What does social legitimacy entail within the multi-level ‘embedded liberalism’ construction of the internal market? China’s Implementation of the Rulings of the World Trade OrganizationWeihuan ZhouAmid the ongoing crisis surrounding the WTO, China’s role and behaviour in the multilateral trading system has attracted overwhelming attention. Overall, this book argues that the issues relating to the quality of China’s compliance and post-compliance practices have to do with the loopholes within the DSM itself which may be utilised by all WTO Members. However, despite the loopholes, China’s record of compliance suggests that the DSM has been largely effective in inducing compliance and influencing domestic policy-making. It is therefore in the interest of all WTO Members and other stakeholders to protect the DSM as the “crown jewel” of the multilateral trading system.

The EU, World Trade Law and the Right to FoodRethinking Free Trade Agreements with Developing CountriesGiovanni GruniIn recent years the European Union has developed a comprehensive strategy to conclude free trade agreements which includes not only prominent trade partners such as Canada, the United States and Japan but also numerous developing countries.

This book looks at the existing WTO law and at the new EU free trade agreements with the Caribbean and sub-Saharan Africa through the lens of the human right to adequate food. It shows how the clauses on the import and export of food included in recent free trade agreements limit the capacity of these countries to implement food security policies and to respect their human rights obligations. This outcome appears to be at odds with international human rights law and dismissive of existing human rights references in EU-founding treaties as well as in treaties between the EU and developing states.

Yet, the book argues against the conception in human rights literature that there is an inflexible agenda encoded in world trade law which is fundamentally conflictual with non-economic interests. The book puts forward the idea that the European Union is perfectly placed to develop a narrative of globalisation considering other areas of public international law when negotiating trade agreements and argues that the EU does have the competences and influence to uphold a role of international leadership in designing a sustainable global trading system. Will the EU be ambitious enough?

A timely contribution to the growing academic literature on the relation between world trade law and international human rights law, this book imagines a central role for the EU in reconciling these two areas of international law.

While also addressing the socio-economic, historical and political factors influencing the development of RTAs in East Asia, the book focuses on the legal institutions governing economic integration in the Association of Southeast Asian Nations (ASEAN), as well as under the ASEAN–China Comprehensive Economic Co-Operation Agreement (ACFTA), the Japan–Singapore New Age Economic Partnership Agreement (JSEPA), and the Mainland China–Hong Kong Closer Economic Partnership Arrangement (CEPA). The TPP is evolving to become the Comprehensive and Progressive Agreement for TPP (CPTPP) as the remaining 11 members try to resurrect the TPP by suspending some of its provisions, over half of which are IP-related. While the TPP excludes the two

Asian giants –India and the People’s Republic of China (PRC)– the ongoing Regional Comprehensive Economic Partnership (RCEP) includes both of them.

The first part of this edited collection sets out to re-examine some basic principles of trade negotiation, such as choosing the right representatives to negotiate, enhancing transparency as a cure to the public’s distrust against trade talks; moreover, it analyses how CPTPP might impact on RCEP’s IP chapter and examines the possible norm setters of Asian IP, and focuses on PRC’s trade and IP strategy against the backdrop of the power games between PRC, India and the US.

The second part of the book reflects on issues related to investor-state dispute settlement and its relationship with IP, such as how to re-calibrate the balance in international investment arbitration, the judicialisation of ISD in Singapore, and whether compulsory license of IP constitutes expropriation in India, PRC and select ASEAN countries.

The third part of the book questions and strives to improve some of the proposed IP provisions, and to redefine some aspects of international IP norms, such as pre-grant patent opposition & experimental use exception, patent term extension, patent linkage & data exclusivity for the pharmaceutical sector, plant variety protection, pre-established damages for copyright infringement and the restructuring of copyright limitations in the public interest.
