Proposal:

The Owner is requesting permission to maintain an existing deck, deck stairs, shed, and A/C unit, with the following variances:

Official Plan:

The subject lands are designated “Low Density Residential” by in-effect OPA #350 (Maple Community Plan), and “Low-Rise Residential” by the new City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board. The proposal conforms to the policies of the Official Plan.

Comments:

The Development Planning Department conducted a site visit with photo documentation on August 13, 2013. The two-storey single detached dwelling maintains a basement walk-out at the rear of the building. The deck stairs and second floor deck are located adjacent to an Agricultural Zone on the southeast side of the property and have limited visual impact on neighbouring properties to the south and east. As such, the Development Planning Department has no objection to the reduced setback of the deck and deck stairs. The Development Planning Department has no objection to the reduced side yard and rear yard setbacks and the increased height of the shed, or to the reduced side yard setback of the raised A/C unit. The Development Planning Department is of the opinion that proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.

Recommendation:

The Development Planning Department supports Minor Variance Application A256/13.

Comments: A site inspection was conducted on August 7, 2013 at 291 Isaac Murray Avenue in relation to minor variance application A256/13. The current location of the air conditioning unit is installed on a raised metal bracket above the drainage area, and will not interfere with the existing side yard drainage pattern.

The proposed setbacks in relation the location of the existing shed with a minimum setback of 0.43m is not impacting the grading of the adjacent properties will not interfere with the approved drainage for the subject lot. The existing deck with a rear yard setback of 4.15m does not interfere with the grading or drainage of the subject lot.

The Development/Transportation Engineering Department has no comments or objection to application A256/13.

PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the project or plan. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of PowerStream’s cost for any relocation work.
