When a person is arrested in South Africa, they are handed a notice that sets out their rights in terms of the Constitution. We have recreated the current notice on the next page. We believe that this notice is not in plain language. We believe that it is not accessible to many, if not most, South Africans. To celebrate International Plain Language Day, we have put together a draft concept that we believe is better. The draft concept is on the following pages. The concept includes: A rewrite and redesign into the 11 official languages of South Africa A sample of a voice recording (isiZulu) – police could play this voice recording to the arrested person in the language of their choice. This document sets out your rights under the Constitution of South Africa. The reason for these rights is to make sure that you get a fair trial. The law presumes that you are innocent until a court says that you are guilty. Custody includes being held in a police van, at a police station, in a prison cell at court, or in a prison. Reason for arrest and being kept in custody The reason you were arrested and are being kept in custody is because you are suspected of having committed the crime of You have nine rights About being treated with dignity 1 Right to be treated with human dignity You have the right to be given adequate accommodation, food and water, reading materials, exercise, and medical treatment.
