As anticipated in the last edition, during May and June this year, two new vessels entered the Premuda’s family: Four Nabucco and Four Otello.
Welcome then to the new “babies” and good luck, calm seas and winds!
This number is introducing the concept of the best practice. The term, commonly used in the quality systems, is becoming more and more familiar in our system too. The general definition of “best practice” is processes that represent the most effective way of achieving a specific objective.
For “process” is generally intended the general concept of carrying out tasks or doing work.
Best practices serve as a general outline for a variety of situations. For instance, in the service process, a list of best practices may be given to people working in the process, highlighting the most efficient way to complete their tasks.
Safety too can be improved through individuated and divulged best practices.
Part of the challenge is to identify practices that are not widely visible. Often the better practices are carried out by individual or teams: a certain effort will then be necessary to individuate the best practices we can encounter and dissemi-nate them among our fleet.
The vetting section is deeply analyzing the re-cent vetting failures: nevertheless to say that failing a MOC approval during a low market pe-riod is creating huge problems, with Charterers having great chances to invoke the breach of the Charter Party provisions.

A “special passenger”!
The premises of the two analyzed cases are different: the first event came out from a planned operation, while
the second case was due to an unauthorized inspection performed by an oiler. Anyway, probably, the main
cause of both occurrences, as evidenced by the analysis, was a lack of working standard. In particular the un-
dervaluation of a very common operation: a fixed ladder climbing.
The analysis carried out for the two cases kin object pointed out the correct best practice for the use of fixed
ladders, highlighting in particular the 3-points contact technique. Other specific items should be taken in con-
sideration with regard to safe use of fixed and portable ladders and discussed during crew safety meetings:
• Portable ladders usage – Position your ladder in the safest location possible; it needs a solid, level base.
The ladder should be set at a 75 degree angle and secured at bottom and top. ...continued on page 3

It should extend the side rails at least 1 mt. above the upper level and the area must be clear of hazards.
• Ladder inspection – Check for cracks, bends, splits or corrosion. Check all rungs and step connections. Make
sure the ladder’s feet work properly. Make sure all bolts and rivets are secured. Make sure steps, rungs and
other ladder parts are free of oil, grease and other materials. Make sure rung locks and spreader braces are
working.
• Ladder’s choice: when the use of a portable ladder is required, length and material of ladder should be evalu-
ated with regard to required workload and the requirement of work going to be performed.

The incident has been deeply analyzed due to
the impact resulted from it to the activities of
the ship and required almost three months to
be closed. As consequence of the incident a
“Vetting Inspection” was cancelled, with poten-
tial consequences on commercial side and
several members of the crew were employed
in cleaning operations for about three days
with a significant increase of their workload,
also considering that the ship was engaged in
close range operations.
The analysis pointed out two main causes for
the incident:
• the safety seal located in pump room
was modified relative to its original
shape. In particular, the transparent level
gauge was removed (probably due to
some break) and never replaced with a
new one and nobody realized that it was
missing. The lack of the level gauge to-
gether with an infrequent use of the line
in object, caused a lack of attention to-
wards the safety seal.
• The vacuum breaker valve placed on top
of the seal was found in very bad condi-
tion, as consequence of a completely
missing maintenance.
In few words, the component was completely
forgotten and after more than three years re-
minded us its existence with the incident in
object.
The present case should be taken in consi -
deration by all tankers as a guidance to make
a check of the bilge/sludge line from E.R. to
slop tank, with particular attention to the non
return seal (required by MARPOL) and to its
components (level gauge and vacuum breaker
valve).

The incident in object is rela-tive to an injury happened during a so-called “routine job”. Topics to be pointed out for this occurrence are the followings:
• Also routine jobs are to be considered as a source of potential hazard and are to be treated with an assess-ment of possible risks and adopting necessary meas-ures according with results of carried out analysis. Of-ten, the familiarity with such operations, deter-mines a low level of atten-tion, with a substantial in-crease of incidents.
• It must be considered the importance assumed by Personal Protective Equip-ments for the occurrence in object. In the analyzed case, the correct wearing of leather gloves, dramatically reduced the physical con-sequences of the incident, downsizing it from a possi-ble partial amputation of a finger, to a wound that was possible to suture.
Studies conducted on arc flash incidents, occurred dur-
ing welding ( Electrical Safety Workshop in St. Louis, February 2009 ) , demonstrate that
where the risk assessment took in consideration PPE, the percentage of incident having as a consequence physical injuries were 60%; on the contrary when PPE weren’t considered by risk assessment process, the percentage raised to 83%.

On tankers, in the Charter Parties for Time Charter Periods, it is always present a top important clause: the vetting clause. As everyone can easily understand, the compliance to the clause is not of easy management.
The clause is issued in various and different terms, but basi-cally all are stating—more or less—as follows:

The clause is severe and probably non in perfect alignment with the actual shipping industry requirements for vetting by Major Oil Companies (OCIMF) and SIRE System: however, it is the clause that, when inserted in the CP, we have to follow and to comply with.
Particularly in case of long T/C, when the market, for any rea-son drops down and the charterers are paying over it, all op-portunities to create problems and reasons to withdraw the Charter Party or to put the vessel off hire is welcomed for char-ters.
Unfortunately, during this last period, one of our good ladies incurred in such unpleasant situation.
The Four Island, employed in a long T/C, unfortunately failed two consecutive vetting inspections (details in the relevant section of the Vetting Issues): thus, the vetting status of the vessel was no more complying with the pertinent CP clause.
Vessel was like a bare lady, like a nice piece of steel still float-ing but useless. This is surely the worst scenario for a ship: to be not able to serve the scope she was built for: make traffic, transport goods from one place to another place, be commer-cially suitable.
Our Company instantly received a message, very short one, clearly stating vessel would had been considered off Hire and
out of service till the conditions would had been restored and vessel was again complying to the CP clause.
The very s e n s i t i v e situation required an immediate involvement of our P&I Club and lawyers in order to find any potential escape and get enough time to organize the good lady conditions and a new inspection by a Major Oil Company.
Vessels and Company passed few months in a critical situa-tion, being always in Charterers hands and intention, while waiting for vessel’s employment in order to understand that at least for the duration of the employment, the risk was mitigated … and start again to be under the frustration of Charterers threat to put the vessel off hire when vessel was again unfixed. Our legal counsels worked well in order to tone down and mitigate the consequences, by looking for any way, even the narrowest and disputable ones.
A sort of fighting took place and really vessel was in a hurri-cane.
Finally, a MOC inspection was organized and vessel passed the examination and was defined to be acceptable for busi-ness. This created a new SIRE report accessible to all OCIMF members and , Company successfully showed the right com-mitment and compliance with CP terms. As consequence of this positive and good SIRE inspection report contained in the OCIMF program, some other MOCs confirmed the ves-sel’s acceptability…then, in a very shot time, the Hurricane passed and vessel escapes from the threat of Charterers penalties. This is not surely the place where to analyze the occurrences: in this section, we have to highlight that the commercial impact could be really massif and nasty in case of non compliance with this sensitive CP clause.
All operators on board and ashore should be aware and stay in alert, not only for the technical questions related to the vetting result, but also for the thoughts to the severe conse-quences in commercial terms.

Following the good period since 08/2009 (Four Island nega-tive inspection with BP 28/08/2009 in Singapore) but gen-erally more than 2 years with excellent results, the alarm/advise sent in the last quarter report came actual with the worst period under my management, so since 2002.
Main negative issues I want here to briefly underline are the following:
• Extreme bad performancebad performancebad performancebad performance, two consecutive failures two consecutive failures two consecutive failures two consecutive failures BP/SHELL of the vessel Four Island after the 15th years Spe-cial Survey and CAP completed by 01/2010.
• Notwithstanding the validity of the approval achieved by positive SIRE done in New Mangalore on 15/03/2010 and with 6 month validity, BP didn’t accept the Four Bay for a voyage to be completed within July with Certificates expiring at 31/07, due to the fact that vessel was reach-ing 15 years of life on 15/07 and no CAP was available. To be added on top of this picture the matter had in Pump Room causing the not possibility to perform the already scheduled inspection with SHELL. The two matters summed created the very difficult possibility to fix the ves-sel for last voyage before repairs, causing the matter to arrive to repairs without a valid SIRE and so the needing to perform a SIRE quite immediately after repairs com-pleted with all the problems related. Even with CAP organi-zation, we missed the Class inspection with vessel under discharging
• It was decided to submit the M/V Four Moon to a SHELL SIRE inspection to verify status of vessel readiness in terms of an International market. As everybody knows the vessel is employed in Caribbean sea with Italian/Cuban crew and not performing SIRE inspection since 2007. For any SIRE failure was issued a Company Analysis, here enclosed and we strongly recommend to all to carefully read and study analysis detailed over there. As a PRECISE ADVISE PRECISE ADVISE PRECISE ADVISE PRECISE ADVISE coming out mainly from the Four Is-land BP and Four Moon failure, SIRE Inspectors raised the acceptability level of safety on respect of any possible leak-age in ER and PR. Any pre-inspection should be extremely careful in detecting any possible problem, leakage or dirty, and immediately address the corrective action, temporarily and final one, locally or through Technical Dept. Management .
In fact the four observations raised in Chapter 11 highlight
a vessel condition in terms of cleaning and safety com-
pletely NOT acceptable for the Company standards and for
a SIRE Inspector. This in addition to a general poor picture
in terms of general maintenance is automatically leading
the vessel to SIRE failure.
Observations 11.22 – 11.23 and 11.36 have been raised
to NCR in accordance with WIN-TEC 31 on Vetting Process

As a quick conclusion although our reply to OCIMF address-
ing the two high risk matters in terms of root cause analysis
and corrective action the two questions added probably to
remaining items leaded to the negative assessment.
Vessel was at the first Vetting SIRE after performing Special
Survey n 3 with CAP done in Batam, Indonesia and com-
pleted in January 2010. Due to correct planning and in con-
sideration last SIRE performed with SHELL in Singapore on
06th November 2009 with # 13 observations but with posi-
tive assessment, the Ship Staff got enough time to prepare
the Vessel and Crew to the SIRE task.

the cause of the failure or which of the observations
caused the vessel rejection; no High risk deficiencies were
mentioned as well. The only memo well underlined is that as
per SHELL policy vessel will be not re-inspected before a
period of six (6) months to be utilized for reviewing all and

To continue with the guidelines for steel cargoes carriage, the following checks should always be taken:

• Read any eventual instruction your Company may have on the steel cargo carriage and all useful publication available on board.
• Avoid stowage in spaces without parallel sides but when this is unavoidable and frequent loadings are expected, arrange for the space to be permanently “squared off” with a steel buttress or heavy duty timber.
• Mark the holds strong points, such as solid floors, on the tank top. Extend the marks up the hold sides. These are the best load bearing positions. Marking them will make it easy to check whether cargo and dunnage is correctly positioned during loading.
• Find out in advance the proposed loading plan. Check whether the best, rather than the easiest, stow is pro-posed. If loading steel coils, check that key coils are cor-rectly positioned. Consider the probable bad weather to be encountered during the voyage.
• Enquire into the proposed method of stowing and secur-ing cargo. Meet with the stevedore superintendent and/or supercargo to discuss the loading plan. Use this as an opportunity to point out any limitations with the ship or its equipment.
• Steel should not be loaded in the same compartment as chemicals, fertilizers, sulphur or other cargoes that could cause damage.

• Steel is a very high density cargo. To avoid damage to the ship’s structure, and to enable a weight distribution, ap-ply dunnage between the ship and the cargo and within cargo tiers.
• Lay dunnage over strong points. The laying process is an important part for a safe and efficient carriage of steel.
• Dunnage should be applied to create frictional resis-tance, spread the load, avoid deformation of the cargo
(especially when loading steel plate, coils and railways lines), protect steel from moisture, reduce possible movements within a stow (especially for steel plate or slabs).
• Dunnage of sufficient thickness should be used, to en-able efficient weight distribution and to facilitate cargo lashing/handling.

Generally, steel is loaded in the following manner:

in any field is a commitment to using all the knowledge and technology at one’s disposal to ensure success. The term is used frequently in the fields of health care, government ad-ministration, the education system, project management, hardware and software product development, and elsewhere. Practically, best practice means finding—and using—the best ways of working to achieve your business objectives (which means also the excellenceexcellenceexcellenceexcellence our Company is looking for). Applying best practices means learning from and through the
experience of others. One way of doing this is through benchmarkingbenchmarkingbenchmarkingbenchmarking which allows you to compare your business with other successful business to high-light areas where your business could improve. Despite the above, it is often noted that demonstrated best prac-tices can be slow to spread, even within an organization. The three main barriers to adoption of a best practice are:
• A lack of motivation to make changes involved in their adoption
• A lack of knowledge and skills required to do so. The idea is that with method processes, checks and testing, a desired outcome can be delivered with fewer problems and un-foreseen complications. Best practices can also be defined as the most (least amount of effort) and effective (best result) way of accomplishing a task, based on repeatable procedures that have proven themselves over time for large numbers of people. A given best practice is only applicable to particular condition or circumstances and may have to be modified or adapted for simi-lar circumstances.
As the term has become more popular, some organizations have begun using the term “best practices” to refer to what in fact are merely “rules”, causing a linguistic drift in which a new term such as “good ideas” is needed to refer to what would previously have been called “best practices”. The Code requires the vessels operators to implement a safety management system that will help them to achieve incident free operations. However, most of the Major Oil Companies felt that there might be a clear distinction between the standards of those vessels operators embracing the spirit of the ISM Code and those that are aiming to fulfil its minimum requirements. This variability may result in a charterer with due diligence concerns having to assess the operational standards of individual ves-sels operators. It’s mainly for the above reason that the TMSA was firstly introduced; it’s scope was lately expanded to encompass all tank vessel operators, including those managing coastal vessels and barges. annex to MARPOL concern-
ing air emissions has also
posed serious challenges
in relation to fuel oil quality
and onboard incineration.
As far as US enforcementsUS enforcementsUS enforcementsUS enforcements,
it has to be reported the war waged against ships trading
in USA waters that are felt to flout MARPOL regulations
(particularly with regard to illegal discharge of oily bilge
water and sludge). The US authorities mainly involved in
such a process are the Coast Guard Coast Guard Coast Guard Coast Guard and the DoJDoJDoJDoJ
(Department of Justice): multi million dollar fines were im-
posed in many of the cases. The illegal practices that are
the subject of these heavy penalties are not confined to
the operation of the oily water separator. In some cases, it
is alleged that the oily water separator is bypassed by the
so called “magic pipe” which allows the discharge of oily
bilge waste that may contain in excess the maximum quan-
tity allowed by Marpol. The direct overboard discharge of
oily sludge from filters and purifiers is also a common alle-
gation. Surely, it can be difficult for the US Authorities to
successfully prosecute for an alleged discharge since this
usually takes place at sea, outside their jurisdiction. This
means that in absence of a discharge in US waters, they
prosecute crew and companies for lying and obstructing
justice within the US jurisdiction. These violations take the

not accurately reflects the illegal discharges that have
taken place.
In many cases, it is also alleged that the crew attempted to
conceal equipment used to bypass the oily water separator
or lied to the authorities or were guilty of destroying or con-
cealing vital evidence such as engine room logs.
It is also alleged in some cases that the shore manage-
ment instructed the crew to indulge in such practices.
But what are the reasons to pollute? It is generally unthink-

arise as a
result of poor shore side management control over the
waste management process, due to inadequate training and
auditing to ensure compliance. There also may be reasons
for engineers acting improperly if they feel they have not
received sufficient training or support, in the form of proper
equipment and spares, in order to deal with the normal and
sometimes abnormal operational problems in the Engine
Room. A ship operator is liable for the actions of its employ-
ees and is therefore exposed to successful prosecution even
if it has no knowledge of the activities in question and even
if the actions were in direct violation of Company policies

ineffective in preventing violations. As a consequence, the
