Based upon our discussions, we have made several minor edits to the plan set as followed: 1. Added the York/Kittery Town line as shown on the Town of York GIS maps; 2. Labeled the status of existing roads in the vicinity of the project as public or private; 3. Added the locations of all existing buildings within 100 feet of the subject parcel; 4. Added note 16 with regard to restrictions within the well protection areas; 5. Designated an area in which a future single family residence may be constructed; 6. Added the notes requested by the York Village Fire Chief (see note 15 on Sheet C3); 7. Addressed comments from Public Works Director; a. Added MDOT sign location requirement to note 13; b. Added note 14 to add a light fixture to illuminate the entrance to Vacation Drive; We have also enclosed the following additional supplemental documents to be included as part of the application: 1. STANDARD EROSION AND SEDIMENTATION CONTROL MEASURES: 1. ALL WORK SHALL COMPLY WITH THE CURRENT VERSION OF THE MAINE ALL WORK SHALL COMPLY WITH THE CURRENT VERSION OF THE MAINE EROSION AND SEDIMENT CONTROL BMP MANUAL PUBLISHED BY MAINE DEP. WHERE THE SOIL HAS BEEN COMPACTED BY CONSTRUCTION OPERATIONS, LOOSEN SOIL TO A DEPTH OF TWO (2) INCHES BEFORE APPLYING FERTILIZER, LIME AND SEED. 8. YORK FIRE DEPARTMENT PROJECT REQUIREMENTS

1. New building must have smoke detection equipment hard wired in to a central alarm panel

contained within building. Noun named zones must be clearly annotated on alarm panel.

Heat detectors must be installed in concealed attic spaces. Alarm systems must be

addressable systems.

2. Knox box must be provided on front of building, nearest main entrance.

3. Reasonable fire apparatus access (not necessarily paved) must be provided to three sides.

4. Provide construction details on building design prior to building permit application to the

fire department.

5. Dry standpipe fire hydrant will be required to be installed in the pond with gravel apron to

allow fire apparatus access for water supply in case of fire. Additional detail available from

YFD for this device. (Kochek)

6. All buildings must have the street number clearly marked on the outside of the building in

bold letters or numbers for ease of locating in case of emergency.

7. The above noted fire safety requirements must appear in print on any final project plans

before approval signature(s) will be granted.

Hi Heather, Thank you for the opportunity to comment on the proposed Lupine Park mixed use development. I have reviewed the traffic assessment provided by Ryan McCarthy of Tidewater Engineering & Surveying Inc. and Bill Bray of Traffic Solutions for the development based on the proposed uses. I concur with their trip generation assumptions, Land use codes (#817 Nursery- Garden Center) and calculations. The trip generation for the proposed development is slightly more than 35 trips in the Saturday and Sunday peak hour. Based on the ITE trip generation criteria I asked Mr. Bray to analyze the existing safety conditions and accident history in the vicinity of Vacation Drive. Mr. Bray has done that and he included the results with the submittal. Therefore at this time no additional traffic analysis is required. The report shows that there are no high crash locations adjacent to the development. Based on Mr. Bray’s Traffic Assessment report I recommend the following improvements:

I recommend that we require the developer to install a Street light to be owned and maintained by the Developer at the existing entrance/exit of Vacation Drive.

I asked the a note be added to the plan that requires the proposed business sign to meet DOT’s requirement for signs installed on Route 1.

These improvements will improve safety at the existing entrance/exit. Let me know if you need anything else from me. Thanks again Dean

On November 13, 2019, Department staff met on-site with Ryan McCarthy of Tidewater Engineering & Surveying, Inc. at 4 Vacation

Drive in York. Staff was asked to review an area on the parcel near a dilapidated structure. The area was accessed by traveling

approximately 500 feet down Vacation Drive and following a trail leading south. The trail leads to the dilapidated structure.

Staff observed surface water flowing west across the trail. The water originates from a man-made pond within a wetland area that abuts

Route 1. Staff observed human alterations to the drainage feature that crosses the trail. The drainage feature was determined to not be a

jurisdictional 'river, stream or brook' as defined in the Natural Resources Protection Act (NRPA), 38 M.R.S. § 480-B(9). The drainage

feature would still be regulated as 'freshwater wetlands' (wetlands) as defined in the Natural Resources Protection Act (NRPA), 38 M.R.S.

§ 480-B(4). Any activities located in, on or over the wetlands may require a NRPA permit. However, replacement of an existin crossing

may not require a permit from DEP pursuant to the NRPA, 38 M.R.S. § 480-Q(2-D).

Please make sure that all local permits, as well as applicable federal permits, have been obtained prior to starting any work. Erosion

control devices must be installed and maintained on the project site during any soil disturbance activity. A Stormwater Management Law

PBR or Maine Construction General Permit "NOI" and "NOT" must be filed with the Department if more than 1 acre of area is going to

be disturbed on the project site at any given time during construction.
