre-entry education. Since 2010, we have funded a free online pre-franchise program run out of Griffith University’s Asia-Pacific Centre for Franchising Excellence. More than 10,000 people have now registered for the course. This is a significant milestone.

As franchising veterans can attest, it’s about going in with your eyes wide open and knowing where to look. What do your franchising documents say about site and territory selection? What are your retail leasing and marketing fund arrangements? And, how can you verify any financial information? All these issues are covered in the course. Pre-entry education of this kind doesn’t tell you where and how to specifically

invest your money, but it can help you make a better overall informed decision.

Pre-entry training also lifts the lid on the practical demands involved in running a franchise business. Despite the fact that many franchising participants already have some form of business qualifications before they turned to franchising, the Griffith/UNSW research found that 58 per cent of current franchisees had no realistic idea about what they were getting themselves into. Pre-entry training can provide first-timers with more realistic expectations.

Pre-entry training also provides franchisees with important background on the Franchising Code of Conduct. The mandatory industry Code sets out the rights and obligations of all participants in the franchising industry. For example, the Code provides new franchisees with a ‘cooling off’ period and requires franchisors to disclose specific information to prospective and existing franchisees. The Code also provides a way for franchisees and franchisors to resolve disputes and requires that both sides act in good faith.

Professional adviceThe Griffith/UNSW research also found that only 35 per cent of current franchisees consulted an accountant, lawyer or financial adviser prior to purchase or start up.

This finding is surprising since the Franchising Code requires you to provide a statement that you have sought professional advice as part of the buying process.

Alternatively, you can sign a statement saying that you are aware that you should seek advice but have decided against it.

The ACCC sees professional advice as imperative, particularly when you consider life savings are on the line and the complexity of some franchise agreements.

When it comes to the crunch, professionals can guide you through the finer points of contracts or the complexities of franchise finances. For example, if the franchisor has provided you with projected earnings, it must also provide you with information about the assumptions on which the projection is based. An accountant or business adviser will be able to assist you to compare and verify any figures or projections given to you. It makes sense to get some professional advice before making one of the biggest investment decisions of your life.

it still surprises me how many people get “tunnel vision” when looking to buy a franchise.

By tunnel vision, I mean that they get fixated on one particular franchise opportunity. They enquire and then go through the steps of buying a franchise without considering any other opportunities or asking the right questions and demanding the right answers.

Many people move forward without stopping to ask questions like:

• “How do the competitors stack up?”

• “Why am I choosing this opportunity over that opportunity?”

• “What else could my money buy me?”

• “How does the industry outlook compare from one franchise to another?”

• “What does my day to day role look like in this business versus that business?”

• “How does the team of people (head office and other franchisees) in this franchise compare to another?”

You would rarely buy the first car you see or test drive, or a home without first looking at different options. We put considerable time and thought into comparing different holiday destinations before making a choice for a two-week vacation. Even buying a phone, a computer or a television has us researching the different features, price points and brands.

The decision to purchase a franchise is a much bigger decision. Some people have even said it’s a bigger decision than choosing a husband or wife! Buying a franchise is not only a financial decision - it shapes your day to day life for an average of seven years, because that’s the industry average for time franchisees spend in a network.

We have all experienced food envy. It’s not a great feeling. Imagine, six months after opening your franchise business, seeing a franchisee from a different network living

a great life - which you could have had! There are some amazing franchise systems out there and I have seen how franchising can enrich families’ lives and shape amazing futures for people.

So how do you weigh up the options and assess the relative merits of different industries, brands and networks?

Here are some tips on evaluating each opportunity and choosing what is right for you and your family at this stage of your life:

Talk to other franchisees and find out what the ramp up period could be and how much money they needed to tide them over till the business started to be profitable.

understand cash Flow

Again, talk to other franchisees, not just in terms of operating capital. Are there seasonal fluctuations, or do the terms of trade with suppliers put strain on cash flow, and how can you prepare for that?

ROi (return on investment)

Ask the franchisor about the return on investment, requesting the average ROI across the group. If that information is not available talk to as many franchisees as possible asking how long it has taken them to make back their original investment plus their salary.

is this Feasible?

Does the size of the investment match what you can genuinely afford or are you stretching yourself to buy this business? What will you do if it takes longer to become profitable or you have insufficient operating capital? What do you stand to lose? Allow some leeway in your calculations for unforeseen circumstances.

Are you just looking for as much money as possible or are you looking for something you will enjoy and can be passionate about as well? It’s easy if it’s only money that motivates you. Otherwise, read on!

This isn’t just about making money. Would you be proud to be an ambassador for this brand, and to talk about your new business with your friends and family?

Finding a Fit

Are the other people in the network people you would be proud and confident to have as colleagues and does the screening and selection process ensure you and they are a good brand fit? Dedication and enjoyment in your work are important to most people,

so you need to speak to each and every franchisee. If possible request a day in-store/in the business, or a week if you can, to make sure this is the job for you.

practical consiDerations:

trading times

Are you a night owl or a morning person? There is no point buying a coffee shop if you operate best later in the day. Do you want to work seven days a week and nights or do you want a 9-5, Monday to Friday job? Do you need a job that can fit in around picking up kids from school? Considering each of these carefully will help you determine whether you should be looking at a food business, a mall-based business, a B2B, or a mobile or home-based business.

Family and support

This is paramount and it’s tied to the previous consideration. Being a successful and profitable franchisee depends on working the business yourself. Yes, you might have staff and if it’s open 60 hours or more a week, you might even have a manager at times, but you need to be there if it’s going to work. So be realistic about how much of your time and effort your business will require and make sure your family is ok with the sacrifices this will mean for all of you. Running your own business can provide future security for your family but you’ll need their support and understanding to pull it off.

location

If it’s a bricks and mortar business is it close to your home? Or if it’s a mobile business is it in the territory where you live? It’s always better to stay local as you know your area and are a member of the community already, so will be more effective at marketing and developing your business. Not to mention – the less travel the better!

As a part of this, the franchisor is obliged to give you a list of all the existing franchisees in the network and those that have left. Go and see them (all of them if possible!) and ask all the questions noted above.

Spend time with the franchise head office staff and the directors if possible. Do they seem genuine? Can you see yourself working with them?

get legal advice

Get advice from professional specialist franchise lawyers who will review the Franchise Agreement and Disclosure Document. Get a fixed fee quote and ask for the review in writing.

get Financial/accounting advice

Again, take all the financial information provided (and ask for anything that isn’t) and go to a business advisor or accountant who has worked with franchised businesses for advice.

professional aDvice:There is a page in the Disclosure Document where the franchisor advises you (as required by the Code) to take legal and business

advice. You will need to sign that you have done so, or that you have declined to do so. Remember, you wouldn’t buy a house without a pest and building report, and this is the same. Get professional advice. It is the final piece of insurance that you are investing in a business that really is right for you.

cash FlowTake time to understand the cash flow cycle of the business. Consider where your customers will come from, how they will pay, any seasonality and when you need to pay creditors and taxes. Build a comprehensive list of assumptions and satisfy yourself of the ongoing viability of the business. This is especially important if the business is new and you are basing your projections on advice alone.

debt levelsDon’t overcommit yourself and keep your business and personal debt to manageable levels. Be wary of financiers who say they will lend you extra money without a proper assessment. Look at the repayment structure and interest rates. Be cautious in committing the business cash flow to non-business related purposes. For example, buying a more expensive house will add nothing to the value and productivity of your business and will become a problem if business cash flow tightens.

understand depreciationWhile depreciation is charged against business income and lowers net profit it establishes a need to continually reinvest in the business. Depreciable items whether they are a car, computer or floor coverings will need to be replaced. Failure to do so may impact business sales or add to maintenance costs and reduce productivity. Ideally set up a ‘sinking fund’ to deposit money to be used to fund future upgrades and replacements.

‘Own’ the businessIt’s your business and you are responsible for everything! This includes ensuring employees are paid correctly and taxes are paid on time. As a business owner it comes down to understanding how to build revenue while watching costs. Take an active role in the management of your business and don’t look to delegate this responsibility to others.

managing through the good timesDon’t become complacent if things are going well. Make sure your business decisions take an inevitable change in business activity into account. Ensure budgets are set and regularly monitored. Take care in committing future cash flow to non-business related purposes. Look for any signs of deterioration and take decisive action early. Specifically, monitor sales levels, gross profit margins and labour costs.

Fall back capitalEnsure you have quick and easy access to additional capital if required. Even in the best of businesses with considerable planning things can go wrong. An unexpected event can impact your business and access to additional capital may need required. The amount of back up capital will vary depending on the business, however, start up (green-field) business will require higher levels of reserves until proven.

economic eventsBusiness conditions and confidence will be impacted by local and international events. Business owners need to understand how their business will be affected by changes to economic conditions. As an example, what is expected to happen if interest rates increase or exchanges rates change?

Quality advice Always get the best independent business advice you can find. This will include accounting and legal advice using advisors with appropriate knowledge of your industry. You may also have a financial advisor, banker, business coach or mentor who is able to assist with your business decisions. Businesses need to continually evolve and move in line with customer and community expectations.

understand business valuesCost does not necessarily reflect value. Set up costs or price paid may or may not represent the ongoing value of the business. When considering the purchase of an existing business look at the historical performance, lease terms, franchise terms, condition of the fit out and equipment. Consider any capital expenditure required and speak to both the franchisor and landlord. Obtain independent advice on the businesses value to support your offer to purchase. When establishing a new location the set up costs may exceed the businesses value until such a stage the business builds to a predetermined level of operating profit.

Research - industry, competitors, RegulationAs a part of your assessment process undertake detailed research. This would include considering the industry, competition (local and more widely if relevant), and regulation. All affect businesses in different ways however these impacts can be significant if not fully understood. For example, consider how the supermarket sector has been impacted by

additional competition, changes to retail trading hours, supplier pricing, internet ordering and delivery etc.

understand time commitmentTo operate successfully a business owner will need to commit significant time and effort. Operating a business is never 9am to 5pm Monday to Friday. get the techGone are the days of doing your accounting and client management with paper and pen. VPN or cloud based solutions are faster, more efficient and more accurate. They enable you to work from wherever, whenever. Though some initial effort is required to get it set up, once it is, you won’t know how you ever lived without it.

have the disciplineIf you go with the flow in your business, you can always find a reason to come into the store or office when perhaps it’s not strictly necessary. Flexibility requires determination and planning – think at the start of the week what you have to fit in and what that will mean for your workload, and stick to it. If

you’re taking Wednesday off, as I do when I’m training for a big race, be determined to make that happen and don’t let anything get in your way.

Find the timeYou might one day get to a point where you are able to have a minimal role in your franchise, but you can have flexibility before you get there. Like with anything, there has to be give and take to achieve flexibility and work life balance if you’re working full time, and the key is to understand what needs to be done when. If you’re leaving early to pick up your kids in the afternoons and spend time with them before bed, you will probably need to log on later and wrap up your admin.

Prepare the team Everything is possible when you have a great team that communicates well. Firstly, make sure you’re hiring people with the right experience so they’re able to fill in when you’re not there. Secondly, flexibility can fall over when everyone is not privy to your plans – meetings can go in on your days off, or someone can need urgent help with a task when you’re due to leave early. Communicate clearly with the team and set up a chain of command for issues when you’re away from the business.

Get these four things right, and you’ll find work/life balance is much more within reach.
