Lucas Smith Affidavit now filed with the US District

Court - Obama Kenyan BCSeptember 4th, 2009

As of today, September 4, 2009, this Affidavit has been filed with the United States District

Court in Southern California ~ represented by Orly Taitz.

This is a legal affidavit that declares Lucas Smith to be of sound mind and judgment. Lucas

can go to jail if he lied on this affidavit.

The document (Certified COPY of Obama Kenyan Birth Certificate) you see here, once it is

validated by the court, is pretty much the proverbial smoking gun.

I believe thats a copy of the real BC. BO was born in Kenya and not

Honolulu like he says. BO is the biggest liar in the world. I sure hope Orly

gets discovery so that she can get the real BC and not just a copy along

with all the other documents requested. BO has to go. I hope sooner than

suspecting that he does indeed, HAVE THE REAL GOODS, in this

Hopsital generated at the point of Birth, BC. The Dictor is authentic and

was practicing medicine at the time in Kenya, the Hospital is authentic

and has existed for a very long time, yes with several name changes, but

still in the same location, and IF that foot print matches, I think that is

the way to prove that Obama is a total fraud on all fronts. We may have

I saw this sometime this morning on Orlys site and am extremely excited

about it!! I think its the smoking gun, alsohow could the judge dismiss

it? I am praying very hard for Judge Carter personally and professionally.

With Gods help, he will do the right thing. There is no way BO should be

allowed to stay in office until he DISPROVES these documents, which he

cant do.

Its amazing that all of this is happening next weekBO trying to

indoctrinate school children, the hearing in Santa Ana, 9/11, and the DC

march on 9/12. There is a reason all of this is coming together. BO isgoing to have the wind taken out of his sails this week for sure! I

We all know Obama is not a legal President as his Father was born in

Kenya and that precludes him from being a Natural Born Citizen no

matter where he was born. If he were born in Chicago on a Construction

site in a Port-A-Pot, after sorting out all the crap and finding Obama, he

could claim citizenship, but sure as the devil, he could not claim to be a

Natural Born Citizen. Why? No matter where he was born, his Father is

still Kenyan and no matter what he does he cannot change that, and both

My biggest fear is that our top secret information, which hes had access

to since January, may have already been shared with our enemies. I feel

this because its obvious, by his actions alone, that this mans allegiance

has never been with our great country. Since taking office, hes kissed up

to our enemies, insulted our allies, as well as tried to destroy everything

that is decent and good about this nation.

I also believe that this has been a set up for a very long time. Have you

wondered, as I have, how the thousands upon thousands of pages of the

stimulus, health care, & cap and tax were seemingly done in a matter of

days to be so quickly voted on without anyone reading them? No, those

bills have been sitting around for a while waiting to be brought out at the

appropriate time. I dont care how many people you have working on

something like that, they cant be done, along with several copies to be

handed out, in just days.

Please pray that truth and justice will conquer this evil administration and

their plans to destroy our country. I also pray that all those involved

(lawyers, judge, plaintiffs and witnesses) in this lawsuit will be kept safe

from harm. The Lord is stronger than Satan. I look forward to Tuesday.

issue is on the mind and hearts of so many American citizens, how can

one look the other way with this lingering over our heads? The truth will

Another issue is I thought the Kenya government went in and took all the

records they had over a few years pertaining to the time Obama was

born? If they took all the records then how can you obtain a copy from

the hospital if all the records were taken by the Kenya government?

This all sounds to good to be true and something seems fishy about this.

Court jurisdiction over political questions as to the fitness and

qualifications of the President which the Constitution entrusts exclusively

to the House and Senate.

1. The military Plaintiffs also lack standing herein because members of

the military cannot challenge the orders of a superior in a judicial forum

It is well settled that when the United States Constitution makes a

textually demonstrable commitment of an issue to another branch of

the government, other than the judiciary, that issue presents a non-

justiciable political question. See Baker v. Carr, 369 U.S. 186, 217, 82 S.Ct.

691, 710, 7 L.Ed.2d. 663 (1962). The political question doctrine serves torestrain the Judiciary from inappropriate interference in the business of

the other branches of Government by prohibiting the courts from

deciding issues that properly rest within the province of the political

branches. United States v. Munoz-Flores, 495 U.S. 385, 394, 110 S.Ct.

1964, 109 L.Ed.2d 384 (1990). Because disputes involving political

questions lie outside of the Article III jurisdiction of federal courts, such

cases are to be dismissed for want of jurisdiction. Corrie v. Caterpillar, 503

F.3d 974, 980, 982 (9th Cir. 2007). The issues sought to be raised by

Plaintiffs in this case regarding both whether President Obama is a

natural born citizen of the United States, and therefore qualified to be

President, as well as any purported claims raised by any criminal statutes

cited in the First Amended Complaint are to be judged, according to the

text of the Constitution, by the legislative branch of the government, and

not the judicial.

Explaining this provision of the Constitution, Alexander Hamilton stated

that: the people of each State shall choose a number of persons as

electors, equal to the number of senators and representatives of such State

in the national government who shall assemble within the State, and vote

for some fit person as President. [emphasis added]. See Federalist Papers,

No. 68.

At the outset, the Constitution indicates that issues related to a

candidates eligibility for the Office of President rest, in

the first instance, with the voters and with their Electoral College, the

Constitutionally created body responsible for selecting the President of the

United States. See U.S. Constitution, Article II, section 1, cl. 2 (Each State

shall appoint, in such Manner as the Legislature thereof may direct,

electors for the President and Vice President) Id. Amend. XXIII section 1

Williams v. Rhodes, 393 U.S. 23, 43, 89 S.Ct. 5, 21 L.Ed.2d 24 (1968)

(Harlan, J., concurring) (The [Electoral] College was created to permitthe most knowledgeable members of the community to choose the

executive of a nation.). The Constitutions commitment to the Electoral

College of the responsibility to select the President includes the authority

to

decide whether a presidential candidate is qualified for office because the

examination of a candidates qualifications is an

integral component of the electors decision-making process.2

The Constitution also provides that, after the Electoral College has voted,

further review of a presidential candidates

eligibility for office, to the extent such review is required, rests with

Congress. Where no candidate receives a majority of the

electoral votes, the Constitution commits to the House of Representatives

the authority to select the President and, in so

doing, to evaluate the candidates qualifications. See U.S. Constitution

Amendment XII. Similarly, the Twentieth Amendment exclusively grants

Congress the responsibility for selecting a President when a candidate

elected by the Electoral College does not satisfy the Constitutions

eligibility requirements. See id. Amendment XX, 3 (the Congress may

by law provide for the case wherein neither a President-elect nor a Vice

President-elect shall have qualified, declaring who shall then act as

President, or the manner in which one who is to act shall be selected, and

such person shall act accordingly until a President or Vice President shall

have qualified.). Thus, review of Presidential qualifications after the

Electoral College has acted rests in Congress, pursuant to the

Constitution.

The Constitutions textual commitment of this responsibility is a

responsibility that Congress has embraced. Both the House and Senate

have standin committees with urisdiction to decide uestions relatin to

Presidential elections. See S.R. 25.1n(1)(5) (the Senate Committee on

Rules and Administration has jurisdiction over proposed legislation,

messages, petitions, memorials, and other matters relating to . . . federal

elections generally, including the election of the President, Vice President,

and members of Congress, as well as Presidential succession) (copy

attached for Courts convenience as Exhibit 1 hereto). See also H.R. 10(j)

(12). (Copy attached as Exhibit 2).

Federal legislation further details the process for counting electoral votes

in the Congress. Under 3 U.S.C. 15, Congress is

directed to be in session on the appropriate date to count the electoral

votes for President, with the President of the Senatepresiding. The statute further directs that the electoral votes be counted,

and then the results be presented to the President of the Senate, who shall

then announce the state of the vote. The statute then provides a

mechanism for objections to be registered and resolved in the following

language:

[e]very objection shall be made in writing, and shall state clearly and

concisely, and without argument, the ground thereof, and shall be signed

by at least one Senator and one Member of the House of Representatives

before the same shall be received. When all objections so made . . . shall

have been received and read, the Senate shall thereupon withdraw, and

such objections shall be submitted to the Senate for its decision and the

Speaker of the House of Representatives shall, in like manner, submit

such objections to the House of Representatives for its decision.

In summary, it is clear, from the text of the Constitution, and the relevant

statutory law implementing the Constitutions textual commitments, that

challenges to the qualifications of a candidate for President can, in the

first instance, be presented to the voting public before the election, and,

once the election is over, can be raised as objections as the electoral votes

are counted in the Congress. Therefore, challenges such as those

purportedly raised in this case are committed, under the Constitution, to

the electors, and to the Legislative branch.3

In summary, the issues which Plaintiffs seek to litigate in this case are,

under the Constitution, within the sole and exclusive jurisdiction of the

House of Representatives and the Senate of the United States.

Additionally, litigation of these issues in this Court, and the granting of

some or all of the relief sought by Plaintiffs herein would violate the

doctrine of separation of powers. Accordingly, this case must be dismissed,

because it presents non-justiciable political questions.

OK, but the problem I see is that everything pertaining to this election

was unconstitutional and the Electoral College, Senate, Congress and the

Courts all violated the constitution by ignoring their duty to uphold the

constitution. Therefore this is not merely a case about Obama being fit to

be President, but it is a constitutional issue whether our elected officials

have violated the constitution by not properly challenging the eligibility

clause in the constitution. So therefore it is the COURTS that have

jurisdiction to resolve matters that are unconstitutional. Yes? No?


First, as discussed below, the political question doctrine precludes redress

to any Plaintiffs because such redress would improperly arrogate to this

Court jurisdiction over political questions as to the fitness and

qualifications of the President which the Constitution entrusts exclusively

to the House and Senate.
