POSITIONS TO UNEMPLOYED YOUTH (UP TO 35 YEARS)

(insert name of school) is offering temporary General School Assistant positions to the unemployed

youth of the Province up to the age of 35 years from 1 December 2020 until 31 March 2021.

The Western Cape Education Department is initiating a drive to create employment for the

unemployed youth who have an interest in education sector and in the community in which they

reside.

Duties/ tasks

Among other things, General School Assistants will be required to render services amongst others

as IT Support Workers, General Maintenance Workers (infrastructure maintenance), Care and

Support Workers, Administrative Support Workers. Help school management team in maintaining of

a safe, secure and clean school, classroom and administrative environment.

Requirements

With or without an NQF 4 qualification (matric) or Year 4 Schools of Skills qualifications or higher

qualifications. Candidate must have good organisational skills; flexibility and creativity; enjoy

working with children and young adults; patience, confidence and a compassionate attitude; good

literacy and numeracy skills; ability to manage groups of learners and deal with challenging

behaviour and ability to communicate in English and one other official language.

Remuneration

PRINCIPLES OF EMPLOYMENT

PEP Annex C

It is proposed that recruitment and selection be left to the discretion of the School

Governing Bodies (SGBs) and the school principals. The overarching principles that

need to be adhered to are that:

(i) the EAs & GSAs should come from the community where the school is located;

(ii) To ensure that there is a fair distribution of appointments within the local

community, it would be preferable where possible to limit appointment to one

per household (e.g. where a five applications are received from one

household, the appointing committee must consider and recommend only

one person for appointment);

(iii) Education Assistants should be unemployed youth up to the age of 35, not in

training, employment or studying;

(iv) Education Assistants at a school for Learners with Special Education Needs

(LSEN) may be a person with disability who is up to 35 years old, not in training,

employment or studying. The school should determine the suitability of such a

person to work with LSEN;

(v) In the category of “General School Assistants”, candidates may be youth who

are up to 35 years old, not in training, employment or studying;

(vi) Education Assistants should be in possession of a minimum of an NQF Level 4

(matric) qualification, however an NQF Level 7 (degree) will be an added

advantage;

(vii) For General School Assistants an NQF Level 4 qualification (matric) is not a

requirement; however, having such a qualification or higher will be an added

advantage;

(viii) People with qualifications in ICT, infrastructure and care workers should be

prioritised;

(ix) in selecting suitable candidates, consideration should be made to prioritise

female applicants and people with disabilities; and

(x) Males and Females should be given equal opportunities, to the extent that 50

per cent (%) of the EAs & GSAs appointed should be female.

SELECTION CRITERIA

(i) The selection of Education Assistants (EA)/ General School Assistants (GSA) will be

done at school level.

(ii) Interviews must be scheduled with shortlisted candidates.

(iii) The following documents and criteria must be adhered to at the selection

meeting:

(aa) A consolidated list of all the applicants;

(bb) Completed application forms;

(cc) Covering letter and Curriculum Vitae (CVs) of each applicant;

(dd) Testimonials (former school, religious leader, etc.);

(ee) Police clearance certificates to be provided within six weeks of

appointment;

(ff) Certified copy of identity document/ passport

(gg) Where applicable: NQF Level 4 qualification certificate, for Education

Assistant applicants with NQF level 6 and 7 will have an added advantage.

These applicants as well as those who have a teaching qualification should

be prioritised.

(hh) Candidates must not be currently studying, in training or employed.

(ii) Up to the age of 35 years of age (as specified for EA/GSA)

(iv) The list of preferred EAs & /GSAs must be submitted to the Provincial Coordinator

within a week of finalising the selection.

PREAMBLE

WHEREAS the Education Assistant/School Assistant must have an interest in supporting schools to

create a conducive teaching and learning environment; and

WHEREAS the School is prepared and able to provide such an opportunity.

NOW THEREFORE THE PARTIES AGREE AS FOLLOWS:

1. APPOINTMENT

1.1 The School hereby appoints the Education Assistant/School Assistant, subject to a clean

criminal record, to perform the services set out in the job description attached as Appendix A

for a fixed contract period commencing on …………………………….. and terminating on 31

March 2021 irrespective of the date of signing of this Agreement.

1.2 The Education and School Assistant’s/School Assistant’s employment and conditions of service

shall be governed by the Basic Conditions of Employment Act No. 75 of 1997 (herein referred

to as “the Act”).

2. REMUNERATION

2.1 The School shall pay the Education Assistant/School Assistant an all-inclusive amount of:

• R3 500 per month

a) The Education and School Assistant shall not be entitled to any payment for the duration of

this Agreement or at its termination other than the payments provided for in clause 2.1;

or

b) Constituting a basic condition of employment in terms of the Basic Conditions of

Employment Act, 1997 (Act 75 of 1997), and which may not be excluded or limited by way

of an agreement.

c) The school will contribute 1% to the Unemployed Insurance Fund and 1% for UIF will be

deducted from your stipend.

3. WORKING HOURS AND LEAVE

3.1 The Education Assistant/School Assistant shall work 40 hours per week and 8 hours per day

(meal intervals excluded).

3.2 All the prescripts regarding annual, sick, special, maternity, family responsibility leave and all

other kinds of leave (if any) and related leave prescripts for employees appointed in a full-time

capacity under the Act shall be applicable to the Education Assistant/ School Assistant.

Specific provisions are indicated below:

ANNUAL LEAVE: According to Section 20(2)(b) of the Act, the Education and School Assistants

will be entitled to one day of annual leave on full remuneration for every 17 days on which the

employee worked or was entitled to be paid.

SICK LEAVE: According to Section 22(3) of the act, the Education and School Assistant is entitled

to one day’s paid sick leave for every 26 days worked, on condition that a medical certificate

must be issued and signed by a medical practitioner or any other person who is certified to

diagnose and treat patients and who is registered with a professional council established by

an Act of Parliament.

FAMILY RESPONSIBILITY LEAVE: According to Section 27 of the Act, this kind of leave only applies

to employees who have worked for an employer for longer than four months; and who works

for at least 5 days a week for the employer.

4. OBLIGATIONS OF THE SCHOOL WITH REGARD TO EDUCATION ASSISTANT’S/SCHOOL

ASSISTANTS PERFORMANCE

4.1 The School shall make every effort to ensure that the work assigned to the Education and

School Assistant is, insofar as practically possible, providing growth opportunities and building

skills.

4.2 The School shall ensure that at least one mentor is assigned to supervise the work of the

Education and School Assistant and to assess the performance of the Education and School

Assistant on a regular basis in accordance with the job description at Appendix A, for purposes

of development only.

4.3 The School shall, as soon as practicable—

a) Furnish the Education Assistant/School Assistant with all relevant and available information

and access to relevant equipment necessary for the Education Assistant/ School Assistant

to perform the duties and receive the experience agreed upon under this Agreement.

5. CONDUCT

5.1 The Education Assistant/ School Assistant shall comply with all the prescripts referred to in clause

1.2 and all Education Assistant/ School Assistant financial and other workplace policies of the

Department.

5.2 The Education Assistant/School Assistant shall—

a) Faithfully and diligently devote his or her time to the service of the School as agreed upon;

and

b) Undertake duties in accordance with Appendix A, as any person duly authorised thereto

by the Department for this purpose requires of him or her.

5.3 Obligations: The Education Assistant / School Assistant may not during the period of this

Agreement or anytime thereafter, disclose or use any record, or any part thereof, obtained as

a result of his or her employment under this Agreement, except if—

a) The necessary written authorisation has been obtained; or

b) Required or permitted by law.

5.4 Any failure by the Education and School Assistant to comply with clause 5.1, 5.2 or 5.3 during

the term of this Agreement shall constitute misconduct.

5.5 Any alleged misconduct or inefficiency by the Education Assistant / Education Assistant shall

be dealt with in accordance with the disciplinary and incapacity procedures outlined in the

Act.

6. TERMINATION OF EMPLOYMENT

6.1 The term of service of the Education Assistant/School Assistant shall terminate at a date referred

to in Clause 1.1 or, if he or she resigns or is dismissed in terms of Chapter 5 of the Act.

6.2 The Education Assistant / School Assistant may resign any time before the end of his or her term

of service by giving—

a) one week’s notice, if the Education Assistant / School Assistant has been employed for four

(4) weeks or less; or

b) two weeks’ notice, if the Education Assistant / School Assistant has been employed for more

than four (4) weeks but not more than one year.

7. GENERAL TERMS AND CONDITIONS

7.1 GOOD FAITH

In the implementation of this Agreement, the parties undertake to observe the utmost good

faith and they warrant in their dealing with each other that they shall neither do anything nor

refrain from doing anything that might prejudice or detract from the rights, assets or interests of

each other.

7.2 INTERPRETATION

The interpretation of this Agreement shall be governed by the laws and legal principles

applicable in the Republic of South Africa.

7.3 JURISDICTION OF THE COURTS

The parties to this Agreement submit to the jurisdiction of the Courts of the Republic of South

Africa in the event of any legal proceedings arising from the provisions of this Agreement.

7.4 VARIATION

7.4.1 The Agreement constitutes the whole of the agreement between the parties to this Agreement

relating to the subject matter of this Agreement, and save as otherwise provided, no

amendment, alteration, addition or variation of any right, term or condition of this Agreement

shall be of any force or effect unless reduced to writing and signed by the parties to this

Agreement.

7.4.2 The parties agree that there are no other conditions, warranties or representations, whether

oral or written and whether expressed or implied or otherwise, save those contained in this

Agreement.

7.5 WAIVER

No waiver of any of the terms and conditions of this Agreement shall be binding for any purpose

unless expressed in writing and signed by the party giving the same, and any such waiver will

be effective only in the specific instance and for the purpose given. No failure or delay on the

part of either party in exercising any right, power or privilege precludes any other or further

exercise thereof or the exercise of any other right.

8. INABILITY TO PERFORM

It shall not be a breach of the Agreement if a party to this Agreement is prevented from or

hindered in the performance or observance of its obligations by any Act of Parliament or other

action of the State or by any cause or event outside the control of that party. Should the

Education Assistant/School Assistant not perform against expectation then clause 6.1 is

applicable.

9. NOTICE AND DOMICILLIUM

9.1 The parties choose as their respective domicilium citandi et executandi (domicile of summons

and execution) for the purpose of legal proceedings and for the purpose of giving or sending

any notice provided for or necessary in terms of this Agreement, the following addresses:

To provide administrative support to the school and assist teachers by supporting learners with their

educational and social developmental needs as well as promoting a safe and secure learning and

teaching environment. (Please note: Education Assistants are not qualified to teach)

The roles and responsibilities that can be allocated to EA include, but are not limited to the following:

(i) Support the teacher with technical preparation of the classroom for teaching and learning and ensure

and during lunch breaks.

(iii) Provide after school support to learners, such as homework classes, sports events, cultural activities

and school trips.

COVID-19 standard operating procedures.

In noting that EAs will be supporting children's learning, they must have certain traits.

(i) Being Flexible

Being flexible is a key trait of a good EA. Having the ability to adapt your time to meet the

everyday needs of the teacher will ensure that lessons are carried out to plan and that pupils get

the best learning tools and environment for their success.

(ii) Being Friendly

When working as an EA, being able to build good relationships is essential as you will be talking

to pupils, staff and parents. The EA should be able to communicate clearly and build a trusting

relationship with the learners they are supporting. This will help to develop learners’ educational

needs and allow their parents to feel confident that their children’s development is in safe hands.

(iii) Being Dedicated

A good EA will show dedication to the task allocated to them. The EA will show initiative and will

cooperate with the supervisors in the school.

(iv) Being Reliable

This means showing up for work consistently, as expected and adhering to the principle of

In noting that EAs will be supporting children's learning, they must have certain traits.

(i) Being Flexible

Being flexible is a key trait of a good School Assistant. Having the ability to adapt your time to

meet the everyday needs of the School Management team.

(ii) Being Friendly

When working as a School Assistant, being able to build good relationships is essential as you

will be talking to the School Management Team and other staff.

(iii) Being Dedicated

A good School Assistant will show dedication to the task allocated to them. The EA will show

initiative and will cooperate with the supervisors in the school.

WHEREAS the Parties have reached an agreement in terms of which the Department

will transfer into the registered account of …………………………………………… aligned

to the approved allocation for the SCHOOL/INSTITUTION (“the funds”) to the

SCHOOL/INSTITUTION for the PRESIDENTIAL EMPLOYMENT INITIATIVE PROGRAMME FOR

BASIC EDUCATION (“the Programme”) for the payment of either:

A. Stipends to education- and schools assistants; or

B. School Governing Body posts’ salaries

NOW THEREFORE THE PARTIES AGREE AS FOLLOWS:

The Department shall effect payment of the funds in tranches, through a transfer payment, prior to the effective payment date of the school’s payroll, subject to the following terms and conditions:

1. The SCHOOL/INSTITUTION hereby confirms that it takes full responsibility for the

management of the Programme for the period as set out in the agreement

between of the Parties.

2. The payment approved for the SCHOOL/INSTITUTION for the Programme will be full

and final payment to SCHOOL/INSTITUTION.

3. The funds may only be utilised for the purpose that has been agreed upon.

4. Funds shall be transferred into the designated account opened in the name of the

SCHOOL/INSTITUTION as registered with the Western Cape Education Department.

5. Should any of the funds not be used as per the agreement, after the funds have

been paid over, the relevant funds must immediately be refunded to the

Department.

6. Payroll sheets, including staff payslips and attendance registers must be retained

for audit purposes.

7. The SCHOOL/INSTITUTION grants authorised officials of the Western Cape

Government, through its Institutional Development Officers, access to its financial

records and these officials shall be entitled to inspect the SCHOOL/INSTITUTION

records at its premises, after reasonable prior written notice of its intentions to do

so has been furnished.

8. Should the SCHOOL/INSTITUTION breach any or all of the conditions as set out in

this agreement, and fail to remedy such breach within 30 days of receiving such

written notice from the Department requiring it to do so, the Department, without

detriment to any other remedy which may be available to it in law, shall be entitled

to cancel this agreement and claim back all allocated funds with interest.

9. This memorandum of agreement constitutes the sole and only agreement

between the parties pertaining to the subject matter thereof and no amendments

thereto shall be of any force or effect unless reduced to writing and signed by both

parties.

10. If any of the clauses of this agreement are found to be invalid or not binding on

the parties, such finding will not affect the validity of this agreement and the parties

agree to be bound by the other provisions of the agreement.
