National Motorway M-4 Shorkot-Khanewal Section Project (120+268 – 184+487 = 64 km)

1. INTRODUCTION

1.1 Project Background

1. This report is the 7th internal monitoring report (October - December 2017) on the implementation of LARP for the National Motorway M-4 Shorkot-Khanewal Section Project (Additional Financing) (hereinafter referred to as the Project) co-financed by ADB, AIIB and DFID.

2. The project starts at chainage120+268 at Mouza Kakki Kohna, crossing through various rural settlements, and ends at chainage184+487 km in Mouza Shamkot (near Khanewal city). Project works include the construction of a four-lane dual carriage way with four (4) interchanges located at chainage 148+400 km (Abdul Hakeem Interchange), 166+000 km (Makhdoompur Interchange), 178+070 km (Kabirwala Interchange) and 184+000 km (Khanewal Interchange). The project is located in the districts of Jhang and Khanewal. The location map of the project is given in Figure 1.1.

1.2 Land Acquisition and Resettlement Impacts

3. The project requires 64 km of 100 meter ROW for the carriageway and 40 meter ROW for the interchange loops. A Land Acquisition and Resettlement Plan (LARP) was finalized, approved and disclosed by ADB in January 2016. Table 1.1 provides a summary of LARP impacts and number of DPs, while Table 1.2 shows the number of DPs entitled to various allowances.

4. This internal monitoring report is prepared by NHA with assistance of Social Safeguards Management Consultants (SSMC) of the project. Internal monitoring reports are prepared and shared with the NHA EALS and ADB for review and disclosure. The report presents the results of internal monitoring of LARP implementation in Section III M-4 Shorkot-Khanewal Section Project covering a period of three months from October to December 2017. The report presents the progress of implementation of LARP and a Corrective Action Plan (CAP) of section III and highlights NHA’s efforts made to facilitate payment of meager amount of compensation to DPs and other types of compensation facing legal and administrative impediments.

1 Due to acquisition of land, the land owners/ DPs also face loss for assets like structures, trees and crops that are appended to acquired land. So, the DPs mentioned against losses other than land are also counted above in the Land Owner DPs. In structure, amount increased as 0.417 million and 29 DPs decreased in Structure as per actual revenue record and duplication has been removed. 2 For two public schools total Rs: 30,103,687 (for Land Rs: 5,239,687 and for structure construction of both schools Rs: 24,864,000) and Rs: 972557 for three mosques has been paid to relevant authorities.

2 NEED FOR INTERNAL MONITORING OF LARP AND CAP

2.1 Internal Monitoring Requirements of LARP and CAP

5. LARP activities under the Project are subject to both internal and external monitoring. The Executing Agency NHA with the assistance of SSMC is responsible for internal monitoring of resettlement activities. Internal monitoring is done on quarterly basis and this report is for 7th Internal monitoring of M-4 Shorkot-Khanewal Section Project (Section III). The results of internal monitoring are included in the quarterly monitoring report for submission to ADB.

6. NHA has engaged the services of an External Monitor Agency (EMA) for external monitoring of section III. External monitoring reports are prepared on a semi-annual basis during the implementation of the project.

2.2 Objectives of the Internal Monitoring Report

7. The objective of 7th Internal monitoring report (IMR) are given below:

i) Delivery of compensation against acquired assets and allowances;

ii) Community consultations and information dissemination measures for effective safeguards management and disbursement of compensation.

iii) Updated status of interchanges ROW land.

iv) Updated status of additional land acquisition emerged along interchanges carriageway ROW.

v) Updates on the grievance redress mechanism; and

vi) Recommendations to improve safeguards management and facilitate disbursement of compensation payments and allowances

2.3 Monitoring Indicators

8. Specific monitoring benchmarks is based on the approved LARP and cover the following:

a) Information campaign and consultation with DPs; b) Status of land acquisition and payments on land compensation; c) Status of crop, trees, structures compensation; d) Relocation of DPs; e) Payments for loss of income; f) Status of payment for Resettlement and Rehabilitation Allowances g) Selection and distribution of replacement land areas; h) Income restoration activities; and i) Ensure gender mitigation measures in the LARP are adhered to during the quarterly

monitoring and reporting process.

2.4 Monitoring Methodology

9. This internal monitoring report is based on a review of: i) LAR institutional arrangements, ii) monthly progress reports; iii) social mobilization activities and community consultation initiatives; iv) status of additional land acquisition arisen along with interchanges carriageway ROW; v) measures implemented to improve coordination between LAR implementation units in PMU/ PIU and line government agencies; vi) DP outreach activities for LARP disclosure and compensation delivery; vii) grievance redress mechanism and complaints recording/ tracking systems; and viii) compensation records.

10. It also includes progress on identification, assessment and redress of construction related emerging LAR issues. It provides brief on identification and assessment of construction related emerging LAR issues with timebound corrective action plan and updated progress on timebound action plan for acquisition of additional land, prepration and implementation of addendum LARP to ensure project implementation is compliant with ADB’s IR sagfegaurds requirments.

2.5 Structure of the Internal Monitoring Report

11. This Internal monitoring report presents the updated status of implementation of LARP (October - December 2017) that includes disbursement of payments, grievance redress mechanism, disclosure of information, institutional arrangements, details components of which are presented below:

i) No. of displaced persons (DPs) paid, unpaid and being paid; ii) Status of land acquisition; iii) Loss of structures and status of payments and income restoration; iv) Affected fruit and timber/ wood trees and status of their payments; v) Affected crops and payments; vi) Payment of allowances including rehabilitation, livelihood restoration and

vulnerability allowances; vii) Categorized payment of land compensation including payments to the DPs (a)

not living in the project area, (b) have meager amounts of compensation, (c) national ID cards, (d) and have issues with land titles/ ownership or inheritance matters;

viii) Efforts underway to complete all categorized payments; ix) Complaints/ redress management; x) Institutional arrangements put in place for LARP implementation and

monitoring; and xi) Conclusions and recommendations.

12. The following section contains the progress of LARP (Section III) and findings of the report.

3. LARP IMPLEMENTATION STATUS

3.1 Status of Land Acquisition for Carriageway/ Interchange ROW

13. NHA is implementing the LARP of section III with assistance of SSMC based at Project Implementation Unit (PIU based in the field at Toba Tek Singh). Total number of land and non-land DPs in Section III and status of payments of DPs are given below:

Out of 1514.61 acres of privately owned land that need to be acquired,1492.71 acres (1461.97 acres for the main carriageway ROW and 30.74 acres for Interchange loops ROW) has been awarded covering 6,484 DPs (carriageway and interchanges ROW). The land acquisition process have been comeleted for remaining 21.9 acres of interchanges ROW land owned by 136 DPs in two villages including 16.363 acres in Jalapahore for Dinpur Interchange and 5.538 acres in village 15-V for Kabir wala interchange. Summary of land acqisition is given in Table 3.1.

3.1.1 Status of Land Acquisition for Interchange ROW

15. For the remaining 21.90 acres acquired land for interchanges ROW in village Jalla Pahore (Abdul Hakeem interchange) and village 15-V (Kabirwala Interchange) efforts to complete by close of the monitoring period the achieved progress in completing for awarded interchanges land of two village is as follow:

• Jalla Pahore: Notices as required under section 9 & 10 dated September 27, 2017 of LAA were properly served upon the affected persons requiring them to appear before LAC on October 16, 2017 to deliver their statements regarding nature of their respective interests in the land and particulars of their claims to compensation and their objections, if any regarding measurement. In response to the Notices under section 9 &10, the affected persons appeared before LAC on October 16, 2017 at Union Council, Mouza Umeed Garh Tehsil Kabirwala & District Khanewal and got recorded their statements and agreed with the rates approved by the District Collector Khanewal. Therefore, land award of 16.363 acres amounting to Rs.38.836 million including compensation of land, crops and trees of interchange ROW was announced and by the end of December 2017, 18 DPs (19.8%) have been paid an amount of Rs. 13.796 million. Copy of award are presented in Annex 3.1.

• 15-Venoi: The estimated cost was framed by District Collector, Khanewal which was properly checked and finally approved by District Collector Khanewal vide No.225/LAC/ADC(R) on Dated October 10, 2017. Notices as required under section 9 & 10 dated Oct. 16, 2017 of the LAA were propely served upon the affected persons requireing them to appear before LAC on November 2, 2017 to deliver their statements regarding nature of their respective interests in the land and particulars of their claims to compensation and their objections, if any regarding measurement. In response to the Notices under section 9 &10, the affected persons appeared before LAC on November 2, 2017 at Govt. Boys Primary School 15-Venoi Adiwal, Tehsil & District Khanewal and got

recorded their statements and agreed with the rates approved by the District Collector Khanewal, Therefore, land award of 5.538 acres amounting to Rs. 13.431,535 including compensation of land, crops and trees of interchange ROW was announced and by the end of December 2017, 22 DPs (48.9%) have been paid an amount of Rs. 8.402 million. Copy of award are presented in Annex 3.2.

16. For the carriageway ROW land, delivery of compensation to all payable DPs is almost completed and leftover unpaid compensation is because of legal and administrative impediments faced by the DPs. During monitoring period, efforts to outreach and facilitate unpaid DPs having legal and administrative impediments continued along with delivery of compensation for acquired 30.74 acres of interchanges ROW land. From October to December 2017, compensation amount Rs 24.417 million has been paid to 65 landowners (including DPs for interchanges/ main carriageway ROW land) for acquired assets i.e. land and an amount Rs. 7.691 million was paid for non-land based assets.

17. Abstract of the progress made during the reporting period are provided in the bullets below and a comparative summary of implementation progress since last monitoring report is provided in Table 3.1:

3.2 Compensation Payment Disbursement

3.2.1 Land and Non-Land Payment

• Land Compensation: 65 landowner (DPs) are paid a compensation amount of Rs. 24.417 million that makes 4,693 DPs (72.4%) paid out of total 6,484;

• Payment of Crop Compensation: During the reporting period compensation amount Rs. 1.026 million was paid to 19 DPs entitled for crop compensation, Out of total 1,066 DPs of crop compensation (102.704 million), overall 832 DPs (78.0%) have received crop compensation of amount (85.545 million);

• Payment of Structure: During this quarter 14 DPs are paid a compensation for structures amount of Rs. 5.865 million that makes a total 235 DPs (94.4%) paid out of total 249;

• Payment of Trees: Compensation amount Rs. 0.800 million was paid to 14 DPs ;

3.2.2 Allowances and rehabilitation/ livelihood restoration

• During the reporting period compensation amount of allowances and rehabilitation/ livelihood restoration are is process of payment.

3.2.3 Payment of Land Compensation for Awarded land

18. A total amount of Rs. 1473.738 million was to be paid to 6,484 DPs. Of which, 4,693 DPs (72.4%) have been paid an amount of Rs. 1,363.21 million (92.5%). During this quarter 21.90 acres of land has been awarded for the interchanges, compensation for DPs to be start in end of January 2018. The Table 3.2 below provides a summary of land compensation for awarded land while village wise payment detail is added as Annex 3.3.

3.2.4 Payment of Crop Compensation

19. As of updated database by December 2017, Out of total 1,066 DPs of crop awarded compensation (Rs. 102.704 million), 832 DPs (78.0%) have received Rs.85.545 million (83.3%) as crop compensation, while efforts are continued to outreach 234 unpaid DPs with impediments to disburse compensation as and when they show-up after resolving their issues. The Table 3.2 below provides a summary of crop compensation while village-wise crop compensation payment status is in Annex 3.4.

3.2.5 Payment of Structures

20. The total amount of compensation for affected structures, including tube wells & hand pumps for 249 DPs is Rs. 108.570 million. Out of which, the payment of Rs. 102.29 million (94.2%) has been paid to 235 DPs (94.4%) as of December 2017. 14 Unpaid DPs with impediments are being coordinated for additioanl documentation and mobilized to show-up for compensation after resovling their issues/ impediments. The Table 3.2 below provides a summary of structure compensation while village wise payment details are presented in Annex 3.5.

3.2.6 Payment of Trees

21. For tree losses, compensation of Rs. 71.678 million is due to 734 DPs. Of which awarded amount, compensation for tree losses amounting to Rs. 65.999 million (92.1%) has been made to 572 DPs (77.9%). DPs with impediments are being coordinated for additional documentation and are being mobilized to resolve their issues/ impediments and show-up for compensation. The Table 3.2 below provides a summary of trees compensation while the village wise payment status is shown on Annex 3.6.

3.2.7 Payment of Allowances

22. Total amount of rehabilitation allowances is Rs 66.922 million. Of which, Rs 54.162 million (80.9%) has been disbursed as of December 2017. The resettlement and rehablitation costs are linked to the acquired land and assets of DPs and entitled allowance can only be paid to respective DPs after delivery of compesnation for acquired assets to ensure transprancy. Mostly the leftover unpaid allowances are for unpaid DPs assets categrories who are facing legal and adminstrative impediments. PIU/ SSMC team is continously making its efforts to reach, motivate and guide DPs to resove their issues and get compensation for acquired assets and entitled rehabilitation and resettlement allowances. Focus will be made to DPs who are vulnerable and severely affected DPs. The Table 3.2 below provides a summary of payment of allowances.

3.3. Pending Payment

3.3.1. Payments Stuck due to Legal Administrative Reasons

23. The findings of the IMR revealed that some land payments are impeded due to some legal and administrative factors. For example payments of land compensation of an amount of Rs. 110.53 million (7.5% of total amount) to about 1,791 DPs (27.6% of total DPs) have been impeded due to the following reasons.

24. The main reasons of delayed payment are legal and administrative impediments faced by the DPs due to which they are not showing up to claim compensation. During reporting period the data for unpaid DPs was reviewed and efforts were continued to outreach and faciliate the unpaid DPs in different categories of impediments for compensation disbursment and additional documentations. Based on field verifcation list of upaid DPs falling in different categories of impediments was revised and updated during this monitoring period. As per updated list of unpaid DPs, the impediments/ reasons contributing towards the delay in payments are described below while number of unpaid DPs against each impediment/ reason are summarized in Table 3.3:

• Delay in land awards for interchanges ROW land: As per LAA, land is considered legally acquired once the land award has been notified and compensation payment has been made. In case of interchanges ROW land, the compensation payment for awarded 30.74 acres and also awarded 21.90 acres acquired interchanges ROW land owned by 136 DPs in village Jalla Pahore (Abdul Hakeem interchange) and village

15-V (Kabirwala Interchange), 40 DPs (29.4%) have been paid an amount of Rs. 22.198 million (50.3%) by the end of December 2017 while the left over unpaid DPs will be coordinated for early submission of claims duirng next monitoring period.

• Inheritance mutation issues: 122 land owners have passed away which requires transfer of land to the inheritors. Payments of compensation to inheritors will be made after transfer of land to the inheritors by the district revenue authority. After inheritence mutation in land record, all heirs of deseased DPs will receive entitled compensation as per their inherited share.

• Living out of project area/ outside countery: As per LAA 1894, DPs have to submit their claims supported with valid title documenmts and receive compensation voucher/cheque in person after due verification of their documents and record. Currently, total 509 DPs who have been reportedly moved out of the project area without leaving a clue or address to with fellow villagers and 5 DPs are residing outside country.

• Meager3 Compensation Amounts and other reasons: The largest (842) number of DPs living in the affected or nearby villages have not showed up to claim compensation are having pending payments because of meager amounts of compensation of less than Rs. 5000. As procedural requirement, DPs have to open bank account to receive even such small amount of compensation for which DPs are reluctant to open bank account as sometimes the amount of opening bank account surplus the compensation amount, lack of interest to submit claim or some other reasons well known to them.

• Title Disputes/ court cases: 105 Landowners/ DPs have title disputes that have not been resolved. The compensation could not be paid to them until land title issues are resolved/decided by the competent revenue authorities/courts.

• Underage DPs (Juvenile) or DPs lacking CNIC4: There are 82 DPs who are either of underage (juvenile) or lack identification documents like computerized national identity card (CNIC).

3.4 Facilitation provided to DPs in Processing of Claims

25. During reporting quarter, SSMC team in collaboration with M-4 Land and Resettlement Unit visited the project effected villages of districts Jhang and Khanewal to: i) locate, motivate and guide DPs and heirs of deceased DPs; ii) facilitate delivery of compensation to the remaining unpaid DPs; and iii) record current residential addresses of those living out of project area; and iv) obtain certification statements of the guardians of juvenile and legal heirs of deceased DPs regarding payment of compensation as and when they approach with requisite legal/ title documents. Besides, the lists of DPs in differnet categories of impediments were reviewed and updated based on field verfications and accordingly the database was revised and the numbers of unpaid DPs in different categories of impediments were re-adjusted. The Table 3.4 below highlights the payement progress achieved against different categories of unpaid DPs and updated number of remaining unpaid DPs (as of 31 December 2017) in differnet categrories of legal and administrative impediments.

26. Meanwhile, efforts were continued to facilitate DPs in resolving their impediments and disburse compensation during next monitoring period. Particularly, the DPs living in project corridor and the legal heirs of deceased DPs were visited and facilitated to get requisite title documents after mutations in the land records and legal heirs of inheritors DPs who got mutations of land were assisted in preparing their compensation claims. Accordingly, during monitoring period, land compensation claim files for 54 DPs were finalized and being processed for delivery of entitled resettlement allowances in next monitoring period. Village-wise summary of files processed and submitted for payment of payable allowances is given in Table 3.5.

3.5 Efforts exhausted to approach unpaid DPs for additional documentation

27. During the reporting period, project villages were visited by the PIU/ PMU and unpaid DPs were approached through their relatives/ local residents. The contact details of DP’s living outside the project were asked and recorded and the legal heirs of the inheritors DPs were motivated for early mutations in land record. Certification statements from 205 DPs acknowledging their awareness that compensation will be provided upon resolution of the legal and administrative issues related to their compensation have been collected. Table 3.6 below summarizes the progress achieved for additional documentation about DPs with legal and administrative impediments and village wise list is Annex 3.7. Sample of copies of filled forms are attached as Annex 3.8, 3.9, 3.10 and 3.11.

3.6 Assessment on Compensation Uses by DPs

28. During the reporting period, along with locating and approaching unpaid DPs for additional documentation and mobilization of DPs to collect their compensation, SSMC team started to collect information from paid DPs about use of compensation paid and restoration of their assets like land and structures by using a pre-structured questionnaire. The DPs were consulted and interviewed to collect information on predominant use of compensation amount and assess restroartion of their residential and productive assets. The analysis of collected data during (October – December 2017) on utilization of compensation amount for acquired assets (structures, land and other asstes) is presented in Table 3.7.

29. In land categroy 11 DPs and in structure category 15 DPs were interviewed to analyze predominant compensation uses by interviewed DPs. The results represent that 63% DPs in land categroy and 66% DPs in structure category utilized their compensation to re-establish their lost assets. The results of interviewed DPs highlighted that the DPs entitled for sizable compensation amount utilized it on productive purposes (i.e use of compensation for reconstruction/ establishment of replacement structure or assets) while the DPs entitled for meager amounts used the compensation on non-productive uses (use of compensation on other household needs).

3.7 Request of NTP for Civil Work in Remaining Loop of Interchanges ROW Land

30. As per LAA 1894, land is considered legally acquired once the land award has been notified and compensation payment has been made. In case of remaining loop of interchanges ROW land, the compensation payment for awarded 22.464 acres owned by 138 DPs in village Jalla Pahore and Umeedgarh (Dinpur interchange) and village 15-V (Kabirwala Interchange- North bound) the left over unpaid DPs will be coordinated for early submission of claims duirng next monitoring period.

31. The findings of field visit are; i) NHA has continued to restrict civil work (Highway Work) to the interchanges ROW for

which the land is 22.464 acres (Dinpur, Kabirwala Interchange (North bound); ii) Whereas available DPs have been fully compensated and validated by the Internal

Monitor for the total 22.464 acres of the cleared land (Dinpur, Kabirwala Interchange – North bound);

32. Furthermore, NHA has been able to make more payment to the DPs in interchange ROW/ portion restricted. Now the situation of the section where payment has been made to DPs and sections are cleared in section III.

33. NHA will request ADB to issue NTP for civil work (Highway Work) to the interchanges ROW of section III for which the land is 22.464 acres (Dinpur, Kabirwala (North bound) Interchanges). The tables identifying interchanges ROW land in which all types of payments have been fully completed to available DPs is given below in Table 3.8 and DPs wise status of payment is provided as Annex 3.12.

34. The updated status reflects that in case of awarded Interchanges ROW land (22.464 acre), overall the reason for delay in payment to unpaid 98 DPs is 10 are deceased and 45 are informed. In addition to this 17 are migrated while disputed cases are 21. The abroad case and underage is 1 each however, 3 DPs identification is in process. The overall villagewise delay in payment status of interchages RoW land (22.464 acres) is shown in Table 3.9:

4. RELOCATION AND CONSTRUCTION RELATED EMERGING LAR ISSUES

4.1 Relocation of Schools

35. Two affected schools including one partialy affected primary school at village Traili and one significantly affected elementary (middle) school at village Shahdat Kandla required relocation. Compensation for land and construction of new building for the schools was deposited in district treasury at the disposal of the district administration for relocating the school of village shahadat kandla. For early completion of land acqusition, tendering and award of civil works for schools a close liasion was maintained with the local administration duirng reporting period. Achieved progress for construction of new school building to relocate school is presnted below.

• Land acquisition of schools: Land acquisition for construction new school buildings has been completed and after land awards for 20 kanal and 4 marla land in May 2017, compensation has already been paid to DPs and the land is mutated in the name of school by local district administration.

• Tender of construction: Tendering/ bidding process for award of civil works for school construction was already completed and civil contracts for construction of new school buildings were awarded in April 2017. Subsequent to contract award, the contractors were mobilized and site possession for construction of new school buildings was handed over in May 2017 by local district administration.

• Commencement of Construction of Schools: The construction works for both schools i.e primary school at Tirholi and elementary school at Shahadat Kandla is continued.

o Elementary School at Shahadat Kandla: Two blocks of school building Shahadat Kandla were to be constructed. Construction of one block has been completed, plaster is completed and after completion this block will be handedover to the school administration by the mid week of January 2017. Construction of second block is continued, walls of building have been completed and shuttering for roof lenter has been done. Construction work is in progress speedily. The contarctor aimed to complete the construction in minimum possible time to ensure schools are ready by November 2017 but still not completed due to some constraints in funds disbursment from district administration to contractor which causes delay.

36. However, the partly retained affected school building are used to continue school service at site and the local governmnet and the contractor have been requested and being followed to ensure that schools are ready and classes are started in new school buildings after December 2017. In this regards, a close liaison and follow-up will be continued with the school administration, disctrict government authorities and contractors in coming quarter.

4.2 Construction Related Emerging LAR issues

37. A 12.2 meter (40 feet) wide land strip is acquired for interchnegs loops carriageway following the detailed design. However, during execution of works in M-4 Shorkot-Khanewal

Section (M-4 Section III) it was identified that the interchanges loops ROW is inadequate to adjust the side slopes for elevated carriageway including approximately 6.5 meter outer side and 3 meter inner side acquired form toe point of interchanges loops carriageway for track for the community to access their farm land on either side of the interchanges loops carriageway. Nonetheless the loops carriageway roads can be completed within acquired ROW by making some design adjustments like retaining walls, managing horizontal and vertical side slopes into 1.5:1 (maximum) and excluding service track on either side of loop carriageway but this will restrict landowners to access their farm lands.

38. Keeping in view the emerging requirement for additional land along interchanges loops in M-4 Shorkot-Khenewal Section (M-4 Section-III), the engineering sections has been requested to finalize design with additional land indicated and marked at site for further assessment and initiating land acquisition process under LAA 1894. The adjoining land owners have been consulted and calrified about need and objectives of additional land strip to be acquired.

39. Section-4/ Gazette notice have been notified for the requisite additional land for interchanges in sections III. Gazette notification/ Section-4 is issued in September 12, 2017 vide letter No. 202/LAC/ADCR on dated August 25, 2017. PIU has been forward letters to respective District Collectors to form DPAC (District Price Assessment Committee) and for price assessment of the required land on priority basis and LAC issued a letter to District Collectors to form DPAC for price assessment vide letter No. 669/2017/Sec-II & III/M-4/NHA/LAC on dated September 27, 2017. After price assessment detailed land measurement survey and census of all affected land owners will be completed and addendum to LARP to address emerged LAR issues will be prepared and submitted to ADB for review and concurrence. A time bound action plan to acquire additional land and finalize the addendum LARP has been finalized in consultation with the engineering staff. Meanwhile the engineering staff has been advised to limit the construction within already acquired ROW ensureing no civil works are commenced in additional land to be acquired unless the acquisition is completed and compensation is paid to the DPs as per ADB’s SPS 2009 requirments. A timebound action plan for acquisition of additional land and prapration of addendum LARP is presented in the Table 4.1.

5. CONSULTATIONS, PARTICIPATION AND INFORMATION DISCLOSURE

5.1 Community Consultations

40. During the reporting quarter, the tasks performed by the LAR management team are discussed below:

5.1.1 Community Consultations with Men and Women Unpaid DPs

41. SSMC has established the displaced persons committees (DPCs) in project affected villages (M-4 section III). The SSMC’s social mobilizers held consultation meetings with men and women in project villages (Section III) during this quarter (as of 31st December 2017). The purpose of these meetings was to inform and facilitate DPs in the process of payments to unpaid DPs, addressing their concerns/ complaints, information disclosure and facilitation in preparation & submission of claims for payment and collect updated status of DPs and to find out contact numbers & addresses of DPs who are out of the project area.

42. SSMC social mobilizer conducted total 89 (59 Men, 30 Women) consultation meetings were held in which total 464 (365 Men, 99 Women unpaid DPs participated) DPs, members of DPCs, and local community residents were contacted in affected villages to assist/ motivate DPs in preparation and submission of compensation claim for payments of their acquired assets and also consultated with the DPs of meager amounts, the DPs were also informed about grievance redress mechanism and role and functions of DPCs were elaborated during consultations. Table 5.1 below summrizes the consultations carried out during reporting period and List of consultation meetings with both men & women and participants is given in Annex 5.1 & 5.2.

43. During consultation meetings, discussed issues concerns and their responses are given below in the table 5.2:

Compensation entitlement concerns among DPs about land occupied due to Quarterly distribution of family owned assets without getting land record updated accordingly.

The PIU/ SSMC will continue coordinating with DPs to motivate and mobilize them to approach land revenue authorities for resolution of land record updating issues as soon as possible so that the payment could be disbursed as per their entitlement in acquired land parcel.

DPs entitled to meager amount are not showing interest to get their compensation. The SSMC will keep coordinating and motivating such DPs to prepare file and to get compensation payment.

Issue on inheritance mutations: In some cases, legal heirs are disinterested to record inheritance mutation due to meager compensation amounts or lack of coordination/ cooperation among themselves which is causing delay in payment of compensation.

The PIU will coordinate and request the land revenue authorities to facilitate DPs for recording inheritance mutation in record, however, the legal heirs of the DPs will have to submit request for mutation and follow the procedures under law. The compensation payment could only be paid when legal heirs of deceased DPs can submit

their claims with valid title after inheritance mutations of land.

Migrated DPs Population in affected villages of section-III is scattered in small hamlets and many DPs have been shifted to other places. Locating DPs who are not living in project affected villages is time consuming. The addresses and contact numbers of DPs are gathered through village headmen/ notable persons and their relatives in the village but in some cases local community lacks addresses and contact numbers of migrated families. Through SSMC efforts will be

5.3 Consultation plan for the succeeding quarter

44. Tentative Community consultation/ mobilization plan for next quarter: The PIU and SSMC will continue consultation in all identified villages to facilitate processing of claims, delivery of compensation for land award and R&R allowances in all project villages. Under the supervision of a resettlement specialist, two teams of social mobilizers will follow the work plan given in Table 5.3 to undertake the consultations with unpaid DPs in various villages in the next quarter as of March 2018. The DPs will be guided on the submission of claims and supporting documents. DPs with legal and administrative impediments will be identified, and certification statements and whereabouts of DPs will be recorded. Details of the consultation will be presented in next internal monitoring report as of March 2018.

5.4 Internal and External Coordination meetings to Facilitate Compensation Payment

45. SSMC team coordinates with revenue department, contractor through PIU regularly and ensures payments consistent with entitlements, construction related emerging LAR issues and changes in DPs data. During this quarter (as of 31st December 2017) 17 meeting between NHA and Revenue Department and other official were facilitated by SSMC. Highlights of these meetings are given in below Table 5.4.

6. GENDER ISSUES/ ANALYSIS IN LARP IMPLEMENTATION

6.1 Gender Segregated Consultations with the Unpaid DPs

46. During this Quarter (Oct. – Dec. 2017) total 89 consultations in Section III were made with unpaid DPs consisting of men and women by the men and women social mobilizers, wherein 464 DPs/ members of DPCs/ DPs as well as local community participated. The main focus of the discussion was to consult those unpaid DPs for the collection of their amount and in case of any issues related to inheritance or ID card the DPs were advised to address it immediately, so that the payment could get cleared. Gender segregated summary of community consultation DPs are given in Table 6.1.

47. The main activities of these consultations were the following

- Information disclosure to the unpaid payable DPs regarding the process of payment. - Identification of issues and grievances regarding the payments of compensation, mode of

payment. - Assessment of the impacts of the project. - Determine the solutions to resolve the issues and concern of the DPs on village level

related to the payment.

48. The DPs actively participated in these consultation meetings and ensured that they would try their level best to contact untraced unpaid DPs and motivate them to collect their compensation amount.

49. Review of gender issues/ and analysis associated with the LARPs Implementation including:

• Payment of compensation by gender

• Gender segregated grievances

• Gender segregated issues associated with the project, such as restricted mobility, eligibility & entitlements, income/ livelihood restoration

50. A strategy to address the gender segregated LARPs (Section III) implementation issues in compliance with ADB's Gender Policy, has been prepared. Women social mobilizers are locating Unpaid DPs (women) in this regard, Initial and consultation meetings with women DPs for DPC formation are being conducted. During this quarter (as of December 31, 2017) 30 meetings have been conducted in project villages and 99 women participated in the meetings. Many women’s DPs are settled out of village after their marriages. Detail of participants in sections (III) has been presented in Annex 5.2.

6.2 Project impact on Women Mobility and Privacy

51. At this stage, there is no as such major impact recorded regarding women mobility and privacy in the project area due to project activities..

6.3 Gender Issues/ analysis in LARP Implementation

52. At this stage, there is no major impact recorded regarding gender issues particularly regarding women’s.

6.4 Issues relating the Payment of Compensation to unpaid DPs

53. These are the main issues relating the payment of compensation:

• Women unpaid DPs are migrated from villages and settled in other villages after their marriages.

• Some women’s DP’s families have been shifted to other villages.

• Some women’s DPs have no CNIC.

• Some women’s DPs are under age.

7. GRIEVANCE REDRESS MECHANISM AND COMPLAINTS HANDLING

54. During this quarter, no new complaint was received.

55. Below GRC recommended actions for remaining 4 complaints including 3 complaints on land measurement, 1 complaint about payment of residential structure are being followed.

� Measurement of Land: 3 Complaint of land measurement is in process.

� Payment residential structure: During last quarter, fact finding report was prepared and verification of structure was also done. Case was discussed in GRC meeting and was found genuine. So file/ case had been forwarded for issuance of cheque in the office of Director Account M-4 Lahore is in process. Although, the complaint is resolved technically, however, in table below it is counted in pending complaints and will be reflected in resolved column after delivery of compensation cheque.

56. Status of complaints received, resolved and pending upto 31st December 2017 has been presented in the Table 7.1.

8 CONCLUSIONS AND RECOMMENDATIONS

8.1 Conclusions

57. The awarded land for the project has already been acquired under the LAA in the project affected villages of section-III. On the whole, total amount of compensation of land (Rs. 1473.738 million) was to be paid to 6,484 DPs, out of which, an amount of Rs. 1363.21 million has been paid to 4,693 DPs on account of payment for the loss of land, acquisition of 21.9 acres of land owned by 136 DPs in two villages for Abdul Hakeem interchnage and Kabirwala interchange award announced by October and November 2017. Out of which, an non-land payment Rs. 253.832 million (89.7% of total amount) has been paid to 1,639 DPs (80% of total DPs) on account of payment for the loss structures, community structures, crops and trees. The achiveed progress in delivery of entitlled R&R allowances represent that 80.9% of entitled allowances cost has been disbursed to entitled DPs. Meanwhile the DPs with impediments are being approached to record additional documents and assist them in delivery of compensation as and when they show-up after resolving their issues.

58. Two blocks of school building Shahadat Kandla were to be constructed. Construction one block has been completed, plaster is completed and after completion this block will be handedover to the school administeration by the mid of January 2018. Construction of second block is continued, walls of building have been completed and shuttering for roof lenter has been done. A close follow-up is continued for early compeletion of constrcution and shifting of classes of new school buildings.

59. Progress on timed action plan for emerging land need at interchanges represent that the timelines for marking additional land along interchanges loops and finalize addendum LARP are being followed. Achieved progress on differnet activities and revised/ updated timles are discussed and provided under section 4.2 of the report.

8.2 Recommendations

60. The following actions will be initiated or continued to facilitate the completion of all pending compensation payments:

• Demarcation of Additional Land Acquired for interchanges: PIU will coordinate and assist the LAC to complete the process of demarcation of additional land acquired for interchanges..

• Pending Payment of Allowances and DPs with Legal and Administrative Impediments: PIU and SSMC will maintain in close liaison and shall continue their outreach activities to mobilize and assist DPs in processing of their claim files and payment of entitled allowances. During field visits, additional documentation for DPs with different categories of impediments will be recorded.The PIU staff will also increase coordination with LAC/ Revenue staff Sec-III to boost up payment process.

• DPs living out of project area with country or overseas. With assistance of the locals and village notables, efforts will be continued to record wherabouts of DPs living out of project area, approach and coordinate with DPs (where ever possible) for recording additional documents and mobilizing them to show-up for submission of claims. In case of DPs whose whereabouts are unknown, the certification statement form village notables will be recorded.

• DPs with Inheritance Mutation issues: The efforts will be continued to ccordinate with legal heirs of the DPs to record certification statements and mobilizing them to get their inheritance mutation recorded in the land records. Meanwhile, the legal heirs will be assisted for early inheritance mutations in land record and delivery of compensation as and when they come-up with valid title documents as per recorded mutations.

• Underage (Juvenile) DPs: The efforts will continue to approach and guide elders/ natural guardians of underage DPs for getting legal guardians certificates to receive compensation. Meanwhile statements will be recorded confirming DP’s understanding that compensation will be made when they come-up with the required legal guardian certificate.

• DPs with meager compensation amounts or lack of interest to take compensation: Efforts will be ensured to motivate DPs to submit compensation claims with the required supporting documents. For DPs who are unwilling to claim meager compensation amounts, statements to that affect will be recorded from willing DPs.

61. For timely compeletion of the new school buildings and handling of emerging land acquisition for interchnages loops carriageway follwing actions are recommended.

• The PIU PD and Engineering staff will closely laise with the District Administration, Education and Buildings Departments of Khenewal and the contarctor enagaged by District Buildings Department Khenewal for timely completion of school buildings to ensure the classes can resume in new school buildings by January 2018.

• A time bound action plan to acquire additional land and finalize the addendum LARP has been finalized in consultation with the engineering staff. Meanwhile the enginnering staff has been advised to limit the construction within already acquired ROW ensureing no civil works are commenced in additional land to be acquired unless the acquisition is complete and compensation is paid to the DPs.
