Are Unpaid Internships Legal?1. The internship, even though it includes actual operation of the facilities of the

employer, is similar to training which would be given in an educational environment; The internship experience is for the benefit of the intern;

2. The internship experience is for the benefit of the intern;

3. The intern does not displace regular employees, but works under close supervision of existing staff;

4. The employer that provides the training derives no immediate advantage from the activities of the intern; and on occasion its operations may actually be impeded;

5. The intern is not necessarily entitled to a job at the conclusion of the internship;

6. The employer and the intern understand that the intern is not entitled to wages for the time spent in the internship

Recently the Supreme Court looked to six factors in deciding whether a work program was for the intern’s own educational benefit or the advantage of their employer

Unpaid Internship Summary

Many argue that the 6 legal criteria require updating as they are based on a Supreme Court decision from 1947, at a time when many internships/apprenticeships were for blue collar production workers. However as of now, these criteria present a situation very difficult to comply with and “For-Profit” companies should be especially cognizant of regulations with some unpaid internship lawsuits in recent years

According to NACE “the average hourly wage rate for interns at the bachelor’s degree level is $16.26”

Which is .3 percent higher than last year ($16.21)

For those with a master’s, the average is $21.90Which is .1 percent lower than last year ($21.93)
