OSHA's Memorandum on EmployerIncentive and Disincentive Policies andPractices
Gary Auman, Director and Attorney withDunlevey, Mahan & Furry from Dayton, Ohioprovided two sessions at IISC's ProfessionalDevelopment Conference last weekconcerning OSHA compliance. During thesessions, a March 12, 2012 memo sent outby Richard E. Fairfax, the Deputy AssistantSecretary for OSHA to all RegionalAdministrators and Whistleblower ProgramManagers, was discussed. Gary hasprovided this article addressing the
memorandum to help IISC members understand possiblechanges may be needed with your company's incentiveprograms. I do want to point out that these are GaryAuman's comments, not IISC's. IISC has not taken aposition at this time and we will wait to see how OSHAintends to enforce this issue. Auman, Dunlevey, Mahan & Furry On March 12, 2012, Richard E. Fairfax, the Deputy AssistantSecretary for OSHA issued the above noted memorandum toall regional Administrators and Whistleblower ProgramManagers. This memo takes OSHA discrimination (11(c))violations to a level which most employers have notanticipated. I think most employers have been aware for years of thewhistleblower protection afforded employees who make acomplaint to their employer or to OSHA regarding safetyhazards in their workplace. This protection is afforded to allemployees under Section 11(c) of the Occupational Safetyand Health Act. That section clearly states that: "No person shall discharge or in any manner discriminateagainst any employee because such employee has filed orinstituted or caused to be instituted any proceeding under or

related to this Act or has testified or is about to testify inany such proceeding or because of the exercise by suchemployee on behalf of himself or others of any right affordedby the Act." What many didn't realize is that OSHA had taken that prettyobvious language and developed and finalized a regulationunder 29 CFR 1904.36 that extends the protection ofSection 11(c) to an employee reporting a workrelatedfatality, injury or illness....Read the full articleat www.iisc.org. AMES, Iowa April 11, 2012 Recently, several motor vehicle crasheswith school buses have prompted theIowa Department of Transportation toremind motorists of when it is illegal topass a stopped school bus on anypublic or private roadway or driveway. The bill known as "Kadyn's Law," inmemory of Kadyn Halverson, went intoeffect with the governor's signatureMarch 16. The 7yearold first graderfrom Kensett was killed last May by adriver who had illegally passed astopped school bus. The new provisions increase the penalties for drivers who fail to abide by the law (IowaCode 321.372) on stopped school buses. Previously, a motorist who passed a bus whenthe red warning lights were flashing was fined $200. The new Iowa law increased thepenalty to at least $250 and as high as $675 for a first offense and up to 30 days injail. For subsequent violations, a driver could face fines of up to $1,875. A driver whoviolates the law and causes an injury could face added fines, jail time and licensesuspension. In addition to the situations described below, drivers should never pass on the right.Violations of Iowa's motor vehicle laws should be reported to local law enforcement. Scenario 1 You are traveling on a twolane or threelane
Nearing the bus from the rear; drivers must always stop when either the amberlights or red lights are flashing. Stop no closer than 15 feet from t he bus.Meeting the bus from the front; drivers must slow their vehicles to 20 mph whenamber lights are flashing. Stop when the lights change to red and the stop armcomes out. Remain stopped until the lights stop flashing and the stop arm iswithdrawn.
Scenario 2 You are traveling on a road with two or more lanes in eachdirection
Stop if nearing the bus from the rear when amber or red lights are flashing. Stop no closer than 15 feet from the bus. When meeting the bus in one of the opposite two lanes (or more), you do notneed to stop even if the bus has stopped with lights flashing and stop arm out.The bus is not permitted to load or unload children who must cross this type ofroadway unless there are official traffic control devices or police officerspresent.

OSHA Announces New National Emphasis Program forNursing and Residential Care Facilities
On April 5, OSHA announced a new National EmphasisProgram for Nursing and Residential Care Facilities to protectworkers from serious safety and health hazards that are

common in medical industries. OSHA develops national emphasis programs to focus outreach efforts and inspectionson specific hazards in an industry for a threeyear period. Through this NEP, OSHA willtarget nursing homes and residential care facilities in an effort to reduce occupationalillnesses and injuries. In 2010, according to the department's Bureau of Labor Statistics, nursing andresidential care facilities experienced one of the highest rates of lost workdays due toinjuries and illnesses of all major American industries. "These are people who havededicated their lives to caring for our loved ones when they are not well. It is notacceptable that they continue to get hurt at such high rates," said Dr. David Michaels,assistant secretary of labor for occupational safety and health. "Our new emphasisprogram for inspecting these facilities will strengthen protections for society'scaretakers."
