DEA Verifications
The Board reviewed information indicating that DEA no longer com-
pletes routine DEA inquiries. The Board adopted a motion that a questionasking whether an applicant knows of any information that has caused an
investigation to be instigated by the Drug Enforcement Administration beadded to the routine questions for licensure, that requests for DEA verifica-tion still be sent, and that a record be maintained of inquiries to whichno reply has been received.
Commentary Revisions
The Executive Secretary discussed reprinting the Commentary. The Boardadopted a motion that the revised version apply to physician extenders and
that it not be reprinted until the nurse practitioner supervision guidelineshave been formulated.
Proposed Rewording for Approved Formulary Regarding Refills
The Board reviewed proposed rewording for the Approved Formulary.The Board adopted a motion that the wording: "A prescription may not indicate arefill. Every prescription must be entered on the patient's chart. A secondprescription for the same medication may be authorized by telephone and
must be entered on the patient's chart and countersigned by the physicianwithin 72 hours. Amount of drug can be no more than 100 dosage units or a
one month supply'' replace the second and third paragraphs under "Other Criteria"on the Approved Formulary.

The Board reviewed a request from Dr. Thul len. The Board adopted a motionthat Dr. Thullen be sent a letter confirming the previous letter and statingthat the Board cannot add to its letter of December 20, 1979.
Restrictin Number of Physician Extenders a Physician May Supervise
The Board adopted a motion that the Executive Secretary with the advice ofthe Board's attorney compose a letter to Tom Adams stating that the Boardis planning either by regulation or legislation to impose a limitationof two upon the number of physician extenders who may be supervised by onephysician. The Board adopted a further motion that Audrey Rogers be writtena letter requesting that she supply twenty-five copies of "Recommendationsfor Nurse Practitioners Applying for Approval to Practice in North Carolina"and that, when these publications are received, copies be sent to all Boardmembe rs.
guestions from the Attorne General Regarding Practice of Chiropractic
The Board reviewed questions from the Attorney General regarding thepractice of chiropractic. The Board adopted a motion that the AttorneyGeneral be written the following letter:
At its recent meeting on August 22, 1981, the Board of Medical Examinersconsidered your letter of August 6 requesting an opinion concerning thepractice of chiropractic.
It is the opinion of the Board that each of the questions posed in yourletter should be answered in the negative.
The members of the Board of Medical Examiners are of the opinionthat the penetration of the human body for the purpose of withdrawing blood,the withdrawal of blood from the 'human body, and the interpretationof the results of a chemical analysis of human blood constitutes thepractice of medicine which is not within the scope of the practice of
chiropractic, as defined by the General Statutes and the chiropracticexemption in G. S. 90-18 (10), and that no scientific or legal basis existsto support a contention that a chemical analysis of human blood might be usedby a chiropractor "within the limited scope of chiropractic. "
In support of these opinions, the members of the Board also expressed thefollowing opinions: A chemical analysis of the content of human blood hasno scientific significance in determining the existence or non-existence ofa misalignment or so-called subluxation of the human spine or the so-calledeffect of such a condition upon the nerves of other portions of the human
body. The expression to a patient of the significance of the results ofan analysis of the contents of human blood would not be within the scopeof chiropractic as defined by our General Statutes.

Tom Adams' Concerns
The Board adopted a motion that the Board's Attorney convey the Board'swishes to Tom Adams concerning the possibility of forming an "umbrella" or"super" Board. The Board adopted a further motion that Mr. Adams be ad-vised the Board will be glad to discuss this matter with him but the Boardis opposed to this concept and considers its function is to regulate thepractice of medicine not to regulate other health professions.

The Executive Secretary reported to the Board that this meeting willbe held in New Orleans, Louisiana, on May 13-16, 1982.
Donald Ralph Coffman, M. D. , Norlina, North Carolina
A continuation of a hearing was held at the Hyatt House, Winston-Salem,North Carolina, at 1:00 p. m. , Friday, August 21, 1981, at which hearing Dr.Coffman did appear and was represented by counsel. The Board adopted a motionthat a decision on Dr. Coffman's hearing be postponed, and that he be requestedto appear before the Board at the October, 1981, Board meeting.
Statement of Rights
The Board adopted a motion that the first time a physician appears foran informal interview before the Board a statement of rights be read to theindividual except in instances when the Board wishes to make an exceptionto this policy.
Harold R. Hoke, M. D. , Charlotte, North Carolina
The Board adopted a motion that the proper procedures be instituted toprefer charges against Harold R. Hoke, M. D. , that he be so notified in writing,and that he be advised he will be given a hearing on such charges that willbe presented against him.
Gyan H. Ke', M. D. , Roanoke Rapids, North Carolina
Dr. Blackmon reported to the Board that he had been working with Dr.Kej, that Dr. Kej has been learning about problem-oriented record keeping,that he has made an effort to begin dictating entries on patient records,that Dr. Kej has been striving to improve his penmanship, and that Dr.Blackmon and Dr. Kej have been in frequent contact. The Board adopted amotion that this report be accepted as information.
Emergency Medical Services
Dr. Baker and Mr. Eddinger appeared before the Board to discuss mutualconcerns. The Board adopted a motion that the office of Emergency MedicalServices make whatever arrangements are necessary to hold a hearing on (1)a proposed amendment to Mobile Intensive Care Rules and Regulations to alloweither Esophageal Obturator Airways or Esophageal Gastric Tube Airways tobe utilized at the discretion of the individual Medical Directors, (2) a pro-posed amendment to the Mobile Intensive Care Rules and Regulations to allowthe Board of Medical Examiners to authorize study projects involving excep-tions to the rules and regulations, and (3) a proposed amendment to the MobileIntensive Care Rules and Regulations stating that when a physician is inattendance his orders take precedence over all EMS protocol within thelimits of the current regulations. The Board adopted a further motion thatthis hearing be held before the October, 1981, Board meeting and that Dr.

The Board also adopted a motion thatEMS, Dr. Baker, and the Director of the EMS Program be instructed to pro-mulgate a directive to all EMS personnel stating that when a physician isin attendance hi s orders take precedence over al 1 EMS protocol wi thin thelimits of current regulations, that this directive be approved by the Boardand prepared for Dr. Baker's signature, and that copies of the directive besent to medical directors of all programs, regional and area medical direc-tors, and to the presiding officers of all local medical societies. TheBoard adopted a motion that it interprets "in attendance'' as meaningacceptance of responsibility on the part of a physician for an individual asa patient. The Board adopted a motion that Dr. Baker be requested to develop aproposed drug list to be utilized by EMS personnel for the Board's considera-tion at the October, 1981, Board meeting. The Board adopted a further motionthat the office of EMS be requested to report to the Board at its October, 1981,meeting on the implementation of House Bill 1223.
