    Notice Inviting Tender- Internal Renovation & External Civil & Structural Repairs, Plumbing & Painting Work to 8 flats at NABARD Officers Qtr. at A Sector Shahpura, Bhopal, Madhya Pradesh- 462 039

    ----------------------------------------------------------------------------------------------

    1. National Bank for Agriculture and Rural Development (NABARD) invites you to tender for the aforesaid work “Internal Renovation & External Civil & Structural Repairs, Plumbing & Painting Work to 8 flats at NABARD Officers Qtr. at A Sector Shahpura, Bhopal, Madhya Pradesh- 462 039.” NABARD intends to carry out the structural repair works and internal renovation work in 8 flats at NABARD Staff Quarters at A sector Shahpura, Bhopal M.P. You are requested to submit your offer in sealed envelope for the aforesaid work as per detailed specifications and other requirements as mentioned more specifically elsewhere in this tender document. The tender document will be available to the contractors for download from on 25 March 2019.

    2. Pre- qualification criteria :

    Civil Contractors/ Firms having minimum experience and qualification, as given below, will be eligible to participate in the tender process.

    a) The annual turnover of the contractor during each of the last 3 years (ending 31.03.2018) should be at least ₹ 31 Lakhs

    b) The contractor should have experience of similar works (Civil contractors in Structural Rehabilitation works) during the last 7 years (ending 31.03.2018)

    The contractor should also have done at least one of the following work assignments:

    ( i ) One similar works whose individual value is not less than ₹ 82.00 lakhs or

    ( ii ) Two similar works whose individual value is not less than ₹ 62.00 lakhs or (iii ) Three similar work whose value is not less than ₹ 41.00 lakh.

    3. Pre Bid Meeting

    - The Pre-Bid meeting will be held on 10th April 2019 at 04.00 PM at Regional Office building of NABARD at E-5, Arera Colony, Bhopal, M.P. - 462016. Any doubts pertaining to the work/tender documents will be clarified by the Consultant/PMC/NABARD in the meeting. All the clarifications of the pre-bid meeting, if any, will be part of tender.

    4 Pre- Contract Integrity Pact

    The contractor should submit signed Pre-Contract Integrity Pact as in Annexure “A”. The Integrity pact should be submitted in a separate envelope duly sub scribed “Pre-Contract Integrity Pact”. The same has to be submitted along with Technical bid & Price bid on or before 24 April 2019, If the “Pre-contract Integrity Pact” is not signed & submitted along with then tender will be rejected.

    5. You are requested to submit your bids as Two Part Tender [Techno-Commercial Bid (Part-1), Price Bid (Part-2)] and Pre Contract Integrity Pact separately in sealed envelopes, duly furnishing all the required information as per detailed specifications and Schedule of Quantities. Tender Document can be obtained from NABARD Regional Office Building , E-5 Arera Colony , Bittan Market, Bhopal , -462016

    a) The tender document is also available on NABARD website www.nabard.org and can be downloaded for use and reference of interested and eligible bidders. Those who download the tender documents from website shall enclose the cost of tender document ₹ 1000/-(Rupees One Thousand only)(Non-Refundable) by way of Demand Draft drawn on any scheduled Bank in favour of “NABARD” payable at Bhopal Madhya Pradesh and enclose the same with Part-1 of the Tender document.

    6. The Tender Documents Part I contain Notice Inviting Tender, Form of Tender, Instructions to the contractors for furnishing individual details in prescribed proforma, General Instructions to the Contractors, Terms and Conditions, Scope of work, Test and Inspection, Preamble to bill of quantities, Special conditions of the contract-1, Detailed classification of structural rehabilitation works, Technical Specifications and list of makes of materials.     7. Your Pre Contract Integrity Pact sealed envelope should be filled and signed as in Annexure “A”

    8. Submission of Sealed offers

    Sealed offers should be submitted separately as follows:

    a. In two Envelopes indicating clearly ‘Part I’ – Technical Bid and ‘Part II' – Price Bid.

    b. The envelopes should be addressed to The Chief General Manager, NABARD Madhya Pradesh Regional Office, E-5 , Arera Colony , Bhopal -462013, and super scribed as “Internal Renovation & External Civil & Structural Repairs, Plumbing & Painting Work to 8 flats at NABARD Officers Qtr. at A Sector Shahpura, Bhopal, Madhya Pradesh- 462 039 "

    c. You can enclose Envelopes 1 & 2 and pre-contract Integrity pact in a 3rd big envelope.

    d. The tenders should be submitted not later than 15:00 hrs. on 24 April 2019.

    9. Content of Envelope No. I and Envelope No. II

    Envelope No.1 shall contain;

    a. Volume I of tender, every page of which should be filled up wherever required and duly signed and stamped for acceptance to the tender conditions

    b. Relevant documents supporting the Pre-Qualification Criteria and Technical Document Sheets.

    c. Bar Chart indicating the program for execution of the work.

    d. Earnest Money Deposit (EMD) of ₹ 50,000/- (Rupees Fifty thousand only) by way of a Demand Draft OR Bank Guarantee from nationalised Bank / Scheduled Bank as per the draft enclosed along with this tender. Tender without EMD shall be rejected.

    e. Cost of the tender document (non-refundable): ₹1000/- ( Rupees One Thousand Only ) by way of demand draft from Nationalized Bank / Scheduled Bank payable at Bhopal in favour of ‘NABARD’. Tender without tender fees shall be rejected.

    f. Signed and stamped copy of Pre-bid clarifications, if any.

    g. Signed, sealed and stamped pre-bid pre-contract integrity pact. The pre bid pre contract integrity pact will have to be stamped as per the relevant Stamp Act of the State of Madhya Pradesh.

    Envelope No. 2 shall contain:

    h. The price / Commercial Bid (Volume II) complete in all respects duly sealed and addressed to Shri S K Bansal ,Chief General Manager, NABARD Madhya Pradesh Regional Office, E-5 ,Arera Colony , Bhopal - 462016.

    i. The price bids should not contain any conditions whatsoever and any conditional bids shall be rejected.

    10. Opening of Envelope I and Envelope II

    Envelope No. I will be opened on the last date of submission of tender, at 16:00 hrs in the presence of bidders’ representatives, should they choose to be present

    Envelope No. II

    After opening of the Envelope No.1 and assessing the conditions stipulated by bidders, if any, NABARD may, if it so decides, inform all the tenderer about any modifications in the tender conditions. Tenderer who agree to the changed conditions along with original in TOTO will be allowed to make modifications if they so wish in their tender prices by means of a letter to be submitted in sealed cover, which, along with their price bid will form the final price bid. A tender will be rejected if any tenderer proposes any deviation from the above.

    The Envelope No. 2 shall be opened only in respect of those tenderer who, after discussion, bring their tenders i n line with the requirements of tender document and are acceptable to N ABARD. The decision of N A B A R D in this regard shall be binding on the tenderer and not open to question or appeals. The date and time of opening of Envelope No. 2 shall be intimated o nly t o q u a l i f i e d b i d d e rs after opening of Envelope No.1.

    11. Before filling up the tenders, the bidders may note the following

    a) All documents that comprise the offer should be signed and sealed by the firm, as a token of acceptance to the terms and conditions specified in the tender.

    b) Tenderer should inspect the existing site and other conditions up to their satisfaction before tendering/quoting.

    c) Applications containing false and/or incomplete information are liable for rejection.

    d) The work shall have to be done in strict coordination with the Bank as per directions issued and within the stipulated timeframe in an expeditious manner.

    e) Intending bidders have to arrange for execution of pre-bid pre-contract Integrity Pact before quoting the rates failing which the tender will be rejected. The pre bid pre contract integrity pact will have to be stamped as per the relevant Stamp Act of the State of Madhya Pradesh. All prospective bidders / vendors have to enter into an Integrity Pact with the Bank otherwise they will not be eligible to participate in the tendering process. The following is the Independent External Monitors (IEMs) appointed by the Central Vigilance Commission.

    12. Completion period of the work mentioned in this tender shall be 4 Months from the date of commencement

    13. Liquidated Damages for delay shall be 0.25% (Zero Point Two Five percentage) of the accepted cost of tender per week beyond the date of completion of the works, subject to a maximum of 5% (Five per cent) of the accepted tender amount.

    14. Defect Liability Period shall be 12 months from the date of Virtual Completion Certificate after complete External Civil & Structural Repairs, Plumbing & Painting Work at NABARD Office Building to be submitted by the contractor and accepted by PMC & NABARD, during which the contractor shall carry out the defects, if any, pointed out in the works carried out.

    15. Guarantee for Terrace and Toilet cum Bathroom water proofing work shall be 05 years Performance Guarantee from the date of Virtual Completion of work.

    16. Validity of the offer shall be 90 days from the date of opening of the price bid.(Part -2)

    17. NABARD reserves the right to accept or reject any or all tenders, without assigning any reasons whatsoever. The work may be divided and awarded separately among the tenderers either in part or whole, at the sole discretion of NABARD.

    18. The successful bidder shall execute an agreement with NABARD in accordance with the standard format enclosed within 14 days from the date of acceptance of the offer failing which the bidder’s EMD may stand forfeited.

    II - PRE CONTRACT INTEGRITY PACT

    1. Integrity Pact (IP) is a vigilance tool first promoted by the Transparency International, for ensuring transparency, equity and competitiveness in public Procurement.

    2. Only those vendors/bidders who have entered into the Integrity Pact with the Bank will be competent to participate in the bidding. In other words, entering into this Pact would be preliminary qualification. For a particular contract, IP would be effective from the stage of invitation of bids till the complete execution of the contract.

    3. The IP envisages a panel of Independent External Monitors (IEMS)- Shri Debabrata Sarkar, Mayfair Boulevard Charayan Apartment, Flat No. 701, Main Avenue Road, Santacruz (west), Mumbai – 400 054. The IEM wall review independently and objectively, whether and to what extent parties have complied with their obligations under the Pact.

    III - FORM OF TENDER

    Dear Sir/Madam

    Tender for “Internal Renovation & External Civil & Structural Repairs, Painting & Plumbing to 8 flats at Officers Staff Qtr. at A Sector Shahpura, Bhopal, Madhya Pradesh.”

    1. I / We have examined the Scope of Works, Specifications and Schedule of Quantities and Terms and Conditions relating to the tender for the said works.

    2. I / We have visited the site, examined the site of works specified in the

    Tender Document and acquired the requisite information relating thereto as affecting the Tender.

    3. I / We hereby offer to execute and complete the works in strict accordance

    with the Tender Document at the item rates quoted by me / us in the attached Schedule of Quantities in all respects as per the specifications and Scope of Works described in the Tender Document and the Annexures containing Terms and Conditions.

    4. I / We enclose herewith interest-free Earnest Money Deposit (EMD)

    for ₹ 50,000/- (Rupees Fifty Thousand Only) by Demand Draft payable at Bhopal Madhya Pradesh in favour of 'National Bank for Agriculture and Rural Development' (NABARD) OR in the form of Bank Guarantee as per format enclosed and the sum shall be forfeited in the event of our withdrawal of Tender before expiry of the validity period of offer and / or in the event of our failure to execute the Contract when called upon to do so by accepting our Quotation.

    5. In the event of this tender being accepted, I/We agree to enter into and

    execute the prescribed Agreement with NABARD as per the format given at Annexure C.

    6. I/ We agree to pay all Government (Central and State) Taxes such as Sales

    Tax, Works Contract Tax, VAT, Excise Duty, Octroy, service tax etc. and other taxes prevailing from time to time and the rates quoted by me/us are inclusive of the same.

    7. The rates quoted by me / us are firm and shall not be subjected

    to variations on account of fluctuation in the market rates, taxes or any other reasons whatsoever.

    8. Should this tender be accepted, I / we hereby agree to abide by and fulfil all the Terms and Conditions and Provisions of the said Contract Document annexed hereto.

    9. We understand that NABARD reserve the right to accept or reject any or all the tender either in full or in part without assigning any reason therefor.

    10. We are enclosing a list of our clients and bankers in India with complete

    details as per the proforma given in the Annexure-I.

    11. The Tender is submitted in two parts in separate sealed envelopes. Part I contains all Techno-commercial terms and conditions along with technical specifications / particulars and Part II contains only the price bid in NABARD's proforma.

    IV - INSTRUCTIONS TO THE CONTRACTORS FOR FURNISHING INDIVIDUAL DETAILS IN PRESCRIBED PROFORMA

    1. The contractors are required to submit their full bio-data giving details about their organization, experience, technical personnel in their organization, space capacity, competence and adequate evidence of their financial standing, etc. in the enclosed form (Proforma-1, 2 & 3) which will be kept confidential.

    2. If the space in the Proforma is insufficient for furnishing full details, such information may be supplemented on separate sheets of paper stating therein the part of the Proforma and serial number. Separate sheets shall be used for each part.

    3. Any letter or document accompanying the Proforma shall be submitted in duplicate.

    4. Tenders containing false and/or inadequate information are liable for

    rejection.

    5. While filling up the Proforma with regard to the list of important projects completed or on hand, the applicants shall only include those works which individually cost not less than ₹ 41.00 lakhs.

    6. Clarifications if any required may be obtained from the Department of Premises, Security and Procurement (DPSP), National Bank for Agriculture and Rural Development, E-5, Arera Colony, Bhopal, Madhya Pradesh.

    7. While deciding upon the selection of contractors for participating in the Price bid, emphasis will be given on the ability and competence of applicants to do good quality works within the specified time schedule and in close co-ordination with other agencies, besides the rate structure of the items. Also, emphasis will be given to the applicants who have executed majority of the similar works (Civil & Structural Repairs, Plumbing & Painting Work)

    8. Decision of the Bank in regard to selection of contractors for selecting them for price bidding will be final. The Bank is not bound to assign any reason therefore.

    9. Each page of the tender document shall be signed. The application shall be signed by person/persons on behalf of the organization having necessary authorization/Power of Attorney to do so.

    V - GENERAL INSTRUCTIONS TO THE CONTRACTORS

    Please note that pre-bid integrity pact is invariably to be submitted along with the part-1 of the tender failing which the tender shall be out-rightly rejected

    1. The site of the proposed works is to 8 flats at NABARD Officers Qtr.

    at A Sector Shahpura , Bhopal, Madhya Pradesh- 462 039. Contractors are advised to visit the site and thoroughly understand the nature and scope of the works and be familiar with the site conditions before quoting.

    2. General Civil/ Specialized Contractors having minimum experience and

    qualification as given below shall be eligible for participating in the tender:

    - The contractor should have experience of similar works (civil construction, Renovation work of old building , contract of multi-storeyed building) during the last 7 years (ending March, 2018)

    - The annual turnover of the contractor during each of the last 3

    years (ending March, 2018) should be at least ₹ 31.00 Lakhs.

    - The contractor should have done at least

    i. One similar works whose individual value is not less than ₹ 82.00 lakhs or ii. Two similar works whose individual value is not less than ₹ 62.00 lakhs or iii. Three similar work whose value is not less than ₹ 41.00 lakhs

    3. Quantities indicated in the BOQ are only tentative and shall be executed only

    at the sole discretion of NABARD.

    4. Quoted rates should be workable and reasonable and should include incidental and all overheads and profits. The contractor should furnish Rate Analysis for scrutiny of the rates by NABARD, if required.

    5. Rates should include all Taxes, Duties, Octroi, Levies, Wages as per

    Act, Service Tax etc. and should be firm for the entire Contract period. No escalation of rates will be allowed for the entire contract period on any account.

    6. Materials used should conform to relevant BIS Codes. BIS and CPWD

    Specifications and Method of Measurements shall be followed as applicable. However, in the absence of the same and / or in case of any discrepancy, the decision of NABARD shall be final.

    7. Income Tax (TDS) and other applicable taxes as per statutory provisions will

    be deducted from total payment due to the Contractors.

    8. The Contractor should arrange to obtain necessary insurance cover (CAR policy (for 1.25 times of the value of the work) including Third party Liability and Workmen Compensation policy) at his cost for his employees as well as for any third party for any losses due to him during the execution of the work. The contractor shall be responsible for the safety of persons employed by him.

    9. All the Standard Conditions of the Contract shall be binding on the parties as

    per Indian Contract Act and prevailing Rules.

    10. The Contractor shall comply with all the applicable Acts, Rules, Regulations and Law (s) for entering into Construction / Maintenance Contract and NABARD will not in any way be liable or responsible for any default / irregularities / penalties on the Contractor's part.

    11. The Contractor shall comply with the provisions of Contract, Labour

    (Regulation & Abolition) Act, 1970, Minimum Wages Act, EPF & NP ACT – 1952 and all other Labour Laws and other Statutory Regulations (both Central and State) that may be enforced from time to time by the appropriate authorities. NABARD shall not be held responsible for any penalty or failure of any Labour Regulations. NABARD shall have the power to inspect the Wage Register, PF Register and for physical verification of salary paid to and PF deduction of the staff with reference to any records of the Contractor and to insist the Contractor to comply with Laws.

    12. The Contractor should be responsible to fulfil all the obligations in

    connection with the workers employed by the Contractor for the purpose of the Contract and all the Statutory and other liabilities, if any, including minimum wages, leave salary, uniform, ex-gratia, gratuity, ESI, Provident Fund, Workmen Compensation, if any, etc. in connection therewith shall be on the Contractor's account and payable by the Contractor.

    13. The Contractor should obtain necessary permission that may be required

    for the purpose of this Contract from such authorities as may be prescribed by Law from time to time.

    14. The Contractor or his authorized representative should visit the site

    frequently as required by Consultant/PMC/NABARD and meet them with prior appointment for any clarifications and to receive instructions, take measurements, etc. at the site.

    15. The Contractor shall be fully responsible and shall compensate NABARD

    with suitable Insurance cover in the event of any damage to men or material, injury / damage or death as the case may be, caused directly or indirectly due to the negligence of the Contractor or his agents and / or his employees or workmen. The decision of NABARD in this regard shall be final and binding.

    16. The Contractor shall indemnify the Employer against any losses as per

    format given at Annexure D.

    17. Any act of indiscipline / misconduct / theft / pilferage on the part of any employee engaged by the Contractor resulting in any loss to NABARD in kind or cash will be viewed seriously and NABARD will have the right to claim damages or levy fine and / or terminate the Contract forthwith, if necessary.

    18. In case of any default or failure on Contractor's part to comply with all/any

    one of the Terms / Conditions, NABARD reserves to itself the right to take necessary steps to remedy the situation including, inter-alia, the deduction of appropriate amount/s from dues otherwise payable to Contractor and / or by taking recourse to appropriate recovery proceedings.

    19. If any dispute arises on any matter concerning this Contract, the decision

    of NABARD shall be final and binding.

    20. The Contractor should not at any time do, cause or permit any nuisance on the site / do anything which shall cause unnecessary disturbances or inconvenience to the occupants/visitors at site or near the site of work.

    21. The work should be carried out with least inconvenience to the occupants

    and the car parking. The workmen employed by the Contractor should abide by the Rules and Regulations maintained by PMC & NABARD in the premises, especially in respect of working hours, entry of the workers to the premises, interpersonal relation with the occupants etc.

    22. The Contractor should obtain approvals, if any, necessary for the work

    from the statutory bodies on behalf of NABARD. The Contractor shall assist PMC fully in respect of any liaison with TNEB / Municipal or any other authority for necessary approval/permission with regard to the construction / maintenance works. The fees and other statutory charges, if any, will be reimbursed to the Contractor based on the original receipts produced to NABARD.

    23. The Contract can be terminated by NABARD on 15 days' notice if services

    are found to be unsatisfactory and if there is no improvement even after issue of three notices to the contractor.

    24. On site storage space will be provided to the Contractor subject to

    availability. However, the Contractor may erect temporary sheds for storage purposes at his cost with the permission of NABARD. NABARD will not be responsible for Contractor's materials. The Contractor may be required to vacate the storage space and sheds as per exigency without any extra cost to NABARD. If any statutory charges are required to be paid for erection of sheds, the same should be borne by the Contractor.

    25. The Contractor shall provide everything necessary for the proper execution

    of the works. NABARD will not supply any T & P materials or any other equipment, materials, labour, etc. and no payment in this respect will be made by NABARD. The Contractor shall supply, fix and maintain all the GI Double scaffoldings, T& P etc. at his cost during the execution of any work and remove them as soon as the work is completed.

    26. The Contractor shall not directly or indirectly transfer, assign or sublet the

    Contract or any part of it, without written permission of NABARD.

    27. Any defect which may appear within the Defect Liability Period of 12 months after the completion of entire work in B-1 Block, should be rectified by the Contractor at his cost and only thereafter the Security Deposit will be refunded to the Contractor.

    28. The bidder shall enclose a Demand Draft/Bank Guarantee (from a

    Scheduled/ Nationalized bank) for ₹50,000/- (Rupees Fifty Thousand only) drawn in favour of National Bank for Agriculture and Rural Development payable at Bhopal Madhya Pradesh towards Earnest Money Deposit (EMD). In case of successful bidder, the EMD will be retained with NABARD, the same will be adjusted in the Retention Money Deposit. In case of unsuccessful bidders, the EMD will be refunded only on award of contract to the successful bidder. The EMD / SD will not bear any interest. If the bidder withdraws his tender before expiry of the validity period of the tender or if the Contractor fails to execute / complete the works satisfactorily, NABARD reserves the right to forfeit the EMD / SD. Any tender not accompanied by the EMD will be rejected.

    29. RETENTION MONEY DEPOSIT (RMD)/ SECURITY DEPOSIT (SD): Five percent (5%) of the gross value of the work done and claimed in the Bills shall be deducted towards Retention Money Deposit. This amount shall not bear any interest. The Security Deposit/RMD & EMD will not bear any interest and will be refunded as provided for under Clause 34 (iii) below after Defects Liability Period of 12 months from the date of Virtual Completion of works, provided the Contractor has satisfactorily carried out all the rectification works and attended to all defects to the satisfaction of NABARD.

    30. DEFECTS LIABILITY PERIOD: Twelve (12) months from the date of

    Virtual Completion (VCC) and actual possession of works, certified by NABARD. Guarantee for Terrace and toilet cum bathroom Water proofing work shall be for 05 years Performance Guarantee from the date of Virtual Completion of work.

    31. CERTIFICATE OF VIRTUAL COMPLETION OF WORKS: The

    Contractor shall report in writing to the Employer in the form of a Certificate as per the format given at Annexure B, as and when the works are completed in all respects. The Employer shall, after due verification of the works, issue to the Contractor a certificate to be called "Virtual Completion Certificate"(VCC). The defects liability period shall commence only from the date of actual possession.

    32. VALIDITY OF OFFER: 90 Days from the date of opening of the price

    bid.

    33. LIQUIDATED DAMAGES: 0.25% of the work value of the accepted tender per week or part of the week subject to maximum of 5% of the value of work.

    34. PAYMENT OF CONTRACTOR'S BILL:

    i. The Contractor shall be entitled under the Interim Certificates, payment

    against the checked bills for the work done not prior to 30 days from the date of issue of the work order subject to the actual work being executed in accordance with the contract, and reasonable scrutiny by NABARD. The Contractor shall submit interim bills only after working out the appropriate measurements jointly recorded with PMC/NABARD at site in the measurement book (MB). This is not only to regulate the correctness of the quantity but also to facilitate expeditious clearing of the bills. The Minimum value of Interim Bill shall not be less than ₹ 25 Lakhs.

    ii. Interim Bills submitted by the Contractor will be paid by NABARD after

    all the statutory deductions viz. RMD @ 5%, TDS , GST-TDS and other statutory deductions etc., as applicable.

    iii. Retention Money Deposit at the rate of 5% (Five percent) of the

    value of the work executed shall be deducted from running interim bills shall constitute the Security Deposit. The Security Deposit shall be released at the end of defects liability period of 12 months from the date of Virtual Completion, provided the defects are made good according to the true intent and meaning thereof after due completion of work.

    35. COMPLETION PERIOD: The work should be completed within 4

    Months from the date of commencement.

    36. DELAY AND EXTENSION OF TIME: If, in the opinion of the

    Employer the works be delayed (a) by force majeure or (b) by reason of any exceptionally inclement weather or (c) by reason of proceedings taken or threatened by the dispute with adjoining or neighbouring owners or public authorities arising otherwise than through the Contractor's own default or (d) by the works or delays of other Contractors or tradesmen engaged or nominated by the Employer and not referred to in the Schedule of Quantities and/or Specifications or (e) by reason of Employer's instructions, or (f) by reason of civil commotion, local commotion of workmen or strike or lockout affecting any of the building trades or (g) in consequence of the Contractor not having in due time necessary instructions from the Employer for which he shall have specifically applied in writing, ahead of time, giving the Employer reasonable time to prepare such instructions, the Employer shall make a fair and reasonable extension of time for completion of the Contracted works. In case of such strike or lockout, the Contractor shall, as soon as may be, given written notice thereof to the Employer, but the Contractor shall nevertheless constantly use his endeavours to prevent delay and shall do all that may reasonably be required to the satisfaction of the Employer to proceed with the work. The Contractor shall take all practicable steps to avoid or reduce any delay in the execution and completion of the works arising out of

    i. Force Majeure ii. Exceptionally inclement weather iii. Loss or damage by fire and earthquake iv. Civil commotion, lockout, strike etc. v. Employer's Instructions, as the case may be vi. Delay on the part of the nominated Sub-Contractor or nominated supplier vii. Delay on the part of the other Contractor employed by the Employer

    37. Additional Terms and Conditions as per enclosure.

    VI - TERMS AND CONDITIONS

    1. The Tender is strictly on Item Rate basis.

    2. All the pages of the Tender Document shall be signed by the bidder.

    3. The Envelope containing Tenders should be properly sealed, addressed, duly super scribed with name of work. The tenders should be submitted in two parts as Techno-Commercial Bid (Part-1) and Price Bid (Part-2) and Integrity pact separately in three sealed envelopes. These three envelopes should be duly superscripted Tender for “Internal renovation & External Civil & Structural Repair, Painting & Plumbing to 8 flats at NABARD Officers Qtr.. at A Sector Shahpura, Bhopal, Madhya Pradesh- 462039” (Part-1: Techno-Commercial Bid)” and “Internal renovation & External Civil & Structural Repair, Painting & Plumbing to 8 flats at NABARD Officers Qtr.. at A Sector Shahpura, Bhopal, Madhya Pradesh- 462039” (Part-2: Price Bid)& Pre Contract Integrity Pact” respectively and should be submitted in the Tender box kept at Third floor at DPSP of National Bank for Agriculture and Rural Development, NABARD Office Building,E-5, Arera Colony, Madhya Pradesh, Bhopal The last date of receipt of tender is on or before 15:00 hours on 24.04.2019.

    4. The Part-1 (Techno-Commercial bid) of the tender who has submitted the

    signed Pre Contract Integrity only will be opened at 16.00 hrs. on 24.04.2019 in the presence of bidders/their authorized representatives, who choose to be present.

    5. The Price Bids (Part-2) of those bidders whose techno-commercial bid are in line with the requirements and acceptable to NABARD as per the NIT and terms and conditions of the tender document will only will be opened. The decision of NABARD in this regard shall be binding on the bidders and not open to question or appeals. The date of opening of Price-bids shall be intimated to the qualified contractors and it shall be opened in the presence of qualified bidders/their authorized representatives, who choose to be present.

    5. Bids submitted by unauthorized agents and FAX / Telex / Telegraphic bids

    shall not be entertained / considered.

    6. Bidders are advised to visit the site at their cost, conduct survey of existing conditions so as to familiarize themselves with the site conditions, nature of works etc. and get all clarifications as may be necessary from Consultant/ PMC/ NABARD before quoting the rates.

    7. The contractors should attend the pre-bid meeting scheduled to be held

    at NABARD Office Building, E-5, Arera Colony, Madhya Pradesh, Bhopal at 04.00 – PM on 10.04.2019. Any doubts pertaining to the work/tender documents will be clarified by the Consultant/PMC/NABARD in the meeting.

    8. Rates should include for removal of debris out of premises to the safe

    Municipal limits, removing stains, cleaning the site thoroughly and unless the same is done to the satisfaction of the Consultant/PMC & NABARD, the bill will not be accepted.

    10. Income Tax (TDS) and other statutory deductions etc., as applicable will

    be deducted from any payment due to the Contractors.

    11. Quantities mentioned in the schedule of quantities may vary to any extent or may be deleted without assigning any reasons and as such, the rates quoted should be firm, workable, reasonable and should include all kinds of Taxes, Duties, Work Contract Tax, Octroy, Service Tax etc. as applicable, overheads and profit etc. No separate charges for carriage or labour would be made. There is no question of extra payment above the quoted rate under any circumstance. In case of any variation in quantity or value, the same will not be made as a subject matter for dispute by the bidder.

    12. The BIS / CPWD specifications shall be followed as applicable and in the

    absence of the same the decision of NABARD shall be final.

    13. The Contractor shall make necessary arrangement for watch and ward.

    14. The bidders should quote their rates strictly adhering to Terms and Conditions stipulated in the Tender Document. Unsolicited correspondence after opening of the Tender shall not be entertained. Conditional/Deviation Tenders may be rejected without making any reference to the bidders.

    15. No bidder will be allowed to withdraw his Tender during the validity period.

    16. Rates should be filled in the Bidders Schedule of Quantity in the Price –

    Bid (Part-2) neatly and no correction shall be made. Corrections, if any should be duly authenticated by the signing authority. The rates quoted should be written legibly in words and figures. If on check, differences are observed between the rates given by the Contractor in words and figures or in the amount worked out by him, the following procedure shall be followed.

    i. When there is a difference between the rates in figures and in words,

    the rates, which corresponds to the amounts worked out by the Contractor shall be taken as correct.

    ii. When the amount of an item is not worked out by the Contractor or it

    does not correspond with the rate written either in figures or in words, then the rate quoted by the Contractor in words shall be taken as correct.

    iii. When the rates quoted by the Contractor in figures and in words tallies,

    but the amount is not worked out correctly, the rate quoted by the Contractor shall be taken as correct and not the amount.

    17. No advance shall be paid towards Mobilization and cost of

    materials.

    18. No compensation shall be admissible for any loss suffered by the Contractor during the execution of the work. It shall be the Contractor's sole responsibility to protect NABARD's staff and his employees against accidents from any cause and he shall indemnify NABARD against any claims for damage for injury to person or property, resulting from any such accidents with necessary Insurance cover.

    19. The Contractor should obtain necessary insurance cover (Workmen

    compensation policy and Third-Party Insurance) at his cost for his

    employees as well as for any third party for any losses due to him during the execution of the work. The contractor shall be responsible for the safety of persons employed by him.

    20. Any damages caused to the building / premises during the execution of the

    work shall be made good by the Contractor at his risk and cost and if necessary, through suitable Insurance cover.

    21. The Contractor shall use necessary safety equipment and maintain all

    safety measures during the execution of works and ensure compliance of Safety Code as per Rules and Regulations in force.

    22. The Contractor shall engage necessary qualified and experienced

    supervisory staff at his cost during the execution of the work for attending to day to day affairs.

    23. The Contractor shall submit the bills along with the accepted and jointly

    recorded measurement sheets duly certified by the Consultant/PMC & NABARD's Engineer.

    24. The Contractor should have necessary Contract License and comply with

    the Labour Laws & PF laws as applicable.

    25. Notwithstanding anything stated above, NABARD reserves the right to assess the bidder's capability and capacity to perform the contract, should the circumstances warrant such assessment in the overall interest of NABARD.

    26. The decision of NABARD in awarding the work shall be final and cannot

    be subjected to arbitration.

    27. NABARD reserves the right to accept / negotiate / reject any Quotation either in whole or in part without assigning any reasons therefore whatsoever and without entering into any further correspondence and hence, NABARD shall be under no obligation to accept the lowest or any other Quotations received in response to this Quotation. The decision of NABARD in this regard shall be final and indisputable.

    28. NABARD also reserves the right of supersession of any of the conditions

    stipulated in the Quotation Document.

    29. The contractor shall require shifting some of the furniture, electrical items, etc., to some other places within the colony during the time of work and may also be required to place them in the appropriate place after completing the work. No extra payment will be made for those works.

    30. The work includes carrying out External Civil & Structural Repair,

    Plumbing & Painting rehabilitation & repairs of reinforced concrete structures including repairs, replacements etc. contractor shall mobilize resources to work simultaneously in the Residential Colonies to complete the works within time schedule. Any other jobs not mentioned in specific but required to be carried out to complete the jobs in all respects. Supply of manpower with tools, tackles etc., along with supervision to carry out the miscellaneous jobs as directed by the Engineer-in-charge.

    31. All the jobs given to the agency shall be taken up on priority basis without any delay by mobilizing all the resources immediately at site

    32. Agency shall mobilize resources to work simultaneously in the Residential Colonies at a time to complete the works in time as per schedule.

    33. Where ever possible the work will be taken up after vacating the flats in the Residential Colonies. But the work may also have to be taken up in the occupied condition of flats also. During such time all necessary precautions shall be taken not to disrupt the occupancy and any services like Electrical, Water supply, sanitary lines etc. Whenever required temporary arrangements shall be made to maintain the continuity of the above services.

    34. Though mentioned above, the scope of the work is not limited strictly to

    the areas/units mentioned, but is required to be carried out at any other locations other than those mentioned above as directed by the Consultant/PMC/NABARD Engineer in charge.

    35. Supply of manpower with tools and tackles etc., along with supervision to carry out the miscellaneous jobs as directed by the Consultant/PMC/NABARD Engineer-in-charge.

    36. All the jobs given to the agency shall be taken up on priority basis without any delay by mobilizing all the resources immediately at site.

    37. If the job is delayed beyond the given schedule, NABARD shall be at its discretion to execute job through any other suitable agency at the risk and cost of the original agency.

    38. The External Repainting works shall be carried out after the completion of Repairs and Rehabilitation of the Residential Colonies simultaneously.

    39. There may be any other contractor working inside/ outside the

    flats simultaneously for carrying out other works. Co-operation

    and coordination between the contractors shall be maintained

    including permitting them to use the Scaffoldings.     VIII - TESTS & INSPECTION

    1. The Agency shall carry out all tests, if required, to establish the quality of material conforming to the relevant standards/ codes degree of performance, described in tender document. The test procedure and acceptance criteria, if not specified in the tender documents, shall be as decided by the Consultant/PMC/NABARD Engineer-in-charge. Such tests either on the field or at outside laboratories shall be carried out by the agency at their own cost.

    2. The work on the field including satisfactory storage of material is subject to inspection at all times by the Consultant/PMC/NABARD Engineer-in-charge. The agency shall carryout all instruction given during inspection and shall ensure that the work is carried out according to the provisions of the tender and other technical documents furnished to him from time to time during the performance of the work. Test procedures and acceptance criteria of all work, if not already described in the tender document, shall be as per direction of Consultant/PMC/NABARD Engineer-in-charge.

    3. Any material brought to site, if rejected by engineer-in-charge; the same shall be removed from the site, rectified and re-tested, where applicable as per directions of engineer-in-charge at agency’s own cost.

    4. Inspection and acceptance of work/materials by the owner/engineer-in-charge shall not relieve the agency from any of his responsibilities under this contract.

    MOBILISATION

    It shall be entirely the agency’s responsibility to provide all types of personal protective equipment to all the labour, provide construction equipment, tools & tackles necessary to perform the work in a workman like and efficient manner and completion of the jobs as per the time schedule indicated.

    CEMENT, REINFORCEMENT STEEL AND CONSTRUCTION CHEMICALS

    1. Cement, reinforcement steel and construction chemicals shall be supplied by the agency.

    2. Agency shall procure the material in sufficient quantities in line with the progress schedule for the work.

    3. Reinforcement steel shall be brought by the agency in standards lengths. Laps in the reinforcement steel shall be paid as per IS guidelines. No payment shall be made for scrap material. Procurement of nonstandard lengths of steel shall not entitle the agency for additional lapping.

    SPECIFICATION OF THE MATERIALS

    CEMENT The cement used shall be ordinary Portland slag cement confirming to IS 455 of approved quality and brand. Grade OPC 43 & 53.

    HIGH YIELD DEFORMED STEEL REINFORCEMENT;

    Cold twisted high yield deformed steel bars shall conform to IS: 1786.

    CONSTRUCTION CHEMICALS

    The construction chemicals need to be conforming to either BS or ASTM or BIS, whichever is applicable (Make of chemicals – Pidilite/Fosroc/Basf).

    TESTS AFTER DELIVERY

    Each consignment of cement/reinforcement steel may, after delivery on the site and at the discretion of the engineer-in-charge be subjected to any or all of the tests and analysis required by the relevant Indian standard specifications and agency shall bear the cost of all such tests. The tests are to be carried out at the laboratories approved by engineer-in-charge. The agency shall submit the test certificate for each consignment of reinforcement steel brought to site for use in works. The Consultant/PMC/NABARD is at their liberty to get the same tested at random at the cost of the agency. In case, the results differ largely, the agency is liable for penalty as deemed fit by the Consultant/PMC/NABARD.

    REJECTION OF CEMENT / REINFORCEMENT STEEL/ CONSTRUCTION CHEMICALS The engineer-in-charge may reject any cement/reinforcement steel & construction chemicals as a result of any tests thereof notwithstanding the manufacturers’ certificate. He may also reject cement which has deteriorated owing to inadequate protection from moisture or due to intrusion of foreign matter or other causes. Any cement/reinforcement/structural steel which is considered defective by the engineer-in-charge shall not be used and shall be promptly removed within 24 hours from the site by the agency at their own expenses. The agency/ firm shall coordinate with the electrical agency if any, for timely completion of the work and also to avoid repair/duplication of works. Special conditions of contract shall be read in conjunction with general condition of contract.

    IX- PREAMBLE TO BILL (S) OF QUANTITIES

    The rates shall be inclusive of costs of all materials, labour, tools & tackles, taxes, etc., and all costs and expenses which may be required in for the construction of the work described, together with all general risks involved, liabilities and obligations set forth or applied in the documents on which the tender is based.

    1. General directions and description of works and materials given elsewhere in the tender documents are not necessarily being repeated in the bill(s) of quantities. A reference shall be made to the other documents for the full information/details.

    2. Unless otherwise specified in the description of items of work in bills(s) of quantities the rates shall be for all heights and levels.

    3. For all cement concrete work, the machine crushed hard blue granite stone aggregate shall be used whether the same has been specifically mentioned in the item of work or not and the rates quoted will be deemed to have been for the use of the above mentioned aggregate.

    4. IS codes/specification referred shall mean latest IS codes/ specifications up to date (e.g. IS456, IS4031, IS800 etc.).

    5. House keeping the area of work and surrounding shall have to be carried out on daily basis.

    6. Agency shall provide personal protective equipment (PPE) to its entire workforce and should as here the refinery safety requirements.

    7. All statutory regulations like ESI, PF, minimum wages registration etc., shall be strictly complied with. The entry permission to refinery premises shall be against photo passes bearing valid ESI numbers.

    8. NOTES TO THE AGENCY

    (a) The agency shall engage a qualified and experienced supervisor who can understand the instructions given by engineer-in-charge and can read and interpret the drawings and specifications and execute the job accordingly.

    (b) Agency shall have contact telephone number to contact any time inclusive of out of office hours and holidays. The agency supervisor shall meet Consultant/PMC/NABARD Engineer-in-charge on every working day morning between 8.30 am and 9.00 am without fail.

    (c) Metallic scaffolding as and when required has to be arranged by the agency for carrying out jobs at all elevations at their own cost and no additional claims shall be entertained on this account. Wooden scaffolding is not permitted in the outer areas.

    (d) The entire jobs at all stages are subject to the inspection and approval by job engineer and carry out the jobs along with the other agencies. (e) Agency shall ensure the presence of their supervisor at the job site continuously during the execution of the job failing which the work permit shall be withdrawn and the jobs suspended.

    (f) Agency shall mobilize necessary material, manpower etc., for carrying out the jobs within two days of intimation. Agency shall mobilize material in sufficient quantities in line with the schedule of the work.

    (g) Cement, reinforcement steel and construction chemicals shall be supplied by the agency.

    (h) Reinforcement steel shall be brought by the agency in standard lengths. Laps in the reinforcement steel shall be paid to the extent justified at the discretion of the engineer-in-charge. Procurement of non-standard lengths of steel shall not entitle the agency for additional laps.

    (i) Agency shall maintain documents giving details of gate entries/other relevant details for the material supply.

    (j) Agency should strictly adhere to the safety rules and regulations as listed in Clause 11

    (k) Agency shall record the measurements only on NABARD approved format only.

    (l) All measurements sheets and other attachments submitted along with the bill shall carry the bill number and date clear description of job carried out and its location.

    9. SPECIFIC REQUIREMENTS

    (a) Cement to be supplied by agency shall conform to IS: 455 (Portland slag cement) of approved brand.

    (b)The CONSTRUCTION CHEMICALS manufactured by FOSROC CHEMICALS (INDIA) LIMITED OR EQUIVALENT are acceptable. The offers of bidders quoting with construction chemicals of any other manufacturer are acceptable and shall be submitted with the required technical data sheet.

    (c) Bidders to note that all the works specified in this tender/bid shall be executed in living condition. Prior permissions have to be obtained from the owner wherever necessary. Work execution shall be carried out within the timings specified by the owner. Special sanction shall be taken from the owner for working beyond standard working hours. Bidders quoted rates shall be deemed to have taken care of the aspects and no extra claim at later date shall be entertained on this account.

    10. IMPORTANT NOTES TO THE AGENCIES;

    (a) The rehabilitation/repair jobs have to be carried out during the normal operation of the living conditions. All the safety precautions stipulated shall

    be strictly followed. Usage of the relevant personnel protective equipment shall be ensured and the work shall be carried out with valid work permits.

    (b) The agency shall support the columns, beams, slabs, etc., under repair to take care of dynamic/static loads as the case may be as per the requirement and take the approval of Consultant/PMC/NABARD before carrying out any repairs. The scheme of the supporting systems shall be approved by Consultant/PMC/NABARD before commencing the rehabilitation/repair jobs.

    (c) While carrying out the chipping of loose/ porous/ spelled/ damaged concrete, it shall be ensured that the area is properly covered so that the chipped material/debris does not fall on the adjacent to and below the area or on parked cars. While chipping at higher elevations, the scaffolding platform shall be covered with sheets/tarpaulins, to prevent the debris falling on the cars/manpower below the area of repair works.

    (d) The agency shall take care of all statutory requirements such as ESI, PF, minimum wages etc. The agency shall possess its own individual ESI code and PF code.

    (e) Agency shall follow professional documentation for material movement, consumption testing and inspection data, work measurements and daily logging etc.

    (h) The agency shall adhere to the time schedule. The agency shall be prepared to execute part order. The quantities are likely to vary.

    (i) Agency shall visit the site, understand the scope of the job and familiarize with the area and site conditions under which the job is to be carried out before submitting their offer. Agency shall meet the engineer-in-charge for any clarifications regarding the scope and locations of the work to be carried out.

    11. SAFETY REGULATIONS FOR AGENCIES (i) Maintain attendance record. (ii) Ensure all contract employees are covered under ESI/PF (iii) Ensure all contract employees are medically fit.

    Ensure all contract employees are more than 18 years and less than 58 years of age.

    (iv) Ensure all contract employees do not work for more than 16 hours per day. (v) Ensure all contract equipment has valid certification. (vi) Always wear safety equipment such as safety shoes and safety helmet,

    safety belt at height etc. (vii) In case of accidents, for contract personnel agency should arrange

    subsequent medical treatment at his own expense.

    Section X - The Conditions Hereinafter Referred To 10.1 Interpretation Clause In construing these Conditions, the Specifications, Schedule of Quantities and

    Contract Agreement, the following words shall have the meanings herein assigned to them except where the subject or context otherwise required.

    (a) “NABARD” Shall mean, National Bank for Agriculture and Rural

    Development, Madhya Pradesh Regional Office, Bhopal and shall include its assigns and Successors.

    (b) “Contractor” “Contractor” shall mean ___________________and ___________ (in the case of a trading in the name and style of ______________and having a place partnership) of business at _____________________and shall include the partners for the time being of the said firm and the legal representatives of a deceased partner.

    (in the case of “Contractor” shall mean M/s ______________________ trading in individual) the name and style of ___________________and shall include his heirs, successors and legal representatives.

    (in the case of “Contractor” shall mean ____________________a company

    Company) incorporated under _______________and having its registered office at ___________and shall include its successors and assigns.

    (c) “Site” Shall mean the site of the contract works including any building and erections thereon and any other land (inclusively) as aforesaid allotted by NABARD for the Contractor’s use.

    (d) “This Contract” Shall mean the Articles of Agreement, the Special Conditions, the Conditions, the Appendix, the Schedule of Quantities and Specifications etc. attached hereto and duly signed.

    (e) “Notice in writing” Or written notice shall mean a notice in written, typed or printed characters sent (unless delivered personally or otherwise proved to have been received) by registered post to the last known private or business address to have been received when in the ordinary course of post it would have been delivered.

    (f) “Act of Insolvency” Shall mean any Act of Insolvency as defined by the Presidency Towns Insolvency Act or the Provincial Insolvency Act or any Act amending such original.

    (g) “Net Prices” If in arriving at the contract amount, the Contractor shall have added to or deducted from the total of the items in the Tender any sum, either as a percentage or otherwise, then the net price of any item in the tender shall be the sum arrived at by adding to or deducting from the actual figure appearing in the Tender as the price of that item a similar percentage or proportion of the sum so added or deducted by the Contractor the total amount of any Prime Cost items and provisional sums of money shall be deducted from the total amount of the tender. The expression “net rates” or “net prices” when used with reference to the contract or accounts shall be held to mean rates or prices so arrived at.

    “The works” Shall mean the Internal Renovation & External Civil & Structural Repairs, Plumbing & Painting Work to 8 flats at NABARD Officers Qtr. at A Sector Shahpura, Bhopal, Madhya Pradesh- 462 039 as provided herein.

    Word importing persons include firms and corporations. Word importing the singular only also includes the plural and vice-versa where the context requires.

    10.2 Scope of Contract

    The work includes the Structural repair works and Internal Renovation work of 8 flats of NABARD Officers quarters at A sector Shahpura Bhopal. etc.. The contractor shall carry out and complete the said work in every respect in accordance with this contract and with the directions of and to the satisfaction of NABARD. NABARD may in his absolute discretion and from time to time issue further drawings and/or written instructions, details, directions and explanations, which are hereafter collectively referred to as ”NABARD’s Instructions” in regard to : (a) The variation or modification of the design, quality or quantity of

    works or the addition or omission or substitution of any work.

    (b) Any discrepancy in the Drawings or between the Schedule of Quantities and/or Drawings and/or Specifications.

    (c) The removal from the site of any materials brought thereon by the Contractor and the substitution of any other material therefor.

    (d) The removal and/or re-execution of any works executed by the Contractor.

    (e) The dismissal from the works of any persons employed thereupon.

    (f) The opening up for inspection of any work covered up.

    (g) The amending and making good of any defects under Clause 21 hereof.

    The Contractor shall forthwith comply with and duly execute any work comprised in such NABARD’s instructions provided always that verbal instructions, directions and explanations given to the Contractor or his representatives upon the works by NABARD shall, if involving a variation, be confirmed in writing by the Contractor within seven days, and if not dissented from in writing within a further seven days by NABARD, such shall be deemed to be NABARD’s instructions within the scope of the Contract. For the purpose of entering day to day instructions by NABARD, the contractor shall maintain at his own cost, a “Site Instruction Book” in triplicate in which the instructions shall be entered by NABARD and to be maintained by engineer-in charge of the contractor. Instructions to the contractor shall be issued through NABARD’s officials. Scope of contract includes, but is not limited to, the following:

    a) The coordination, scheduling and management of work of component suppliers and subcontractors.

    10.3 Contractor’s Duties

    Contractor’s duties include the following:

    a) Provide and pay for labour, materials and equipment, tools, construction equipment and machinery and other facilities and services necessary for the proper execution and completion of the specified works.

    b) Secure and pay for required permits, statutory workman’s compensation insurance, fees and licenses necessary for proper execution and completion of required work.

    c) Give required notices.

    d) Enforce strict discipline and good order among employees. Do not employ persons unskilled in assigned task.

    10.4 Variations to be approved by NABARD

    The Contractor shall submit a statement of variations giving a quantity and rates duly supported by analysis of rates, vouchers etc. The rates on scrutiny and final acceptance by NABARD shall form a supplementary tender. NABARD shall not be liable for payment of such variations until these statements are sanctioned by it.

    10.5 Drawings, Schedule of Quantities & Agreement

    The Contract shall be executed in duplicate and the Contractor shall be entitled to one executed copy for his use. Before the issue of the final certificate to the Contractor, he shall forthwith return to NABARD all Drawings and Specifications.

    10.6 Work sequence

    The successful Contractor shall include all costs in the tender to complete the works in the time schedule as given by him in the work schedule table. By submitting a tender, the Contractor agrees that they have reviewed the project specifications, toured the jobsite, and will complete all work in accordance with the overall time frame of 90 days as per the approved schedule. The Contractor shall provide a detailed execution schedule, in accordance with the time frame approved as per the work task schedule, prior to award of the project.

    10.7 Contractor's use of Estate

    The site of the work is an occupied building. Contractor's use of premises shall be subject to following:-

    • Confine operations at the site to areas permitted by law, ordinances, permits, Specification, and NABARD’s specific instructions.

    • Do not unreasonably encumber the site with materials or equipment. Staging area shall be located as directed by NABARD.

    • Assume full responsibility for protection and safekeeping of tools and products stored on or off site .

    • Move stored products which interfere with operations of building or the operations of other trades.

    10.8 Contractor to provide everything necessary at his cost

    The Contractor shall provide at his cost, everything necessary for the proper execution of the works according to the intent and meaning of the Drawings, Schedule of Quantities and Specifications taken together

    whether the same may or may not be particularly shown or described therein provided that the same can reasonably be inferred there from, and if the Contractor finds any discrepancy in the Drawings or between the Drawings, Schedule of Quantities and Specifications, he shall immediately and in writing refer same to NABARD who shall decide which is to be followed. The Contractor shall provide all works under this specification in full accordance with Health and Safety Regulations.

    10.9 No disruption to normal office functions

    It is essential that the Contractor gives special attention and priority to all matters concerning safety, protection from dust and loose materials, reduction of noise levels, protection from water and air infiltration into building, and maintenance of neat and orderly conditions in and around work areas inside and outside of building. Packaging, scrap materials and demolition debris shall be promptly removed from the building and site on a daily basis.

    If the contract includes works, which will be disruptive during normal business operations, or would be dangerous to building occupants, said works shall be performed during hours as directed by NABARD. Examples of such work include, without limitation, saw cutting of concrete, jack hammering, welding, metal cutting, pouring concrete, erecting steel or hoisting equipment over occupied portions of the building or performing tests. The Contractor shall perform such work during NABARD dictated hours and shall include all costs in its tender.

    The Contractor shall keep noise levels within permissible limits during normal building hours. When it is necessary to produce noise above this level, the Contractor shall advise NABARD of such needs and times will be scheduled as directed. The Contractor shall anticipate any excessive noise reducing procedures and include an allowance for it in the tender.

    10.10 Protection of Work and Property

    The Contractor shall install a suitable protective covering on area where the works are being performed. No material handling equipment shall be permitted on or over finished floors unless said floors have been protected in a manner approved by NABARD. Any damage to building finishes caused by the Contractor shall be refinished at no additional cost to NABARD. The Contractor shall take photographs of any adjacent finishes that may be damaged during the works for a photographic record.

    10.11 Authorities, Notices and Patents

    The Contractor shall conform to the provisions of any Act of the Legislature relating to the works, and to the regulations and bye-laws of any authority, and of electric supply and other companies and/or authorities with whose systems, the installation is proposed to be connected and shall, before making any variations from the Drawings or Specifications that may be necessitated by so conforming, give to NABARD, written notice, specifying the variation proposed to be made and the reason for making it and apply for instructions thereon. In case the Contractor shall not receive such instructions within ten days, he shall proceed with the work conforming to the provisions, regulations or

    bye-laws, in question, and any variation so necessitated shall be dealt with under Clause No. 24 thereof.

    The Contractor shall bring to the attention of NABARD, all notices required by the said Acts, regulations or bye-laws to be given to any authority and pay to such authority, or to any public office, all fees that may be properly chargeable in respect of the works, and lodge the receipts with NABARD.

    The Contractor shall indemnify NABARD against all claims in respect of rights, and shall defend all actions arising from claims, and shall himself pay all royalties, license fees, damages, cost and charges of all and every sort that may be legally incurred in respect thereof.

    10.12 Setting out of work

    The Contractor shall set out the works and shall be reasonable for the true and perfect setting out of the same and for the correctness of the positions, levels, dimensions, and alignment of all parts thereof. If at any time any error in this respect shall appear during the progress of the works within a period of one year from the completion of the works, the Contractor shall, if so required, at his own expense, rectify such error to the satisfaction of NABARD.

    10.13 Materials and workmanship to conform the descriptions

    All materials and workmanship shall so far as procurable be of the respective kinds described in the Schedule of Quantities and/or Specifications and in accordance with NABARD’s instructions, and the Contractor shall upon the request of NABARD furnish him with all invoices, accounts receipts and other vouchers to prove that the materials comply therewith. The Contractor shall at his own cost arrange for and/or carry out any test of any materials which NABARD may require.

    10.14 Contractor’s superintendence and representative on the works

    The Contractor shall give all necessary personal superintendence during the execution of the works, and as long thereafter as NABARD may consider necessary until the expiration of the “Defects Liability Period” stated in the Appendix hereto. The Contractor shall also during the whole time the works are in progress, employ a competent representative who shall be constantly in attendance at the works while the men are at work. Any directions, explanations, instructions or notices given by NABARD to such representative shall be held to be given to the Contractor.

    10.15 Dismissal of Workmen The Contractor shall on the request of NABARD, immediately dismiss from the works, any person employed thereon by him who may, in the opinion of NABARD, be incompetent or misconduct himself and such persons shall not be again employed on the works, without the permission of NABARD.

    10.16 Access to Works

    NABARD and their respective representatives shall at all reasonable times have free access to the works and/or the workshops, factories or other places where materials are lying or from which they are being obtained and the Contractor shall give every facility to NABARD and their representatives necessary for inspection and examination and test of the materials and workmanship. No person not authorised by NABARD except the representatives of public authorities shall be allowed on the works at any time.

    10.17 Assignments and Sub-letting

    The whole of the works included in the Contract shall be executed by the Contractor and the Contractor shall not directly or indirectly transfer, assign or under-let the Contract or any part share thereof or any interest therein without the prior written consent of NABARD, and no undertaking shall relieve the Contractor from the full and entire responsibility of the Contract or from active superintendence of the works during their progress.

    No alteration, omission or variation shall vitiate this Contract but in case NABARD thinks proper at any time during the progress of the works to make any alterations in or additions to or omissions from the works or any alteration in the kind or quality of the materials to be used therein and shall give notice thereof in writing under his hand to the Contractor, the Contractor shall alter, add to or omit from, as the case may be, in accordance with such notice but the Contractor shall not do any work extra to or make any alterations or additions to or omissions from the works or any deviation from any of the provisions of the Contract, Stipulation, Specifications or Contract Drawings without the previous consent in writing of NABARD and the value of such extras, alterations, additions or omissions shall in all cases be determined with the prior approval in writing of NABARD in accordance with the provisions of Clause 21 hereof, and the same shall be added to or deducted from the Contract Amount, as the case may be, accordingly.

    10.18 Schedule of Quantities

    The Schedule of Quantities, unless otherwise stated, shall be deemed to have been prepared in accordance with the Standard Method of Measurement.

    Any error in description or in quantity or in omission of items from the

    Schedule of Quantities shall not vitiate this contract but shall be rectified and the value thereof as ascertained under Clause 26 hereof, shall be added to, or deducted from the Contract Amount (as the case may be) provided that no rectification of errors, if any, shall be allowed in the Contractor’s Schedule of Rates.

    10.19 Sufficiency of Schedule of Quantities

    The Contractor shall be deemed to have satisfied himself before tendering as to the correctness and sufficiency of his tender for the works and of the prices stated in the Schedule of Quantities and/or the Schedule of Rates and Prices which rates and prices shall cover all his obligations under the Contract, and all matters and things necessary for the proper completion of the works.

    10.20 Measurement of Works

    Contractor shall take measurement of the work from time to time and inform the NABARD for the same. Measurements shall be taken and recorded in measurement books in accordance with the Mode of Measurement detailed in the Specifications. All authorised extra works, omissions and all variations made with the prior approval in writing of NABARD shall be included in such measurements

    10.21 Prices for extra etc. ascertainment of

    The Contractor may, when authorised by NABARD, add to, omit from, or vary the works shown upon the drawings, or described in the Specification, or included in the Schedule of Quantities, but the Contractor shall make no addition, omission or variation without such authorisation or direction. A verbal authority or direction by NABARD shall, if confirmed by him in writing within seven days, be deemed to have been given in writing.

    No claim for any extra shall be allowed unless it shall have been executed under provisions of Clause 4 hereof with the concurrence of NABARD as herein mentioned. Any such extra is herein referred to as authorised extra and shall be made in accordance with the following provisions.

    (a) (i) The net rates or prices in the original tender shall determine the

    valuation of the extra work where such extra work is of similar character and executed under similar conditions as the work priced therein.

    (ii) Rates for all items, wherever possible, should be derived out of the rates given in the Priced Schedule of Quantities.

    (b) The net prices of the original tender shall determine the value of the items

    omitted, provided if omissions vary the conditions under which any remaining items of works are carried out, the prices for the same shall be valued under sub-clause (c) hereof.

    (c) Where the extra works are not of similar character and/or executed under

    similar conditions as aforesaid or where the omissions vary the conditions under which any remaining items of works are carried out or if the amount of any omission or additions relative to the amount of the whole of the Contract works or to any part thereof shall be such that in the opinion of NABARD the net rate or price contained in the Priced Schedule of Quantities or tender or for any item of the works involves loss or expense beyond that reasonably contemplated by the Contractor or is by reason of such omission or addition rendered unreasonable or inapplicable, NABARD shall fix such other rate or price as in the circumstances NABARD shall think reasonable and proper.

    (d) Where extra work cannot be properly measured or valued, the Contractor

    shall be allowed day work prices at the net rates in accordance with the local day work rates and wages for the district, provided that in either case vouchers specifying the daily time and materials employed, be delivered for verification to NABARD at or before the end of the week following that in which the work has been executed plus 15% towards establishment charges, contractor’s overhead and profits.

    The measurement and valuation in respect of the Contract shall be completed

    within the “period of final measurement” stated in the Appendix, or if not stated, then defined in Clause 24hereof.

    10.22 Unfixed materials when taken into account to be the property of NABARD

    Where in any Certificate (of which the Contractor has received payment) NABARD has included the value of any unfixed materials intended for and/or placed on or adjacent to the works, such materials shall become the property of NABARD and they shall not be removed except for use upon the works, without the written authority of NABARD. The Contractor shall be liable for any loss of or damage to such materials.

    10.23 Removal of improper work

    NABARD shall, during the progress of the works, have power to order in writing from time to time the removal from the works within such reasonable time , as may be specified in the order, of any materials which in the opinion of NABARD are not in accordance with the Specifications or the instructions of NABARD, the substitution of proper materials, and the removal and proper re-execution of any work executed with materials or workmanship not in accordance with the Drawings and Specifications or instruction, and the Contractor shall forthwith carry out such order at his own cost. In case of default on the part of the Contractor to carry out such order, NABARD shall have the power to employ and pay the other persons to carry out the same, and all expenses consequent thereon, or incidental thereto shall be borne by the Contractor, or may be deducted by NABARD from any moneys due, or that may become due, to the Contractor.

    10.24 Defects after virtual completion

    Any defect, shrinkage, settlement or other faults which may appear within the “Defects Liability Period” stated in the Appendix hereto, if none stated, then within 12 months after the virtual completion of the works, arising in the opinion of NABARD from materials or workmanship not in accordance with the contract, shall upon the directions in writing of NABARD, and within such reasonable time as shall be specified therein, be amended and made good by the Contractor, at his own cost and in case of default, NABARD may employ and pay other persons to amend and make good such defects, other faults, and all damages, loss and expenses consequent thereon or incidental thereto shall be made good and borne by the Contractor and such damage, loss and expenses shall be recoverable from him by NABARD or may be deducted by NABARD from any moneys due or that may become due to the Contractor, or NABARD may in lieu of such amending and making good by the Contractor deduct from any money due to the Contractor a sum to be determined by NABARD equivalent to the cost of amending such work and in the event of the amount retained as Security Deposit being insufficient, recover the balance from the Contractor, together with any expenses NABARD may have incurred in connection therewith. Should any defective work have been done or material supplied by any Sub-Contractor employed on the works who has been nominated or approved by NABARD as provided in various clauses hereof, the

    Contractor shall be liable to make good in the same manner as if such work or material had been done or supplied by the Contractor and been subject to the provisions of this Clause and Clause 2 hereof. The Contractor shall remain liable under the provision of this Clause, notwithstanding the signing of any certificate or the passing of any accounts, by NABARD.

    10.25 Certificate of virtual completion and Defects Liability Period

    The works shall not be considered as completed until NABARD has certified in writing that they have been virtually completed. The Defects Liability Period of 15 months shall commence from the date of such Certificate or obtaining of licence whichever is later.

    10.26 Nominated Sub-Contractor

    All Specialists, Merchants, Tradesman and others executing any work of supplying and fixing any goods, for which prime cost prices or provisional sums are included in the Schedule of Quantities and/or Specifications, who may be nominated or selected by NABARD are hereby declared to be Sub-Contractors employed by the Contractor and are herein referred to as nominated Sub-Contractors.

    10.27 Other persons employed by NABARD

    NABARD reserves the right to use the Estate and any portions of the site for the execution of any work not included in this Contract, which it may desire to have carried out by other persons, and the Contractor shall allow all reasonable facilities for the execution of such work but shall not be required to provide any plant or materials for the execution of such work. Such work shall be carried out in such manner as not to impede the progress of the works included in the Contract and the Contractor shall not be responsible for any damage or delay which may happen to or occasioned by such work.

    10.28 Insurance in respect of damage to person and property

    The Contractor shall be responsible for all injury to persons, animals or things, and for all structural and decorative damage to property which may arise from the operation or neglect of himself or of any nominated Sub-Contractor or any employee or either, whether such injury or damage arises from carelessness, accident or any other cause whatever, in any way connected with the carrying out of this Contract. This liability under this clause shall be held to include inter alia, any damage to buildings, whether immediately adjacent or otherwise, and any damage to roads, streets, footpaths, bridges or ways as well as all damage caused to the buildings and other structures and works forming the subject matter of this Contract.
