Dear Ms Malphury,

You've done a remarkable job of documenting this case, and the only thing missing is understanding

how we did the best we could do, based on questions we asked the Internal Revenue Service and the

Florida Elections Department We did not make the rules, but did everything possible to follow them,

even though we received, at times, conflicting information about the interpretation, from the very

people that supposedly could give definitive answers about those rules

The paperwork we received stated that we are a "committee" There were comments in the first

paragraph of you letter stating, "your committee", violated .etc We are not a committee, but a 501c 4

corporation registered with Sun Biz I just wanted to correct that

When we started this 501c4, Pets' Voice, our attorney did extensive research, including speaking with

the IRS and Florida Election department explaining our mission At that time we were not doing

anything political, and had no thoughts of doing anything political .. The advice we were given was to

form the 501 c 4, because it allowed us to operate as a social welfare organization, AND to be political to

some extent if need be

The "some extent" appears to be the issue, and from everything I've read, it seems the Supreme Court

and Congress are trying to figure it out as well Unfortunately, it seems we are caught between

conflicting positions on how 501 C 4's can operate, and hopefully it gets sorted out soon

We take issue that we didn't call the Florida Elections Department until a "complaint was filed" Our

attorney called when the 501 c 4 was set up, almost one year before we did anything "political" Of

course we called AFTER the complaint was filed because we wanted to find out if we had done anything

wrong! According to the Florida Election Department, (and please review the email) we had options,

but nothing was mandated that we needed to do We were told we didn't need to change anything

There was certainly not any "willful" intent to circumvent the law, and our discovery of the legal

national issues between PAC's and 501c4's only came to light when we saw that clarity was not a fine

point regarding these laws Everyone seems to have their own opinion of what is right and how to do it

It is hard to willfully do anything wrong when no one really knows what is right or what is wrong.

We made the best effort possible to do everything correctly, including speaking with the Florida

Department of Agriculture which seemed very satisfied with the reports we sent them They said we

were on time, and told us that our financial reports were on time as well

If you were in our shoes, I don't see how you would have done anything differently We worked exactly

as the directions we were given, by people that should know.

STAFF RECOMMENDATION FOLLOWING INVESTIGATION

Pursuant to Section 10625(4)(c), Florida Statutes, undersigned staff counsel files this written recommendation for disposition of the sworn complaint in this case recommending that there is probable cause to charge Respondent with violating Sections 106 .. 03(1)(a), 106.19(1)(b), and 106.19(1)(c), Florida Statutes, and that there is no probable cause to charge Respondent with violating Section 106.143(1)(c), Florida Statutes Based upon a thorough review of the Report of Investigation submitted on December 15, 2014, the following facts and law support this staff recommendation:

L On August 11, 2014, the Florida Elections Commission ("Commission") received an amended sworn complaint from Juan-Carlos Planas, Esq ("Complainant"), alleging that Pets' Voice (''Respondent") violated Chapter I 06, Florida Statutes

2 Pets' Voice, Inc, a Florida corporation ("corporation"), filed its Articles of Incorporation with the Florida Secretary of State on June 27, 2013 (ROI Exhibit 1, page 1)1 The corporation appears to be registered with the Internal Revenue Service as a section 504(c)(4) organization. (ROI Attachment A)

3 By letter dated October 2, 2014, the Executive Director notified Respondent that Commission staff would investigate the following statutory provisions:

Section 106.03(1)(a), Florida Statutes: Respondent, a registered nonprofit 50l(c)(4) organization, was required to register as a political committee, but failed to do so, as alleged in the complaint

Section 106.143(1)(c), Florida Statutes: Respondent, a registered nonprofit 501(c)(4) organization, was an umegistered political committee that failed to mark political advertisements with proper disclaimers, as alleged in the complaint

Section 106 .. 19(l)(b), Florida Statutes: Respondent, a registered nonprofit 50l(c)(4) organization, was an unregistered political committee that failed to report contributions required to be reported by Chapter 106, Florida Statutes, as alleged in the complaint

Section 106.19(1)(c), Florida Statutes: Respondent, a registe1ed nonprofit 50l(c)(4) organization, was an unregistered political committee that falsely 1epo1ted or deliberately failed to include info1mation in one or more campaign repo1ts 1equired by Chapter I 06, Florida Statutes, as alleged in the complaint

4 Complainant alleged that Respondent violated Florida's election laws by failing to register as a political committee, distributing political advertisements without the prope1 disclaimers, and failing to file campaign finance ieports.

Background

5. Prior to the formation of the co1poration, Pets' Voice existed as a political committee registe1ed with the Division of Elections as of Ap1il 5, 2012 (ROI Exhibit 2, page I) The committee later disbanded and registe1ed as a political committee ("committee") with the Miami-Dade Elections Department on October 10, 2012 (ROI Exhibits 3, 4, & 10) Michael Rosenberg was the chai1pe1son of the State and Miami-Dade County political committee (ROI Exhibit 2, page 2, & ROI Exhibit 4, page 2) The committee's interest was promoting animal welfare and suppo1ting issues to improve quality of lifo for animals .. (ROI Exhibit 4, page I)

6 Mme specifically, the committee was established fo1 the sole purpose of suppoiting the Pets' Trust ballot initiative. (ROI Exhibit 11, page I) The ballot initiative was a non-binding straw vote placed on the November 6, 2012 Miami-Dade County General Election ballot Miami-Dade voters approved the straw vote which sought to increase taxes in order to generate 1evenue to fond improved animal services in Miami-Dade County (ROI Attachment B)

7.. The committee disbanded on Januaiy 23, 2014 .. (ROI Exhibits 5 & 9, page I) The co1poration, Pets' Voice, Inc was established on June 27, 2013. (ROI Exhibit I)

9 Respondent's Articles of Incorporation show that Respondent initially had three directors (ROI Exhibit 1, pages 2-3) According to Michael Rosenbe1g, President, Pets' Voice, Inc .. , as of December 2014, the corporation had 12 advisors or members (ROI Exhibit 13, page 2)

10 Mr .. Rosenberg stated that in June 2014 Respondent requested donations to help support candidates that would honor the 2012 Pets' Trust Vote Mr .. Rosenberg stated that the corporation was vety specific about what the donations would be used for Mr Rosenberg stated that the corporation made contributions to the campaigns of Majorie Figueha and Daniella Levine Cava.. ML Rosenberg also admitted that the corporntion published the political advertisements that were submitted with the complaint (ROI Exhibit 13, pages 2-3) Mt. Rosenberg stated that the two political mailers distributed by Pets' Voice, Inc .. cost between $2,000-$3,000. (Attachment A, Phone Log Entry 7) The mailers contained the following express advocacy language: "Fire Pepe Diaz on August 261h!" and ''Goodbye to Pepe Diaz on 26 August!" (ROI Exhibit 6, page 2, arid ROI Exhibit 7, page 2)

11 The corporation's Articles of Incorporntion show its stated pmpose is to promote social welfare within the meaning of section 50l(c)(4) of the Internal Revenue Code of1986 (as amended) by undertaking activities that geneially improve the welfare of companion animals (ROI Exhibit 1, page 1) Mr.. Rosenberg further stated that the primary purpose of the corporation is to educate the community about pet welfare and the mission of the Pets' Tmst ballot issue (ROI Exhibit 13, page 2)

12. Respondent is a political committee under Section 106Ol1(16)(a), Florida Statutes The corporation made expenditures in excess of $500 that expressly advocated for the defeat of a candidate when it pm chased the two mailers mging Miami-Dade voters to fire Pepe Diaz on August 26th. (ROI Exhibits 6-7) The corporation also accepted contributions eaimarked for specific candidates, although it is unclear the total amount of contributions accepted Fmther, the corporation does not qualify for the Chapter 617 business entity exemption because although it was formed for a purpose other than to support or oppose issues or candidates, it received contributions

Mr Rosenberg stated that the corporation did not need to register as a political committee because until June 2014 the co1poration did not act on behalf of candidates in any financial way and that according to an email from the Division of Elections, as long as Respondent's primary purpose was social welfare then it had the option to create a political committee if it wanted. (ROI Exhibit 12, page I) Mr Rosenberg also stated that the corporation spoke to the IRS and was told that a section 50l(c)(4) corporation can support and end01se candidates, as long as it is not the main goal of the organization (ROI Exhibit 11, page I)

15 Mr. Rosenberg stated that he relied upon information fiom the Division of Elections regarding whether the corporation needed to register as a political committee An email from Mr Rosenberg to the Division of Elections stated that "[Pets' Voice] can promote and endorse political candidates that believe in our mission Howeve1, we cannot seek donations specifically for the purpose of political activity, but rather for the overall purpose of our group .. .. I understand if we put Pets' Voice Political Committee [on a flyer] then we need to form a PAC that could be a part of the Pets' Voice, with the money that people donate clearly marked if it is being used for the Pets' Voice general fund, or the PAC Ifwe do this PAC, we would need to report on a much more defined schedule as the State requires. We are not going to start a PAC, so we removed from our website the information about donating for candidates. (Which had only been on our website for a week.) . "Kristi Reid Bronson, Bureau Chief, Bureau of Election Rec01ds, Division of Elections, in her email response to Mr. Rosenberg stated that "This is an accurate recollection of our conversation "(ROI Exhibit 11, page 2)

16 It should be noted that the email fiom Mr. Rosenberg to the Division is dated August 7, 2014, more than a year after forming the corporation and approximately two months after the corporation began collecting contributions for the purposes of supporting and opposing candidates for public office (ROI Exhibit 11, page 2) Therefore, it does not appear that the corporation attempted to determine its responsibilities under Florida's election laws until after it became aware of the pending complaint

17 As a political committee, Respondent made expenditures during the 2014 calendar year in an aggregate amount which exceeded $500 when it purchased the two mailers which advocated for the defeat of Pepe Diaz (Attachment A, Phone Log Entry 7) Therefore, Respondent was required to file a statement of organization within 10 days after its organization, but failed to do so

Alleged Violation: Section 106.143(1)(c), Florida Statutes

19.. The two political mailers and YouTube video each contain a vauatron of "Political Advertisement Paid for and approved by Pets' Voices Inc 6952 NW 12th Street, Miami, FL 33126" The flyer contained the entity name "Pets' Voice Political Committee Independent of any candidate" in addition to the same address .. (ROI Exhibits 6-8)

20.. Mr.. Rosenberg stated that the flyer had an incorrect disclaimer because it referenced Respondent as a political committee (ROI Exhibit 12, page 1) Mr.. Rosenberg stated that he reviewed the advertisements for content Mr Rosenberg directed the printer to use the disclaimer that Pets' Voice had used in the past not realizing it included the words "political committee" but he stated he conected the advertisements once he realized the eno1 (ROI Exhibit 13, page 3) Mr Rosenberg also stated that the flyers were posted to telephone poles and were only up for one day (Attachment A, Phone Log Entry 7)

24.. As a political committee, Respondent was required to report any contributions it received for the purpose of influencing the results of an election, but failed to do so.

25 Under Section 106.. 19(1 )( c ), Florida Statutes, political committees are prohibited from falsely reporting or deliberately failing to include any information required to be reported by Chapter 106

26. Chapter 106 requires political committees to report any contributions received and any expenditures made fo1 the purpose of influencing the results of an election. Respondent deliberately failed to include information 1equired to be reported by Chapter 106 when it failed to disclose contributions received and expenditures made to the campaigns of Majorie Figueira and Daniella Levine Cava .. 27 "Probable Cause" is defined as reasonable grounds of suspicion supported by circumstances sufficiently strong to warrant a cautious pe1son in the belief that the person has committed the offense charged Schmitt v State, 590 So 2d 404, 409 (Fla. 1991).. 28 The facts set fo1th above show that Respondent is a Florida corporation. Respondent made expenditures in excess of $500 that expressly advocated for the defeat of a candidate and was therefo1e required to file a statement of organization, but failed to do so As a political committee, Respondent was required to iepo1t any contributions it received for the pmpose of influencing the results of an election, but failed to do so Respondent also deliberately failed to include information required to be reported by Chapter 106, when it failed to disclose contributions received and expenditmes made to the campaigns of Majorie Figueira and Daniella Levine Cava .. Based upon these facts and circumstances, I recommend that the Commission find no probable cause to charge Respondent with violating Section 106J43(1)(c), Florida Statutes, and find probable cause to charge Respondent with violating the following:

On or about June 1, 2014, Pets' Voice violated Section 106 03(1)(a), Florida Statutes, when it failed to file a statement of organization within 10 days after its organization

Count2:

He also explained that an advertisement, he thought it to be the first adve1tisement published, did include a political disclaimer; howeve1, it included the word "political committee " He said that "we" spent hours correcting the disclaimer by taking a marker and blackening out the word "political committee " He added that each advertisement aftet that had a correct political disclaimer.

Mr Rosenberg was asked about the company that printed and mailed the mailers.. He said that it was some "advertising agency" but was unsure which company. When asked about invoices, he said that he did not have any invoices as the group of volunteers who make-up Pets' Voice has more-or-less gone their own way since the election and he was not involved in that aspect of it He added that he did not know, who from the grnup, may have retained the invoices, if any. However, he did stipulate that he would guess that the two mailers costs somewhere between $2,000 and $3,000.

He began to p10test that he was told by "you guys" that a 501(c)(4) grnup could accept contributions and make expenditures as long it was not used primarily for campaigning.. I advised him that the purpose of requesting the invoices was to determine exactly whether the group made expenditures during a calendar year in an amount exceeding $500 Mr Rosenberg again stated that he would guess that the two mailers cost at least between $2,000 and $3,000

Section 106 143(1)(c), Florida Statutes, failure of a political committee who made an expenditme for and published a political advertisement before the election to mark p10minently the advertisement with the required disclaimer;

Section 106 19(1 )(b ), Florida Statutes, failure of a person or organization to report a contiibution required to be reported by Chapter 106, Florida Statutes; and

According to Complainant, Respondent published a number of advertisements that opposed the candidacy of incumbent County Commissioner Jose Diaz4 and he is of the belief that Respondent raised and spent over $500 and should have registered as a political committee Withhis complaint, Complainant offered vaiious mailers, and a flyer, for review.

9 Incumbent Miami-Dade County Commissioner Jose Diaz was opposed in the primaiy election held on August 26, 2014, by Maijorie C Figueira. Mr.. Diaz was re-elected to office after seeming 72 27% of the vote.

Complainant alleged that Respondent also published a "You Tube" video advocating that voters vote against Commissioner Jose Diaz and the election of candidate Marjorie Figueira Commission staff viewed the video, which states: "Sometimes it's hard deciding who to vote for but in the August 26 election for County Commission, DistJict 12, a hard decision could be pretty easy. Consider this: 'and it was 65% in general .in my District it was a little over 80% " (Commissioner Diaz is speaking) The voters had spoken They wanted THE PETS' TRUST .. Pepe Diaz betrayed voters It's time to send Pepe packing The Pets' Voice Choice Maijorie Figueira .. She listens.." A disclaimer printed across the screen reads, "Paid Political advertisement paid for by Pets' Voice 6952 NW 12th Street, Miami, FL 33126"

14. In a telephone interview with Michael Rosenberg, Chairman of Pets' Voice, he

16 Michael Rosenberg responded to the complaint on behalf of Respondent According to Mr Rosenberg, there ate two "Pets' Voice" In his response, Mr.. Rosenberg explained that originally, there was a Pet's Voice, an issues-based political committee, which was properly registered with the Miami-Dade County Supervism of Elections' office but that eventually closed sometime later Mr Rosenberg added that the original Pets' Voice, which he refened to in his response as "Pets' Voice (one)," was never involved in the 2014 election To review the response fl om Michael Rosenberg, refer to Exhibit 11 ..

17.. In a separate response, Mr Rosenberg further explained that the original Pets Voice (Pets' Voice one) was established for the purpose of promoting a single issue, the Pets' Trust ballot initiative (Item #240 on the November 6, 2012 Miami-Dade general election ballot) and when the election was over, the political committee closed ..

18. Mr.. Rosenberg added that in the summer of 2013, he and others begin to realize that certain county commissioners were not going to honor the results of the non-binding straw ballot and "we needed some other way to communicate om message of action " He added that also around the same time, he and others were trying to get the state to pass legislation, to make the results of the straw-ballot binding He farther added that meant seeking State Representatives and Senators to help them sponsor this legislation

19. According to Mr .. Rosenberg, at the time, he and others were not thinking about supporting candidates, only working with the existing officials, which, he said, a 50l(c)(4) organization, can do Mr Rosenberg reported that he and others spoke to the "elections department" and the IRS and were told that a 50l(c)(4) organization can support and endorse candidates, as long as that is not the primaiy or main goal of the organization He added that as the year went on, and after meeting with members of the county commission and the mayor, he and others folt it was time to find and support candidates that would honor what the people had previously voted for Io review an additional response from Michael Rosenbe1g, refor to Exhibit 12.

6 Mr Rosenberg said that he had no idea who had or where invoices would be as he did not deal with the financial aspect of the group and that volunteers have more-or-less gone their own way I also called Lindsay Gorton, who was named as the secretary/treasurer, but she said that she had resigned her position sometime in September 2013 and therefore, she was no longer affiliated with the group

20 As part of his response to the complaint, Mr Rosenberg submitted a copy of an e-mail exchange between him and Kiisti Reid Bronson, Chief~ Bureau of Election Records .. Theemail is dated as August 7, 2014, and is from Mr. Rosenberg to Ms Bronson and the subject line is titled, "The Pets' Voice . thank you for explaining."

21 In the e-mail, Mr .. Rosenberg reminded Ms B10nson that he had previously spoken with her relative to his questions and concerns about how a 50l(c)(4) organization works in the state Mr Rosenberg's e-mail was an overview of his previous telephone conversation with Ms. Bronson and making sure that he understood her position on the matter In a response e-mail to Mr Rosenberg, Ms Bronson stated, "This is an accurate recollection of om conversation Have a great day." Mr. Rosenberg's response to questionnaire-affiavit

22. In a questionnaire-affidavit, Mr.. Rosenberg was asked to explain the primary pmpose or mission of Pets' Voice He stated, "Pets' Voice 501c4 - To educate the community about pet welfare, and the mission of the Pets' Trnst ballot initiative" Mr.. Rosenberg also attested that Pets' Voice relies solely on donations and that when donations are received, the fonds are then used, in part, for educational videos, and meetings, in which they travel to Tallahassee to educate legislatms. Mr.. Rosenberg also attested that it is "Board Members" who determines how fonds are spent

In an affidavit, Miami-Dade County Supervisor of Elections' Penelope Townsley attested that Respondent was not registered as a political committee or as an electioneering communication organization with her office relative to the 2014 election In addition, she attested that Respondent's chairman, Michael Rosenberg, has not sought elective office within her jurisdiction

50 As part of her affidavit, Ms Townsley included a copy of a letter, dated October 15, 2012, addressed to Michael Rosenberg The letter congratulated him on organizing a new political committee within Miami-Dade County and reforred him to the Miami-Dade County Committee Handbook The letter also stated, "We encourage you to familiarize yourself with these resources to ensure compliance with applicable laws .. 5 engaging in other charitable and educational activity as determined by the Board of Directors incidental to the foregoing purposes except as restricted herein

1.. Notwithstanding any provision of these Articles of Incorporation, this Corporation shall not carry on any activities not permitted to be carried on by an organization exempt from federal income tax under Section 501 (c)(4) of Internal Revenue Code of 1986 (as amended) or the corresponding provision of any future federal tax code.

2.. The Corporation shall not participate or intervene in any political campaign on behalf of, or in opposition to, any candidate for public office to an extent that would disqualify it from tax exemption under Section 501 (c)(4) of the Internal Revenue Code .. The Corporation shall never be operated for tt1e primary purpose of carrying on a trade or business for profit. No part of the net earnings of the Corporation shall inure to the benefit of, or be distributable to its members, trustees, officers, or other private persons, except that the Corporation shall be authorized and empowered to pay reasonable compensation for services rendered and to make payments and distributions in furtherance of the purposes set forth in the Purpose clause hereof.

Upon tr1e dissolution of the Corporation or the winding up of it's affairs, the assets shall be distributed to a nonprofit fund, association, or corporation which is organized and operated exclusively for tax exempt purposes which are reasonable related to the purposes and goals of this Corporation, as may be determined by the Board of Directors of this Corporation, and which has establisr1ed it's tax exempt status under S01c(3) or S01c(4) of the Internal Revenue Code of 1986, as amended. Below in red is a brief overv,iew of the Pets' Voice. Below that is an email from Kristi Bronson confirming rr{y email to her ........ which is below that. The laws ar-e not simple, and in fact are so complex that even your office could not answer without doing research ........ even for the most basic questions .. And, that is what your office handles every day .. Imagine a newcomer working within those guidelines .. So, I wrote Ms. Bronson and she verified that after all of our conversations throughout the day ........ what I wrote defines that conversation.. I will answer more of the complaint in a second email, but I want to start with this.

PART ONE

The original Pets' Voice was a PAC, set up in Dade County, for the purposes of promoting a single issue .. the Pets' Trust ballot initiative. After the election was over, the original Pets' Voice PAC was just on the books, and of no further use The election was over That PAC was closed in early 2013

In the summer of 2013, we saw the commissioners were not going to honor their promise to the community, and we needed some other way to communicate our message of action. The Pets' Trust is about educating and not legislating. At that time, we were also trying to get the State to pass legislation, similar to the Children's Trust, to make this vote binding, and also so that other counties could do the same thing That meant seeking state representative and state senators, to try to get them to sponsor this legislation

At that time, we weren't thinking about supporting candidates, only about working with the existing officials, which a 501 C4 can do, as a social welfare organization However, when we spoke to the elections department at this time. and the IRS, we were told that the 501C4, can support and endorse candidates, as long as it is not the main goal

As the year went by, we went to Commissioners, met with the Mayor, and the vote to honor the Pets' Trust election was going nowhere That meant it was time to find and support candidates that would honor what the people voted for. Again, under the 501C:4 we can do that

The first Pets' Voice was an issue based Political Committee which was registered properly in Miami Dade County Pets' Voice (one) It was closed in early 2013

The second Pets' Voice is a 501c4 registered on June 27th 2013 with the State Of Florida A social welfare organization Pets' Voice (two)

The disbanded Pets' Voice (one) was never involved in the 2014 election, and was a part of supporting the Pets' Trust ballot initiative ofNovember 2014 Pets' Voice (1), an issue based political committee was closed, including the bank account, and the Miami Dade election department has notice of that The flyer in question had a disclaimer printed by mistake and all others were subsequently conected. The conect disclaimer in those subsequent flyers saiq Pets' Voice .the mistaken one had Pets' Voice Political Committee

The volunteers who proofread that first flyer confused the language with disclaimers we had used in 2012 When we realized the error, we made the changes, including taking markers to cross out the two words "political committee" on those original flyers (We spent many hours doing this.) We did not need to register as a political committee because from June 27 of2013, until late June of 2014, we didn't act on behalf of candidates in any financial way, and according to the Fl01ida Election Department, (see previous email) as long as our primary purpose was social welfare we had the option to create a PAC if we wanted

Pets' Voice (two) is required to file a report once a year with the Florida Agriculture Department We did that earlier this year, and will do so once again at the appropriate time A 501 c 4 is not required to issue weekly or monthly reports, and from everything I've read, the Supreme Court has recently allowed 501 C 4's to be used in this fashion TD.ere is understandably some controversy in their ruling, but Pets' Voice (two) did everything proper under the currnnt law .again verified by the F101ida Elections Department.

The disbanded Pets' Voice (one) was never involved in the 2014 election, and was a pai:t of supporting the Pets' Trust ballot initiative of November 2014.. Pets' Voice (1), an issue based political committee was closed, including the bank account, and the Miami Dade election department has notice of that The flyer in question had a disclaime:r printed by mistake and all others were subsequently corrected. The correct disclaimer in those subsequent flyers said Pets' Voice .. .the mistaken one had Pets' Voice Political Committee

The volunteers who proofread that first flyer confused the language with disclaimers we had used in 2012 .. When we realized the error, we made the changes, including taking markers to cwss out the two words "political committee" on those original flyers (We spent many hours doing this.) We did not need to registe:r as a political committee because from June 27 of 2013, until late June of 2014, we didn't act on behalf of candidates in any financial way, and according to the Florida Election Department, (see previous email) as long as our primaiy purpose was social welfare we had the option to create a PAC if we wanted.

Much of this is answered under paragraph one Pets' Voice (two) is required to file a report once a year with the Florida Agriculture Department We did that eai:lier this year, and will do so once again at the appropriate time. A 501 c 4 is not required to issue weekly or monthly reports, and from everything I've read, the Supreme Court has recently allowed 501 C 4's to be used in this fashion. There is understandably some controversy in their ruling, but Pets' Voice (two) did everything proper under the current law . again verified by the Florida Elections Depaitment

The Miami Dade County Elections Department told us that we should register at the highest level of our political activity We were told, for example, if you are only going to wOik on legislation or with candidates in Miami Beach, you need to register your "organization" in Miami Beach. If your issues our countywide, then register with Miami Dade .. But, if you were going to be involved state wide .. you need to do Tallahassee, and that is what we did, on June 27th 2013 M1 Planas is complaining that we did not register in Miami. We did not have to, and if he would have checked further, he would have found we are in good standing with the State of Florida·

Below that is an email from Kristi Bronson confirming my email to her .......... which is below that The laws are not simple, and in fact are so complex that even your office could not answer without doing research .......... even for the most basic questions .. And, that is what your office handles every day Imagine a newcomer working within those guidelines .. So, I wrote Ms .. Bronson and she verified that after all of our conversations throughout the day ....... what I wrote defines that conversation.. I will answer more of the complaint in a second email, but I want to start with this ..

PART ONE

The original Pets' Voice was a PAC, set up in Dade County, for the purposes of promoting a single issue the Pets' Trust ballot initiative After the election was over, the original Pets' Voice PAC was just on the books, and of no further use. The election was over. That PAC was closed in early 2013

In the summer of 2013, we saw the commissioners were not going to honor their promise to the community, and we needed some other way to communicate our message of action The Pets' Trust is about educating and not legislating. At that time, we were also trying to get the State to pass legislation, similar to the Children's Trust, to make this vote binding, and also so that other counties could do the same thing That meant seeking state representative and state senators, to try to get them to sponsor this legislation

At that time, we weren't thinking about supporting candidates, only about working with the existing officials, which a 501 C4 can do, as a social welfare organization However, when we spoke to the elections department at this time .and the IRS, we were told that the 501 C 4, can support and endorse candidates, as long as it is not the main goal

As the year went by, we went to Commissioners, met with the Mayor, and the vote to honor the Pets' Trust election was going nowhere .. That meant it was time to find and support candidates that would honor what the people voted for. Again, under the 501 C 4. we can do that.

I suppose we could start a PAC, but the Department Of Elections said that was an option, if we planned to solicit

The purpose behind Florida's Campaign Finance and Disclosure laws are to provide voters infotmation as to where campaign money comes from .. See Worley v. Florida Secretary of State, 717 FJd 1238 (II th Cir, 2013) When individuals attempt to circumvent the campaign finance disclosure laws, it prevents voters from dete1mining who is financing these campaigns .. When a disbanded Political Committee (PC) that was only registered as an "issued based" PC begins to distribute political advertising for or against a candidate without registering as a "Candidate" based PC, that group is technically committing a criminal violation because it is failing to disclose its donors publically .. See Falzone v. State, 500 So.2d 1337 (Fla .. , 1987)..

Florida Statutes§ 106 .. 03(3) requires a PC that will raise and spend money and produce political advertising in a County election, to register as a PC in the County in which the candidates they are supporting or opposing qualify to run for office .. Accordingly, any PC that is opposing or supporting a candidate for Miami-Dade County Commissioner, must register as a "Candidate" based PC, identify in its organizational documents, which candidate it supports and file copies of campaign finance reports with the Miami Dade County Elections Department "Pets' Voice" has failed to do that and is guilty of violating Florida's campaign financing laws in several ways ..

Pets' Voice registered as an "Issues" based PC with the Miami Dade Elections Department in October of 2012.. (See Exhibit "A", Organizational Paperwork).. The initial purpose of the PC was to support passage of a referendum in the Miami-Dade November 2012 General Election. The PC was subsequently disbanded at the beginning of2013 .. To this date, the Miami Dade Elections Department has received no new paperwork either updating Pets' Voice committee status or registering a new "Candidate" based PC with the same name. (See Exhibit "B'', emails from the Miami Dade Elections Department)

Pets' Voice, a formerly registered "Issues" PC, has now sent out mail pieces (See Exhibit "C", Mail Pieces, sign and picture of posted sign) and even produced a video political advertisement1 advocating voters to vote against Incumbent Miami Dade Commissioner Jose "Pepe" Diaz and/or to vote for his opponent, Marjorie Figueira .. (See ad at: https://www.youtube.com/watch?v=jAuFwvG 1 YXs&feature=youtu.be) The PC has now also set up a website at www.petsvoice.org.. On that website, it advocates for the election of Daniela Levine Cava, a candidate in Miami-Dade County Commission, District 8 and for Marjorie Figueira in the District 12 race. The website

states that it is sponsored by the Pets' Voice Political Committee, but as stated above, no such committee currently exists.. While the mail pieces state that they are political advertising, they would be classified as "Electioneering" under the statutes.. The problem lies in the fact that an "Issues" PC is not allowed to do Electioneering against candidates.. More troubling, the signs, the website and the video all ask voters to vote for Marjorie Figueira, but the PC was never intended to be a "Candidate" PC. Even more distwbing, the website asks for donations and provides a link for citizens to contribute online.. F S .. § 106 .. 03 requires that such donations be reported in a similar manner as contributions to a candidate, again with the same entity in which the candidate the group supports qualified; ie .. , the Miami Dade Elections Department There is no record of any contributions being reported as Pets' Voice has not filed any paperwork

There is credible information that the original Chairman of Pet's Voice, Michael Rosenberg, has been the individual placing ads for the committee.. Additionally, both the mail piece and the website contain different addresses, neither of which seem to be a legitimate address associated with the group, in direct violation of F.S. § 106143 ..

Although Pets' Voice is registered as a Florida Non-Profit Corporation and purportedly has 50l(C)(4) status by the IRS, Chapter 106 of the Florida Statutes still requires them to register as a Political Committee and report all contributions and expenditures if they raise and spend more than $500. (See Florida Op.Atty .. Gen, 073-407) .. Additionally, even if Pets' Voice or Michael Rosenberg were to wish to make an Independent Expenditure according to FS .. §106 .. 071, either would still be responsible for the same reporting requirements as a PC because they have more than likely spent over the $5,000 limit One way or another, Pets' Voice is violating both the statutes on Political Committee registration and reporting, as well as contributing money to a candidate over the lawful amount, in direct violation of F.S .. § 106.08 and/or F .S. § 106..087 ..

Whomever is responsible for these violations, whether it is indeed Michael Rosenberg or a third party, can be discovered easily through either the printer/mail-house that produced the mail piece and through the website that briefly ran the video

This PC has violated numerous campaign financing laws and shows no sign of any intent to either stop or lawfully registering as a PC according to Chapter 106 They should be found in violation and the Commission should do all possible to enjoin Pets' Voice from continuing to violate the law ..

The pmpose behind Florida's Campaign Finance and Disclosure laws are to provide voters information as to where campaign money comes from See Worley v .. Florida Secretary of State, 717 FJd 1238 (11th Cir., 2013) When individuals attempt to circumvent the campaign finance disclosure laws, it prevents voters from determining who is financing these campaigns .. When a disbanded Political Committee (PC) that was only registered as an "issued based" PC begins to distribute political advertising for or against a candidate without registering as a "Candidate" based PC, that group is technically committing a criminal violation because it is failing to disclose its donors publically .. See Falzone v. State, 500 So.2d 1337 (Fla., 1987) ..

Florida Statutes§ 106 .. 03(3) requires a PC that will raise and spend money and produce political advertising in a County election, to register as a PC in the County in which the candidates they are supporting or opposing qualify to run for office.. Accordingly, any PC that is opposing or supporting a candidate for Miami-Dade County Commissioner, must register as a "Candidate" based PC, identify in its organizational documents, which candidate it supports and file copies of campaign finance reports with the Miami Dade County Elections Department "Pets' Voice" has failed to do that and is guilty of violating Florida's campaign financing laws in several ways ..

Pets' Voice registered as an "Issues" based PC with the Miami Dade Elections Department in October of 2012.. (See Exhibit "A", Organizational Paperwork).. The initial pmpose of the PC was to support passage of a referendum in the Miami-Dade November 2012 General Election. The PC was subsequently disbanded at the beginning of2013 .. To this date, the Miami Dade Elections Department has received no new paperwork either updating Pets' Voice committee status or registering a new "Candidate" based PC with the same name. (See Exhibit "B", emails from the Miami Dade Elections Department)

Pets' Voice, a formerly registered "Issues" PC, has now sent out mail pieces (See Exhibit "C", Mail Pieces, sign and picture of posted sign) and even produced a video political advertisement1 advocating voters to vote against Incumbent Miami Dade Commissioner Jose "Pepe" Diaz and/or to vote for his opponent, Marjorie Figueira. (See ad at: httos://www.youtube.com/watch?v=jAuFwvG 1 YXs&feature=youtu.be) The PC has now also set up a website at www.petsvoice.org.. On that website, it advocates for the election of Daniela Levine Cava, a candidate in Miami-Dade County Commission, District 8 and for Marjorie Figueira in the District 12 race.. The website

states that it is sponsored by the Pets' Voice Political Committee, but as stated above, no such committee cunently exists.. While the mail pieces state that they are political advertising, they would be classified as "Electioneering" under the statutes. The problem lies in the fact .that an "Issues" PC is not allowed to do Electioneering against candidates.. More troubling, the signs, the website and the video all ask voters to vote for Marjorie Figueira, but the PC was never intended to be a "Candidate" PC. Even more disturbing, the website asks for donations and provides a link for citizens to contribute online.. FS .. § 106 03 requires that such donations be reported in a similar manner as cont1ibutions to a candidate, again with the same entity in which the candidate the group suppo1ts qualified; ie .. , the Miami Dade Elections Depaitment There is no record of any contributions being reported as Pets' Voice has not filed any paperwork.

There is credible information that the original Chaiiman of Pet's Voice, Michael Rosenberg, has been the individual placing ads for the committee.. Additionally, both the mail piece and the website contain different addresses, neither of which seem to be a legitimate address associated with the group, in direct violation ofFS .. §106 . .143 ..

Although Pets' Voice is registered as a Florida Non-Profit Co1poration and pmportedly has 501(C)(4) status by the IRS, Chapter 106 of the Florida Statutes still 1equires them to register as a Political Committee and report all contributions and expenditures if they raise and spend more than $500 .. (See Florida OpAtty Gen , 073-407).. Additionally, even if Pets' Voice or Michael Rosenberg we1e to wish to make an Independent Expenditure according to FS .. §106 .. 071, either would still be responsible for the same repo1ting requirements as a PC because they have more than likely spent over the $5,000 limit One way or another, Pets' Voice is violating both the statutes on Political Committee registration and reporting, as well as cont1ibuting money to a candidate ove1 the lawful amount, in direct violation ofFS .. § 106 .. 08 and/or F.S.. § 106 .. 087

Whomever is iesponsible for these violations, whether it is indeed Michael Rosenberg or a third party, can be discovered easily through either the printer/mail-house that produced the mail piece and through the website that b1iefly ran the video ..

This PC has violated numerous campaign financing laws and shows no sign of any intent to either stop or lawfully registe1ing as a PC according to Chapter 106.. They should be found in violation and the Commission should do all possible to enjoin Pets' Voice from continuing to violate the law.
