ORDER No. 597-OF 2018DATED: -01-10-2018

This order disposes off departmental enquiry against constable Daya Krishan No. 888/Ktr, PID No.EXJ-986874 of District Police Kishtwar.Brief facts of the departmental enquiry are that the above named constable was posted at PP Drabshalla where from he was deputed for special duty as Bugler for Martyr's Day

Parade from PP Drabshalla to DPL Kishtwar and joined DPL Kishtwar vide DDR No. 40 dated 17-10-2015. But on 18-10-2015 the said constable was found absent during the Fall inof nafri at DPL Kishtwar and accordingly he was marked absent vide DD.No.38 Dated 18-10-2015 at DPL Kishtwar. Subsequently, the delinquent official was placed under suspensionby DySP Dar DPL Kishtwar vide his office order issued under Endst. No. Suspension/15/7107-12/DAR dated 21-10-2015 which was confirmed vide DPO Kishtwar order No. 648 of2015 dated 30-10-2015 and a departmental enquiry in this regard was initiated against the above named official which was entrusted to Dy.SP Hqrs Kishtwar.

The Enquiry Officer has conducted the enquiry against the above named official and has submitted his report to this office vide No. DySP/Hqrs/DE/17/2384 dated 22-02-2017mentioning there in that during the course of enquiry, the relevant papers were obtained against constable Daya Krishan No. 888/Ktr, PID No.EXJ-986874 S/O Sh. Gian Chand R/oBhalra Tehsil Bhaderwah District Doda. During further proceedings lines officer DPL Kishtwar was asked to secure the presence of constable Daya Krishan No. 888/Ktr PID No.EXJ-986874 for facing the departmental enquiry before the enquiry officer. Lines officer DPL Kishtwar vide PCR log No. 1261/PCR/Ktr dated 23-02-2016 intimated that the said constableis continuously running absent w.e.f 18-10-2015. On this the enquiry officer brought the matter into the notice of DPO Kishtwar vide his office letter No. DySP/Hqrs/DE/16/2641 dated23-10-2016 and requested for issuance of Attendance notice to the delinquent official constable Daya Krishan No. 888/Ktr PID No.EXJ-986874.

Accordingly an attendance notice was issued against the delinquent official from this office vide No. Estt/Att.-Notice/16/6873-78 dated 07-06-2016, copy of which was sent toincharge Police Post Bhalra with the direction to provide necessary assistance to the deputed official from DPL Kishtwar. HC Mohd Shaban No. 161/Ktr was deputed for the purposefrom DPL Kishtwar for serving the attendance notice to the delinquent official constable Daya Krishan No. 888/Ktr PID No.EXJ-986874 at his residence village Bhalra Tehsil BhaderwahDistrict Doda. The deputed official reported at Police post Bhalra where from SPO Mukesh Kumar No. 1511/SPO of Police Post Bhalra was deputed along with him. Both the officialswent to the house of delinquent official at village Bhalra but the delinquent official was not found present at his home. On enquiring about the whereabouts of constable Daya KrishanNo. 888/Ktr PID No.EXJ-986874 from the respectable of the village (lumberdar/chowkidar) his whereabouts could not be ascertained. In this aspect a written certificate was taken fromchowkidar Halqa Bhalra Sh. Hans Raj Bhagat. Copy of the attendance notice was then handed over to one Bal Krishan S/O Gian Chand R/O Bhalra real brother of the delinquent offi-cial constable Daya Krishan No. 888/Ktr PID No.EXJ-986874 with the directions to inform the delinquent official to resume his duties in presence of Lumberdar/chowkidar Halqa BhalraTehsil Bhaderwah District Doda..

Whereas another attendance notice was issued vide this office No. Estt/Att.-Notice/17/750-54 dated 17-01-2017, copy of which was sent to I/C Police Post Bhalra with the direc-tion to provide necessary assistance to the deputed official from DPL Kishtwar. ASI Dawood Khan was deputed for the purpose from DPL Kishtwar for serving the attendancenotice to the delinquent official constable Daya Krishan No. 888/Ktr PID No.EXJ-986874 at his residential address village Bhalra Tehsil Bhaderwah District Doda. Copy of the atten-dance notice was handed over to the delinquent official constable Daya Krishan No. 888/Ktr PID No.EXJ-986874 against a proper receipt with the directions to resume his dutiesbut despite that the delinquent official did not resume his duties.Whereas another attendance notice was issued from this office vide No. Estt/Att.-Notice/17/1491-95 dated 02-02-2018. Constable Bagh Hussain No. 779/Ktr was deputed forthe purpose from DPL Kishtwar for serving the attendance notice to the delinquent official constable Daya Krishan No. 888/Ktr PID No.EXJ-986874 at his residential address vil-lage Bhalra Tehsil Bhaderwah District Doda. Copy of the attendance notice was handed over to the delinquent official constable Daya Krishan No. 888/Ktr PID No.EXJ-986874against a proper receipt with the directions to resume his duties in presence of Lumberdar/chowkidar Halqa Bhalra Tehsil Bhaderwah District Doda, but the official failed to reportat DPL Kishtwar. Whereas final attendance notice was issued from this office vide No. Estt/Att.-Notice/18/3933-36 dated 30-03-2018 against the delinquent official constable Daya Krishan No.888/Ktr PID No.EXJ-986874 copy of which was sent to SHO Police Station Bhaderwah with the direction to depute an official from police station Bhaderwah to deliver/executethe attendance notice to the delinquent official constable Daya Krishan No. 888/Ktr PID No.EXJ-986874 at his residential address SHO Police Station Bhaderwah sent the noticeto I/C Police Post Bhalra for execution of the same and report thereof. The notice was got noted by the delinquent official in presence of Lumberdar/chowkidar Halqa Bhalra TehsilBhaderwah District Doda through SPO Uttam Singh No.1427/SPO of Police Post Bhalra. But once again the delinquent official failed to report at DPL Kishtwar.Whereas, a Show cause notice was issued from this office vide No. Estt/Show cause.-Notice/18/8603-12 dated 29-06-2018 against the delinquent official constable Daya KrishanNo. 888/Ktr PID No.EXJ-986874 which was published in Newspaper Daily Excelsior on 01-07-2018 and also got noted by the delinquent official through Sgct Pritam Lal No. 180/Ktrof DPL Kishtwar in presence of Lumberdar/chowkidar Halqa Bhalra Tehsil Bhaderwah District Doda but the delinquent official did not resume his duties.Whereas, a final Show cause notice was issued from this office vide No. Estt/Show cause.-Notice/18/11947-56 dated 14-09-2018 against the delinquent official constable DayaKrishan No. 888/Ktr PID No.EXJ-986874 which was published in Newspaper Kashmir Times on 18-09-2018 and also got noted by the delinquent official through Sgct Mohd IsaqNo. 216/Ktr of DPL Kishtwar in presence of Lumberdar/chowkidar Halqa Bhalra Tehsil Bhaderwah District Doda but the delinquent official again showed no response to resumehis duties.

The delinquent official was given reasonable opportunity to represent his case/resume his duties which inter- alia include message No.1. Estt/16/2357 dated 29-02-20162. Estt/Absent/2016/7524-25 dated 24-06-20163. Estt/Absent/2016/7745-46 dated 30-06-20164. Estt/Absent/2016/7737-40 dated 30-06-20165. Estt/DE/2016/9147-48 dated 08-08-2016

Despite of the above he choose to stay away from the process of departmental enquiry and is still absent from duties which reflects his gross negligence and also shows that heis not interested to work. It has also been proved that the official has absented himself unauthorisely on 18-10-2015 which is an act of indiscipline as per Rule 208 (g) of Police RuleJ & K.

Rule 208 (g) of Police Rule J & K read as "Absence without leave or after the end of leave involves loss of appointment except in case of ill health when the absen-tee must produce the certificate of the Medical Officer".

Whereas, almost 2 years and 11 months have passed since the departmental enquiry was initiated against him but the delinquent official is still running absent and avoiding theenquiry which has forced the undersigned to take ex-partie decision.Whereas on the perusal service record, it has been found that the delinquent official is habitual of absenteeism and in consequence of which he has earned the below mentionedpunishments:-

1. Annual increment forfeiture for one year = 02 times2. Annual increment stoppage for one year = 02 times3. Censure = 05 times4. Diesnon = 04 times (316 days)

Therefore, after giving thoughtful consideration to pros and cons of the enquiry and paying due consideration to the regulations contained in the Police Manual, I am constrainedto take affirm view about the indiscipline exhibited by the delinquent official. In addition to the commission of service misconduct, the delinquent official has resorted to insubordinationwithout caring for the rules and norms of a disciplined organization like J & K Police and deserves to be dealt with under Law/Rules and regulations of the Department. Keeping himin the organization will badly affect the discipline of the organization which is considered to be a

law enforcing agency of the state. If the delinquent official is kept on the Roll of the department it will tarnish the image of the organization as a whole and will have a bad impacton the force.

In view of the above facts, it is ordered that the delinquent official constable Daya Krishan No. 888/Ktr PID No.EXJ-986874 of District Police Kishtwar is hereby "removed" fromservice and he is struck off from the roll of District Police Kishtwar w.e.f 18-10-2015, the date he absented himself un-authorisely and the period of his un-authorised absence w.e.f 18-10-2015 to till date is treated as Diesnon on the principle of NO WORK NO PAY. The delinquent official will deposit all uniform/Govt. articles in District store DPL Kishtwar forthwith,failing which action as warranted under law shall be taken against him. Army organisesmedical camp

STATE TIMES NEWS DODA: In order to address themedical needs of the local popu-lace in far flung area of theregion, Indian Army under tookan initiative to organise a med-ical camp at village Panchai ofDoda district. The camp wasaimed at providing basic med-ical facilities to villagers ofChagsoo, Malohta, Kawani,Pamassa, Bagh, Kemagha,Gurekra, Bhatian, Hakuna andSharni. A medical team underMedical Officer of Indian Armyalongwith doctors from the CivilHealth Department of DistrictDoda, Govt of J&K providedmedical aid and screening tolocal population. Medicines werealso distributed to patients.

A total of 508 patients weretreated including 37 children,173 males and 298 females.The local population appreciat-ed the efforts of the army inameliorating the medical needsof the region.
