First of all let me say, what could be greener than recycling an old

president?

I’d like to thank each of you for the opportunity to serve as your president – for the second time. It’s an honor. I would also like to thank Past President Lisa Clark for her fortitude throughout 2009. With her leadership we have prevailed together. My plans for this year only require one thing – show up!

With the holidays behind us, we are all planning for a lean 2010. The past market conditions have spawned a conservative economy which shows itself on many levels. As GHBA members, this is most evident to us in the housing market.

As we brace ourselves for the coming year, now is not the time to venture off on our own. Now is the time to work together, and stand united for our industry. It has been said that, “If you’re not at the table you could be on the menu.” Nothing could be truer today. Through the association, we each have the ability to be at the figurative table – many different tables in fact. We have a strong voice on legislative issues, access to first-class continuing education and a forum to share our challenges, ideas and successes with like-minded individuals.

With the support of our membership and our fine staff, we cover all the bases. Even in lean times, you can’t afford not to be at the table. Together we form a strong,

collective voice. So make the time to amp up your GHBA participation. Come to a meeting or an event, and bring a friend! You’ll be surprised at who you might meet, and the effect it will have on your business.

If you don’t want to be on the menu, you must be at the table. Where will you be?

GHBA Government Affairs is looking forward to an incredible 2010. With the change in city leadership, we will work hard to continue building strong relationships. And amazingly enough, it’s already time to start getting ready for the 2011 legislative session! At the same time we must make sure that codes are on the right track throughout the region and that Green Built Gulf Coast is up and running smoothly.

The Government Affairs Committee will meet January 20 at 3 p.m. at the GHBA offices. GHBA’s past president, Lisa Clark, will be the new chair and without a doubt will lead the way as we move through the trials and tribula-tions the year may bring. Join us, and be a part of addressing the industry’s needs in the most effective, efficient means possible.

HOME-PAC ASKS:Could You Run for Office?HOME-PAC was created to support

pro-housing candidates for elected of-fice, and your trustees do a very good job. GHBA extends a great big ‘thank you’ to everyone who contributes to HOME-PAC, and we look forward to exceeding our contribution goal of $125,000 in 2010.

However, we still need to find OUR candidates. Take this year’s City of Houston election as an example. Al-though we support candidates, they are not homebuilders. Outside of Steve Costello, no one running had ties to the homebuilding industry, so our industry will likely not be a priority to any of them when it comes time to vote and make critical decisions.

Consider running for office. Your industry needs you, and you can have a huge part in keeping the building industry favorable in Houston. If you are interested please contact the Government Affairs Department. Our members are our greatest asset. We can make the biggest difference by electing pro-housing candidates to of-fice. And who better to take that role than YOU – our homebuilders.

The Greater Houston Builders Asso-ciation Remodelors Council (RMC)

was honored with two awards at the 2009 Council Award for Demonstrating Remod-eling Excellence. The awards—known in the industry as the CADREs—were an-nounced during the NAHB Remodelers Annual Gala at the 2009 Remodeling Show in Indianapolis on October 29.

The awards were presented by Jarred Roy from the Pella Corporation, title sponsor, and NAHB Remodelers Chair Greg Mie-dema, CGR, CGB, CAPS, CGP, a remodeler from Tucson, Arizona.

Winners in eight categories were honored for outstanding contributions and per-formance at the local council level. The Houston RMC was recognized in two of the eight categories – Community Service and Public Relations and Promotion.

The CADRE Awards, judged by members of NAHB Remodelers’ board of trustees, are presented each year to local remodelers councils and individuals whose work at the local council level exemplifies the best practices of the remodeling industry. The CADRE is the NAHB Remodelers' highest national award that a local remodelors

council can achieve. The Houston RMC has been a pillar of the annual awards, winning at least one CADRE every year since 2003.

“Local NAHB remodelers councils across the nation nurture excellence in profes-sional remodelers with programs, educa-tion and leadership development,” said Greg Miedema, CGR, CGB, CAPS, president of Dakota Builders, and 2009 chairman of the NAHB Remodelers. “The CADRE awards celebrate their achievements and raise the bar for local excellence.”

Community Service ProjectRemodelers of the Greater Houston Build-ers Association remodeled the House of Tiny Treasures, an early childhood devel-opment center serving homeless children and families. The large-scale remodel included leveling the house and replacing foundation, installing insulation, replacing flooring, painting the interior, building a ramp, building new stairs with handrails, and more. The facility now allows needy families to obtain services for their chil-dren while parents attend to education and employment training to get back on their feet.

Presenter Jarred Roy applauded the council for “donating time, materials and expertise to improve the lives of people in need. Your work provides valued respite for families experiencing tough times.”

Public Relations and Promotion

The GHBA Remodelors Council won its second CADRE for publishing an annual consumer magazine and promoting its members. First created in 1997, the Houston Remodeling Guide magazine has grown to 66 pages targeted to homeown-ers considering remodeling. The magazine includes articles and photos from council members, including information for con-sumers about the remodeling process and member directories.

Roy commended the Houston RMC for “educating consumers with a beautiful magazine about remodeling that provides ideas and resources to undertake a suc-cessful home remodel.”

Minute Maid Park became the playing field for 20 families working through homelessness, as HomeAid Houston and the Astros kicked off Hunger and Homelessness Awareness Week (HHAW) with a joint event themed "Take a Minute." Astros Jeff Bagwell, Lance Berkman, Hunter Pence and new Astros Manager Brad Mills joined the fun by giving autographs and photo opportunities. Families were treated to a Thanksgiving feast, tours of Minute Maid Park, base running, autographs and gift bags.

“Partnering with the Astros to raise awareness about Houston’s homeless is a wonderful experience,” said Bette Moser, HomeAid Houston executive director. “The organization’s professionalism and true understanding of what homelessness means have added a new dynamic to HomeAid’s efforts.”

“Hunger and homelessness impact thousands every day in Houston,” said Marian Harper, vice president of the Astros in Action Foundation. “Our goal with the Take a Minute Day was to draw attention to their struggles and to ask Houstonians to Take a Minute to rethink what homelessness really looks like and what we can all do to help.”

The Take a Minute event was a

fun way to help mark the annual HHAW, co-sponsored each year by the National Coalition for the Homeless and National Student Campaign Against Hunger and Homelessness.

“The average homeless family is a single mother with two children under age six,” said Anthony Love, CEO of the Coalition for the Homeless in Houston. “This isn’t a matter of choice for them but circumstance. It just takes a minute to make a call to a homeless agency, or make a donation to help.”

HomeAid Houston, a GHBA charity, has been building transitional housing for the homeless since 2003. Through its efforts and the donations by hundreds of association members, 360 beds have been added to Houston’s homeless community providing care for 4,200 adults and children.

challenge of rewriting the Residential Sale Contract for Newly Constructed and Completed Residence on the Builder’s Lot (commonly known as the Custom Spec Contract) and related addenda. The coun-

cil’s objective was to clarify language often misconstrued and to simplify the “contract to close” terms of buying a newly built custom home.

Although there are many changes in out-line and terminology, this article will focus on the seven changes to the contract that will significantly affect—and probably, ease—the transaction between the builder and the consumer. In turn, this will make the Realtor’s role more educational than adversarial.

Resolution of DisputesThe new GHBA contract clearly states the order of preferred steps for conflict resolu-tion to be:

a. Hold informal discussionsb. Mediationc. Mutually agreed arbitration d. Submit the issue to the American

Arbitration Association for binding arbitra-tion if no agreement can be reached once the above steps have been taken.

This, Paragraph 11b, as well as the Ad-dendum for Dispute Resolution aligns the builder’s preference for mediation with that of most consumers.

Home Evaluation/AcceptanceThis October 20, 2009 revision provides for an evaluation period (Paragraph 3) in which the buyer is encouraged to conduct third party inspections, secure an appraisal, review the survey, check the builder’s title and seek financing within a specified time. Should the buyer choose to have an unrestricted right to terminate as well as the evaluation period during the stipulated time period, she may pay for that right as stated on the Termination Option Exhibit E. The option fee is not credited to the sale, and termination during this option period would result in the return of the earnest money only. This inspection time and op-tion period are similar to those in the Texas Real Estate Commission (TREC) contract and should be familiar language for Real-tors assisting in a new home transaction.

Builders will find in due time that the option period serves many positive pur-poses in that money is committed for the option, inspections and perhaps an ap-praisal up front with a very short period before the earnest money “goes hard.” Most issues are re-solved and not left to marinate in the full length of the contract.

The TREC contract added an option pe-riod in 1997, much to the chagrin of the Realtor community. This option is now an integral means to smoother transactions with more defini-tive timelines. It is recommended that the option fee reflect a per diem or portion of the daily costs, and that the time period should be no longer than the number of days it takes to get the home inspected. Ten to 14 days should suffice.

Title CompanyPurchase Price and Deposits (Paragraph 2c) states that the purchaser “selects” the title company since she is paying the premium for the Owner’s Title policy (Para-graph 7). This is a clarification of the Real Estate Settlement Procedures Act (RESPA) requirement regarding title company selec-tion. However, your listing representative should mention to the prospect or their agent that often builders have previously opened title when purchasing the lot, and by remaining with this title company, the buyer could benefit from a slightly less ex-pensive and streamlined title procedure.

ClosingFor the first time in a GHBA custom con-tract, there is a closing date (Paragraph 7) with acceptable delays referenced in Ex-hibit B. Reasonable, established timelines enable all parties to plan better and to be more accountable to task completion in a timely manner.

Risk of LossIn older versions of the Custom Builders Council contract, only the builder had the right to terminate in case of catastrophic damage to the property prior to closing. The new language clearly gives the builder and the purchaser the same rights regard-ing their termination options under these conditions.

Limited WarrantyNew language states that the Limited Warranty will be purchased by the builder (not just a “document provided”) and then delivered to the purchaser at closing. This stronger language should address the specifics of what a buyer will receive at the closing table regarding the limited warranty, a sample of which should have been provided and reviewed prior to this closing date.

Brokerage CommissionThis paragraph should be a welcome change to all buyers’ agents and builders alike. Paragraph 13 now allows for the buy-er’s agent’s name, the broker’s name and license number as well as earned commis-

sion amount to be inserted in the body of the contract. This clarifies buyer’s rep-resentation at the time of contract, alleviating any com-plication regarding the old addendum that was sometimes misused, neglected or added after the selling price was es-tablished.

These new con-tract terms will be greatly appreciated by those Realtors whose businesses rely heavily on the custom new home sales market and

may have been hesitant to use the older versions which were less consumer-friend-ly. Local builders, Realtors and the GHBA legal counsel consolidated their efforts in the creation and implementation of these changes with their sole focus being a smoother, more transparent transac-tion with the consumer’s interests well represented.

If the TREC New Home Contract (completed construction) is used in the purchase of a new custom home, there are also new GHBA addenda now available with matching language to the terms stated above. These are the Addendum to Earnest Money Contract and the Addendum for Construction Related Activities and can be provided by your builder or a GHBA Real-tor member.

materials, labor and services by GHBA members. The homes often include numerous upgrades and amenities not always found in others with similar pricing. They are sold at market value and the majority of the proceeds are donated to the charities. Texas Chil-dren’s Cancer Center, the Alzheimer’s Association and HomeAid Houston are this year’s recipients. Since the Project began 29 years ago, more than $5 mil-lion has been raised.

“Both of us loved the openness of the floorplan,” added Hernandez. “We were also impressed with the large kitchen and family room, and my hus-band and two sons especially loved the media room.”

Highland’s 947 Plan is a two-story, four bedroom design that features a formal dining room, a family room, three full baths plus a half bath, a three-car garage, game room, media room and a covered patio. Highland built the Benefit Home on a homesite in Cinco Ranch that was donated by Newland Communities, the developer of the community.

“The volatile market has not discour-aged the membership from contribut-ing to this annual fundraiser,” said Don Klein, chairman of the Project. “In fact, the opposite has been true for 2009 with three houses being built. This is a reflection of the generosity of Hous-ton’s building industry.”

Chesmar Homes constructed the first home of 2009 in Discovery at Spring Trails. Land Tejas, the developer, donated the homesite. That home sold before the ground breaking. Trendmaker Homes constructed its home in The Woodlands. The Wood-lands Development Co. donated the homesite.

“We were immediately delighted with Highland’s 947 Plan,” said Rosa-lina Hernandez. “But the fact it was also a GHBA Benefit Home made our purchase even more rewarding.” The Hernandez family is being transferred from Colorado by Conoco Phillips.

The Woodlands Development Co. Donates Check to Benefit Homes CharityThe Woodlands Development Company (TWDC), one of three

developers donating a homesite for the annual GHBA Benefit Homes Project, recently presented a $1,720 check to Texas Children’s Cancer Center. The company donated the proceeds from concession sales at the May valley Turkey Trot, a special event held in The Woodlands’ village of Sterling Ridge on November 14. The Turkey Trot commemorated the opening of the new May valley Park, and included a tour of the Benefit Home that was built on a lot in May valley. Trendmaker Homes constructed its 3,807 square foot Living view Product Plan M242N for the Project. The home, recently completed, is priced in the mid $400s.

“The Turkey Trot was a fun, family-oriented event with a Thanksgiving theme,” said Susan vreeland-Wendt, director of marketing for TWDC. “In the spirit of giving thanks, we chose to donate the proceeds from the food sales to Texas Children’s Cancer Center, one of the 2009 GHBA Benefit Home Charities.”

look forward to 2010, GHBA would like to introduce you to some of its key members – the incoming board of directors. These professionals come from all sectors of the building industry. Together they volunteer countless hours to the association, helping shape policy, drive growth, and lead the charge for education and advocacy.

The GHBA board of directors is comprised of 30 members, each with unique strengths and points of view to contribute. Over the next few months, we will profile the entire board. We invite you to get to know your leadership, starting here. This is part two of a three-part article series.

Beth AvalosBeth Avalos’ 18 years in the homebuilding industry encompass inter ior des ign, product develop-ment, purchasing and design center management. She

is responsible for builder and product development for Floors Inc in Houston, and works with builders creating flooring programs designed exclusively for their buyers. She has received multiple awards for model home designs, and her most personal successes were the multiple J.D. Powers awards achieved during her De-sign Center Management tenure. Writing is her passion and her articles have been featured in Hers, Options and Professional Builder magazines. On a national level, she has been a speaker at the Pacific Coast Builders Conference. Most recently, she was elected to the HomeAid Houston board of directors after two years volun-teering with the organization.

“Having a heart for service along with a personal commitment to the success of the homebuilding industry and members we serve are the reasons I am excited to serve as a 2010 GHBA board member,” Avalos adds.

Wayne Ball, CGR, CAPS

Wayne J. Ball CGR, CAPS, is the owner and president of Lone Star Building and Construction Services Inc. Lone Star Building is a

general contracting company, specializing in design/build residential and light com-mercial remodeling since 1976.

Ball has been an active member of the GHBA Remodelors Council for many years, and will serve as the council’s 2010 president. When asked why he serves on the board, he said: “Serving on the RMC board has and will give me the opportunity to give back to the industry and the com-munity in which I make my living.”

Rusty DeBordeRusty DeBorde, president of Texas Signature Builders, has been in the building industry for more than 15 years. Prior to a career in construction, Rusty received a BBA de-

gree from Stephen F. Austin State Univer-sity. Rusty has been an active member of the GHBA, serving on the board of directors for the Bay Area division for the past sev-eral years, and is the 2010 Bay Area Build-ers Association president. In 2009, Texas Signature Builders was presented with the BABA Builder of the Year award.

“At Texas Signature Builders we know that the building of a project should be a deeply felt process shared from start to finish with our clients. Providing a quality job is important to us and creating value beyond all others is our passion,” says DeBorde.

In his personal life Rusty has been married to his lovely wife Keri for more than 12 years and they have two beautiful daugh-

ters – Morgan, 9, and Reagan, 6. Rusty is an avid sports and outdoorsman and is a member of St Helen’s Catholic Church and Kappa Alpha Order.

When asked why he serves on the GHBA board, Rusty responded: “I feel it is impor-tant to give back to the industry that has made me so successful and it helps Texas Signature Builders keep informed and in touch with the current issues facing the building industry.”

Warren ClarkWarren Clark’s busi-ness career has ex-clusively been in building products distr ibution. He managed Owens Corning’s distribu-t ion operat ions

throughout the southwestern states until accepting the presidency of a public com-pany and its 13 subsidiaries, all distributors of building products. Subsequently, Clark co-founded two building products dis-tributorship companies. Upon dividing this partnership’s companies, Warren managed his firm, The Metro Collection, until selling its assets to BMC West Building Materials in 2006. He now serves as the marketing manager for BMC West’s Houston Region. BMC West is also a GHBA Platinum Partner for three years running.

Steve HefnerSteve Hefner, se-nior vice president of construction, is responsible for directing and su-p e r v i s i n g C a m -den’s construction operation across the company’s en-

ties developed by Camden and third-party clients. Hefner has overseen more than $2 billion of real estate transactions and more than 20,000 units of construction. He is involved in site due diligence, acquisition, design team selection and direction, as well as cost estimating, project manage-ment, and general contracting.

Hefner began his career in construction with Worthing Southeast Builders, man-aging multifamily housing development projects, then moved to SAE Spaw Glass/Cahaba Residential, a light commercial and residential builder. Later, Hefner served as construction manager for Gross Builders, a privately-owned development and con-struction company in Houston. He oversaw general contracting for the owner and de-veloper before transferring to Camden.

Hefner received an Associate’s Degree in Applied Science, Building Construction, from Texas State Technical Institute, and studied Finance at Southwest Texas State University as an undergraduate.

Hefner is chairman of the GHBA Multi-family Council, and is a member of the Houston Building Council and the Houston Apartment Association. He is a licensed contractor in multiple states.

“I feel a passion toward improving the in-dustry to which I’ve dedicated my career," says Hefner. "Providing quality housing for people from all walks of life, both locally and across America, is my calling."

Ron MartinRon Martin built his first home with U.S. Home in Mandev-ille, Louisiana in 1982, and his been an industry strong-hold every since. Af-ter spending eight years in mobi le home production,

purchasing and sales, he was hired as proj-ect manager for Huntington Homes, a divi-sion of Highland Homes. He later became first division manager at Darling Homes in McKinney, Texas before he was transferred to Houston and promoted to vice president of operations in 2002. Martin is currently managing the start-up operations at Grand view Builders.

On the association level, Martin is an advo-cate of GHBA’s charitable arms. He served as the GHBA Benefit Homes Project chair from 2005 to 2007 and also built three homes for the charity. He also serves on the HomeAid Houston board of directors. On the political front, Martin has been a HOME-PAC Trustee since 2006, and lobbies in Austin for Rally Day. He has also been ac-tive on the TAB volume Builders Council.

Martin earned his B.S. in Industrial Man-agement at the University of Cincinnati, and was president of Phi Kappa Tau frater-nity. He and his wife Donna were married in 1988, and have two children, Zack and Molly. His hobbies include watching foot-ball, reading, politics, hiking, racquetball, washers and Sudoku.

“I serve on the board to help keep the GHBA strong and on the mission to edu-cate, advocate and serve,” adds Martin. “I apply my experience and leadership abili-ties to address the needs of our great and noble industry.”

Kathleen Stadler

Kathleen Stadler has been a mem-ber of GHBA since 1997, serving on the Membership Committee, Re-tention Commit-

tee, Associate Council and volume Builders Council. She has chaired both the Mem-bership and Retention committees during her tenure. Stadler is a past president of HomeAid Houston, and currently serves on its board of directors. She is also a director for the Texas Association of Builder and the National Association of Home Builders.

Professionally, Stadler is the sales manager for Eric L. Davis Engineering Inc., which provides engineering to homebuilders, multifamily builders, and commercial both in Texas and other states.

“I serve on the GHBA board because it is the right thing to do, to give back to the industry that I am passionate about and to promote our beloved industry in a con-structive and positive way,” says Stadler.

Kathleen and her husband Ken have been married for 20 years with four daughters.

Emilio silvestriEmi l io S i lvestr i , president of Silvestri Homes of Texas cur-rently serves on the GHBA board of di-rectors and is a life director of the Texas Association of Build-

ers. He will be named a senior life director of the National Association of Home Build-ers in January at the International Builders Show in Las vegas. He has been in the building industry for 41 years and began recruiting members in 1983. Emilio is a 3,000+ Spike and has served on the NAHB Membership Committee off and on for past 25 years. Emilio has been the top GHBA recruiter for several years and continues to maintain full speed ahead!

Scott StevensScott Stevens has been in the real es-tate development business for the past eight years, four of which have been in Montgom-ery County. He cur-rently works for

Stoecker Corporation, a residential real estate developer in Conroe, where he manages the ongoing development of several residential subdivisions. Stevens has been a member of the Montgomery County Builders and Developers Division since 2006 and currently serves as the division president.

“I have really enjoyed being a part of all that GHBA does to help protect and grow the real estate industry in the Houston area,” says Stevens. “I became a board member of the Montgomery County Di-vision in 2007 because I wanted to help make a difference in the real estate com-munity in which I worked. I felt that one way to make a positive impact was to join the board in bringing in quality speakers to our meetings who could articulate the important issues of the day and how they might affect local real estate development and homebuilding, both now and in the future.”

Marina, Model Home Construction Begin in

Edgewater CommunitySold signs and rooftops dot the land-

scape, and construction of the highly an-ticipated marina has begun in Edgewater, a new Bay Area community positioned directly on NASA Parkway, the main thor-oughfare leading to the Johnson Space Center and Space Center Houston. The NASA Parkway Bypass, a 2.7-mile con-nector between Interstate 45 and NASA Parkway that sidesteps traffic at the Inter-state 45 and NASA Parkway intersection, provides residents uninterrupted access to

and from the Edge-water community.

As the Edgewa-ter name indicates, w a t e r f e a t u r e s prominently in the community, which is inspired by the Mediterranean coast and is slated for only 400 single-family homes. Now under-way, the marina will be equipped to ac-commodate power-boats as large as 50 feet. The marina also will be a gateway to daylong or extended cruises, as it will have

direct access to Clear Creek, which offers access to Clear Lake, Galveston Bay and the Gulf of Mexico.

The marina is being built in stages with the main basin being designed to accom-modate 50 boats or more, depending on market demand. Amenities planned for the marina include a restaurant, a ship’s store, an open space park with a covered pavilion and a promenade along the shoreline.

“Slip space at nearby marinas is in high demand, with boat owners waiting months to find space to dock their boats,” said Bob Douglas, the community’s general manag-er. "Our marina will meet pent-up demand and also provide a prime location."

“At the Edgewater marina, boats will be parked in a protected cove near downtown

Webster, the central business district of the Bay Area,” Douglas continued. “If boat owners live in Houston, they can reduce their commute by as much as 20 minutes in each direction, on every trip to their boats. That’s especially important for enthusiasts who essentially use their boats as a second home on the weekend.”

Coventry Homes and Newmark Homes have launched an array of designs to com-plement the unique setting and lifestyle of the new Johnson Development commu-nity. Both builders are constructing model homes within Edgewater and are celebrat-ing early sales success. Coventry offers more than a dozen designs in Edgewater, with prices starting in the $270,000s. New-mark’s pricing in Edgewater also starts in the $270,000s with several new designs of-fering rear-entry garage access to preserve the community's lush streetscape."

Walkathon in Woodforest Raises Nearly $20,000 for

Children’s Miracle NetworkRE/MAX Hometown’s recent Walk for A

Miracle 5K raised nearly $20,000 as crowds of participants spent a Saturday supporting a good cause. Under the Children’s Miracle Network fundraising umbrella, the walk-athon raised money for Texas Children’s Hospital in Houston, which has the nation’s largest pediatric cancer and hematology program. It was held in Woodforest, a 3,000-acre master-planned community in South Montgomery County.

The Elite Choir from Montgomery Intermediate School performed for the crowd before supporters ran and walked the tree-lined streets in Woodforest. Also on hand was Rylee Dean, a local recipient of the Children’s Miracle Network who was treated for a tumor at Texas Children’s

New Home Sales Up 8% in Cinco Ranch, 12% in Telfair

In an overall market where new home sales are generally down, new home sales increased during the first three quarters of 2009 in two Newland Communities developments in Houston.

In Cinco Ranch, new home sales in-creased 8% for the first nine months of 2009, with 697 new homes sold in the 7,600-acre west Houston community in the first three quarters of 2009. That compares to 643 new homes sold during the same time last year in Cinco Ranch.

In Telfair, a 2,018-acre community in Sugar Land, new home sales are up 12% for the first nine months of 2009. A total of 347 new homes were sold in Telfair during the first three quarters of 2009, compared to 313 new homes sold during the same time last year.

Strong relocation sales helped Cinco Ranch achieve its sales increase, while an

increased number of local move-up buy-ers boosted Telfair, according to Heather Gould, marketing director for Newland Communities.

Cinco Ranch was also buoyed this sum-mer when the Texas Education Agency gave its top accreditation rating – exemplary – to 12 of the 13 Katy Independent School Dis-trict campuses serving the community.

Telfair has benefited from the attention surrounding the new Houston Museum of Natural Science at Sugar Land, which opened earlier this month in a historic Telfair building donated by Newland.

Both communities have expanded their offerings of homebuilders, price ranges and product styles in 2009. And Telfair recently added Pulte, part of the nation’s largest homebuilding company, to its team of homebuilders.

“Offering a variety of new-home styles and price ranges, along with an expanding array of recreational amenities, has been key to the success of both Cinco Ranch and Telfair,” Gould said.

BBQ & Wild Game Cook-OffThe GHBA Associate Council gave Friday the 13th new meaning with its annual BBq and Wild Game Cook-Off that delivered the goods and then some. With 24 teams gathered at GlassCraft Door Corporation competing for the top honor, competition was friendly but fierce.

Preparation for this wildly popular GHBA event began on Thursday, November 12 at noon. By 2 p.m. the teams' booths were prepped, decorated and cooking was about to begin. Judges began receiving delectable entries at 11 a.m on Friday the 13th. Montgomery County is a great place to work and live, and in spite of the recent downturn in

the market, Montgomery County has continued to see activity in its real estate market. As a Conroe area land developer, it is encouraging to see activity of any kind in light of today’s flat growth, high unemployment, and essentially zero construction financing available. Builders and developers alike have had to get creative in order to survive in these conditions, but several have weathered the storm and are beginning to position themselves for 2010 and beyond. I’ve spoken to builders in the past couple of months that are actively looking for lot po-sitions in Montgomery County, which is a great sign that we may finally be emerging from what has been the worst real estate market in the past 20 years.Looking forward to 2010, the Montgomery County Builders & Developers Division has put together an exciting lineup of speakers and panels which will focus on important topics that significantly impact our real estate market. Topics vary from the explosive growth of area school districts, to the future of homebuilding in the county, to the future economic impact from changes in the local and regional groundwater conservation regulations.For our January meeting, we have invited Jace Houston with the San Jacinto River Authority to speak to us about recent

progress on their surface water program known as Water Resources Assessment Plan (WRAP) that will undoubtedly have a huge impact on large volume ground-water users like the City of Conroe, The Woodlands and area MUD districts and utility providers. Mr. Houston will give us an update on where they are to date and what to expect in the coming months as it relates to regulations from Lone Star Groundwater Conservation District (LS-GCD), as well as the economic impact of the WRAP. As of mid-November 2009, the LSGCD board members agreed to extend the compliance deadline to January 1, 2016 for large volume users to comply with groundwater regulations limiting groundwater usage to 70% of permitted gallons. The only practical alternative to groundwater is the use of surface water to meet the needs of large volume users. But surface water usage from reservoirs like Lake Conroe may have significant economic implications to the real estate market if lake levels drop as a result of its usage. To be sure, this will be an interesting and very informative meeting for the Mont-gomery County real estate community, and I encourage everyone to attend.I look forward to serving the GHBA in 2010 and want to thank the association and my fellow board members for the opportunity.

I can’t believe that the New Year is upon us already! The new 2010 Remodelors

Council (RMC) board of directors has been installed, and we are ready to get to work. Serving as the 2010 RMC president is a huge honor for me, and I plan to use this unique opportunity to give back to the industry that I have made a living at for the last 35 years. As I take the helm, I would like the personally thank Past President Allen Griffin, the board of directors, our speakers, and especially our sponsors for a great year in 2009. During my four years on the RMC board, I have had the pleasure of working with some of the best remodelers and associates in the Houston area. I can’t begin to tell you how dedicated and professional these members are. If you have the chance, please take a moment to thank our past presidents and board members for all their hard work and dedication to our industry. Over the next year, the challenges we overcome will shape who we become in the future – personally, professionally, and spiritually. Being a part of and supporting the Remodelors Council can bring so much growth in so many areas. So if you are new to the RMC, or haven’t been active for awhile, make it your resolution to get back onboard.

When I first got involved with the Remodelors Council, I was very skeptical that my in-volvement would have no impact on my business. My attitude was, “What’s in it for me?” So for the first two years, I only came to the luncheons. Then I decided to acquire my Certified Graduate Remodeler (CGR) certification, and that is where I started meeting and networking with associates and remodelers. The GHBA educational classes not only helped me improve my business, they created a network of friends and colleagues who are doing the same things and facing the same challenges.If you want to improve your business, net-work, share ideas, then now is the time. Get involved, volunteer for a committee, sponsor an event, acquire a certification, and let’s have some fun. My challenge to everyone in 2010 – let’s work as a group. Members working with members, members recommending mem-bers. If you’re working with companies outside the GHBA and Remodelors Council family, ask them to join, or better yet lever-age them to join. There are thousands of remodelers and associates in our arena who could benefit from our organization. Most of them just need a personal invitation. Be an advocate and raise the bar for our entire industry.

I am honored to begin my role as president of your Sales & Marketing Council (SMC). This journey began in 1995 when a man

walked into the New Home Search office and personally invited me to a GHBA Sales & Marketing Council meeting. The irony is I can’t for the life of me recall that man’s name, but his one kind act created a “ripple effect” that brought me to this place today.Many “GREATS” have served in this role and hold the title “SMC Past President”…1985 Ray Hurlbut, 1986 Roger Fiehn, 1987 Tim Welbes, 1988 Dick Francis, 1989 Marlene White, 1990 Ed Barrett, 1991 Susan Davis, 1992 Glenn Howard, 1993 Sharon Geedman, 1994 Brian Binash, 1995 Pat Dietrich, 1996 David Jarvis, 1997 Bill McConnell, 1998 Pam Minich, 1999 Susan Baldwin, 2000 Greg Carr, 2001 Sandi Shurley, 2002 Margaret Greenwood, 2003 Ressie Pate, 2004 Lorna Potter, 2005 Kathy Morgan Harris, 2006 Keith Rodgers, 2007 Yvonna Chavez, 2008 Tracy Cook, CSP and 2009 Terry Dawson. We will begin by incorporating custom builders and remodelers into the Parade of Homes under the leadership of Scott Frankel, Frankel Custom Homes.If you are an associate, I encourage you to partner with a custom builder or remodeler to showcase your unique offering. You will both benefit from the marketing exposure to consumers touring these homes on August 7-15, 2010.All things will be possible with support from the talent you have elected to be your 2010 Sales & Marketing Council board of direc-tors. I look forward to this journey we will take together!

COLLEEN ELLISON, CSP, MCSP, CMP, PRESIDENThas been actively involved in the GHBA and SMC since 1995, which has earned her the SMC Associate of the Year distinction in 1999 and again in 2006. Colleen is also the National Sales and

Marketing Council (NSMC) liaison for GHBA. Colleen is a 14 year veteran of Move.com as a regional sales director managing the Central to East Coast.

ASHLEIGH GENzER, VICE PRESIDENT With more than 10 years experi-ence in the real estate industry, Ashleigh Genzer is responsible for builder/developer sales for Stewart Title. She serves on several councils including SMC,

Membership, Ambassadors, and Associate. In 2009 Ashleigh received a Houston's Best Award for SMC Board Member of the Year.

TRISH JOSEPHS, TREA-surEr began her homebuilding career in Houston in 1995 at Centex Homes. With more than 14 years experience, she has di-rected marketing and advertising for some of the nation’s largest builders and developers. In 2004,

she was honored with the PRISM award for Marketing Professional of the Year. In 2009, Trish attained her Real Estate license and joined RE/MAX Realty Center. She's been active with the SMC board since 1997.

AMY HAYWOOD, SECRE-TARY began her homebuilding career at Pulte Homes, then later at Standard Pacific Homes, receiv-ing the PRISM award for Rookie On-site Salesperson of the Year in 1999. She then pursued an

opportunity on the vendor side of the homebuilding business with Ranger American Security Systems. In 2005, Amy joined Taylor Morrison as vice president of sales and marketing, and has been an integral part of the growth of the company through the merger with Taylor Woodrow. Amy was awarded the 2007 PRISM marketing pro-fessional of the year

TERRY DAWSON, PAST PRESIDENT is a New Home Specialist who has assisted more than 800 new homeowners in the purchase of their homes. He was named 2002 Sales Manager of the Year for the Southwest U.S.

TRACY COOK, CSP has been in the new home sales and mar-keting arena since 2001, winning numerous awards including Rook-ie Spike of the Year in 2002. Tracy has chaired numerous SMC and GHBA committees, and served as SMC President in 2008.

SCOTT FRANKEL, GMB CGP. With a B.A. in Political Sci-ence and a Business minor, Scott began working with Newmark Homes, then went to work for a new building company called Lin-denwood Homes, which was later acquired by John Lang Homes.

Recognizing an opportunity to expand his vision and passion for custom home design and building, he joined Frankel Building Group.

HEATHER GOULD currently serves as marketing director for Newland Communities, respon-sible for Cinco Ranch and Telfair. Prior Newland, Heather served as a marketing manager for a builder, then spent two years as a builder's design studio manager.

KRISTINA JONES is an ex-perienced marketing professional with 10 years in the industry. She is currently the marketing director for Meritage Homes Corp. and oversees advertising, marketing and branding for the company's 40+ Houston area communities.

TERESA SHANNON began her real estate career in 2003 as a new home sales associate for Taylor Morrison. A year later, she was promoted to marketing manager and currently works as marketing and Internet sales manager. In 2008, she received the PRISM award for Marketing Professional of the Year.

LONA SHIPP has been involved in marketing for 10 years, the last five of which have been in the home building and land development industry. Currently she is the marketing manager for Bridgeland and handles all aspects of promoting the master-planed community.

She has been an integral part in winning more than 40 awards for the community on a local, regional and national level, most recently NAHB’s Community of the Year for 2008.

SARAH STARR started in the homebuilding industry in 2003. She has worked for various builders in both sales and mar-keting roles and currently serves as marketing and Internet sales manager for Taylor Morrison Homes. She is responsible for all aspects of advertising,

marketing and branding for all the Houston area com-munities and has played a vital role in her company winning more than 20 PRISM/Houston’s Best awards in the past three years alone.

CHRISTY STRATTON has more than 16 years of marketing and public relations experience spanning many industries, in-cluding real estate, hospitality and nonprofits. Back with Pulte Homes, Stratton is focused on the operational marketing communications of the Houston

division. Stratton spent most of the last decade in Las Vegas, Nevada, also working for Pulte Homes and even stepping out to start her own marketing and public relations firm. While in Nevada she helped start the state’s ENERGY STAR® Partners program.

Well, it is time to bring 2009 to a close and say hello to 2010. We have had

a wonderful year with the Associate Council and look forward to all the great times and success ahead next year.

The Associate Council board and all of our members would like to extend a special thank you to David Hodges for being an outstanding Associate Council president. We continue to grow, implement new ideas and bring in phenomenal speakers, and much of that is due to our strong leadership. So, thanks David!

We look forward to welcoming new presi-dent, Jamie Walter of Shamrock Equity Ad-visors. It's gonna be another great year!

On a special note, on December 3 the BSSG Committee held a Holiday Party at the House of Blues for this year’s speakers and luncheon winners. This is the first year we have had such an event, and everyone had a great time. A huge thank you goes out to D’Nita Kuhn, our staff liaison, and Beverly Jordan, the council's vice president. You two did an amazing job. Thanks for all

your hard work to make the party such an overwhelming success.

Members, please plan to join us at the first Associate Council meeting of the New Year, scheduled for January 7 in the GHBA Education Center. We are excited to kick off the year by hearing from the associa-tion's incoming president, Kevin Holland of Cervelle Homes. This is Kevin's second term as GHBA president, so he is sure to have to great insight for us. You won't want to miss this very special meeting.

All Associate Council meetings are held the first Thursday of each month. The board has so many exciting things planned for next year, and cannot wait to show you how to get more involved with this great group of people. 23 master-planned communities as well as two of development communities – Crighton Woods and Cross Creek Ranch. Tori's responsibilities includ-ing making sure that Realtors® are up to date on all of the upcoming events and incentives. With her tenure with the company, Tori has worked with Trendmaker to maintain up to 85% Realtor® sales. JACKIE WILCOx is busi-ness development manager for Stewart Title and has been in that position for 11 years. She has been involved in the real estate industry for most of her career. Active with the GHBA, she chaired the New Home &

Remodeling Show for three years. Jackie is also a member of the executive committee and a co-founder of The Fort Bend Society of Commercial Realtors®. She was a recipient of the PRISM award for Marketing Director of the Year as well as the PRISM award for Associate Member of the Year in 2000. Jackie is a member of the Fort Bend Chamber of Commerce, Houston Associa-tion of Realtors®, and a former vice chairman of the Group Ticket Sales committee for the Houston Livestock Show & Rodeo.

FINAL THOUGHT

Immigration – an ongoing challengeA couple of years ago one of our hot topics, one that we took to Capitol Hill, was the issue of a very broken immigra-tion program, and no clear direction, no real policy for resolving the very complex issue. Legislation floated around, but nothing worked. GHBA and NAHB were involved with various groups and presented position papers on key ele-ments necessary for a successful immi-gration policy. But here we still are.

The dreaded “No Match Rule” is finally history. (But those pesky no match let-ters will continue to arrive without clarity regarding what to do with them; talk to your counsel.) While nothing seems to be happening legislatively, the emphasis on “enforcement” has shifted from the individuals to the employers. I attended a legal seminar covering some recent developments. While this is not legal advice (my disclaimer), I will share some of the points made. But if you are contacted by Immigrations & Customs Enforcement (ICE), I encourage you to talk to knowledgeable counsel and be certain that you are complying with all I-9 requirements.

You must have a form I-9 for every em-ployee. Watch for a Notice of Investiga-tion for I-9 audits. Failure to have your I-9s in order can result in high fines. ICE must give an employer three days notice, although they have been known to come in and ask to see the files immediately. Let them know you are aware of the three day notice, and then call counsel to perform an I-9 audit before the notice period has expired. Counsel may also call ICE and ask for an extension.

Counsel will review the I-9s and call employees in if they are incomplete. On that point it is important to have an absentee policy that allows you to terminate should an employee be called in to complete forms and that employee not come back to work. When going through this process, do not tell employ-ees that ICE is coming, just call them in for routine form completion.

When ICE is investigating, limit the conversation to just this investigation. They cannot record the interviews, al-though they may try. Do not consent to interviews without counsel present.

Investigations are often instigated by disgruntled employees or whistleblow-ers, or sometimes by competitors. I-9 audits are compliance matters, and while they may result in high fines, they are not the same as a criminal investiga-tion which may start with a raid which requires no notice.

The bottom line is that all paperwork should be in order and all contracts with subcontractors must state that they will comply with all laws. Contact legal counsel to be certain you are doing everything properly.

As for the policy reform, we will con-tinue to work on it along with the NAHB and other interested groups. This is a very serious and complex issue that must be resolved.

Various cities and counties, as well as the state, have asked for GHBA’s cooperation in controlling the use of directional signs, also known as “bandit signs.” The proliferation and illegal placement of these signs in public rights-of-way have once again become problems. Various citizen groups are pressuring the government to enforce the laws. The fines are potentially enormous, with penalties up to $1,000 per day, per sign in the City of Houston alone.

These signs are legal on private property only. The GHBA board of directors passed resolutions in 1998, 2001 and 2004 urging members to cooperate with local authorities and abide by all applicable laws.
