Response to Records Requested

1. Baltimore County Police Department's Standard Operating Procedures for License Plate Reader (LPR) use is attached. Grant information concerning procurement of LPRs is also attached. The Department is not in possession of any additional documents requested in your letter under this number.

2. Baltimore County Police Department began use of LPR technology in 2005. The first units were donated to the Department through the Maryland/ DC Anti-Car Theft Committee. Additional units have been acquired through funding from grants from either the Maryland Governor's Office of Crime Control and Prevention or the Maryland Vehicle Theft Prevention Council. Any documents relating to this process have been attached.

3. The data obtained from the LPR units are two photographs of a vehicle license plate, the date and time that the photographs were recorded, and the Global Positioning System (GPS) coordinates of the location in which the photographs were taken by the unit. License plate registration information cannot be disclosed by the Police Department under Maryland Code, State Government Article 10-616(p). The Department compiled records for a period of August 8, 2011 to August 7, 2012. During this period, the LPR units had 9,252,839 reads. Baltimore County owns 19 LPR units. Baltimore County has 19 vehicles equipped with a LPR. None of the 19 units are fixed or stationary. Documentation from the vendors is attached to provide information concerning capabilities.

4. The Police Department maintains a central server in which the records from each read is kept for a period of one year. After the one year period, the records are deleted from the server automatically. The Department currently has 9,252,839 reads stored on the central server.

5. Dissemination of information through the LPR unit is addressed within the attached Standard Operating Procedure. Additionally, each officer having access to the information provided by the LPR must have access to Maryland Motor Vehicle Administration (MVA) records and records maintained by the National Criminal Information Center(NCIC). Security and monitoring procedures for NCIC and MVA records are in place, in compliance with federal and state law.

6. Two Memorandums of Understanding attached to this response describe the sharing of information between any agency outside of Baltimore County. Baltimore County Police Department is not authorized to share any information without approval from the state and federal agencies providing NCIC and MVA information.

7. Baltimore County Police Department receives information from the National Vehicle Locator Service (NVLS) for use with the LRP units. NVLS does not receive or have access to the data held by Baltimore County.

This SOP Supersedes Operations Bureau SOP 08-7. Background

An Automatic License Plate Reader (ALPR) is an automated system that remotely reads license plate numbers and compares them to the current NCIC stolen vehicle database. The system is mounted within a vehicle and consists of a camera and processing unit that is networked into the police ''ehicle's mobile data terminal. The ALPR can be used as an investigative tool to assist officers with .\eir investigations whenever vehicles are involved in any particular crime.

Purpose

To establish procedures for the deployment, use and maintenance of the ALPR equipment and technology.

Relationship to Department Values

The deployment of ALPR technology is a valuable crime-fighting tool in identifying stolen vehicles and license plates. By establishing these procedures we demonstrate our continued commitment to provide the highest level of SERVICE to the communities of Baltimore County.

Procedures \

1. Permanently installed ALPR units will be listed on the appropriate Form 75, Vehicle Condition Report.

2. Only trained personnel will operate the ALPR. 3. Trained patrol personnel assigned to use the ALPR will:

a. Inspect the unit for any damage or missing parts prior to use. b. Complete the logbook documenting use and status of the equipment. c. Ensure NCIC and MVA downloads have been performed on the ALPR by verifying the date of

the updates:

d. Follow up on any discrepancies, lost equipment or problems that occur with the ALPR units with the appropriate precinct coordinator.

f. Collect the ALPR log and hits documents on a monthly basis and forward a copy to the RATT ·Unit Commander for statistical purposes.

8. RATT personnel will: . a. Establish and provide 'Train the Trainer" seminars for personnel tasked with training ALPR

operators. b. Collect, evaluate and file the ALPR statistical data. c. Act as a secondary/alternate contact for ALPR maintenance. d. Ensure the ALPR data file obtained from the reads is expunged 1 year from the date it was

NVLS License Plate Recognition (LPR) Database Server: Law Enforcement Agency User Agreement

This Agreement is valid and considered to be binding only upon those NVLS users wherein such user and/or such user's employer has not executed a specific agreement with Vigilant Video which governs their behavior while utilizing the LEARN-NVLS LPR Database Server relative to an agreed server Acceptable Use Policy.

"You agree" you have provided your full consent to this Agreement ("Agreement11) which contains the complete terms and

conditions that apply to your user account and governs use of any and all data that is shared with you by others (such as private LPR data scan records within the server's database) which you may have been granted access to upon the LEARN­NVLS LPR Database Server (LEARN-NVLS) via NVLS Tier-11 data access program. The purpose of this Agreement is to facilitate and memorialize the terms and conditions which will govern use of data. Please note that throughout this Agreement, 11 We, 11 11 Us," and ''our" will mean LEARN-NVLS, and "you," "your," and "yours" will mean your NVLS user account. You expressly agree to abide by all the NVLS data use terms and conditions outlined below.

1. RECITALS

1.1. Whereas, Vigilant Video, Inc. (hereinafter, "NVLS") is a Delaware corporation that does business throughout the United States and administers connections to the nationwide LEARN-NVLS server.

1.2. Whereas, NVLS represents that it is a legal entity, authorized to do business in the state(s) in which it conducts business. NVLS represents that it is in the business of or desires to be in the: business of gatherip.g license plate and/br vehicle location data for purposes of assuring public safety and/or site security.

1.3. Whereas, NVLS and National Vehicle Service (NVS), NFPC (NVS- OR! identifier VANVSOOSV), via Project Code NVLS- [National Vehicle Location Service], may store and disseminate to law enforcement agencies publicly and privately gathered LPR data. The purpose of the project_is to provide a common database and a web-based user interface to allow coordination with Federal, State, and Local Law Enforcement Agencies in the US and Canada to have access to certain publit: and privately <..:olle<..:ted LPR-scan data.

1.4. Whereas, a dedicated LEARN-NVLS server exists in a class-I data facility in Virginia. NVS provides services to Law Enforcement and other Government Agencies, and has the aforementioned dedicated LEARN-NVLS serve-f connected to NLETS and NCIC for the limited purposes for which NVS is granted access.

1.5. Whereas, all data received, uploaded and shared within the NVLS is placed within a physical environment secured by the same security apparatus required by the NLETS and NCIC Security Policies.

2. DEFINTIONS

2.1. LEARN-NVLS LPR Database- Refers to a physical database server that hosts LPR data records acquired nationally for purposes of dissemination to local, state, federal and govemmental Law Enforcement Agencies (LEA) by method of LEARN and NVLS account users- this database otherwise known as the National LPR Database for Law Enforcement only.

2.2. NVLS Program - Refers to the available software, support, and services provided by NVLS to those users who have entered into this Agreement with NVLS.

2.3. User - Refers to any individual or legal entity that enters into this NVLS Agreement. The term "User" herein, includes the entity, its owners, partners, employer or shareholders affiliated with such individual who executes this Agreement, as well as any other entity, employer or organization which is owned in whole or in part by ally of the owners, shareholders, employer, partners or principals of such user that executes this Agreement.

2.4. License Plate Recognition ("LPR") - Refers to the process of utilizing cameras, either stationary, or mounted on moving vehicles, to capture and interpret images of license plates located on vehicles.

2.5. LEARN- Refers to the Vigilant Video Law Enforcement Archive and Reporting Network LPR server software and apparatus.

2.6. LPR Kits- Refers to the package of electronic hardware consisting of Vigilant Video provided LPR cameras, digital signal processor(s), one Mobile Data Computer (MDC), and a Garmin GPS device, as specified to interface with -NVLS.

2.7. Confidential Information -Refers to all data, information, user interfaces, business strategies, business processes, software technology, software processes, user or customer lists, and calculations ofNVLS.

3. VALID LAW ENFORCEMENT USERS AND DATA DISTRIBUTION

3.1. Eligibility· NVLS will only knowingly provide access to the NVLS Program to parties that can lawfully enter into and form contracts under applicable law. Additionally, NVLS will not knowingly enter into this Agreement with entities who are not later determined by NVLS to be among a group of appropriate users of NVLS and the data contained therein (e.g., a valid Law Enforcement Agency granted an ORI designator is one example of an appropriate user) based upon the then cun·ent verification process of NVLS to evaluate applicants desiring to execute this Agreement.

3.2. Account Security- You will be issued an http://nvls-lpr.com/nvls/ usemame and password (one per user account) after this agreement has been successfully executed and you have been verified as a genuine NVLS user or applicant. You will be responsible for keeping username and password credentials confidential and prevent all use of username and pass.word' credentials by any unauthorized person(s). You must notify NVLS immediately if you believe your password has been, or may have been obtained or used by any unauthorized person(s) or entity. In addition, you must notify NVLS immediately if you become aware of any other breach or attempted breach of the security of your Account, NVLS's online resources or the NVLS Program.

3.3. Data Sharing- You agree to share your LPR data with similarly situated users who have executed this Agreement (for example, law enforcement users can share LPR data scans with other law enforcement users.) Additionally, the mlture of your user account may allow fo.r you to gain access to certain privately obtained LPR data that 1) you have been granted access to and 2) which also exists within the LEARN-NVLS server.· You agree that your user may receive LPR 'Hit' data reports whereupon your Hot-Li$t license plates are seen to match with LPR data scans within your jurisdiction (or otherwise specified in writing) whereby such scan data exists and is made available to NVLS account users. You also agree that LPR hit data reports based on matches to your Hot-List records (if you have uploaded any such Hot-List records to NVLS) which are out of your jurisdiction (or other agreed ten·itory) are subject to being communicated via NVLS to law enforcement agencies with the appropriate jurisdiction in proximity to the GPS coordinates of the LPR data sCan record.

4. OBLIGATIONS OF USER

4.1. Non Disclosure of Confidential Information. Each User will, or may, be privy to Confidential Infonmition. User acknowledges that a large part of the NVLS value to users comes from the collection and analysis of this Confidential Information and disclosure of any such Confidential Information by any user to unauthorized entities would cause irreparable damage to NVLS. As a result of the sensitive nature of the Confidential Information, User agrees not to disclose, directly or indirectly, any information obtained or gamered as a result of its' user status Within NVLS to any third party except to the extent necessary to complete the obligations under this Agreement.

TillS PROVISION SURVIVES THE TERMINATION OF THIS AGREEMENT AND PROHIBITIONS AGAINST DISCLOSURE OF CONFIDENTIAL INFORMATION ARE FOR AN INDEFINITE PERIOD QF TIME.

4.2. Prohibition against Selling of Vehicle Location Information (e.g., LPR data)- As a User, you are prohibited from selling any NVLS data or providing access rights to· view such data to any third party.

4.3. You must use your account in a manner that demonstrates integrity, honesty, common sense and respect for the rights ofNVLS and other users ofNVLS. You must comply with any data usage guidelines set forth or adopted by NVLS.

4.4. User watTants and represents the following: You, or if you are a company, are duly organized, validly existing and in good standing, and are qualified and/or licensed to do business in all jurisdictions to the extent necessary to carry out your obligations under this Agreement; -

5. PROHBITJONS OF DISCLOSURE BY USER

5.1. You shall not create, publish, distribute, or permit any written, electronically transmitted or other fonn of publicity material that makes reference to NVLS or this Agreement without first submitting the material to NVLS and receiving written consent from NVLS. This prohibition is specifically intended to prohibit users from cooperating with any media outlet to bring attention to NVLS. If you breach this provision NVLS may terminate this Agreement immediately upon notice to you.

6. ADDITIONAL TERMS

7.1. Grant of Licenses. During the term of this Agreement, we grant to you a non-exclusive, non~transferable right and license to (i) access the NVLS site solely in accordance with the terms and for the purposes of this Agreement and (ii) use NVLS logos, trade names, trademarks, and similar identifying material (collectively, the "Licensed Materials") that we provide to you. You may not alter, modify or change the Licensed Materials in any way and you are only entitled to use the Licensed Materials during such time as you are a USER. This license will terminate immediately upon termination of this Agreement.

7.2. USER agrees not to use proprietary materials or information in any manner that is disparaging. This prohibition is specifically intended to preclude USER from cooperating or otherwise agreeing to allow photographs or screenshots to be taken by any member of the media without the express consent ofNVLS. USER also agrees not to voluntarily provide ANY information, including interviews, related to NVLS, its products or its services to any member of the media without the express written consent afNVLS.

7.3. Term of this Agreement. Subject to the Automatic Termination Clause set forth in Section 8.5 below, this Agreement shall be for a term of one (1) year and shall renew automatically for successive one ( 1) year terms, unless either party gives written notice of termi~ation for Cause no less than 30 days prior to the end of the term.

7.4. Termination. This Agreement shall not be Prematurely terminated unless either pmty breaches this Agreement and such breach remains uncured for 30 days after receiving writlen notice Qf such breach.

7.5. NVLS may modify any of the terms and conditions in this Agreement, at any time. You will be notified of any modification. Modifications may inctude, but are not limited to, USER rules and policies. If any modification or change is unacceptable, you may terminate this Agreement. Your continued participation as a USER fallowing the receipt of notice of the change or new agreement will indicate and constitute your acceptance of the changes, modifications or new agreement.

7.6. Disclaimer. NVLS makes no express or implied representations or warranties regarding NVLS related equipment, website, online utilities or their performance, availability, functionality. Any implied warranties of merchantability, fitness for a particular purpose are expressly disclaimed and excluded.

7.7. Limitations ofLiabiiity .. NVLS WILL NOT BE LIABLE TO YOU UNDER.ANY CIRCUMSTANCES Willi RESPECT TO ANY SUBJECT MATTER OF THIS AGREEMENT UNDER ANY CONTRACT, NEGLIGENCE, TORT, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY FOR ANY INDJRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF REVENUE OR GOODWILL OR ANTICIPATED PROFITS OR LOST OF BUSINESS). IN NO EVENT WILL THE COMPANY'S CUMULATIVE LIABILITY TO YOU ARISING OUT OF OR RELATED TO THIS AGREEMENT, EXCEED $10,000.00.

7.8. Indemnification. You agree to indemnify, defend and hold harmless NVLS and their employees, representatives, agents, officers, directors, and corporate employees (each, an 11lndemnified Party"), against any and all claims, suits, actions, or other proceedings brought against the Indemnified Party based on or arising from any claim (i) resulting fi·om your breach of this Agreement, (ii) that involves any vehicle owned or operated by you, (iii) or any employee or independent contractor hired by you or {iv) any and all claims based on your actions or omissions. You will pci.y any and all costs, damages, and expenses, including, but not limited to, reasonable attomeys' fees and costs awarded against or otherwise incurred by the Indemnified Party in connection with or arising from any such claim, suit, action, or proceeding.

7.9. Independent Contractor Status. E<ich party will at all times be deemed to be an independent contractor with respect to the subject matter of this Agreement, and nothing contained in this Agreement will be deemed or construed in any manner as creating any partnership, joint venture, joint enterprise, single business enterprise, employment, agency, fiduciary or other similar relationship.

7.1 0. Assignment of this Agreement. You may not assign your rights or obligations under this Agreement to any party, without the express written consent ofNVLS which will not be unreasonably withheld.

7.11. You understand that NVLS may at any time, directly or indirectly, engage in similar arrangements on terms that may differ from those contained in this Agreement with ather parties, including parties which may conduct operations in your geographic area. NVLS reserves the right to provide vehicle location data to appropriate third party entities for purposes of promotions, marketing, business development or any ather commercially reasonable reason that NVLS deems necessary and supports the continued growth of the NVLS network ofLPR information.

7.12. You represent that you have independently evaluated this Agreement and are not relying on any representation, guarantee, or statement from NVLS or anyone else, other than as expressly set forth in this Agreement.

7.I3. TillS AGREEMENT WILL BE GOVERNED BY AND INTERPRETED IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS WITHOUT REGARD TO THE CONFLICTS OF LAWS AND/OR PRINCIPLES. YOU CONSENT TO THE EXCLUSIVE JURISDICTION IN THE STATE AND/OR FEDERAL COURTS LOCATED ll'f TARRANT COUNTY, TEXAS, IN ANY DISPUTE INVOLVING TI!IS AGREEMENT.

7.14. Except as otherwise permitted by this Agreement, no amendment to this Agreement or waiver of H.ny right or obligation created by this Agreement will be effective unless it is in writing and signed by both you and NVLS. Our waiver of any breach or default will not constitute a waiver of any different or subsequent breach or default.

7.15. This Agreement represents the entire agreement between us and you and supersedes all prior agreements and communications, oral or written between you and NVLS, its agents or representatives.

7.16. Neither party will be liable for failure to perform or delay in performing any obligation under this Agreement if

such failure or delay is due to fire, flood, eruthquake, strike, power outage, blizzard, war (declared or undeclared), commercial impracticability, embargo, blockade, legal prohibition, governmental action, riot, insmrection, damage, destruction or any other cause beyond the reasonable control of such party.

7.17. If any provision of this Agreement is held to be invalid, illegal or unenforceable for any reason, such invalidity, illegality or unenforceability will not affect any other provisions of this Agreement, and this Agreement will be construed as if such invalid, illegal or unenforceable provision had never been contained herein.

7.18. All notices required by this Agreement shall be addressed to and mailed through the U.S. Postal service to the parties' addresses as set forth below. Additionally, the parties may agree at a later date to allow all such notices to be con_ducted in a different manner, inducting via e-mail or through electronic posting on a designated website.

YOU ARE AGREEING THAT YOU HAVE READ AND UNDERSTAND THE TERMS AND CONDITIONS OF THIS AGREEMENT AND THAT YOU AGREE TO BE LEGALLY RESPONSIBLE FOR EACH AND EVERY TERM AND CONDITION

The Baltimore County Police Department Regional Auto Theft Team requests accesi>"to the National Vehicle Location Service (NVLS) license plate reader database. Vigilant Video collects license plate reader data from public and private sources that is added to the NVLS database. This program is only offered by Vigilant Video. The database is available to law enforcement agencies to research license plate and/or vehicle location data.

Having access will allow our investigators to conduct license plate searches from a database that currently houses over 585,000,000 data records. They estimate a daily average of 1,170,000 new vehicle locations. NVLS has a concentrated coverage of the Northeast area of the United States. The NVLS database would be a valuable investigative resource for our detectives.

Funds are available in the FY11 Maryland/De ACT grant 005-015-1130 to cover the annual cost of this service. The grantor has encouraged the Regional Auto Theft Team to utilize this product.

Vigilant Video is the only company that offers access to an extensive private and public license plate reader database. We request a sole source procurement of NVLS-Tier II Extended LPR Data Subscription.

Mobile license Plate Reader

ELSAG NA's Automatic Ucense Plate Reader (ALPR) system, the Mobile Plate Hunter-900 (MPH-900) can be mounted to patrol cars capturing license plate numbers during entire shifts_ II a

suspect license plate number is read, audible and visual alarms alert lhe officer wilhin milliseconds of license plate capture.

Cameras, a processing unit and proprietary software, allow officers to capture images of license plates and instantaneously compare !hem with milllons of Hot list records to identify vehicles of interest. This highly advanced Automatic License Plate Reader system reads platl!s day or night, from all 50 States and most foreign countries including Arable characters. It can also read other alpha-numeric identification systems--even from 1500 feet in the air. The MPH-900 ALPR system minimizes the guesswork and safety risks that challenge officer_s every day.

The MPII-900 has unique capabilities, many of which arc much more advanced than features of other mobile ALPR systems

Digital Camera Technology.

The MPH-900 ALPR's digital cameras see more than analog cameras do. Compared to tha analog cameras used by all other ALPR systems, images taken by the MPH-900's digital cameras capture nearly twice the physical area-the swl!l!t spot-and that means more information for law enforcl!ment. While images taken with analog cameras show little more than the license plate, MPH-900 ALPR cameras show the plate, a signlflcant portion of the car and part of the car's surroundings-day or night and in any wealhl!r. This visual information can grea!ly aid investigations.

The MPH-900 ALPR takl!s "progressive scan" images, which present a bailer quality image than competitive technology using the "interlace scan" melhod. Progressive scans are digital and license plate images are read and captured one line at a lime, sequentially. A progressive scan produces a far clearerread. providing more detail and a larger image area than the analog "interlaced scans" used by competitive ALPR systems. With interlaced scans, the camera can only record every other line of the license plate over two separate scans. In a final step. the system weaves the two scans together to form one complete image.

MEMORANDUM OF UNDERST ANDil'!G BETWEEN

MARYLAND STATE POLICE AND

MARYLAND LICENSE PLATE SCREENING TECHNOLOGY USER AGENCY

GENERAL PROVISIONS

1. PURPOSE: The purpose of this Memorandum of Understanding (MOU) between the Maryland State Police as the National C1ime Infom1ation Center (NCIC) Oiminal Justice Infonnation Systems (CJIS) Systems Agency (CSA) and Baltimore County Maryland, on behalf of the Baltimore County Police Department, hereinafter referred to as the "pariies", is to memorialize the pariies' understar1ding regarding the trar1smitting, receiving, and storing of infmmation contained in the National Crime Infon11ation Center (NCIC) system of records.

2. BACKGROUND: The FBI maintains the NCIC system of records containing multiple files. Two of the files, the and o, contain information relating to stolen vehicles, vehicles wanted in conjunction with felonies, and vehicles subject to seizme based on federal court orders. Additionally, infon11ation relating to vehicles in association with wanted persons is contained in the --

Several law enforcement agencies in Maryland have instituted state ofthe mi license plate screening technology from mobile m1d fixed sites. Their vendors provide software and screening devices that have the capability of scanning license plates and sear'Ching a lo.cal database loaded into a patrol vehicle computer or other location controlled by the agency. Data is provided to law enforcen1ent agencies, not the vendor. Consequently, these law enforcen1ent agencies have requested for the CSA to obtain relatively cmrent infonnation from the NCIC files in order to compar·e scarmed numbers against stolen license plates.

3. AUTHORITY: The CSA shall have the sole discretion topromulgate and retain any rules, regulations, and procedures necessary to the operation of the license plate screening teclmology.

4. SCOPE: Tllis MOU applies to the CSA's transmission ofinfom1ation fi·om thE·

B. The User Agency will:

1. Use the NCIC extracts for law enforcement purposes;

2. Update its local database as the CSA updates become available, ensuring that those numbers. deleted from the NCIC system are also deleted fi"mn all local databases;

3. Confitm extract hits are still active in NCIC, in accordance with cunent hit confirmation policy;

4. Ensure all users are aware extracts do not contain up-to-date infonnation; and

5. Provide the CSA with the name and telephone number of a technical and administrative point of contact.

5. DISCLOSURE AND USE OF INFORMATION: The exchange ofinfom1ation will be linlited to exh·acts from the and vehicle infonnation in the

7. INDEMNIFICATION OF THE MARYLAND STATE POLICE: The User Agency agrees to indenmi:f}r the Maryland State Police, its officers and employees, to the extent petmitted by law and subject to the limitations as set forth in the State Tort Claims Act, Title 12, Subtitle 1 of the State Govemment Article or the Local Govennnent Tort Claims Act, Title 5, Subtitle 3 of Courts and Judicial Proceedings .A~1:icle, Am10tated Code of Maryland fimn and against a!! claims, demands, actions, suits, and proceedings by others, against all liability to others, including, but not limited to, any liability for damages by reason of, or arising out of any false atTest or imprisomnent, or any other cause of action whatsoever, and therefi·om, arising out of or involving any negligence on the part of the User in the execution of the Agreement. Notbing contained in this agreement shall be deemed t~ constitute a waiver of the sovereign immunity ofthe State or to provide indemnification for negligent acts by the Maryland State Police, their officers, employees, or agents.

8. TERM: All activities of the parties under tllis MOU will be canied out in accordance to the above described provisions. The CSA reserves the right to immediately suspend furnislling the extract whenever the security, ptivacy, use or dissemination requirements established by this

MOU are violated. The CSA may reinstate access in such instances upon receipt of proof the violation has been corrected. Either party may terminate this MOU upon 30 days written notification to the other pmiy. Such notice will be subject of immediate consultation by the parties to decide upon the appropriate course of action. In the event of such tem1ination, the following rules apply:

1. The parties will continue participation up to the effective date of termination.

2. All project information, copies, thereof, and rights therein received under the provisions of this MOU prior to the termination will be destroyed within six months of the termination of this MOU.

9. This MOU, which consist of nine sections, will enter into effect upon signature of both parties and will remain in effect until terminated. The foregoing represents the understandings reached between the CSA and the User Agency.

MEMORANDUM OF UNDERSTANDING between the

MARYLAND STATE POLICE and

BALTIMORE COUNTY POLICE DEPARTMENT

THIS AGREEMENT IS BETWEEN THE MARYLAND STATE POLICE (HEREINAFTER REFERRED TO AS "MSP") and

BALTIMORE COUNTY MARYLAND A BODY CORPORATE AND POLITIC, FOR ITS BALTIMORE COUNTY POLICE

DEPARTMENT

PURPOSE OF AGREEMENT

Pursuant to the Edward J. Byrne Memorial Justice Assistance Grant (BJAG) to State and Local Law Enforcement Agencies, the Governor's Office of Crime Control and Prevention (GOCCP) has provided cettain funds under the License Plate Recognition Expansion (LPR) Grant Program. GOCCP is the grantor of these funds, the MSP is the grantee and Maryland local law enforcement agencies are sub-grantees of the program. The grant award number is BJAG-2008-1002, and the CFDA number is 16.783. The period of performance is March 1, 2011 through Febmary 29, 2012 The purpose of this funding is to use grant funds to purchase LPR equipment and related services needed to install this equipment and make it operational.

GOCCP has designated all funds for the LPR project from the Edward J. Byrne Memorial Justice Assistance Grant (BYRNE-JAG) to be administered by the MSP.

The MSP has agreed to facilitate the distribution of equipment purchased under this grant to the participating law enforcement agencies who, in turn, agree to abide by the rules governing the purchase and use of the qualifying equipment. In accordance with EYRE­JAG grant policy, all equipment purchased under this grant shall remain the property of the Maryland State Police for a period of three (3) years following its purchase. At the end of that period the equipment will become the property of Baltimore Co. Police Depmtment in accordance with all Federal, State and local laws and regulations.

SUB-GRANTEE OBLIGATIONS

Baltimore County Police Depmiment agrees to receive equipment from the MSP pursuant to the grant award, and to use and maintain the equipment within the guidelines of this grant. As sub-grantee, the Baltimore County Police Department agrees to the conditions outlined in "License Plate Recognition Expansion Grant Program, Program Requirements" (Attachment #1) to include, but not limited to, inventory management, location designation, periodic auditing, and periodic statistical repotiing.

In the event any equipment provided through MSP is damaged, lost or stolen while in possession of Baltimore County Police Department, it shall be the sole responsibility of

Baltimore County Police Department to repair or replace the equipment, at the discretion of the MSP. The MSP shall have no responsibility to repair or replace equipment damaged, lost or stolen while in the possession of Baltimore County Police Depmiment.

DURATION OF AGREEMENT

This agreement shall remain in effect for the period of pe1formance (March 1, 2011 tluough Febmary 29, 2012), and may be extended by agreement between the MSP and Baltimore County Police Depmiment.

The Maryland State Police reserves the right to monitor inventories of equipment provided to the sub-grantee under this agreement for a period of three years after its purchase.

OTHER PROVISIONS

This agreement is entered into with the intention that the law of the State of Maryland shall govern its constmction and enforcement.

Notwithstanding any other provision in this agreement to the contrary, nothing in this agreement nor any action taken by the MSP pursuant to this agreement shall constitute or be construed as a waiver of the sovereign or governmental illllllunity of the MSP or its troopers or employees. Fmihermore, notwithstanding any other provision of this agreement to the contrm·y, the MSP shall have no obligation to explicitly or implicitly

·indemnify or hold harmless Baltimore County Police Depmiment or any third patiy from any liability whatsoever.

License Plate Recognition Expansion (LPRE) Grant Program Program Requirements

Attachment #1

1. Any sub-grantee recipient agency accepting equipment provided under this grant will be responsible for having in place, prior to the receipt of LPR equipment, a department Standard Operating Procedure (SOP) goveming the proper use ofthe equipment. A copy of this SOP will be provided to the Maryland State Police (MSP) at or before the time the equipment is transfetTed to the sub-grantee recipient agency. The SOP shall also be kept on file by the sub-grantee agency with inventory records for audit purposes. Inventory records regarding LPR equipment must be maintained for a period ofthree years from the time the equipment is transfened to the sub-grantee recipient agency .

2. A sub-grantee recipient agency understands that the scope of the grant covers basic LPR equipment, "standard" installation and mounting equipment, oper<tting software, initial training, and a wananty agreement. All other costs, including custom or modified installation, storage and archiving equipment, air cards or power source connections, additional training or costs associated with moving the equipment to a new location or vehicle is the sole responsibility of the sub-grantee agency.

3. Sub-grantee recipient agency must provide a Mobile Data Tem1inal (MDT) or laptop (needed for use as a client user interface with the system) with sufficient capacity and configuration to operate the LPR for each mobile unit provided under this grant. Fixed units must be connected to a working computer system capable of perfonning the same function as the MDT/KDT!laptop function for mobile units.

4. Sub-grantee recipient agencies must have sufficient vehicles in their inventory as to have more vehicles than mobile LPR units provided to that agency under this grant, and be able to make modifications to those vehicles, if necessary, to facilitate the installation ofLPR equipment.

5. At the conclusion of the grant provided warranty period, the responsibility and costs for repair, maintenance, upgrades or other support for the LPR equipment will be the sole responsibility ofthe sub-grantee recipient agency.

6. Initial training of a reasonable number of personnel will be provided by the vendor chosen and funded by this grant. Additional, recurrent or specialized training will be the responsibility of the sub-grantee recipient agency.

7. Grant provided LPR equipment and all infonnation obtained from its use will be utilized for law enforcement purposes only, and is to be govemed by

provisions of Maryland statute, the grant, Maryland State Police and sub­grantee recipient agency policy.

8. All agencies agree to have their LPR equipment networked to the Maryland Coordination and Analysis Center (MCAC) within six months of receipt. An extension may be granted by agreement between the MSP and XXXX.

9. There will be no transfer ofLPR equipment by the sub-grantee recipient agency to another agency or depatiment. If a sub-grantee recipient agency no longer wishes to utilize the equipment in accordance with these requirements, all grant provided equipment shall be retumed to the Maryland State Police.

10. Specific data related to the effectiveness of grant supplied LPR equipment will be provided by the sub-grantee recipient agency to the Maryland State Police on a quarterly basis. Perfonnat1ce Measure and Project Progress Report infom1ation must be submitted to the Matyland State Police by the following dates: JU11e 30,2011 September 30, 2011 December 31, 2011 February 29, 2012.

This data may be used to show the effectiveness of the equipment or the grant itself and shall not include personal or infommtion otherwise controlled by law, policy or statute.

11. Any sub-grm1tee recipient agency participating in the LPR Grant Program agrees to consider any request from a non-participating agency within its jurisdictional boundaries for assistance with monitoring vehicle license plate data through the nse of grat1t provided LPR eqnipment.
