PRAYERS Pursuant to Standing Order 11(1), the Speaker offered a prayer. INTRODUCTION OF PAGES The Speaker informed the Assembly that Sonali Malhotra, Morgan Paul and Karine Potvin from F.H. Collins Secondary School; Amanda Dendys, Joshua Ladue and Pierre Lefebvre from Porter Creek Secondary School; and Midhula Kalpak and Nicole Mabilog, from Vanier Catholic Secondary School, would be serving as Pages during the Fall Sitting. Midhula Kalpak and Nicole Mabilog were introduced and welcomed to the House. SPEAKER’S STATEMENT (Re: Changes to the Order Paper – withdrawal of Motions) Prior to proceeding with the Daily Routine, the Speaker made the following statement regarding changes made to the Order Paper.

“The following motions have been removed from the Order Paper because they are outdated: Motion #179, standing in the name of the Leader of the Official Opposition; Motions No. 21 and 168, standing in the name of the Leader of the Third Party; Motion #36, standing in the name of the Member for Pelly-Nisutlin; Motion #83, standing in the name of the Member for Watson Lake; Motions No. 95, 118 and 173, standing in the name of the Member for Mayo-Tatchun; and Motions No. 165, 171 and 227, standing in the name of the Member for Takhini-Kopper King.

Also, Motion #231, standing in the name of the Member for Pelly-Nisutlin, was not placed on the Notice Paper as it is outdated.”

Pursuant to Standing Order 11(2), the House proceeded with the Daily Routine. TRIBUTES (In remembrance of Don Taylor, former MLA and Speaker) The Hon. Mr. Laxton, Speaker, paid tribute to the Hon. Don Taylor, former MLA and Speaker, who passed away on October 7, 2012. Mr. Taylor served as territorial councillor and MLA for Watson Lake for 24 years from 1961 to 1985 and as the Speaker of the Yukon Legislative Assembly from 1974 to 1985.

THAT Standing Order 14.2(2) of the Standing Orders of the Yukon Legislative Assembly be amended by adding the following:

“(c) Notwithstanding Standing Order 14.2(2)(b), an independent member in opposition shall have the fourth position on the roster; and

(d) Where there are two or more independent members in opposition the Speaker shall determine the allocation of the fourth position on the roster to those Members.”;

and

THAT Standing Order 14.2(3)(b) be amended by adding the phrase “or independent member” between the words “group” and “in”.

Amendment A debate having started on the motion , it was moved by Mr. Silver, Leader of the

Third Party, in amendment thereto:

THAT Motion #265 be amended by: deleting clause (c) and substituting the following for it: “(c) Where there is an independent member in opposition to the

government, the roster shall be comprised of seven positions and the independent member shall have the seventh position on the roster.”

and deleting the word “fourth” from clause (d) and substituting the word

SPEAKER’S RULING (Re: Point of Order re Standing Order 19(g)) Prior to proceeding with Question Period, the Speaker gave the following ruling pertaining to a Point of Order raised on October 30, 2012 during Question Period, by Ms. White, Member for Takhini-Kopper King.

“During yesterday’s Question Period, the Leader of the Official Opposition asked questions regarding the Canada-China Foreign Investment Promotion and Protection Agreement. In response to the final supplementary question from the Leader of the Official Opposition, the Premier asked why the Official Opposition opposed the agreement and then said, ‘Is it just that the NDP don’t like the Chinese? Is it the fact that they are not only anti-Chinese —‘

At that point the Member for Takhini-Kopper King rose on a Point of Order and alluded to Standing Order 19(g) which empowers the Speaker to call to order any Member who attributes a false or unavowed motive to another Member. The Government House Leader and the Leader of the Official Opposition also spoke to the Point of Order.

The Chair believes there is a Point of Order in this case. In suggesting that Members of the Official Opposition opposed the investment agreement because they are ‘anti-Chinese’ the Premier attributed to Members of this House an unworthy motive, specifically a bias against an identifiable group of people.

Such a statement personalizes the proceedings and is not in keeping with a fundamental principle of parliamentary procedure, that Members are to treat one another as honourable, no matter how strongly they disagree with one another about matters of public policy.

Whenever the Chair rules a Member out of order for something that Member has said, it is a good time for all Members to reflect upon statements they make in the House. While these statements may not be out of order, Members should consider whether they contribute to raising the rhetorical temperature in the House.

The Chair recognizes that Members are here to debate important issues; issues about which they, and their constituents, hold strong views. Strongly held views often lead to strongly worded statements. All Members will have to accept that. However, Members should always be mindful of the role they play in ensuring that the proceedings are orderly. (2) recognizing the historical and tourism value of Bear Creek by opening it to the public and providing guided tours during the summer season,

(3) restoring the funding for the curatorial, conservation and collections management of the quarter of a million artifacts in Dawson City, including the preservation of Dawson’s historic buildings,

(4) continuing to provide year-round access to Kluane National Park, including access to emergency medical and search and rescue services, ski trails and winter camping opportunities at the Kathleen Lake campground,

(5) ensuring that the S.S. Klondike continues to be open to the public with guided tours, and that operating hours during the summer season are not reduced,

(6) continuing to provide year-round services for the Chilkoot Trail National Historic site; and

(7) promoting the development of interpretive and instructional material for Ivvavik National Park and Vuntut National Park.

“Motion #14, standing in the name of the Member for Mayo-Tatchun, has been removed from the Order Paper at the request of that Member.” SPEAKER’S STATEMENT (Re: Withdrawal, retraction or apology for unparliamentary

language) Prior to proceeding with the Order Paper, the Speaker made the following statement about an event that occurred during Second Reading debate on Bill #7, Second Appropriation Act, 2012-13 on Monday, November 5, 2012.

“During the speech of the Leader of the Third Party, the Leader of the Official Opposition raised a Point of Order about comments made by the Leader of the Third Party about her. During the discussion of the Point of Order, the Leader of the Official Opposition used unparliamentary language. The Chair asked the Leader of the Official Opposition to retract and apologize for the use of unparliamentary language.

The Leader of the Official Opposition offered an apology, which the Leader of the Third Party accepted.

Nonetheless, the Chair has reviewed the Blues regarding this incident and wishes to make a statement about it.

When the Chair asks a Member to withdraw, retract or apologize for something they have said, that withdrawal, retraction or apology should be unqualified. This is not an opportunity for the Member to restate, rephrase or justify the offending words.

In dealing with the Point of Order yesterday, the Chair accepted a withdrawal that was qualified, one in which the Leader of the Official Opposition rephrased the words that had been

This House does not have a lot of experience with the type of language used by the Leader of the Official Opposition yesterday. However, I can assure all Members that, in the future, the Chair will only accept unqualified retractions, withdrawals or apologies for the use of unparliamentary language.”

THAT this House urges the Government of Yukon to: (1) implement an immediate moratorium, (2) conduct a full and rigorous scientific review; and (3) conduct a public consultation

on the effects and desirability of hydraulic fracturing, also known as “fracking”, before any regulatory approvals or permitting is allowed in Yukon.

Mr. Pasloski, Premier, Ms. White, Member for Takhini-Kopper King, Mr. Silver, Leader of the Third Party, and Mr. Elias, Member for Vuntut Gwitchin, paid tribute to Remembrance Day. The Hon. Mr. Laxton, Speaker, made the following statement:

“Sunday, November 11 is Remembrance Day. Remembrance Day marks the end of Veterans’ Week. It is a time for Yukoners and other Canadians to honour the men and women who defended Canada during times of war and have brought peace to troubled parts of the world. The freedoms we cherish exist largely because of the sacrifices made by these brave individuals. At this time of year we wear poppies. We pause for two minutes of silence to pay tribute and attend ceremonies to honour their memory.

As this is the last sitting day before Remembrance Day, it is appropriate for Members to observe a moment of silence. I ask that everyone present reflect on the extraordinary sacrifices of those Canadians who have served, and continue to serve, in times of war and turmoil. Please stand for a moment of silence.

Following the moment of silence, the Speaker then concluded the tribute with: ‘They shall grow not old, as we that are left grow old: Age shall not weary them, nor the years condemn. At the going down of the sun and in the morning We will remember them.’

Chair’s Ruling (Re: Unparliamentary language)

Prior to starting Committee of the Whole, the Chair, Ms. McLeod, made the following ruling on a Point of Order raised on Tuesday, November 6, by Mr. Cathers, Government House Leader.

“On Tuesday, during general debate on Bill #7, Second Appropriation Act, 2012-13, Ms. Hanson noted what she believed to be, ‘a certain repetition to the Yukon Party.’ She then made reference to the 28th

Yukon Legislature when the Yukon Party had formed the government and quoted a statement made by an opposition member at that time. The statement contained the phrase ‘the big lie’ and asserted that repetition is essential in getting people to believe it.

Mr. Cathers then rose on a Point of Order and said that in using the word ‘lie’ in the way that she had, Ms. Hanson was trying to indirectly accuse a Member, or Members, of lying, something that she could not do directly. Mr. Cathers argued that such an action had been ruled out of order in the past.

In her defense Ms. Hanson said she was, ‘simply quoting from Hansard’ and that the words in question had not been ruled out of order when they had been used previously.

At the time the Chair said she would look at the Blues and give a ruling, if necessary. The Chair is now prepared to rule on the Point of Order.

First, in ruling on unparliamentary language the Chair has to consider the context in which the words were used at the time the Point of Order was raised. The context in which the words were used previously may, or may not, be instructive, but it is the current context that is definitive.

Second, when the Chair speaks of context, this includes evolving standards of what is, and what is not, considered unparliamentary language.

Third, Ms. Hanson, like all Members, is responsible for the words she uses in proceedings. The fact that she was quoting someone else is no defense if the words used are unparliamentary.

In this case, the Chair finds that there is a Point of Order. The Chair believes that the proximity of Ms. Hanson’s reference to Yukon Party repetition, and repetition as a tactic to convince persons of ‘the big lie’ is too close for procedural comfort. Members, or other persons, listening to these proceedings, or reading Hansard, could reasonably conclude that Ms. Hanson accused one or more Members of the Government of lying.

If Ms. Hanson wanted to avoid that interpretation she should have not used a quote that contained the word ‘lie.’

The Chair also believes that if a quote containing the phase ‘the big lie’ were ruled in order, in any context, we would run the risk of having the phrase used over and over, to the detriment of the orderliness and decorum of these proceedings.

Tuesday marked the second time in two days that Ms. Hanson had used the word ‘lie’ during proceedings, the first time directly, the second time indirectly. The Chair would suggest that she, and all Members, avoid the word – and similar words – entirely, in order to avoid any misunderstanding as to their intentions.”

(1) inventory their programs related to child welfare, cyber-safety, bullying, cyber-bullying, sexualized violence against children, and victims of crime,

(2) review the existing and proposed programs to ensure a continuum of services, (3) examine partnerships with local organizations like parent groups and with agencies

dedicated to child protection like the Royal Canadian Mounted Police and the Canadian Centre for Child Protection; and

(4) conduct awareness campaigns periodically to assist Yukon students and parents in understanding the resources available to them.

SPEAKER’S STATEMENT (Re: Members treating one another with respect) Prior to proceeding with Question Period, the Speaker made the following statement regarding Members treating one another with respect.

“On October 31st the Chair ruled on a Point of Order regarding unparliamentary language. During the course of that ruling the Chair warned all Members about using language that may not be unparliamentary in and of itself, but contributes to raising the rhetorical temperature in the House. The Chair feels that now is an opportune time to revisit this issue.

In the October 31st ruling the Chair also said that one of the fundamental principles of parliamentary procedure is that Members are to treat one another as honourable, no matter how strongly they disagree with one another about matters of public policy.

Recently, however, the Chair has noticed Members from both sides of this House making comments about other Members that are increasingly personal and disrespectful. Yesterday, for example, we heard comments that a Member is pursuing conflict with First Nations, that a Member chooses not to accurately reflect certain facts, and that certain Members do not pay attention to the proceedings. We also heard a comment about the manner in which a Member pronounced a word, and that Members take ‘cheap shots.’ The Chair could, but will not, cite similar examples from previous days.

Members may feel justified in making these kinds of remarks about other Members. That does not concern the Chair. What concerns the Chair is that some Members are personalizing the issues or treating some other Members with disrespect. In reviewing these remarks the Chair also believes that Members could have made their point without personalizing their comments.

The Chair would prefer not to intervene in Question Period and debates. However, if Members continue to disrespect one another they will find the Chair intervening.

Finally, the Chair would like to reiterate a point he has made previously: The Chair recognizes that Members are here to debate important issues; issues about which they, and their constituents, hold strong views. Strongly held views often lead to strongly-worded statements. All Members will have to accept that. However, Yukoners have a right to expect that in debating issues of public importance, Members will focus on those issues, and not on getting the better of one another.

SPEAKER’S STATEMENT (Re: Questions about Committee Business) Prior to proceeding with Question Period, the Speaker made the following statement regarding the kinds of questions that may be asked during Question Period about committee business:

“During yesterday’s Question Period the Member for Riverdale South asked questions regarding the Select Committee on Whistle-blower Protection. The Minister responsible for the Public Service Commission answered those questions.

Guideline 4 of the Guidelines for Oral Question Period says, ‘A question must relate to a matter within the administrative responsibility of the Government of Yukon.’ The activities of standing, select and special committees of the Yukon Legislative Assembly do not fall within the administrative responsibility of the Government of Yukon. All committee matters, including their membership and activities, are fully within the control of the Legislative Assembly and the committees themselves.

Guideline 13 says, ‘A question is out of order if it seeks information from the Chair of a Committee about proceedings in a Committee that has not yet made its report to the House, but is in order if it asks only if the Committee has considered a certain matter, when the Committee will next meet, or when a Committee report will be tabled in the House.’

It is in order, therefore, for Members to raise questions about committee business. However, these questions must be answered by the Chair of the Committee, not a Minister. Also, the range of questions that can be asked, as outlined in Guideline 13, is specific and limited.

THAT this House urges the Government of Yukon to: (1) implement an immediate moratorium, (2) conduct a full and rigorous scientific review; and (3) conduct a public consultation on the effects and desirability of hydraulic fracturing,

also known as “fracking”, before any regulatory approvals or permitting is allowed in Yukon.

Adjourned debate: Mr. Tredger Amendment A debate having resumed (from November 7, 2012) on the motion, it was

moved by the Hon. Mr. Cathers, Minister of Energy, Mines and Resources, in amendment thereto:

THAT Motion #275 be amended by: (1) deleting the words “implement an immediate moratorium” in clause (1),

and replacing them with the words: “respond positively to the joint request by the Yukon Conservation Society and Northern Cross (Yukon) for the Yukon Government to work with the Yukon Environmental and Socio-economic Assessment Board to improve clarity around assessment for oil and gas projects,”

(2) adding the words “of any proposed oil and gas project at each of the following stages of oil and gas development: exploration, production, and reclamation; “after the word “review” in clause (2) ;

(3) deleting the words “conduct a public consultation on the effects and desirability” and replacing them with the words “work with the Vuntut Gwitchin First Nation and stakeholders to facilitate an informed public dialogue about the oil and gas industry, including risks and benefits” in clause (3); and

(4) deleting the words “is allowed” in clause (3) and replacing them with the words “allows the use of this activity.”

GOVERNMENT MOTIONS Motion #309 Moved by the Hon Mr. Cathers, Minister of Energy, Mines and Resources:

THAT this House urges the Government of Yukon to: (1) respond positively to the joint request by the Yukon Conservation Society and

Northern Cross (Yukon) for the Yukon Government to work with YESAB to improve clarity around assessment for oil and gas projects,

(2) conduct a full and rigorous scientific review of any proposed oil and gas project at each of the following stages of oil and gas development: exploration, production, and reclamation; and

(3) work with the Vuntut Gwitchin First Nation and stakeholders to facilitate an informed public dialogue about the oil and gas industry, including risks and benefits of hydraulic fracturing, also known as “fracking”, before any regulatory approvals or permitting allows the use of this activity in Yukon.

Amendment A debate having started on the motion, it was moved by Ms. Hanson, Leader of the

Official Opposition, in amendment thereto:

THAT Motion #309 be amended by: (1) adding the words “of the practice of hydraulic fracturing, also known

as ‘fracking’, and” between the words “review” and “of” in clause (2); and

(2) deleting the words “work with the Vuntut Gwitchin First Nation and stakeholders to facilitate an informed public dialogue” and replacing them with “work with all Yukon First Nations governments, stakeholders and citizens to conduct a comprehensive public consultation” in clause (3).

Association (Motion #351) MINISTERIAL STATEMENT No ministerial statement was given. SPEAKER’S RULING Re: Standing Order 19(g), December 10, 2012 Prior to proceeding to Question Period, the Speaker made the following ruling on a Point of Order raised on December 10, 2012, by the Hon. Mr. Cathers, Government House Leader.

“Yesterday, during Second Reading debate on Bill #49, Act to Amend the Oil and Gas Act, 2012, the Leader of the Official Opposition said, ‘There are some Yukon politicians still involved who are very against the whole process of Yukon land claims. Some of them have gone on to bigger and better things, but the historic record will show that they never wanted Yukon land claims. They did not think that Yukon Indians should be accorded that right. That attitude seems to still be prevalent within the Yukon Party.’

The Government House Leader then rose on a Point of Order and said, ‘Mr. Speaker, you have ruled before, that Members are supposed to treat each other as honourable and not to suggest that someone has a bias against a group of people. To suggest that the type of attitude the member described, which is offensive and racist, was present today would certainly seem to be clearly contrary to 19(g). I think she should retract and apologize to this House and to past members of the Legislative Assembly.’

The Official Opposition House Leader then intervened on the Point of Order and said, ‘My colleague is expressing opinions based on knowledge that she is aware of, and I would suggest that this is a dispute between members.’

The Leader of the Official Opposition then said, ‘The Member opposite implied that I used the word ‘racist’. I did not.’

In raising the Point of Order, the Government House Leader made reference to Standing Order 19(g) which says, ‘A member shall be called to order by the Speaker if that member…imputes false or unavowed motives to another member.’

In reviewing the statement made by the Leader of the Official Opposition the Chair does not find that she attributed a motive, false or otherwise, to any Member. Further, the Chair agrees that the Leader of the Official Opposition did not use the word ‘racist’, nor does the Chair feel her comments implied racism on the part of any current or former member of this House. To find otherwise would be to assert that it is racist for anyone to oppose First Nations land claims or aboriginal rights. These are political issues about which people are free to disagree.

In the Chair’s view, what occurred yesterday afternoon is another example of something that has occurred with some frequency during this Legislative Assembly. To quote from a ruling I gave on May 9, 2012: ‘It is common for Members, during the course of debate and during Question Period, to offer their interpretation of the positions or policies of parties other than their own. These characterizations, which tend to be unflattering, frequently give rise to points of order.

Procedurally speaking, characterizing a party’s policies or positions in an unflattering manner is not the same as attributing a false or unavowed motive to another Member.’

I went on to say, ‘Determining the true nature of a party’s policy or position on an issue is a matter for Members to resolve through the process of debate, questions and responses. It is not a matter of procedure on which the Speaker can rule.’

All that being said, the Chair would also like to reiterate a point he made in ruling on a Point of Order on October 31 of this year. At that time the Chair urged Members to ‘…reflect upon statements they make in the House. While these statements may not be out of order, Members should consider whether they contribute to raising the rhetorical temperature in the House.’

Members have to realize that, as Members of this Legislative Assembly, they play a leading role in setting the tone of political discussion in Yukon. During this sitting there have been accusations from both sides of the House that certain Members or parties are dividing or polarizing Yukoners. The Chair believes that all Members are honourable and doing their level best for their constituents and Yukoners.

However, Members need to ask themselves whether the debate — from both sides of the House — is contributing to division and polarization. For example, Members need to ask themselves whether the public interest is being served when they inject into current debates discussions of past political conflicts.

Members of this House, and the general public, have expressed a desire for a higher level of order and decorum in the House. At the same time, Members want to be free to express themselves as they wish during proceedings, including when it comes to criticizing their political opponents. I hope Members can appreciate the difficult position that this creates for the Chair. This position is made more difficult by the fact that any intervention by the Chair, either on his own or in ruling on a Point of Order, will necessarily occur after the offending words have been spoken.

The point the Chair wishes to make is that the Chair will do what the Chair can to balance the need for order and decorum with the right of Members to express themselves. The Chair looks forward to all Members doing the same.

The Chair thanks those Members who contributed to resolving the Point of Order.
