THE EXECUTIVE COMMITTEE RECOMMENDS THAT 0.24 hectares (0.59 acres), more or less, of vacant land be purchased from 433405 Ontario Inc., being Part of Lot 3, Concession 9 and designated as Blocks 126, 127, 128 and 143 on a Draft Plan of Subdivision prepared by Donald E. Roberts Ltd., Ontario Land Surveyors, under their Reference No. 85.1507-9, dated August 18, 2005, Town of Whitchurch-Stouffville, Regional Municipality of York, located east of Ninth Line, north of Millard Street (12627 and 12663 Ninth Line - Stouffville);

THAT the purchase price be $2.00;

THAT the Toronto and Region Conservation Authority (TRCA) receive conveyance of the land free from encumbrance, subject to existing service easements;

RATIONALEThe subject property falls within the TRCA's approved master plan for acquisition for the Duffins Creek watershed as outlined in the approved Natural Heritage Lands Protection and Acquisition Project 2001-2005. Through the review of residential subdivision 19T(W)-01.002 (Fairgate Homes), TRCA staff established the limits of the open space lands (i.e. Blocks 126, 127. 128 & 143 on Draft Plan of Subdivision) which are comprised of a portion of the Regional Storm flood plain of the Stouffville Creek and a 10 metre environmental buffer.

TAXES AND MAINTENANCEIt is proposed that the lands be turned over to the Town of Whitchurch-Stouffville for management.

FINANCIAL DETAILSFunds for the costs related to this purchase are available in the TRCA land acquisition capital account.

Based on a preliminary review of the new criteria, it would appear that the majority of these lands will be eligible for the exemption for the 2006 taxation year. The addition of the subject parcel will not have a significant impact on the TRCA’s costs for this area.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT 0.177 hectares (0.436 acres) more or less, consisting of a rectangular shaped parcel of land, be purchased from Fizul Ali, said lands being Part of Lot 2, Concession 1, North of Dundas Street, City of Mississauga, Regional Municipality of Peel, located on the south side of Burnhamthorpe Road East, east of Ponytrail Road;

THAT the purchase price be $374,000;

THAT acquisition by Toronto and Region Conservation Authority (TRCA) is conditional on the availability of all necessary funding;

THAT TRCA receive conveyance of the land required free from encumbrance, subject to existing service easements;

THAT Gardiner, Roberts, Barristers and Solicitors, be instructed to complete the transaction at the earliest possible date. All reasonable expenses incurred incidental to the closing for land transfer tax, legal costs, and disbursements are to be paid;

Acquisition of this property removes a building lot of record from the flood plain. The adjacent lands are owned by TRCA and managed by the City of Mississauga as Fleetwood Park.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS THE Toronto and Region Conservation Authority (TRCA) is in receipt of a request form the Oakdale Golf and Country Club to provide a permanent easement for the installation of two wells and a water line on TRCA-owned property in Downsview Dells Park, City of Toronto, Humber River Watershed;

WHEREAS it is in the best interest of the TRCA in furthering its objectives as set out in Section 20 of the Conservation Authorities Act to cooperate with the Oakdale Golf and Country Club in this instance;

THEREFORE LET IT BE RESOLVED THAT a permanent easement containing a total of 0.86 hectares (2.14 acres), more or less, be granted to the Oakdale Golf and Country Club for the installation and operation of two wells and a water line on TRCA-owned property in Downsview Dells Park, City of Toronto on the following terms and conditions;

(a) the consideration be $90,935 (may be adjusted to reflect acreage determined by final survey) plus all legal, survey, and other costs to be paid by the Oakdale Golf and Country Club;

(b) the Authority in consultation with the Black Creek Project direct the funds received from Oakdale Golf and Country Club to stream improvement projects on the Black Creek upstream of the Oakdale Golf and Country Club;

(c) the Oakdale Golf and Country Club be responsible for all costs associated with the installation and operation and of the wells and water line;

(d) the Oakdale Golf and Country Club obtain required approvals under Ontario Regulation 158 for applicable works;

(e) the Oakdale Golf and Country Club obtain required approvals under Ontario Regulation 128/03 (wells) and Ontario Regulation 387/04 (water taking and transfer)and copy TRCA on monitoring reports that may be required by permit and that they meter the wells and provide TRCA with yearly records;

(f) the Oakdale Golf and Country Club obtain the necessary work permit from the City of Toronto, through the Parks, Forestry and Recreation Department;

(g) the Oakdale Golf and Country Club is to fully indemnify the TRCA from any and all claims from injuries, damages or costs of any nature resulting in any way, either directly or indirectly, from the granting of this easement or the carrying out of construction;

(h) an archaeological investigation be completed, with any mitigating measures being carried out to the satisfaction of TRCA staff, at the expense of the Oakdale Golf and Country Club;

(i) the Oakdale Golf and Country Club will prepare a comprehensive water management strategy to the satisfaction of TRCA and in consultation with the Humber Watershed Alliance;

(j) the Oakdale Golf and Country Club review their water management program with TRCA and in consultation with the Humber Watershed Alliance on a annual basis;

(k) any additional considerations as deemed appropriate by the TRCA solicitor;

THAT said easement be subject to approval of the Minister of Natural Resources in accordance with Section 21(2) of the Conservation Authorities Act, R.S.O. 1990, Chapter C.27, as amended;

AND FURTHER THAT the appropriate TRCA officials be authorized and directed to take whatever action may be required to give effect thereto, including the obtaining of necessary approvals and the execution of any documents.

CARRIEDBACKGROUNDAt Authority Meeting #5/05, held on June 24, 2005, Resolution #A140/05 was approved as follows:

(g) Members of Humber Watershed Alliance be invited to participate in future discussions when appropriate regarding the terms and conditions of the proposed easement agreement;

AND FURTHER THAT staff report to the Executive Committee at the earliest possible date regarding the terms and conditions of the proposed easement agreement.

The Oakdale Golf and Country Club currently has a Permit to Take Water from the surface flow of the Black Creek. The TRCA encourages golf course owners to reduce their dependency on surface water takings since these takings have the greatest impact on watercourses, particularly during low flow periods when the golf courses need the most water.

The Oakdale Golf and Country Club needs an alternate water supply for quantity and quality reasons. Currently their primary water source for irrigation purposes is an on-line pond, thereby drawing down the base flow of the Black Creek. Extensive surveys of their lands have been conducted with no source of groundwater supply found.

Golf course representatives subsequently approached TRCA regarding exploration of Downsview Dells for groundwater resources. TRCA considered this as an opportunity to request the Oakdale Golf and Country Club to carry out a comprehensive water management strategy for the course, including the removal of the on-line irrigation pond. Permission was granted for them to determine if: a) sufficient groundwater resources are present in the area (both quality and quantity); and if b) extraction of the groundwater resource would negatively impact the creek. The club agreed to proceed with the exploratory work at their cost and risk.

R. J. Burnside and Associates Limited, consultants for the club, arranged for two test wells to be installed, together with stream bed monitors installed at several locations in the Black Creek, in Downsview Dells Park, in the vicinity of the groundwater well. A hydrogeological study outlining the findings from the pump test has been submitted for review be technical staff. The consultant’s report confirmed that there is suitable water quantity for irrigating the golf course, and that the groundwater withdrawal had no impact on water levels or flow in Black Creek. The consultants have also indicated that a preliminary water line alignment has been chosen that will have minimal impact on vegetation. In addition, the water line will be installed using directional boring methods which will minimize disturbance to the park and help to reduce potential impacts on vegetation.

Staff have had several meetings with officials from the Oakdale Golf and Country Club to discuss the terms of the proposed easement, together with a meeting dated September 8, 2005 with a member of the Black Creek Project and a member of the Humber Watershed Alliance to seek their input. Based on these discussions staff are prepared to recommend a permanent easement be granted to the Oakdale Golf and Country Club on the basis outlined in this report.

THAT a permanent easement containing 2.4 acres, more or less, be granted to the Town of Whitchurch-Stouffville for a storm water management facility to facilitate the development of adjacent lands owned by Hillmount Properties Ltd., said land being part of Lot 3, Concession 9, Town of Whitchurch-Stouffville, Regional Municipality of York, subject to the following terms and conditions:

(a) The easement price is $312,000 which is to be paid by Hillmount Properties Ltd. to TRCA, plus all legal and survey costs incurred to complete the transaction;

(b) All disturbed areas are to be restored to the satisfaction of TRCA as soon as possible after completion of construction;

(c) Sediment control measures in a manner satisfactory to TRCA are to be practiced during construction;

(d) The Hillmount Properties Ltd. shall monitor the effectiveness of the facility for a two year period following construction;

(e) The Town of Whitchurch-Stouffville is to be responsible for any repairs or maintenance required in the future and for indemnifying TRCA from any and all claims arising from the construction and payment of all taxes;

CARRIEDBACKGROUNDThe proposed storm water management facility will service lands owned by Hillmount Properties Ltd. located north of Millard Street, in the Stouffville area of the Town of Whitchurch-Stouffville, Duffins Creek watershed. The subject TRCA-owned property is table land which is isolated from the valley and remaining TRCA lands by the Canadian National Railway line.

In accordance with TRCA guidelines "Use of Authority Owned Lands For Storm Water Management" approved at Authority Meeting #11/92, January 22, 1993, the proponent has demonstrated that the proposed location on TRCA land is reasonable and all technical requirements of TRCA staff has been satisfied. A detailed design will be carried out prior to construction of the pond.

The Town of Whitchurch-Stouffville hosted a public meeting to consider the Functional Servicing Study (FSS) for the Northeast quadrant of the Stouffville Community which includes the Hillmount Properties Ltd. lands on May 21, 2002. The document presented at the meeting contained a storm water management pond partly on TRCA lands in essentially the same location as shown in the approved FSS document.

The subject land is part of a larger parcel acquired from the Estate of A. B. Bartholomew, under the Stouffville Dam and Reservoir Project, Duffins Creek watershed.

Staff have carried out negotiations with representatives of the developer and respectfully submit that the compensation package relating to the 2.4 acre easement, is fair and reasonable.

FINANCIAL DETAILSIt is proposed that the funding obtained from this easement be utilized for the purchase of other higher priority properties under the Natural Heritage Lands Protection and Acquisition Project 2001 - 2005.

TAXES AND MAINTENANCETaxes on the property were $3,506.14 in 2004. While the Fowlers are in possession of the property they will be responsible for the taxes and maintenance. After TRCA obtains vacant possession of the property, it is proposed that the building be demolished.

Proposal:The purpose of this application is to alter a waterway, and place fill within a regulated area to facilitate the construction of a residential subdivision (known as Enclaves Phase III, Cottrelle Part 'F' - 21T-03001B), and rehabilitate and existing stormwater outfall, located near the northwest corner of Goreway Drive and Castlemore Road, in the City of Brampton. Please note that all works associated with the development of the residential dwellings are located on the tableland portion of the subject property. In addition, all works associated with the rehabilitation of the existing stormwater outfall will be located outside of the Regional Storm Floodplain, and a comprehensive valley revegetation plan is proposed to mitigate for any potential negative ecological impacts. It has been determined that the proposed works do not constitute a harmful alteration, disruption or destruction (HADD) of fish habitat. As such, a letter of advice on behalf of Fisheries and Oceans Canada (DFO) will be issued with this permit.

Control of Flooding:The proposed works will occur outside of the Regional Storm Floodplain. As such, no adverse impacts to the storage and/or conveyance of floodwaters are anticipated.

Pollution:Appropriate sediment and erosion control measures will be put in place and maintained during all phases of construction.

Conservation of Land:This application proposes to revegetate a portion of the valleylands to increase the ecological functions of this area. In addition, there are no geotechnical and/or fisheries related concerns with this application. However, please note that a letter of advice on behalf of DFO will be issued with this permit.

PlantingsAll disturbed areas will be restored and stabilize using a TRCA approved seedmix. In addition, all proposed plantings are native and non-invasive species that are consistent with TRCA's planting guidelines.

The purpose is to alter a waterway to facilitate the construction of a hydro training facility.

The permit will be issued for the period of October 14, 2005 to October 13, 2010 in accordance with the following documents and plans which form part of this permit:

Site Grading and Servicing Plan, drawing no. G-1, prepared by V.A. Piscione and Associates Inc., last revised on June 16, 2005.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The purpose of this application is to alter a waterway to facilitate the construction of an access service road associated with a hydro training facility to be located at 5345 Creekbank Road, in the City of Mississauga. The subject property is located within the Etobicoke Creek watershed, and is characterized by a deciduous forest covering the ravine and tableland landforms on the site (site area approximately 2.4 hectares). The ravine feature contains a remnant tributary that is enclosed upstream and downstream of the site, ultimately draining to the Etobicoke Creek just south of the Twin Leaf Environmentally Significant Area (ESA). A large portion of the woodlands on the property was determined to provide critical habitat for butternut (federally endangered species), as well as provide additional important ecological functions that contribute to the site meeting many of the criteria to be considered a provincially significant woodland. The remnant tributary located within the ravine receives only localized run-off and was determined to support only intermittent aquatic habitat.

This application proposes to locate a training facility on the tableland portion of the property, with supporting infrastructure including an access service road and a short hydropole corridor to be located on the ravine floor. The applicant will implement appropriate mitigation measures to ensure the functions of the natural heritage features on the site are maintained (forest management plan). In addition, the applicant has also committed to placing a conservation easement on the property for the long term protection of the noted features, as well as collaborate with TRCA staff in efforts to renaturalize portions of the Etobicoke Creek corridor - in terms of enhancements to similar riparian habitat ensuring a 'net gain' is provided to the natural system. Please note that it has been determined that the proposed works will not significantly impact the natural features on the subject property, nor constitutes a harmful

Pollution:Appropriate sediment and erosion control measures will be put in place and maintained during all phases of construction.

Conservation of Land:The proposed works will not significantly impact the natural features on the subject property. In addition, commitments made by the applicant to coordinate future efforts with the TRCA to provide mitigation and enhancements to similar habitats within the Etobicoke Creek corridor will ensure that a 'net gain' is provided to the natural system. Similarly, adequate development setbacks from the predicted long term stable slope limits on the tableland portion of the site has been provided, as such, all geotechnical related concerns with this application have been addressed. The existing single span concrete structure has a span of 4.0 m, a deck length of 13.3 m, a deck width of 4.7 m and a soffit elevation of 76.53 m. The replacement crossing structure will be a precast concrete structure with a span of 12.2 m. The minimum soffit elevation for the proposed bridge will be 76.64 m. The two-lane urbanized roadway will have a width of 9.75 m and sidewalk and parapet walls on both sides. The total width of the bridge will be 15.0 m. Instream works will be required to facilitate the construction of the foundation of the replacement crossing structure.

Land owner authorization has been provided by Ontario Power Generation to the City of Pickering to allow work to take place on its property in accordance with Drawing S-1.

The project was reviewed by TRCA staff during the Environmental Assessment process and it conforms to TRCA requirements.

Proposal:This proposal by the Town of Richmond Hill involves the rehabilitation of an existing pedestrian trail along the southern side of the Lake Wilcox Outflow Channel and to replace the existing boardwalk for the Lake Wilcox Fish Sanctuary. The existing trail from the outlet channel crossing to the sanctuary will be upgraded to a standard park trail and surfaced with limestone screenings. The proposed boardwalk structure is the same size as the existing structure to be removed and will be installed at the same location.

Proposal:This proposal is to alter a watercourse to facilitate the development of a residential subdivision (Metrus Springdale 10-01) located on the west side of Torbram Road, south of Countryside Drive, in the City of Brampton. Please note that at the July 8, 2005 Executive Committee meeting, the Executive Committee approved a permit associated with these works to authorize a temporary road culvert crossing of this feature allowing for the pre-servicing of these lands (permit# C-05228). The works associated with this application involve the enclosure of the small ephemeral watercourse feature (tributary to the main H4 Tributary) that TRCA and Fisheries and Oceans Canada (DFO) staff have determined to be indirect fish habitat. In this regard, a stream corridor enhancement plan has been submitted which proposes to improve the form and functions of the main H4 Tributary, providing a 'net gain' to the system. As the proposed works have been determined to be a mitigateable harmful alteration, disruption or destruction (HADD) to fish habitat, this permit will not be issued until such time that DFO authorization is received.

Control of Flooding:The subject watercourse feature is ephemeral in nature and only receives localized runoff during storm events. In this regard, TRCA technical staff have determined that there is no Regulatory Floodplain associated with this feature. Proposal:This permit is the second of two permits recently submitted by Sheridan Nurseries for works on the subject property at 2069 Burnhamthorpe Road in the City of Mississauga. A permit was issued by the Executive Committee on April 8, 2005 for phase one of the subject works, which involved the creation of a new outdoor plant display area. This second permit is to permit the construction of a replacement greenhouse, which is to be attached to the existing Sheridan Nurseries building, and for a new covered (roof-only) outdoor display area.

The property on which the works are proposed is located within the Regulatory Floodplain and the floodway associated with Etobicoke Creek. Due to the flood-prone nature of the property, TRCA staff have had a significant amount of history with previous applications on this property, and have worked with the applicant on this permit application to ensure that it results in a net gain from both an environmental and a risk management perspective.

Many factors have been taken into consideration in the review completed by TRCA staff on this application. Among these are the potential to reduce flood hazards that currently exist with respect to the existing structures, and the potential to limit future development on the subject property. The proposed greenhouse structure will replace an existing greenhouse that is currently in poor repair. The new greenhouse will be constructed of materials that are to be able to withstand greater flood events, and will break-up in large storm events to reduce downstream impacts. While the proposed greenhouse structure will be larger in size than the existing structure, it will allow for materials that are presently stored externally (in closer proximity to Etobicoke Creek) to be move inside the greenhouse, and for on-site storage containers to be removed. Additionally, the agreement limits the uses within an existing partially enclosed structure, to ensure that it will not be enclosed, or its uses expanded in the future.

As a condition of TRCA’s approval of a new greenhouse structure, the landowner has committed to enter into a conservation easement agreement to limit all future development and uses of the subject property, and has committed to enter into a Save Harmless agreement with the Authority and other agencies. These agreements will clearly establish the permitted limits of development on the property, and will provide Authority staff with a greater ability to inspect the property to ensure compliance (should it be necessary), and to rectify any deficiencies, should they be found.

Through the above, TRCA staff are satisfied that the above noted agreements and restrictions on the property, and design requirements for the new structures will result in a net improvement to this operation.

Control of Flooding:The works will occur within the Regional Storm Floodplain, however the proposed works are anticipated to result in no additional negative impacts upon flooding, or a net improvement with respect to flooding, as a result of the measures noted above.

Proposal:The purpose is to alter a waterway to facilitate modifications to the outlet of an existing on-line pond and the installation of a base flow maintenance system (piped siphon system).

The on-line pond was created in the early 1960s through the construction of a fill embankment across a tributary of the Humber River. The pond was constructed to capture surface water for use in irrigating the golf course. The surface water is supplemented by groundwater from the well system located on the subject property. There is an existing culvert in the fill embankment, which conveys flows to the downstream reach of the tributary. In the process of conducting a hydrological study to support a Permit to Take Water Application for the Ministry of Environment, it was noted that base flow downstream of the fill embankment is impacted when the water level in the on-line pond drops below the invert of the culvert.

To improve base flow downstream of the fill embankment, the applicant proposes to construct a base flow maintenance system consisting of 4 piped siphons. Each siphon will consist of a 37 millimetre diameter PVC pipe, which will be installed through the fill embankment. Each siphon will draw water from a fixed depth within the on-line pond, convey it over the embankment and outlet to the watercourse downstream. The siphon system will be utilized when the golf course is drawing water from the on-line pond for irrigation, and the pond level drops below the invert of the existing culvert. Flows entering and exiting the on-line pond will be monitored daily to ensure the base flow is maintained.

Modifications to the existing fill embankment are also proposed as part of the proposed works. Specifically, fill will be placed at the base of the downstream side of the embankment to establish a 3:1 slope. This is intended to improve the structural integrity of the fill embankment and prevent erosion should the on-line pond overtop the embankment during a major storm event. All disturbed areas are to be covered with topsoil and seeded. Native, non-invasive shrub plantings will also be provided to enhance slope stability on the embankment. The top of the embankment will be paved with asphalt, as this area is currently used for access purposes. The existing culvert will be extended 6 metres to accommodate the new slope of the fill embankment. Rip rap and filter fabric (6 metres in length) will also be placed immediately downstream of the culvert outlet to prevent erosion.

The proposed modifications will help insure an appropriate level of base flow is discharged downstream during the golf season. This system will be a significant improvement to the current system.

Control of Flooding:TRCA Water Management staff has reviewed the technical drawings relating to the proposed works and has determined that there will be no negative impacts on the storage or conveyance of flood waters.

Pollution:Sediment and erosion control measures will be erected and maintained throughout construction to prevent construction-generated sediment from entering the watercourse.

Conservation of Land:There are no geotechnical/slope stability issues associated with this proposal. The proposal is not considered to be a harmful alteration, disruption or destruction (HADD) to fish habitat. As such, a Letter of Advice will be issued on behalf of Fisheries and Oceans Canada (DFO) for the proposed works. Furthermore, the works will be conducted during the warmwater fisheries timing window (July 1 to March 31). There are no other significant natural features on, or adjacent to, the site that may be negatively impacted by the project.

The proposed development will be located on an existing lot of record within a registered plan of subdivision. The subdivision was approved in 1986, before the Valley and Stream Corridor Management Program was in place. The subject property contains a portion of the valley corridor of a Humber River tributary. The building envelope on the subject lot was established through the subdivision's implementing zoning by-law, so that only a portion of the lot can be developed. The envelope was staked by TRCA staff in 1986, and facilitates the protection of the majority of the vegetation in the riparian zone of the tributary. The proposed development is restricted to the approved building envelope. Further, the tributary is intermittent, and is not subject to flooding under Regional Storm conditions. RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The applicant proposes to regrade through conducting a balanced cut and fill exercise in order to accommodate a residential plan of subdivision and stormwater management pond partially within the Regional Storm Floodplain and in excess of 100 metres from the West Robinson Tributary of the Rouge River. The lands of the proposed cut and fill are currently agricultural lands which have been designated for development as part of the Wismer Commons Community within the Town of Markham. The cut and fill exercise will occur to accommodate two north to south arterial roadway alignments at the east and western flood fringes of the watercourse on the subject lands. These roadways will front onto and will be the boundary to a wide stream corridor which has been partially used for agricultural purposes. The adjacent residential development is removed from the floodplain. As part of this exercise the stream corridor will be re-established with native vegetation. The existing vegetated portions of the site will remain undisturbed with the exception of the construction of an outlet for stormwater management. All areas will be vegetated in accordance with detailed plans submitted by the applicant to the satisfaction of TRCA staff. The works will vastly improve the ecological conditions adjacent to the watercourse.

Control of Flooding:The cut and fill exercise will not impact the control of flooding as an equal balance has been maintained by cutting and filling at adequate cross sections within the valley corridor to the satisfaction of TRCA engineering staff. There will be no upstream and downstream impacts from the proposed grading exercise as the works are occurring at the fringes of the floodplain and in areas where the depths of flooding are measured in inches.

Pollution:The works will not expected to impact the control of pollution as the applicant is erecting sediment and erosion control fencing between the proposed works and the watercourse. In addition a temporary sediment pond will be erected at the location of the permanent facility and will remain on place until all grading works are complete and the site is stabilized.

Proposal:The applicant proposes to construct a metal pedestrian bridge crossing of a small tributary of the Rouge River as part of a developing trail system in the new Box Grove Community within the Town of Markham. The bridge structure and abutments will be setback from the watercourse and has been designed not to impede the conveyance of flood flows. The abutments have been setback from the low flow channel and areas of more frequent flooding and the bridge structure will not be impacted during these storm events. The abutments and all disturbed areas will be planted in accordance with detailed planting plans submitted by the applicant and approved by TRCA staff. All other portions of the trail system are beyond the Regional Storm Floodplain and are not part of this permit.

Pollution:Sediment fencing will be erected at the perimeter of the work site and between the watercourse and the proposed works. All disturbed areas will be seeded and stabilized with native plant material once grading is complete.

Conservation of Land:The crossing and approach ramps are perpendicular to the watercourse thereby minimizing any impacts to the existing vegetation and structural encroachment into the valley.

Proposal:The proposal is to excavate and place fill within a Fill Regulated Area, alter a waterway and construct within the Regional Storm Flood Plain of the Rouge River in order to service the expansion of cemetery lands at Elgin Mills Cemetery, in the Town of Richmond Hill. The subject property is located on the southeast corner of Leslie Street and Elgin Mills Road and is approximately 71 ha in size. The property is bounded to the east by Highway 404, to the north by Elgin Mills Road East and to the west by Leslie Street. The proposed stormwater pond is located on the south side of the property, in unopened cemetery lands, within the Rouge Valley corridor.

At this time, a portion of the property functions as a cemetery and it is proposed that the remaining undeveloped areas within the site be developed in stages. Authority staff previously reviewed and approved a related site and master plan for lands to the north of the pond. These lands which comprise Phase I of the cemetery expansion, consisted primarily of tablelands. No natural features were impacted by the proposed Phase I expansion. Phase II, of which the proposed pond and outfall are a part of, also includes other tablelands on the southern portion of the site. Upon the ultimate completion of the expansion, the site will consist of burial gardens, mausoleums, administrative buildings and a chapel.

The proposed stormwater pond is located partially within the Rouge River stream corridor and partially within the Regional Storm Flood Plain. The location of the proposed pond is devoid of any woody vegetation and was previously used as part of an adjacent farm operation. The applicant provided an Environmental Impact Statement (EIS) which was reviewed by TRCA technical staff. After several revisions to the location of the pond, staff is satisfied that the proposed works will not significantly affect the surrounding natural features. In order to obtain a net environmental benefit in lieu of the stormwater facility being located within the stream corridor and Regional Storm Flood Plain, several sites around the subject property in the stream corridor and on tablelands were identified as locations for restoration with native species.

In accordance with the Cemeteries Act, the stormwater management pond, outfall, valley and stream corridor will be privately held by the applicant (Mount Pleasant Group of Cemeteries), as opposed to the normal dedication of open space lands into public ownership. Given the proposed use, paved areas will be kept to a minimum (road network), with a majority of the site consisting of manicured landscaped areas or natural areas maintained for the visiting public.

Control of Flooding:Technical staff has reviewed all detailed drawings relating to the proposed stormwater facility and associated outfall and is satisfied that the proposed works will not affect the storage and conveyance of flood waters, provided restoration works in surrounding areas are implemented.

Pollution:Erosion and sediment control measures will be implemented prior to construction of the proposed works. These measures will be maintained for the duration of construction to ensure that sediment does not enter the nearby watercourse.

The permit will be issued for the period of October 14, 2005 to October 13, 2010 in accordance with the following documents and plans which form part of this permit:

Truck Sewer and Watermain Drawing Nos. P-113 and P-114, Project No. 03343, prepared by Sernas and Associates as received on September 13th, 2004.Letter of Undertaking with respect to the proposed enhancement plans for any disturbances caused by the bore pits for the proposed servicing as received on October 12th, 2005.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The applicant proposes to construct a sanitary and watermain crossing of a small tributary valley of the Duffins Creek in order to service draft approved plans of subdivision within the developing Stouffville urban expansion area. The crossing for both pipes is in excess of two metres below the invert of the watercourse. The crossing will be conducted through a jack and bore method and will not result in any interference with the low flow channel of the tributary. Bore pits are required and the pits will be located in excess of ten metres from the watercourse. Portions of the sanitary pipe beyond the bore pits will be trenched in accordance with details provided by the applicant. No significant dewatering is required for the installation of the servicing pipes. The pits and trenching will be restored to the satisfaction of TRCA staff.

Control of Flooding:Works are not proposed within the Regional Storm Floodplain. Therefore there will be no impact on the control of flooding.

Pollution:Sediment fencing will be erected between the proposed bore pits and the watercourse and will remain in place for the duration of the works. All disturbed areas will be renatuarlized through a native seed mix to further stabilize the soils and the site will be planted to the satisfaction of TRCA staff.

Conservation of Land:The alignment chosen is devoid of significant woody vegetation and is at a narrow section of the gently sloping valley corridor. Further, the servicing pipes are below grade. As a result it is expected that there will be no long term impacts on the functioning of the valley corridor and watercourse.

PlantingsAll disturbed areas will be planted to the satisfaction of TRCA staff.

Policy Guidelines:The works are in compliance with Section 4.3 "Infrastructure and Servicing" of the Authority's Valley and Stream Corridor management Program. The works do not constitute a Harmful Alteration Disruption or Destruction to fish habitat and Fisheries and Oceans Canada(DFO) approval is not required.
