6. TRAVAUX PRÉPARATOIRES
Travaux Préparatoires are the preparatory works from the drafting and negotiation of a
treaty, such as minutes, drafts and reports, and as such are often of interest to legal
researchers. They are also used as an interpretive aid in clarifying the intentions or
meanings of treaties. Most useful to researchers in this regard are guides to travaux
preparatoires. These resources usually track the agreement article by article with
references to the locations in the travaux preparatoires relating to the text being discussed.
In addition, there are also collections of travaux preparatoires – these are usually published
in chronological order, requiring the researcher to collate them to the text of the
agreement. As well, article by article commentaries and other expert analysis of treaties

and conventions will often cite travaux preparatoires. Travaux preparatoires may also be
found on treaty-body websites, or published in print and online by the signatories.
6.1 Finding travaux preparatoires
Search the catalogue and periodical indexes by combining the phrase “travaux
preparatoires” with keywords identifying the instrument, e.g. “Covenant on Civil and
Political Rights”.
Search the website of any bodies established by the treaty, as well as related UN sites. Both
will often contain travaux preparatoires.
Search the catalogue and periodical indexes for commentaries or analysis on the
instrument, as these works will often cite travaux preparatoires as part of their analysis.
Search the UN Diplomatic Conferences site, which contains negotiation records for various
treaties and conferences in a searchable interface.
If you are unsuccessful in finding any travaux preparatoires using the name of the treaty,
try to find out if there was a conference for negotiation of the instrument, and search using
the conference name instead.

UN human rights bodies are categorized in two classes: charter-based bodies and treaty-
based bodies. The current Charter-based bodies are the Human Rights Council and its
subsidiaries. For information on the differences between Charter-based bodies and treaty-

Articles appearing in UN periodicals are individually indexed. Indexing of the bilateral and

Trusteeship Council, Secretariat and International Court of Justice - are indexed. Full-text
resolutions from the General Assembly, Security Council and the Economic and Social
Council are appended to their respective bibliographic citations.
ODS( Official Documents System of the United Nations)
Full-text access to official documents back to 1993 and resolutions back to 1946. Offers
‘simple’ , ‘advanced’ and ‘global’ search options. Best used when you have a U.N. document
number (e.g. CERD/C/225/Add.1) and want the full-text of the document.
UNBISNET (1979-)
Catalogue of UN publications and documentation indexed by the United Nations Dag
Hammarskjöld Library and the Library of the UN Office at Geneva. Coverage is primarily
from 1979 forward, however, indexing for resolutions of the General Assembly, Economic
and Social Council, Security Council and Trusteeship Council are included back to 1946.
UNBISNET also includes an index to speeches (from the mid 1980s on) and voting
information (from the beginning for the Security Council and from the mid 1980s for the

UN Treaty Collection
Provides access to the full text of treaties contained in the United Nations Treaty
Series (UNTS) as well as The Status of Multilateral Treaties Deposited with the
Secretary-General and Recently Deposited Multilateral Treaties.
OHCHR treaty-body
University of Minnesota Human Rights Library
Provides full-text search capabilities for human rights related treaties and related
documents. (choose the “search these documents by KEY WORD” link) Offers
simultaneous searching across multiple human rights web sites, including the
United Nations, European Court of Human Rights, Amnesty International. Also lists
treaties by subject matter and according to ratification by country.
Flare Index to Treaties

Searchable database with information on over 1,500 significant multilateral (three
or more parties) treaties from 1856 to the present, with details of where the full text
of each treaty may be obtained in paper and, if available, electronic form on the
Internet. Treaties included in FLARE have been selected for their significance.
International Legal Materials
Bi-monthly publication of American Society of International Law that includes the
full text of selected new, treaties in addition to other important legal materials,
including selected international case law. Available through UofT catalogue via Hein
Online. Also available through LexisNexis Quicklaw and Westlaw Canada (database:
ILM).

League of Nations Treaty Series
Information about the 205 volumes of the League of Nations Treaty Series (LoNTS)
has been made available in the United Nations Treaty Collection website. During
migration of the database, the full text of the League of Nations material was lost.
Efforts are underway to recover this data. Basic information about the treaties is
available.
The United Nations Human Rights Treaties
This site provides access to documents and information from the UN human rights
treaty system. Materials include the text of treaties, documents from the UN treaty
bodies, information on reform of the system, and other information. Documents
issued by the treaty bodies are arranged by state, by category, and by theme or
subject matter. This last category (by theme or subject) is something not available
on other web sites.

14.1 UN Instruments
The page for each treaty-based UN Human Rights Body usually contains a link to

Treaty Body Document Search
This database was established to monitor the implementation of the principal UN
human rights treaties. The database provides information on submission of reports
by States, documents issued by the treaty bodies and reporting and ratification
information. The documents are available as well as status and submission
information. Documents can be accessed in a variety of ways (by treaty, country,
symbol, etc.).

15. HUMAN RIGHTS JURISPRUDENCE
Finding human rights cases can be a difficult task; not all cases are reported, and case
reporters in this area are often published irregularly.

Oxford Reports of International Human Rights Law
Via the UofT catalogue, provides case law from the African Commission, the
European court of Human Rights, the UN Committee against Torture, the UN
Committee on the Elimination of Discrimination against Women, the UN
Committee on the Elimination of Racial Discrimination, and the UN Human Rights

This web site provides access to databases containing summaries of the case law
of the Human Rights Committee, the Committee Against Torture, and the
Committee on the Elimination of Racial Discrimination. There is also a database
containing information on judgments of the European Court of Human Rights and
the concluding comments of the United Nations treaty bodies have been made
accessible. Coverage varies. Users must register to use the databases, but there is
no charge for access.
International Courts & Tribunals Library at WorldLII
A searchable collection of international courts and tribunals, including those that
focus on human rights. Coverage for each court and tribunal varies.
The Project on International Courts and Tribunals
Provides the full-text of selected cases and decisions from various international
courts and tribunals, including the European Court of Human Rights, the Inter-
American Court of Human Rights, and the International Criminal Tribunals for
Rwanda and the former Yugoslavia. Note: This site does not seem to have been

Refworld (UNHCR)
Search for case law from various human rights courts and dispute settlement
bodies. Although concerned mainly with refugee/asylum seeking case law it allows
some flexibility when searching for human rights cases, including UN Treaty body
jurisprudence.

Includes Butterworths Human Rights Cases, International Journal of Refugee Law
and the Northwestern University Journal of International Human Rights.

African Human Rights Law Reports
Selected national decisions and decisions from the African Commission on Human
and Peoples' Rights, as well as decisions of United Nations treaty bodies that deal

A UN document symbol is a unique identifier for a United Nations document that is usually
located in the upper right-hand corner of a document e.g. S/2009/391

You can often locate the corresponding document using the Official Document System of
the United Nations (ODS), which contains the almost all documents issued since 1993 and
select documents from earlier years.
For older documents try UNBISnet, which provides bibliographic records for documents
from roughly 1980 onwards. Select keyword Search and choose “UN Doc. Symbol / Sales
Nos. “ from the drop down menu and input the UN document symbol without punctuation
i.e. for E/CONF.85/L.33 you would input ECONF85L33 as the search term. UNBISnet will
provide a link to the full-text where available.
