Freedom of Expression

From 2008 to 2014, there have been at least 74 individuals litigated under the Electronic Information and Transaction (EIT) Law. 92% of the cases were for online defamation, 5% for blasphemy, and 1% for online threats all under Article 27 Paragraph 3.

There have been 90 cases related to online defamation from January 2015 through April 2015 alone. The current trends indicates at least four additional cases per month.

Revision of EIT Law

The Ministry of Communication and Information Technology (MCIT) and Indonesian Parliament (DPR-RI) have agreed to revise the EIT Law as a priority for the 2015 National Legislation Program.

Civil Society Organizations (CSOs) and human rights activists advocate eliminating the defamation article completely to encourage freedoms of expression. However, the MCIT Minister proposed in early 2015 that the revision would be focused to reduce the maximum prison sentence from the current six years.

Content Filtering

On July 2014, the MCIT enacted a Ministerial Decree No.19 / 2014 (Permen 19/2014) to address Internet sites that were considered to contain "negative content". CSOs such as Institute for Policy Research and Advocacy (ELSAM), Institute for Criminal Justice Reform (ICJR), Pers Legal Aid (LBH Pers) and ICT Watch, contested this decree on November 2014 for a material review of this Ministerial Decree to the Supreme Court. One of the arguments against this decree for the lack of transparency and accountability in implementing the decree. A boundless interpretation of this law has serious implications to the freedom of expression in Indonesia. To begin addressing this concern, the MCIT recently formed a multi-stakeholder panel (panel team) to determine reasonable and proper Internet filtering.

The Indonesian Internet Governance Forum (ID-IGF) was established in N o v e m b e r 2 0 1 2 t o assemble government, private sector, and civil

society organizations to discuss public and social matters relating to the Internet in Indonesia. The ID-IGF emphasized the goal to promote transparent, democratic, and inclusive governance of the Internet for national development.

The 8th Global IGF in 2013 at Bali, Indonesia where the ID-IGF emphasized its commitment to implementing internationally recognized principles and goals relating to develop and govern the Internet.

In addition, the ID-IGF hosted the 2014 National ID-IGF Dialogue to discuss national matters of the Internet relating to infrastructure, economy, law, and social and culture.

Indonesia Child Online Protection (ID-COP)

The Indonesian Child Online Protection (ID-COP) is a multi-stakeholder hub that focuses on protecting children on the Internet. This was initiated by

the Indonesian Children Protection Commission (KPAI) in order to coordinate efforts by government, private, and civil society entities including ECPAT Indonesia, Nawala Foundation, Terre Des Hommes, Google, Sejiwa Foundation, Indonesia ICT Volunteers (RTIK) and ICT Watch. Currently, the ID-COP is developing a response procedure for child safety incidents through the Internet.

Internet Negative Content Handling Forum

MCIT formed a forum (panel team) that come from multi-stakeholder organization to provide recommendations for the minister to determine an internet site can be filtered, not filtered, or normalization from closure. This forum is expected to be able to develop platform for transparent and accountable the governance of internet content. Members of this forum was selected from experts and practitioners that come from representative prominent institution in Indonesia.

Indonesian ICT Volunteers

In 2011 Indonesian ICT Volunteers was established as a community to help educate the Indonesian public about various ICT topics. The volunteer community consists of individuals with various backgrounds such as ICT activists, open source communities, bloggers, teachers, academia, private sector, and government

officials. The community's goal is to help enhance the use of ICT and fill the gap of ICT literacy in order to increase public participation and ownership of the the ICT sector.
