1 Introduction1.1 Purpose of the DocumentThis draft procurement plan outlines how the SKA Observatory (SKAO) intends to procure/acquire the work-packages described within this plan.

3 Executive Summary
The overall SKA-1 procurement model is a hybrid of allocation and tendering, with a number of significant work-packages, including the CSP Low work-packages which were provisionally allocated to The Netherlands by the Council Preparatory Task Force during its eighth meeting (CPTF-08) in September 2019.
Work-packages not allocated by the CPTF will be bundled into contracts and competitively tendered amongst the membership of the SKAO.
Members with provisional allocations were asked to submit outline proposals. The Netherlands and Australia prepared an outline CSP proposal for Work Package 01.03.04 CSP Low;
The Netherlands SKA1 tier 1 CSP Low Work package Delivery Plan [RD1]
These outline proposals were reviewed internally by the SKAO and preliminary positive feedback was provided by the SKAO to CPTF-10 in November 2019.
The CSP Low contracts will be procured for a cash consideration for both the Dutch and Australian contributions.
There is one issue that remains to be concluded, the agreement on the type of NEC4 contracts. This document addresses the current form of contract and indicates that changes may still occur in order to align contracts used throughout SKA-1 construction and/or further negotiations with contracting parties. Note that the SKAO holds the central contingency and controls the processes by which the contingency is released.
This draft procurement plan is a further iteration of the outline proposal [RD1] received from The Netherlands and Australia. This draft procurement plan, once approved, will form the basis for the procurement section of the SKA-1 Construction Proposal.
4 Background and History
The original CSP element consisted of five sub-elements, with the correlator/beamformer dedicated to respectively the Mid or Low telescopes (Mid.CBF, Low.CBF) and sub-elements common to both telescopes (LMC, PSS, PST). When the SAFe method was introduced, the work package breakdown structure for CSP Low changed and now only contains CSP Low Activity Management and the Low Correlator and Beamformer (Low.CBF).

The CSP Low Activity Management work package contains the organisation and the Assembly/Integration/Verification for all sub-elements of CSP Low. This includes the integration of Pulsar Search (Low.PSS), Pulsar Timing (Low.PST), Correlator and Beamformer (Low.CBF), and Local Monitoring and Control (Low.LMC). Note that Low.PSS, Low.PST and Low.LMC are not part of this work package. To coordinate delivery, all development tasks are performed within the SAFe framework.
The Assembly/Integration/Verification activity within CSP Low, now called CSP Sub-System Integration (SSI), depends strongly on the availability of PSS, PST and LMC, therefore close cooperation with the SAFe PSS, PST and LMC development teams is required.
The Low.CBF work package delivers the CBF to the CSP Low SSI. It contains the hardware development, production, and the code development for the complete correlator and beamformer functionality.
Both hardware development at ASTRON and code development at CSIRO will be organised within SAFe which optimizes the integration within the SKA and prepares for the CSP SSI. The Tier 1 Lead will work closely with the SKA SAFe teams to ensure overall on schedule delivery and technical alignment of CSP Low. The Hardware Production sub-contractor will primarily interface with ASTRON in technical matters and the Tier 1 Lead for scheduling and financial matters.
Figure 1 illustrates a possible cost breakdown of CSP Low starting with the allocations provided in the CSP Low Work Packages. The approximate internal CSP Low allocations are indicative only and will be finalised before contract award.

5 Description of Contract(s) to be procured
5.1 Scope of work
The SKAO will procure, in accordance with the SKAO Procurement Policy and Procedures [AD2], four single source contracts (to be formally confirmed) for The Netherlands and Australia covering the following outline scope of work:
1. Management and System Engineering for the CSP Low and Low.CBF work packages, including delivery to System ITF and/or Site according to the Roll-out Plan for SKA1 Low [AD3]
2. Development and design verification of the Low.CBF hardware 3. Production and testing of the Low.CBF hardware 4. Development of the Low.CBF code (firmware and software), integration of the
Low.CBF sub-element, and CSP Low sub-element Sub-System Integration (SSI) including testing of products delivered by other CSP Low product contracts (CBF, PSS, PST and LMC), as well as integration support with all SKA Low products (CSP Low, LFAA, TM, INAU, SDP, and SADT)
CSP Low contract documents, including the CSP Low reference designs, for all contracts will be prepared by the SKAO during the bridging phase. SAFe contracts are to be written to cover the full scope of work to be delivered by The Netherlands and Australia. Commercial tender packages (such as hardware production) will be prepared by the CSP Low Tier 1 Lead during construction.
5.2 Contract Duration and Key MilestonesThe SKAO intends to procure these contracts as soon as possible after T0 as this work is on the SKA1 Low critical path.
The duration of the contracts will extend throughout all Array Assemblies and will end after completion of support services to the Low System AIV team.

These contracts will be activity-based with key delivery milestones derived from the SKA-1 Master Schedule [AD4] and Roll-out Plan for SKA1 Low [AD3].
5.3 Estimated Contract ValuesThe estimated contract values below are as per the SKA-1 Cost Book (System CDR version) [AD1].
The Cost Book value of these CSP Low contracts is approximately €23M excluding contingency. These contracts are allocated to two countries as shown in Table 1. Costs indicated are approximate internal CSP allocations and will be finalised before the contracts are awarded (to achieve an appropriate balance of management and technical work).
Note that for Australia:
the Low.CBF code development, Low.CBF integration and CSP Low SSI contracts will be with CSIRO.
For The Netherlands:
the hardware development contract will be awarded to ASTRON the hardware production contract will go to a Dutch production company The Low.CBF Management contract will be awarded to a commercial Dutch company
and will deliver Low.CBF to CSP Low (and effectively SKAO) The CSP Low Management Tier 1 contract will be awarded to a commercial Dutch
company and will deliver CSP Low to SKAO.

5.4 Critical Dependencies and Constraints
There are a number of critical dependencies and constraints that could impact this Procurement Plan, including:
■ CSP Low PSS/PST/LMC are contracted to other Tier 1 contractors which may potentially result in this CSP Low contract not delivering the product or functionality (and/or to schedule) due to lack of direct control of the other CSP sub-elements.
■ Lack of maturity of the interfacing SKA SAFe process particularly with regard to the integration of hardware and software products.
■ AA0.5 was not identified as an Array Assembly milestone in the CSP Low CDR roll out plan [RD2] and consequently this will place extra constraints on the delivery schedule.
■ The Roll-out Plan for SKA1 Low [AD3] has evolved in pre-construction and may be different to the CDR version which may result in schedule discrepancies.
■ Exchange rate variations may result in costs beyond the contract estimated value.
■ COVID-19 may create travel restrictions between The Netherlands and Australia and could result in schedule constraints.
6 Through Life Costs
All NEC4 Engineering and Construction Contracts (ECC) will include the following:
● Delivery of the functionality for the particular array assembly
● Simulators and/or emulators, as needed, for integration activities
● As Built Information and data packs
● Training materials and documentation
● Warranties (and Spare Parts)

● Maintenance of assets after handover to SKAO
All NEC4 Professional Service Contracts (PSC) will include the following: Delivery of the functionality for the particular SAFe Program Increment (PI) Activity schedule for each PI Mutually agreed set of objectives or features Up to date documentation on the delivered products As built information and data pack provided to SKAO
7 Contractual Considerations
7.1 Contract TypesNEC4 contracts are felt to be appropriate to SKA’s context as it is based on collaborative rather than adversarial processes. The following information on NEC4 is provided for reference only (source: Wikipedia)
NEC4-ECC: The NEC4 Engineering and Construction Contract (ECC) has been developed for any construction based contract between an Employer and a Contractor. It is intended to be suitable for any sector of the industry. Within the ECC contract there are six family level options.
NEC4-PSC: This contract is for anyone providing a service, rather than doing any physical construction works. Designers are the most obvious party that fit into this category. Whilst they are producing a design for an employer or contractor, they would sign up and follow the clauses within the PSC. Most of the clauses within this contract are the same or similar to those in the main ECC contract, so that all contractors, designers and subcontractors have pretty much the same obligations and processes to follow as each other.
NEC4-SC: This is for a supplier of supplies or goods to a project, and puts extra contractual requirements on them during their procurement/manufacture period. The Supply Contract is for big bespoke items i.e. designed and manufactured specifically for that contract, with the Short Supply Contract potentially being for more run of the mill / commoditised items on a project. Neither of these contracts cover working on a Site. i.e., as written they are not 'supply and install' contracts.
The exact type of contract will be determined before contract award, however for the moment the assumption is that
ECC contracts could be used for the management (CSP Low and Low.CBF) SC contract could be used for hardware production PSC contracts could be used for SAFe teams (development and integration)

Figure 2 illustrates a possible management structure for both CSP Low and Low.CBF. CSP Low delivers the overall element to SKAO, and Low.CBF delivers the sub-element to CSP Low.

7.2 Price Type and Payments
The CSP Low Tier 1 contracts will be cash contribution agreements based on NEC4 contracts.
All construction credits awarded by the SKAO for work performed under the Tier 1 CSP Low contracts will be made upon satisfactory completion of milestones (which may be based on time contributed to SAFe teams).
8 Status of Technical Requirements for Procurement
The current scope of work is for the full SKA-1 Design Baseline. However, the SKA-1 Construction Proposal could be developed around a reduced SKA-1 Deployment Baseline.
The SKA Office is currently assessing and planning to update the following documents to reflect the Deployment Baseline as required:

The Design Baseline has been approved at S-CDR, any changes will follow the ECP process.
9 Outline of Proposed Principles for Market Engagement
The CSP Low Contracts will be awarded to organisations within the Netherlands and Australia and need to be expedited as a sole source negotiated acquisition in order to enable timely appointment within 6 months of T0 so as to allow construction to start as soon as possible.
10 Supplier selection In the case where sub-contracts are placed, these are bound to national procurement laws and will be advertised according to applicable rules/regulations.
All potential suppliers will be pre-qualified. Prequalification will be led by the Tier-1 Lead on behalf of the SKAO in accordance with criteria set by the SKAO in consultation with the Tier-1 Lead. These will include both qualitative and financial criteria and must include health, safety and environmental criteria.
Shortlisting of potential tenderers will be carried out based on ranking. Any final shortlist will be capped appropriately.
Tendering and subsequent contract award will be carried out in accordance with SKAO Policies and Procedures.
11 Risks associated with this Procurement Plan
Time to award is delayed by lack of maturity of the interfacing SKA SAFe process particularly about definition of the responsibilities for integration of hardware and software products and identification of resources to undertake any additional integration activities.
● CSP Low PSS/PST/LMC are contracted to other Tier 1 contractors which may
potentially result in this CSP Low contract not delivering the product or functionality (and/or to schedule) due to lack of direct control of the other CSP sub-elements.
● Exchange rate variations may result in costs beyond the contract estimated value.
● For the integration of CSP Low hardware and software products the identification of
which resources (System AIV, CSP Low SSI, Low.CBF Integration) are to undertake any issue-fixing activities to make the integration successful. It is often the case that responsibility gets pushed down to lower parties even though they may not be responsible.

12 Fair Work ReturnAll contracts will be awarded to entities from the Netherlands or Australia. The contract amounts are within the Fair Work Return specified and approved by the SKAO.
13 RecommendationsRegarding the SKA-1 CSP Low contracts, and subject to consideration of the risks identified in Section 10 above, the authors recommend that:
● This Procurement Plan is endorsed and approved; and
● This Procurement Plan is used to develop the procurement section of the SKA-1
