1 Introduction

1.1 What is an interest? An Interest can be described as:

‘anything that may effect the use and enjoyment of land, which has some form of governing legislation or regulation and has a defined custodial government agency for the provision of information about the Interest’

Interests are commonly referred to as rights, restrictions and obligations. ‘Heritage Sites’ is one example of a type of Interest that impacts the use and enjoyment of land and can be restrictive or beneficial in nature.

1.2 Are all Interests recorded on the Certificate of Title? Some Interests affecting land are recorded on the Certificate of Title. However, there are many types of Interests that are not being recorded on the Certificate of Title.

As these Interests are governed by a variety of agencies, to date, this has meant industry has had to spend large amounts of time asking individual government agencies about Interests affecting land by phone, fax or email.

Landgate has been working with government agencies to bring you as much information on Interests affecting land as possible through a single online location, Interest Enquiry.

Interest Enquiry can now provide you with access to interest information from across government.

1.3 What is Interest Enquiry? Interest Enquiry provides you with a quick and convenient tool to search for information about interests affecting land in WA.

Not only does it help you to identify which interests affect your area of interest but also allows you to obtain information on who from government to contact for further clarification.

Interest Enquiry will allow you to:

Search and locate a parcel of land using basic and advanced searching techniques

Identify Interests impacting your selected area of interest

View interests covering your area in a mapviewer

Order Interest Reports providing you additional information on how an interest affects a particular area of interest

Identify the Custodian responsible for the Interest for further follow up

1.3.1 Benefits of Interest Enquiry Use Interest Enquiry to:

Save time By using Interest Enquiry as the initial search tool you can first establish if an Interest type exists and where go for further clarification and details.

Be informed Read about Interests and understand how they could affect land

Quick Update Check regularly and quickly for any updates or additions to Interest Enquiry by using the ‘My Preferred Reports’ feature.

24/7 Access Through our My Landgate website, Interest Enquiry provides you with access to interest information outside of business hours.

1.3.2 Are all Interests available through Interest Enquiry? Given the number of government and non-government agencies that look after Interests, the number of Interests that could possibly affect land and the amendment of existing or creation of new legislation, Interest Enquiry can not provide a definitive list of all Interest Types in Western Australia at this time.

Interest Enquiry provides a great starting point to understand and obtain online information relating to Interests affecting land in WA, all form a single location - a service that previously has not been available to industry.

Landgate will continue to work with government agencies and in doing so will update Interest Enquiry accordingly. Updates will occur not only when information is verified but also as more Government agencies and later non-Government agencies become involved and share their Interests with us.

1.3.3 How accurate is the information? Interest Enquiry accesses information direct from Custodians databases. This means that we have access to information as and when they update it.

Each Interest Report is approved for release by the Custodians.

Note: Content displayed is sourced direct from agency data and has been verified for accuracy by those agencies.

Interest Enquiry will be continually updated, so make sure you check regularly for the latest updates!

1.3.4 What is a Custodian? Many government agencies are responsible for Interests and the maintenance of interest information pertaining to land. We refer to these agencies responsible for interests as Custodians.

Custodians have a vested interest in managing Interest information. This is generally performed through acts of legislation or policy and can cover both local and state jurisdictions.

Landgate has been working with agencies in obtaining information on the Interests they govern, for use in Interest Enquiry. This information is accessed directly from the custodian’s database.

Note: Questions relating to Interests should be directed to the relevant Custodian.

The Interest Dictionary will provide further information as to who to contact in order to obtain further details.

1.3.5 Products and Interest Reports Interest Enquiry provides you with an ability to obtain written information on how an Interest affects a specific property or area of interest. This confirmation comes in the form of products/Interest Reports.
