Thedonor will not receive any preferential treatment, endorsement, or recommendation; and thedonor is not allowed the use of any Los Angeles Police Department patent.

Administrative Services Bureau has reviewed the donation and determined that it has beensubmitted in accordance with Section 5.467 et seq. of the Los Angeles Administrative Code,which provides for the receipt and acceptance of donations to the Police Department.

It is requested that Administrative Services Bureau approve and forward correspondence to theBoard of Police Commission to accept a donation for the amount of $2,775.00, from the LosAngeles Police Foundation (Foundation). On August 29, 2011, the Office of the Chief of Policereceived notification that the Foundation had approved the grant request for the above listedamount. The funds will be used to pay for the Los Angeles Police Department's (LAPD) entryfee for the 2012 Tournament of Roses Parade.

The Tournament of Roses Parade is seen, annually, by approximately one billion parade routespectators and television viewers, world-wide. Participation in this event will be an excellentway to showcase the Los Angeles Police Department as a preeminent law enforcement agency,while further enhancing the LAPD's positive public image, and attracting potential new hires.

No expressed or implied commitment or promises were made to the donor or representatives ofthe donor. The donor will not receive any preferential treatment, endorsement, orrecommendation; and the donor is not allowed the use of any LAPD patent.

Congratulations! Your group, LAID Mounted Police, has been accepted to participate in the 123"ITournament of Roses Parade themed, "Just Imagine...". Please note that the parade will be held onMonday, January 2" this year.

Enclosed you will find an 'Acceptance and Release/Waiver Agreement' form for completion by youand your group. Please make copies as needed for your group members; and instruct them to return thecompleted forms to you. One Acceptance cmd Release/WaiverAgreentent . form must be completedby e.acb:

1) PARADE PARTICIPA4Yr in the upcoming Rose Parade, specifically each rider each outwalker, end each passenecr or driver on a parade coach or carriage.

2) HORSE OWNER (if not participating in the parade) specifically, an owner whose horse isheing ridden or driven in the upcoming Rose Parade by someone other than the owner.

3) SUPPORT PERSON, such as a support vehicle driver, groomer, handler, or any other non-parade participant that will be in the equestrian staging and/or disbanding areas.

Due to security restrictions in the staging and disbanding areas on January 2nd, we must carefullymonitor the number of Parade Participants and Support Personnel in each group. Based on yourApplication, you have been Accepted for a maximum of 37 Parade Participants on Parade day.

Parking space is very limited in our staging and disbanding areas. Please carpoo/ and "horse-pool".(Lc. usc a few larger horse trailers rather than several smaller ones) so that your vehicles consume theleast possible amount of parking space. If you bring more vehicles to the staging area than expected,they must exit the staging area immediately after unloading.

INDIVIDUAL EQUESTRIANACCEPTANCE AND RELEASE/WAIVER AGREEMENT

Section I: Waiver Agreement (Applies to everyone in each Equestrian Unit)

The undersigned "Participant" (Parade Participants walking or riding down the parade route, and SupportPersonnel assisting an Equestrian Unit in the pre- or post-parade areas), for the benefit of the PASADENATOURNAMENT OF ROSES ASSOCIATION, a California non-profit corporation (the 'Association"), the CITYOF PASADENA, a municipal corporation (the "City"), Los Angeles Equestrian Center (LAEC), and City of LosAngeles Department of Recreation and Parks, in consideration of the granting by the Association to Participant of anon-exclusive license to participate in thc upcoming Tournament of Roses Parade, including Equestrest and othermimed activities before and after the Parade (the "Parade"), held annually in Pasadena and Los Angeles, California,to celebrate the New Year, hereby agmcs as follows:

Participant is fully aware and understands that: the Parade is sponsored annually by the Association; theCity has granted the Association a permit to hold the Parade; the Parade route is nearly six (6) miles long;nmu-ly one million spectators line the Parade role; and, the Paradc is generally comprised of floral floats,bands, ewes-L.-Ian units, and dignitaries in vehicles, and special activities and events before, during and afterthe actual Parade.

2. Participant is further aware and understands that: the Association cakes precautions for the safety ofpersons and property in connection with the Parade, but that many things happen in connection with theParade that are beyond thc reasonable control of the Association; by way of example and not limitation:horses and other animals in the Parade may act in an uncontrolled fashion Injuring riders and/or spectators;floats may lurch, break down, collapse, lose brakin g.: ability, catch fire, and otherwise operate other than asplanned, hurting operators, riders and/or spectators; band members may suffer injuries on the street orbecause of the length of the Parade; spectators may engage in unreasonable conduct; and, death, bodilyinjury and/or property damage may occur in connection with the Parade.

3. Participant further acknowledges that the Parade is not the type of event or activity thought suitable forintense public regulation; the Parade, while enjoyable for Participant and the public, is not a matter of greatimportance to the public or a matter of practical necessity; the Association does not hold itself out aswilling to allow any member of the public to participate in the Parade; the Association does not Possess anyparticular bargaining strength over Paricipant with regard to negotiating arrangements for Paradeparticipation; and, Participant is aware of the option of acquiring special Insurance to protect against therisks associated with the Parade.

4. Participant ftzther acknowledges that Participant has voluntarily and without compulsion or compensationby the Association decided to participate in the Parade; as a condition to Participant participating in theParade, the Association requires Participant to execute and deliver this Agreement; and, except as set forthherein, the Association has made no representation or warranty, express or implied, of any kind whatsoeverrelating to the subject matter of this document.

S. PARTICIPANT FEEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TOCOMMENCE LEGAL ACTION AGAINST THE ASSOCIATION, THE CITY, LAEC, CITY OF LOSANGELES DEPARTMENT OF RECREATION AND PARKS, THEIR OFFICERS, DIRECTORS,EMPLOYEES, MEMBERS, AGENTS, CONTRACTORS AND REPRESENTATIVES (THE"RELEASED PARTIES") FROM ANY AND ALL CLAIMS, DAMAGES, LIABILITIES, COSTS ANDEXPENSES, INCLUDING ATTORNEYS' FEES, RESULTING FROM OR IN ANY WAY RELATEDTO THE INJURY OR DEATH OF THE 'PARTICIPANT OR PARTICIPANT'S HORSE INCONNECTION WITH OR AS A RESULT OF THE PARADE, WHETHER OR NOT CAUSED BY THENEGLIGENCE OF THE RELEASED PARTIES.

6. PARTICIPANT VOLUNTARILY AND WITH FULL KNOWLEDGE OF THE RISKS, HEREBYASSUMES FULL AND COMPLETE RESPONSIBILITY FOR, AND RISK OF, HIS OR HER OWNDEATH, BODILY INJURY AND/OR PROPERTY DAMAGE RESULTING FROM, CONNECTEDWITH, OR IN ANY WAY RELATED TO PARTICIPANTS PARTICIPATION IN THE PARADE.

7. Participant further acknowledges that: Participant's participation in the Parade is the result of a non-exclusive license gained by the Association; Participant shall be deemed to be a licensee with respect toParticipant's relationship with the Association: nothing whatsoever ir.volvcd with Participant'sparticipation in the Parade shall constitute Participant as an agent, partner, joint venture, or any other suehlegal status that legally could bind the Association as a result of Participant's actions; and, Participant shallhave no authority whatsoever to bind the Association in any way.

8. This Apeement shall be deemed a contract made tinder the laws of the State of California and shall beconstrued and enforced in accordance with the Jaws of such state.

9. This Agreement shall be binding upon and inure to the benefit of the parties hereto, the Released Parties,thcir heirs, executors, successors and assigns.

JO In the event any prevision of this Agreement is held invalid, the remaining portions of the Agreement shallremain in full force and effect. Thc release and waiver provisions contained herein are intended by theparties to be as broad and inclusive as permitted by law and shall be interpreted accordingly.

Section 2: Acceptance of Equestrian Invitation for 2012 Rose Parade (Applies to ParadeParticiptints and Horse Owners Only)

Thc following is agreed to by each Parade Participant (a horse rider, out walker, coach/wagon passenger, Orcoach/wagon driver going down the Rose Parade Rout: ph_u each Horse Owner, if not the rider). Should you notagree to the following, the Tournam ent of Roses Association will have the right to withdraw this in vitation toparticipate.

I. A promotional insurance fee of 575.00 for =eh Parade Participant (as defined above) in the RoseParade must accompany this form. The insurance secured by the Tournament of Roses on eac!,Parade Participant is to protect the City of Pasadena, the Tournament of Roses and the paradespectators for injuries caused by the horse or Parade Participant. This does net cover injury to thehorse or Parade Participant arising out of participatioo in ;the Parade, by the activitiee ofTournament of Roses members, governmental agencies (including police), agents or the Tournamentof Roses and parade spectators or other persons on the parade route or in the pre/post parade stagingareas. You must insure yourself for injury to you, your horse and for damage to your property.

2. Both Parade Participant and Horse Owner must read, dare and sign this form and return it to thePasadena Tournament of Roses Association no later than August 31, 2011. If a Parade Participant isunder 18 years ofage on 1,2112. then his/her parent or legal guardian must also sien this form.

3. It is agreed that the color photovapli of the Parade Participant, horse, equipment, and costumesubmitted to the Tournament of Roses Association with the Equestrian application will be the horse.equipment and costume used by the Parade Participant in the parade. If it is not, the EquestrianCommittee will not allow the Parade Participant to enter the parade forma:ion. Any variation on thisrequirement must be approved in writing from the Equestrian Committee Chairman.

4. In ordcr to assure a place in thc 2012 Rose Parade, this Waiver! Acceptance form, fully executed, andthe promotional insurance fee must be received by the Tournament of Roses by August 31, 2011. Ifacceptance is pot received by then, this invitation is withdrawn and an alternate Parade Participantwill be selected.

5. The undersigned Parade Participant certifies that he or she is in good physical health, is not sufferingfrom any physical condition which would impair his or her ability te participate in the 2012 RoseParade and is physically able to 50 participate.
