EU Financing for Broadband Infrastructure Projects 2014 - 2020Broadband Infrastructure in Europe – A New Key Priority for Growth TheEUprovidesmultiplesourcesoffinancingforbroadbandprojects,informofvarious

EU funds as well as European Investment Bank instruments. In the programming period

2014-2020, broadband projects are not solely supported via European Structural and

Investments Fund (ESIF), including EAFRD and through the Connecting Europe Facility

(CEF). Particularly the new and powerful European Fund for Strategic Investments (EFSI)

is aiming to boost broadband infrastructure development and networks to a higher level

through new sources of direct investments. As part of the ‘Juncker Plan’, broadband

infrastructuredevelopment isasignificantkeyfactorwithintheCommissionpriorityof

creatingaDigitalSingleMarket(DSM).Theapplicationprocessvariessignificantlywithin

therangeofthesenewfinancingopportunitiesandrequiresahighlevelofexpertiseof

all stakeholders involved.

Moreover, the European Commission adopted new State aid regulations. The General

Block Exemption Regulation (GBER) frees broadband infrastructure projects from

therequirementofpriornotificationtotheCommissionunderspecificconditions.This

simplificationwill fosternewinvestmentsandhastobetakenintoconsiderationwhile

assessing and selecting different funding opportunities in the future. The comprehension of

the changes in the regulatory framework and guidelines is absolutely necessary to ensure

the success and effectiveness of the approval application as well as the implementation

of broadband projects.

V./Federation of German Industries) in Berlin. Between 1999 and 2000, he was Private Secretary of the President of the EPP/ED-Group, Prof. Dr. Hans-Gert Pöttering, in the European Parliament. From 1998 to 1999, Dr Robert Henkel was Assistant to the Director General of the Joint Research Centre (JRC), Herbert J. Allgeier, and member of the Cellule de Communication in Brussels. He was Assistant to the Deputy Director General Hendrik Tent in the European Commission in the Directorate-General Science, Research and Development for 3 years. In this position, he had

Before that, he was Deputy to the Chief Economist and Case Handler, responsible for different economic sectors within DG Competition and worked for DG TRADE (1993-1997) and DG INFSO (1991-1993). Dr Oliver Stehmann has a Ph.D in economics

Harald GruberHead of Division, Digital Economy and Education (DEE), Projects Directorate, European Investment Bank (EIB)Harald Gruber is Head of the Digital Economy and Education (DEE) Division at the Projects Directorate of the European Investment Bank. He oversees project appraisal in the telecommunication sectors and advises on the Bank’s business strategy with respect to the telecommunications sector and the knowledge economy in general. Furthermore, he is on the editorial board of Telecommunications Policy and Information Economics and Policy and co-authors articles on the mobile telecommunications sector in several scholarly refereed journals such as Economic Policy, European Economic Review and International Journal of Industrial Organisation. He has also been Professor at Bocconi University (Milan) for telecommunications economics.

Crister MattssonSenior Advisor, Acreo Swedish ICT, Official Expert to the European Commission, Sweden Crister Mattson is a Senior Advisor at Acreo Swedish ICT. Crister Mattsson specialises in broadband strategies for public sector, including policies and business models. He is engaged as advisor to regions, municipals and European organizationsandisofficiallylistedasexperttotheEuropeancommission.HewasinvolvedinthedevelopingtheDigital Agenda 2020 and is one of the authors of the Guide to High-Speed Broadband Investment by the European Commission. Prior to Acreo, he was Senior Advisor at Ericsson, and before that, Market and Information Director at STOKAB, the municipal network organisation in Stockholm. He also is the former Director of the Sweden Broadband Alliance. Crister Mattsson has participated in several other research projects such as the recent OECD study of the role of municipals in the development of high speed networks.

Elizabeth HarrisonProgramme Director, Kent Broadband Programme, Kent County Council, United Kingdom Elizabeth Harrison is the Programme Director for Kent County Council’s broadband programme and has over 15 yearsofexperience inworkingacrosstheregeneration,digitaland infrastructureagendas.ElizabethHarrisonis responsible for leading the Council’s broadband upgrade programme, which has already delivered superfast broadband access to over 120,000 homes and businesses through a variety of different approaches – including projects that have worked with communities on locally driven solutions. Prior to leading the Council’s broadband work, Elizabeth Harrison managed a number of EU funded rural development programmes, including LEADER – and has been particularly keen to bring the learning from these schemes into the Council’s broadband work.

Joakim HolbackHead, Office for Broadband and Digital Agenda, Dalarna County, SwedenJoakimHolbackhasbeenmanagingthenewlyestablishedOfficeofBroadbandinDalarnasince2012andhasdevelopedamodelforthedevelopment,informationandfundingoffiber-basedbroadbandinDalarna.Hehasalsorun a project to facilitate the deployment of mobile broadband in Dalarna by including smoother decision making. Earlier, Joakim Holback has worked as a Business Developer at one of the big four consultancies and as IT / metro network manager in Mora municipality.

Vladimir MakucDirector, Belavita d.o.o, SloveniaVladimirMakuc is Director of Belavita d.o.o. and has over 15 years of experience in regulatory affairs in thetelecommunications sector. Since 2000 he had been working for one of the most successful Slovenian alternative operator. He worked as Carrier Relations and Regulatory Affairs Director before he became independent. In the last fiveyearshehasbeenconsultingaserviceproviderwithwhichhehasbeeninvolvedinnumerousnegotiationswithall major Slovenian white area network operators. He has been dealing with municipalities, ministry responsible for broadbandandNRAinordertooptimisefinancingandrelationsbetweenmunicipalities,whiteareanetworkoperatorsand service providers.

Terms & Conditions for Conferences, Seminars and other Training Courses1. Area of ApplicationThefollowingtermsandconditionssettlethecontractualrelationshipbetweenconferenceparticipantsandtheEuropeanAcademyforTaxes,Economics&LawBraunerKlin-genbergGmbH[referredtoas“EuropeanAcademyforTaxes,Economics&Law”inthefollowing].Differingtermsandconditions,aswellas,othersettlementsand/orregulati-ons have no validity.

2. Registration / Confirmation of ApplicationAregistrationcanbemadeviainternet,mail,fax,oremail.TheregistrationisconsideredgrantedandlegallybindingifnotrejectedbytheEuropeanAcademyforTaxes,Eco-nomics&Lawinwritingwithinseven(7)daysafterreceiptofregistration.Theregistrationwillbesupplementedbyabookingconfirmationviaemail.Partialbookingsareonlyvalid for seminars designed in modules.

3. ServiceThe course fee covers the fee per participant and course in € net, subject to current German VAT. It includes training course documents as per course description, a lunch meal/snackandrefreshmentsduringbreaks,aswellas,aparticipationcertificate.TheEuropeanAcademyforTaxes,Economics&Lawhastherighttochangespeakers/instructorsandtomodifythecourseprogramifandwherenecessarywhilemaintainingtheoverallnatureofthecourse.Allregisteredparticipantswillbenotifiedincaseofacoursecancellationduetoforcemajeure,duetospeakers’preventions,duetotroublesatthechosenlocationorduetoalowregistrationrate.Coursecancellationnotificationduetoalowregistrationrateisissuednolaterthantwo(2)weeksbeforethecoursedate.Coursefeesarereimbursedinthecaseslistedabove;however,reimbursementfortravelexpensesorworkabsenteeismisonlygrantedincasesofintentionorgrossnegligencebytheEuropeanAcademyforTaxes,Economics&Law.Anyreimbursementoftravelexpensesaretobeconsideredasanexceptionalgoodwillgestureandformnofuturege-neralobligation.Incaseofdisturbancesand/orinterruptions,theEuropeanAcademyforTaxes,Economics&Lawcommitsitselftosolveorlimitanyproblemsthatmightoccurin order to maintain and continue the course as planned.

4. Payment Date and Payment, Default of PaymentPayment of the course fee is payable immediately upon receipt of invoice. Where payment is not received or lacking clear assignment to a participant prior to commencement of thecourse,theEuropeanAcademyforTaxes,Economics&Lawmayrefusetherelevantparticipant’sparticipationinthatcourse.Thecoursefee,however,isstilldueimmedia-tely and can be claimed as part of a dunning procedure or legal action. In accordance with BGB §247 (1), in case of default of payment within the stipulated time period, default interestonarrearsofatleast5%abovetheECBbaserateisdueandpayable.TheEuropeanAcademyforTaxes,Economics&Lawcanclaimhigherdamagefordelayifandwhereproven.Equally,theparticipantmayprovethatadamagehasnotoccurredorhashadlesseffectthanestimatedbytheEuropeanAcademyforTaxes,Economics&Law.

Paymentshallbemadebycashlessbanktransfer;cashorchequeswillnotbeaccepted.TheEuropeanAcademyforTaxes,Economics&Lawisnotliableforanylossofmeansofpayment.TheparticipantmayonlyoffsetsuchclaimsagainsttheEuropeanAcademyforTaxes,Economics&Law’sasareundisputed,legallyrecognizedorrecognizedinwritingbytheEuropeanAcademyforTaxes,Economics&Law.Therightofretentionisonlyacceptableinaccordancewithacounterclaimbasedonthesamecontract.

5. CancellationCancellations need to be issued in writing. Cancellation by the participant will be subject to cancellation charges as follows:• 30 days or more prior to commencement of the course: service charge of 80,00 € net, subject to current German VAT, payable immediately, course fee will be reimbursed,• two(2)weeksto30dayspriortocommencementofthecourse:50%ofcoursefeenet,subjecttocurrentGermanVAT,payableimmediately,• non-attendanceorcancellationlessthantwo(2)weekspriortocommencementofthecourse:100%ofcoursefeenet,subjecttocurrentGermanyVAT,payable immediatelyTheEuropeanAcademyforTaxes,Economics&Lawgladlyacceptswithoutadditionalcostsasubstituteparticipantnominatedincaseofacancellationifthesubstituteparti-cipantisregisteredatleastthree(3)dayspriortothecommencementofthecourse.Neithercancellationofaspecificmodule/partofthecourseorsubstitutionpermodule/perday is possible.

6. CopyrightSeminar/course documents are protected by property rights and may not be duplicated, processed, amended, circulated or published in any other way without the written con-sentoftheEuropeanAcademyforTaxes,Economics&Law.TheEuropeanAcademyforTaxes,Economics&Lawreservesallrights.

7. LiabilityAllseminarsandcoursesarepreparedandpresentedbyqualifiedspeakersandinstructors.TheEuropeanAcademyforTaxes,Economics&Lawacceptsnoliabilityfortheup-to-dateness, correctness and completeness of the seminar documentation, as well as, presentation of the seminar.

8. Applicable Law, Place of Jurisdiction, Place of PerformanceAllcasesshallbegovernedandconstruedinaccordancewithGermanlawtotheexclusionoftheUNSalesConvention.Asfaraslegallyadmissible,placeofperformanceandplaceofexclusivejurisdictionshallbeBerlin,Germany.

9. Data ProtectionTheEuropeanAcademyforTaxes,Economics&Lawprotectspersonaldatabytakingappropriateprotectionmeasures.Forthepurposeofoptimizationoftheproductandser-viceportfolioandaccordingtotheregulationsofthedataprivacylaws,itstoresandprocessesperson-specificdataonthetrainingparticipants.Hence,allEuropeanAcademyforTaxes,Economics&Lawwebsitehitsareregistered.Allpersonaldatawill,inaccordancewiththelaw,beusedfordocumentationrequests,placedordersorotherenquiriesin order to send information out by post.TheEuropeanAcademyforTaxes,Economics&Lawwill,inaccordancewiththelaw,informparticipantsbyemailaboutspecialoffersthatresemblepreviouslybookedsemi-nars.Ifandwherepersonaldataneedstobetransferredtocountrieslackingappropriatedataprotectionschemes,theEuropeanAcademyforTaxes,Economics&Lawshallgrantalternativeadequateprotection.Furthermore,theEuropeanAcademyforTaxes,Economics&Lawwillusepersonaldataasfarasparticipantshavegrantedrespectivepermission.Whencollectingpersonaldata,theEuropeanAcademyforTaxes,Economics&Lawwillalwaysaskforpermissionregardingemailinformationaboutoffers.Theparticipantmay,atanytime,expresstheirobjectiontodatacollectionforthepurposeofadvertisementoraddressviaemailorfax.AnydataprovidedtotheEuropeanAcademyforTaxes,Economics&Lawwillbeprocessedforreservationsandbookings,aswellas,forinformationaboutotherseminars.Namesandcompanynameswillbepublishedina participants’ list and forwarded to the mailing company.
