What is a franchise agreement?

The ACCC website defines a franchise agreement as follows:

”A franchise agreement is an agreement (written, verbal or implied) under which:

● one party (the franchisor) grants another party (the franchisee) the right to carry on a business supplying goods or services under a specific system or marketing plan substantially determined, controlled or suggested by the franchisor or an associate of the franchisor

● the business is associated with a particular trademark, advertising or a commercial symbol owned, used, licensed or specified by the franchisor or its associate

● the franchisee is required to pay, or agree to pay an amount to the franchisor before starting or continuing the business (there are some exceptions).”

What you could earn

We aim to be clearly better than any

guarantee of earnings although our experience

to date to date shows that you can expect a

gross income of around $60,000 after the first

year. We back this with our Income Guarantee.

Questions you might ask us

We plan to take a great deal of time and effort in attracting the right calibre of franchisees to join

the TIME FOR YOU family. With that in mind, we have drawn up a list of questions that we feel all

franchisees (and in particular, their professional advisors) will want answers to. We will ensure that

the answers are fully covered in both the presentation of the business to you and in the franchise

legal agreement.

Please feel free to ask any questions of your own at any time, this is not an exhaustive list.

➢ How long does the franchise licence last? 5 years with four 5 year options.

➢ Will you provide an earnings forecast to suit my individual circumstances? We will provide

you with a spreadsheet to use with all known costs built in, and access to existing franchise

owner average earnings. For privacy reasons we are not able to give you individual

franchise owner results.

➢ What if I want to cancel the franchise contract? Our franchise agreement has a voluntary

termination clause. Alternatively you have the right to sell your franchise.

➢ What help will you provide to start my business? The Time for You proven initial training

program will assist you to get your new business off to a great start, and you will then

receive ongoing support and counselling.

➢ What are the on-going fee that I have to pay to the franchisor? You will pay 12% of your

sales as ongoing costs. These costs are Royalty 6.5%, Marketing 1.5% and Administration

Services 4.0%

➢ Will there be an extra cost to renew the franchise? Yes, there is a renewal fee payable prior

to the start of your next term of five years which is set at just 20% of the then current

initial fee for a new franchise.

➢ How many people have you trained so far? The franchise became available in Australia for

the first time in 2015. In the UK the founders of the Time for You franchise system have

trained more than 200 franchise owners.

➢ What will happen if I prove unsuitable? At Time for You we pride ourselves on a careful

franchise owner selection program which is designed to choose the individuals that best

suite our system. If we believe you are not suited to Time For You, we will let you know.

➢ What support can I expect from the Support Office? The Support Office can provide various

types of support to you. This support can vary from individual to individual. We aim to

support you to help make your business a success.

➢ Does your franchise agreement provide an exclusive area? Yes.

➢ Do I need to register for GST? Yes, you will need to be registered for GST.

➢ Is the franchise agreement fair to both parties? All franchise agreements have rights,

benefits and privileges as well as obligations to both parties. You should discuss your

proposed agreement with a franchise experienced solicitor or advisor. Franchise

Agreements are designed to protect the franchise brand.

➢ Do I have to operate the business through a company or can I operate as a sole trader?. You

are able to trade as either and your accountant will advise you as to which suits you best.

➢ Can I sell my franchise and business? Yes, at any time to a buyer who must be approved by

the franchisor following the same processes as you go through.

➢ Are there any royalties to pay? Yes, see ongoing costs above.

➢ Are there opportunities for development and more responsibility? Yes, many of the

franchise owners with the system around the world have purchased larger territories or

employ staff to assist with sales, marketing and admin.

➢ Are there any advertising costs? Yes, there will be a monthly fee payable to the central

marketing fund as mentioned above as well as any other costs for advertising to advertise

your business in your local community.

➢ How will you be paid by your customers? Once a customer signs a contract with you, you

charge their first month immediately, then automatically charge their credit card one and

two months later. Then the contract is re-signed.

➢ Is the training covered within the franchise fee? The training fee is separated from the

Initial Franchise Fee as this has tax advantages for you.

➢ Can I have other business interests or paid employment? Yes.

➢ Are there training manuals? Can I see them? Yes there are excellent manuals available and

you will be able to examine them prior to your final decision to proceed.

➢ Are there documented systems and procedures? Yes, see above.

➢ Can I work part time? Yes, you can start part-time if you wish.

➢ I don't have much space, can I still work from home? Yes, operation of the business requires

very little space and can be operated from your home.

➢ Is there on-going training? Yes, there is an ongoing training support and mentoring

program.

➢ What do I need to spend over and above the costs of the franchise? Operation of your local

marketing program will be your major costs. We will discuss this with you in detail.
