103.03 Application for Environmental Clearance under EIA Notification dated 14.09.2006 for mining of minor minerals (brick clay) in the revenue estate of Vill. Bhutta, Tehsil & Distt. Ludhiana by M/s Akal Brick Kiln, Vill. Bhutta, Tehsil & Distt. Ludhiana.

The SEAC decided that the project proponent be informed that in light of the OM dated 24.12.2013 stayed by the Hon'ble National Green Tribunal, application filed under category B2 cannot be decided and is to be kept pending till the final orders are passed by the Hon'ble National Green Tribunal. However, the project proponent may submit application under category 'B' for obtaining environmental clearance for mining of minor

minerals (brick clay).

The decision of the SEAC has been conveyed to the project proponent vide letter no. 3450 dated

17.11.2014.

103.04 Application for obtaining Environmental Clearance under EIA notification dated 14.09.2006 for proposed commercial project “Hotel & Timeshare Suits- Amritsar” at Sultanwind Sub-Urban Towards Mahal-II, Amritsar, Punjab By M/s DJB Infrastructures & Developers India Pvt. Ltd.

The SEAC decided to ask the project proponent to submit the reply to its observations and defer the case till the project proponent submits the same.

The decision of the SEAC has been conveyed to the project proponent vide letter no. 3500 dated

26.11.2014.

103.05 Application for obtaining Environmental Clearance under EIA notification dated 14.09.2006 for construction of "Thapar University" in the revenue estate of Bhadson Road, Patiala.

The SEAC decided to categorize this project as category B-1 and finalized the "Terms of Reference" to the project proponent for preparation of the draft Rapid EIA report.

The Terms of Reference have been conveyed to the University vide No. 3491 dated 26.11.2014.

103.06 Application for Environmental Clearance under EIA notification dated 14.09.2006 for developing a residential complex namely “Trishla City” in the revenue estate of Village Nabha Sahib, Tehsil Derabassi, SAS Nagar, Punjab by M/s Trishla Buildtech Pvt. Ltd.

The SEAC decided to ask the project proponent to submit certain document and defer the case till the project

proponent submits the same.

The decision of the SEAC has been conveyed to the project proponent vide letter no. 3499 dated

17.11.2014.

103.07 Application for obtaining Environmental Clearance under EIA notification dated 14.09.2006 for development of an "Integrated Municipal Solid Waste Management Facility" for Patiala Cluster at Village Dudhar, Distt. Patiala by Municipal Corporation, Patiala.

The case was considered by the SEAC. However, no one from the project proponent attended the meeting inspite of the fact that the project proponent was informed telephonically to attend the said meeting. The Committee, in compliance to office memorandum of the MoEF dated 04.08.2009 as amended on 25.02.2010, decided to defer the case.

The decision of the SEAC has been conveyed to the project proponent vide letter no. 3497 dated 26.11.2014. Also, the case has been included in the current agenda as a

separate item.

103.08 Application for obtaining Environmental Clearance under EIA notification dated 14.09.2006 for development of a housing project namely “RESIDENTIAL MEGA TOWNSHIP” at Village Salamtpur, Dhode Majra, Rasulpur, Saini Majra and Ghandauli in Mullanpur Planning Area, Distt. S.A.S Nagar by M/s Greater Punjab Officers Corporative House Building Society and M/s Altus Space Builders Pvt. Ltd. (In joint Venture).

The SEAC decided to accept the request of the project proponent and allow him to submit the EIA report using the baseline data from the monitoring/study already started w.e.f. 1st September, 2014 and the same be carried out up to 30th November, 2014.

The decision of the SEAC has been conveyed to the project proponent vide letter 3498 dated

26.11.2014.

103.09 Application for obtaining environmental clearance under EIA Notification dated 14.09.2006 for the expansion of a commercial mall namely “The Celebration Bazaar" in the revenue estate of Village Bullepur, G.T. Road, Khanna, Distt Ludhiana by M/s Advance India Projects Ltd.

The Committee awarded 'Silver Grading' to the project proposal and decided to forward the case to the SEIAA with the recommendation to grant environmental clearance.

The case file has been sent to SEIAA for further necessary action

in the matter.

103.10 Regarding complaint received against "Wellington Estate" a Residential Group Housing Project developed by M/s Mittaso Projects Pvt. Ltd. at Kalka Road, NAC Zirakpur, District Mohali.

The SEAC decided that: i. Compliance report

regarding the shifting of DG set as assured by Sh. Pradeep Kapoor, representative of M/s TDI Infrastructure Ltd., to the visiting team, be sought from the project proponent as well as Regional Office of the Punjab Pollution Control Board at Mohali.

ii. M/s TDI Infrastructure Ltd., be further asked to submit the compliance report of the conditions of the environmental clearance granted to it by the Ministry of Environment, Forests & Climate Change, within 10 days.

As decided, (i) the PPCB, Regional Office, Mohali has been asked to send the requisite report vide letter no. 3508 dated

26.11.2014.

(ii) The project proponent has been asked to submit the compliance report of the conditions of the environmental clearance granted to it by the MoEF, vide letter No. 3507 dated

26.11.2014.

103.11 Regarding monitoring EIA Notification dated 14.09.2006, which fall in the competence of SEIAA, by the Ministry of Environment & Forests, New Delhi, for the month of August & September, 2014.

It was seen by the SEAC. No further action is required to be taken in the matter.

103.12 Application or obtaining Environmental Clearance for construction of Residential Apartment Complex namely "Jalandhar Heights- Phase-3" in the revenue estate of Villages Pholriwal & Alipur, Tehsil & District Jalandhar by M/s A.G.I. Infra Ltd.

The SEAC decided to ask the project proponent to submit the reply to its observations and defer the case till the project proponent submits the same.

The decision of the SEAC has been conveyed to the project proponent vide letter no. 3496 dated

26.11.2014.

103.13 Complaints received by SEIAA/SEAC against the violations of the provisions of EIA, Notification, 2006.

(A) The SEAC decided that: (i) For complaint at Sr. No. 1,

the SEAC decided that a sub-committee be constituted for verification of the contents of the complaint and send its report within 15 days.

(ii) For complaint at Sr. No. 2, the SEAC decided that a copy of the complaint be forwarded to RO of PPCB at Hoshiarpur for verifying the contents of the complaint and sending the report within 10 days.

(iii) For complaint at Sr. No. 3, the SEAC observed that the complaint does not relate to EIA notification and thus decided forward the same to PPCB under intimation to the complainant.

(B) The SEAC further decided that:

(i) Complaint log / register be maintained in respect of all the complaints received with SEIAA/SEAC.

(ii) Action initiated / taken on the complaint be intimated to the complainant.

(iii) Anonymous complaints need not be attended to.

(iv) Status report w.r.t. complaints received be placed in every meeting of the SEIAA/SEAC.

103.14 Regarding visit to verify the construction status of the projects received by SEIAA/SEAC for obtaining environmental clearance under EIA notification

dated 14.09.2006.

The SEAC decided that in future the practice of sending all the case(s) to PPCB for verification of the construction status at the project site, be dispensed with and the cases as and when received be placed before the SEAC for appraisal. Any decision for getting the site visited to verify the construction status will be taken by the SEAC on case to case basis.

The decision has been noted for compliance in future.

Item No. 104.03: Application for obtaining Environmental Clearance under EIA notification dated 14.09.2006 for development of an "Integrated Municipal Solid Waste Management Facility" for Patiala Cluster at Village Dudhar, Distt. Patiala by Municipal Corporation, Patiala.

The facts of the case are as under:

The Municipal Corporation, Patiala has applied for obtaining

Environmental Clearance under EIA notification dated 14.09.2006 to establish an

‘Integrated Municipal Solid Waste Management Facility’ for Patiala Cluster at

Village Dudhar, Distt. Patiala. The project of the promoter is covered under

Category 7 (I) of the Schedule appended to the said notification.

The Corporation was requested by the SEAC vide letter no.

759 dated 28.02.2012 to attend its 56th meeting on 27.02.2012 to present the

project proposal.

Following were present on behalf of Municipal Corporation,

Patiala on 27.02.2012 to present the details of EIA study:

1. Sh. A.K. Goyal, Asstt. Commissioner, Municipal Corporation, Patiala

2. Sh. Suman Banerjee, Environmental Consultant of M/s Ind Tech Consultant

3. Sh. Yashwant Chauhan of M/s IL&FS,

Due to paucity of time, the case could not be taken up in the

meeting on 27.02.2012, as such, the Committee decided to roll-over the same on

01.03.2012 with venue in the office of PSCST, Sector-26, Mahatma Gandhi

Institute, Chandigarh at 10.00 a.m.

Following were present on behalf of Municipal Corporation, Patiala

on 01.03.2012 to present the details of EIA study:

Sh. Suman Banerjee, Environmental Consultant, presented the

project proposal before the SEAC as under:

1. Municipal Corporation, Patiala intends to establish Integrated Municipal

Solid Waste Management facility in two stretches measuring as 20.72 acres

and 20.05 acres in the revenue estate Village Dudhar, District Patiala,

which will cater to 24 no. of Urban Local Bodies of Patiala cluster. Both

these sites are located at a distance about 440 m from each other and

these are property of Nagar Panchayat, Dudhar.

2. Presently, one of the stretches is used for agricultural purpose and the

other stretch is a barren land.

3. The proposed site of the facility is located at a distance 17 km from Patiala

city.

4. Total water requirement for the project is about 50 KLD, which will be met

through ground water.

5. The scope of the project includes the following:

a) Direct collection of segregated waste from waste generators, within

Municipal limits.

b) Storage of MSW including street sweeping and drain silting waste at

secondary collection units within municipal limits of Patiala.

c) Transportation of MSW including street sweeping and drain silting

waste from secondary collection points to site.

d) Receiving of MSW from Transfer stations and Urban Local Bodies

(ULB's).

e) Establishment of transfer stations at Sangrur, Barnala and Nabha to

the site.

f) Transportation of waste from transfer stations at Sangrur, Barnala

and Nabha to site.

g) Municipal waste processing facility comprising of RDF plant to process

300 TPD of mixed waste and compost plant for processing of 200TPD

of organic fraction of MSW.

h) Development, operation and maintenance of the Engineered Sanitary

Landfill site.

i) Disposal of Residual Inert Matter at the Engineered Sanitary landfill.

6. The present generation of solid waste from all 24 urban local bodies has

been estimated as 437.45 TPD and the Integrated MSW facility will be

installed to handle 500 TPD of municipal solid waste. The refuse dried fuel

will be generated the form of fluff having gross calorific value of 2600 to

2800 Kcal/kg of fluff. The RDF plant will be operated for 330 days in a year

and will have following operations.

Receipt of leaves and horticultural waste directly to the RDF storage.

Receipt of mixed MSW in one of the pits.

Manual separation and rejection of odd size objects.

Primary size reduction and homogenization.

Screening to remove minus 70 mm size.

Drying (when required).

Screening to remove Grits.

Classification into light fraction (RDF), heavy rejects and residual dust.

Secondary size reduction and pelletizing option.

Residual organic matter from the RDF plant will be utilized in compost plant.

7. The compost plant will be of capacity 200 TPD, which will be used to

process organic fraction of MSW and organic rejects to be generated from

RDF plant. This compost plant will be based on aerobic composting

process.

8. Engineered sanitary landfill shall also be developed for disposal of

processing rejects and residual inert matter. This facility shall be designed

as per the guidelines prescribed in the Municipal Solid Waste (Management

& Handling) Rules, 2000.

9. The MC will require 350 KW of electricity, which will be taken from Punjab

State Power Corporation Limited. The MC has proposal to install 1 No. DG

set of 250 KVA, which will be used as standby arrangement of power

supply and this D.G. set will be provided with proper acoustic enclosures.

10. It has been proposed that dust emissions to be generated during handling

waste/movement of vehicles will be controlled by spraying water and

providing enclosures.

11. The site of the project is largely conforming to the locational criteria

suggested by the Govt. of India, Ministry of Urban Development in the

manual titled as "Manual on Municipal Solid Waste Management".

However, as per record only one time flood came in the area in which the

proposed site of the facility is located,in the year 1993 and as per manual a

landfill may be built up within the flood plains of secondary streams if an

embankment is built along the stream side to avoid flooding of the

area.Therefore there is a proposal to construct an embankment of

adequate height to avoid flooding of the area.

12. There is a small substation of PSPCL adjoining to proposed site of the

facility where a deep tubewell has been provided to get the supply of water

for the workers of the said substation.

13. The aviation club of Patiala is at a distance of about 8 Km from the

proposed site of the facility.

14. The odour problem will be mitigated by spraying organic inoculants

The Committee considered the above said project proposal and

details as presented by the project proponents and after discussions, the 'Terms

of Reference' were finalized to be suitably added to those furnished by the

project proponent.

The TOR are applicable for Integrated Municipal Solid Waste Management

Facility, however, rapid EIA and public hearing shall be conducted as per provisions of

the Environment Impact Assessment Notification, 2006 and the issues to be raised by the

public should be addressed in the Final Environmental Management Plans for these sites.

A detailed draft EIA/EMP report should be prepared as per the

above additional TOR and should be submitted to the SEAC.

The Committee further observed that the project proponent shall

also submit the following documents alongwith draft EIA report:-

1. No Objection Certificate from pollution angle of the Punjab Pollution Control

Board.

3. All the documents, which were not submitted alongwith the application and shown

as not submitted in the agenda of the 56th meeting of SEAC uploaded on the

official website www.seiaapunjab.co.in.

3. NOC from the Aviation Club Patiala.

4. A certificate issued by the Department of Town & Country Planning showing the land use of the site as per the Master Plan, Patiala.

5. Proof of distance from existing protected area and 'No Objection certificate' from the Department of Forest & Wildlife Preservation.

6. The ownership of the land in which the integrated MSW management facility is to be established, is in the name of Nagar Panchayat, Dudhar.

Therefore, Municipal Corporation Patiala is required to submit a resolution passed by said Nagar Panchayat and duly approved by the competent authority of the state to the effect that the said land can be used for development of integrated MSW management facility by Municipal Corporation Patiala.

The decision of SEAC and TOR’s were issued to the project

proponent vide letter no. 12550 dated 16.03.2012.

7. Now, the public hearing of the MSW site was conducted on 01.10.2014 and

the proceedings of the same have been received in this office vide letter

no. 43695 dated 20.10.14. However, the project proponent has not yet

submitted the final EIA report as well as the reply of the observations of

SEAC conveyed to the project proponent vide letter no. 12550 dated

16.03.2012.

Moreover, the Ministry of Environment and Forests has issued an

Office Memorandum dated 22.08.2014 wherein, the validity of Terms of

Reference (TORs) prescribed under EIA Notification, 2006 for undertaking

detailed EIA and EMP studies for developmental projects requiring

environmental clearance has been clarified and the relevant part of the

same is as under:

“ 2. Based on experience gained in implementation of aforesaid

OMs, issues like linkage of validity of TORs with public hearing, the issue of

further extension of validity of TORs, etc. has emerged. The matter has

been examined in detail and the following has been decided in order to

provide more clarity on the subject:

(i) The TORs prescribed for a project or activity will be valid for a

period of two years for submission of EIA and EMP report, except

for River Valley and HEP projects, where the validity of TORs will be

for three years. The TORs will specifically mention the date of expiry

of validity and state that TORs will lapse after that date.

(ii) This period of validity could be extended by the Regulatory Authority

concerned by a maximum period of one year provided an application

is made by the applicant to the Regulatory Authority, atleast three

months before the expiry of validity period, together with an

updated Form-I, based on proper justification and also

recommendation of the EAC/SEAC.

(iii) Some cases have come to the notice of this Ministry where an

application for extending the validity of TORs, as stated at (i) above,

was made by the project proponent and instead the project

proponent submitted complete proposal with EIA / EMP reports

within the period for which it could have obtained extension of TORs

as stated at (ii) above, for grant of environment clearance. Strictly

speaking, all such proposals, not being in line with the existing

instructions, should not be considered by the Regulatory Authority.

However, requests have been received for considering such

proposals citing the reasons that EIA / EMP reports have been

submitted within the prescribed outer time limit for validity of TORs,

efforts put-in for preparing these reports, etc. It has been decided

that while such proposals received till the date of issuance of this

O.M. may be considered by the Regulatory Authority, any such

proposal after the issuance of this O.M., shall not be considered by

the Regulatory Authority. The State Pollution Control Boards

(SPCBS) shall ensure that the public hearing (PH) is conducted

within the timeline of 45 days as prescribed in the EIA Notification,

2006. The SPCBs shall also ensure that PH is held within the validity

period of the TORs, and that no PH is held after the validity period,

of TORs is over. The PH conducted after the expiry of the TORs shall

not be accepted by the Regulatory Authority for appraisal. The PH

should be held well before the expiry of validity of TORs so that EIA

I EMP reports are submitted by proponent within the validity period

of TORs.

(iv) Extension of Validity of TORs beyond the outer limit of three years

for all projects or activities and four years for River Valley and HEP

projects shall not be considered by the Regulatory Authority. In such

cases, the project proponent, will have to start the process de novo

and obtain fresh TORs in case the proponent is still interested in

pursuing the clearance for the project. Re-use of old baseline data

(provided it is not more than 3 years old) for the purpose of

preparation of fresh EIA and EMP report will be considered subject

to due diligence by the EAC/SEAC which may make appropriate

recommendations including the need for revalidation. Baseline data

older than 3 years will not be used for preparation of EIA /EMP

report. In any case, the PH shall have to be conducted afresh in

such cases.

(v) Instances have also come to the notice of this Ministry wherein,

though the EIA / EMP report is submitted by the proponent within

the validity period of TORs, the case remains pending for want of

additional information from the proponent, State Government, etc.,

as sought by the EAC / Ministry. This Ministry has already decided

vide OM No.J-11013/5/2009-IA-II (Part) dated 30.10.2012 that such

cases will be delisted in case such information is not received within

six months. In some cases the proponents have been requesting for

re-listing of their projects after the requisite information has been

submitted after considerable lapse of time. For such cases, it has

been decided that they could be considered provided the date of

public hearing is not more than 3 years old and the data used in

preparation of EIA / EMP report is not more than 3 years old. In

case these conditions are not met, the proponent will have to start

the process de novo after obtaining fresh TORs.”

The case was considered by the SEAC in its 103rd meeting held on

18.11.2014. However, no one from the project proponent attended the meeting

inspite of the fact that the project proponent was informed telephonically to

attend the said meeting.

The Committee, in compliance to office memorandum of the MoEF

dated 04.08.2009 as amended on 25.02.2010, decided to defer the case.

The case is placed before the SEAC for consideration.

Item No. 104.04: Application for obtaining Environmental Clearance for

construction of Residential Apartment Complex namely "Jalandhar Heights- Phase-3" in the revenue estate of Villages Pholriwal & Alipur, Tehsil & District Jalandhar by M/s A.G.I. Infra Ltd.

The facts of the case are as under:

i. M/s G.I. Builders (P) Ltd. was granted environmental clearance vide letter

no. 28225 dated 02.07.2012 for construction of township project namely

'Jalandhar heights' with an area of 30,070 sqm (having seven blocks of 8

floors each, two blocks of 6 floors each, one block of four floors and one

block of 7 floors having total built up area of 75,125 sqm), in the revenue

estate of Village Pholriwal & Alipur, Tehsil & District Jalandhar.

ii. Thereafter, M/s A.G.I. Infra Ltd., was granted environmental clearance vide

letter no. 2779 dated 18.09.2013 for carrying out expansion of an already

existing Residential Apartment Complex namely "Jalandhar Heights" in the

revenue estate of Villages Pholriwal & Alipur, 66 feet Road, Near Urban

Estate Phase-II, Tehsil & District Jalandhar having total built up area of

1,47,790 sqm (total after expansion), in an area of 44,870 sqm (total plot

area after expansion).

iii. Now, M/s A.G.I. Infra Ltd., has applied for obtaining environmental

clearance as required under the EIA notification dated 14/9/2006 for

construction of Residential Apartment Complex namely "Jalandhar Heights-

Phase-3" in the revenue estate of Villages Pholriwal & Alipur, 66 feet Road,

Near Urban Estate Phase-II, Tehsil & District Jalandhar.

iv. The SEAC in its general discussion felt that the project for which

application is received for obtaining environmental clearance should be

visited by the Punjab Pollution Control Board and its construction status be

verified before placing the same in the agenda of SEAC for appraisal.

Therefore, the SEAC decided that as and when an application is being

received for obtaining environmental clearance, PPCB be requested to visit

the site of the project and verify its construction status before the case is

placed in the agenda of the SEAC for appraisal.

v. Therefore, the Punjab Pollution Control Board, Regional Office, Jalandhar

vide letter no. 3292 dated 10.11.2014 was requested to visit the site of the

project and send the detailed status of construction of the project at site,

within 3 days.

vi. The Punjab Pollution Control Board, Regional Office, Jalandhar vide letter

no. 6411 dated 17.11.2014 has intimated that the site was visited by the

AEE on 13.11.2014 and observed that no construction activity was started

at site yet. The site is located adjoining to M/s Jalandhar Heights (Ph-I &

Ph-2), Pholriwal, Jalandhar. The boundary wall construction work of the

project is complete.

The case was considered by the SEAC in its 103rd meeting held on

18.11.2014, which was attended by the following on behalf of project proponent:

a. Sh. Ashwani Kant, General Manager of the promoter Company

b. Sh. Vishal Duggal, of M/s Ace Engineers & Consultants, Environmental Consultant of the promoter company

Before allowing the Environmental Consultant of the promoter

company to present the case, the SEAC observed that the project namely

'Jalandhar Heights' has already been granted environmental clearance for its

Phase-1 and Phase-2 in the revenue estate of Villages Pholriwal & Alipur, 66 feet

Road, Near Urban Estate Phase-II, Tehsil & District Jalandhar having total built up

area of 1,47,790 sqm, in an area of 44,870 sqm. However, the project proponent

has now applied for obtaining separate environmental clearance for the Phase-3

of the project and has filed fresh application.

To the above mentioned observations of the SEAC, the project

proponent informed that Phase-2 was an expansion of Phase-1 of the project and

both the projects were sharing resources such as water supply & sewerage, solid

waste management, STP and power supply etc. However, Phase-3 is an

independent project of the company and the land for the project has been

purchased separately in the year 2014. All the approvals/permissions have been

obtained from the various departments separately for this project (Phase-3).

Moreover, this project is not sharing any resources with the already existing

Phase-1 & Phase-2 of the project. Therefore, fresh application has been filed for

obtaining environmental clearance for the Phase-3 of the project.

The SEAC observed that the reply given by the project proponent is

tenable and allowed the Environmental Consultant to present the case before the

Committee.

Sh. Vishal Duggal, of M/s Ace Engineers & Consultants,

Environmental Consultant of the promoter company presented the project

proposal before the SEAC as under:

The total plot area of the project will be 44870 sqm having the total built up

area 92,161.30 sqm. Permission for change of land use has been granted by

the Deptt. of Town & Country Planning, Punjab for an area measuring as 6.91

acres, vide Memo no. 1057 STP (J) CLU (J) dated 14.03.2014.

The layout plan has been approved by the Department of Town & Country

Planning (STP, Jalandhar) vide letter no. 2627 STP(J) L-11(G) 10-A dated

06.05.2014.

The total water requirement for the project will be 337 KLD, out of which 225

KLD will be met with MC water supply and balance 112 KLD will be met

through recycling of treated wastewater.

MC, Jalandhar issued NOC vide no. SPL-SE/07 dated 07.10.2014, wherein, it

has been mentioned that:

a. The promoter company is allowed to dispose of the sewage into MC, sewer and it shall deposit the necessary charges for getting sewer connection.

b. The existing water supply line has capacity of more than 1000 KLD and the promoter company can take required quantity of 250 KLD of water supply from the said line. However, the promoter company will be liable to pay the requisite charges.

c. The promoter company shall make its own arrangement for door to door collection of garbage and transportation to the nearest dumping site of MC. The promoter company shall comply with the provisions of MSW Rules, 2000.

During summer season, the total wastewater generation from the project will

be 245 KLD, which will be treated in a STP to be installed within the project

premises. The total treated wastewater generation from STP will be 245KLD,

out of which 80 KLD will be used for flushing purpose, 32 KLD will be used for

irrigation of green area and remaining 133 KLD will be discharged into MC

sewer. During winter season, 80 KLD will be used for flushing purpose, 10 KLD

will be used for irrigation of green area and remaining 155 KLD will be

discharged into MC sewer. During rainy season, 80 KLD will be used for

flushing purpose, 3 KLD will be used for irrigation of green area and remaining

162 KLD will be discharged into MC sewer.

The total generation of MSW will be 1000 kg/day. The complex will have

facility for segregation of solid waste followed by disposal through M.C.

Jalandhar.

The power requirement of the project will be 3000 KW, which will be taken

from Punjab State Power Corporation Ltd. The project proponent has a

proposal to provide DG sets (1500 KVA) as power back-up source.

The project proponent has proposed to provide rain water harvesting pits to

replenish the groundwater.

Parking provision has been kept for 866 ECS.

The ambient air monitoring has been got done from M/s Industrial Testing

Laboratory & Consulting House and the analysis results indicate that the

concentration of various pollutants such as PM2.5, PM10, SOx, NOx, O3 and CO

have been measured. Also, ambient noise monitoring has been got done from

the said firm and the analysis results indicate that the noise levels during day

and night times, have been measured as 50.1 dB(A) leq and 49.5 dB(A) leq,

respectively, against the prescribed standards of 55 and 45 dB(A) leq.

The Environment Management Cell will be responsible for implementation of

EMP. Rs. 1.48 crores will be incurred for implementation of EMP. After, the

commissioning of the project, the Environment Management Cell comprising of

Sh. Sukhdev Singh (Managing Director), Sh. Ashwani Kant (General Manager),

Sh. Sharanjit Singh Sahi (Dy. General Manager), Sh. Virender Singh (Project

Manager) will be responsible for implementation of EMP.

Rs. 5 lacs will be utilized for following activities under Corporate Social

Responsibility.

- Arrangement for safe drinking water. - Public hygiene and sanitation - Medical camps including provision of free medicines. - Educational support in form of Scholarships, books, uniforms, computer

facility in schools. - Repair of roads, drains and village ponds. - Provision of road lights/ street lights. - Organizing workshops/camps for educating community on- agriculture,

energy conservation and solar energy, child women health-care, substance abuse etc.

- Plantation.

The traffic circulation plan and Disaster/Risk Assessment & Management Plan

has been prepared and the same has been submitted.

The project proponent requested that there is a proposal for disposal

of the treated wastewater into the M.C. sewer and the permission for the same

has been obtained from M.C. Jalandhar. He further informed that the M.C.

Jalandhar has an operational STP of adequate capacity which can take care of

wastewater to be generated from the proposed project. As such, they may be

exempted from installing their own STP and be allowed to dispose off the

wastewater to be generated from the project, directly into the M.C. sewer without

any treatment.

After the presentation of the Environmental Consultant of the

project proponent, the SEAC raised certain queries to which the project proponent

replied as under:

After considering the reply submitted by the project proponent and

deliberating on the matter, the SEAC decided that the project proponent is

required to submit the certain documents/information for further appraisal of the

project proposal.

(i) Revised proposal for the treatment, reuse and disposal of the wastewater

to be generated by the project which may include segregation of black &

grey streams of wastewater, so that the grey wastewater can be reused

after adequate treatment for flushing purpose etc.

(ii) Revised water balance by considering the water consumption rate as

prescribed by SEIAA, Punjab for population above 5 Lacs i.e. 200 lpcd.

(iii) Proposal for storm water management for areas other than roof top area.

(iv) To carry out ambient air quality monitoring for all the parameters as

prescribed in the NAAQM, for at least one sample.

(v) Location of the DG set, the power station and other utilities, if any, duly

marked on the layout plan of the project.

(vi) Revised plan for the solid waste management of the non-recyclable waste

including its quantification and disposal arrangements.

(vii) The project proponent is required to carry out the groundwater sampling at

shallow aquifer/surface water strata for all the parameters provided in

IS:10500.

The SEAC further, decided to ask the project proponent to submit

the reply of the said observations and defer the case till the project proponent

submits the same.

The decision of the SEAC was conveyed to the project proponent

vide letter no. 3496 dated 26.11.2014.

Now, the project proponent vide letter dated 20.01.2014 has

submitted reply to the observations raised by the SEAC, the details of the same

are as under:

(C) Rainy Season: The fresh water requirement will be 350 KLD which will be met from Municipal water supply. The total wastewater generation from the project will be 360 KLD, which will be separated into two streams of 'black wastewater' and 'grey wastewater' each @ 180 KLD. The 'Grey wastewater' will be treated at site and reused for flushing @ 100 KLD, for green area @ 3 KLD and remaining 77 KLD alongwith black wastewater @ 180 KLD (total 257

Solid waste (MSW) management The MSW is classifiable into following distinct segregable components; 1. Total MSW likely to be generated –

~1000 kg/day 2. Recyclable rejects (e.g., plastic,

paper, rubber, metal, etc.) – about 25% (by weight). Total quantity of this waste is expected to be ~250 kg/day.

3. Non-recyclable rejects – about 75% (by weight).

This is the quantity which needs solid waste management facility.

Total quantity of this waste is expected to be a maximum of 750 kg/day.

Additionally, about 200 kg/day of partially bio-degradable solid waste will be generated, in the

form of primary and secondary sludges from the sewage treatment facility.

MSW Management includes; a) Segregation into the components –

recyclable, and non-recyclable – at source.

The wastes will be dumped in service bins. Separate storage space will need to be provided for each type of component.

b) Collection, handling and disposal of the wastes

The recyclable component to be directly sold to the authorized recycler

The non-recyclable component will need to be disposed through municipal solid waste management site.

It is the responsibility of the MC, Jalandhar, for collection, transportation, and disposal of the non-recyclable solid waste [Rule 2 and Schedule II of Municipal Solid Waste (Management and Handling) Rules, 2000]. The MC shall be paid requisite fee, as applicable from time to time.

7. The project proponent is required to carry out the groundwater sampling at shallow aquifer/surface water strata for all the parameters provided in IS:10500.

Item No.104.05: Application for obtaining Environmental Clearance under EIA notification dated 14.09.2006 for construction of a housing project namely “Vera Gold Mark” at Vill. Bishangarh, Zirakpur, Tehsil Derabassi, Distt. Mohali by M/s Vera Developers Private Limited.

M/s Vera Developers Private Limited has applied for obtaining

the Environmental Clearance under EIA notification dated 14.09.2006 for

construction of a housing project namely “Vera Gold Mark” at Vill. Bishangarh,

Zirakpur, Tehsil Derabassi, Distt. Mohali. The project is covered under category 8

(a) of the Schedule appended to the said notification. The details of the project as

given in Form 1 and 1A and other documents are as under:

o The total land area of the project is 19,156.4 sqm and the total built up

area will be 38,306.8 sq. m.

o The cost of the project is Rs. 50 crores.

o The total water requirement for the project will be 157 KL/day, out of

which 116.4 KL/day will be met through own tubewell and remaining 40.6

KL/day will be met through recycling of treated wastewater.

o The total wastewater generation from the project will be 125.6 KL/day,

which will be treated in a STP to be installed within the project premises.

The project proponent has proposed to use 40.6 KL/day of treated

wastewater for flushing purpose, 34.9 KL/day will be used for irrigation of

green area and remaining 50.1 KL/day will be discharged to MC sewer in

summer season. In winter season, 40.6 KL/day of treated wastewater will

be used for flushing purpose, 9.5 KL/day will be used for irrigation of green

area and remaining 75.5 KL/day will be discharged to MC sewer. In rainy

season, 40.6 KL/day of treated wastewater will be used for flushing

purpose and remaining 85 KL/day will be discharged to MC sewer.

o The total quantity of solid waste generation will be 468 kg/day, which will

be segregated at source as biodegradable and non-biodegradable

components as per the Municipal Solid Waste (Management & Handling)

Rules, 2000. The biodegradable waste would be sent to the approved site.

The non-biodegradable and recyclable waste will be sold to recyclers.

o The total load of electricity required for group housing will be 1500 KW

which will be taken from the PSPCL. There is a proposal to install DG sets

for stand-by arrangement.

o The e-waste generated will be stored in an isolated room and will be sold

to the manufacturers.

o Used oil to be generated from the DG sets will be managed & handled as

per the provisions of the Hazardous Wastes (Management, Handling &

Transboundary Movement) Rules, 2008.

submitted by the promoter and the details of the proposed project are as under:

of land initially by constructing 272 no. residential flats in this land.

(iii) The project proponent has not started any construction activity at the

proposed site, so far.

M/s Chandigarh Colonizers Private Limited has applied for

obtaining the Environmental Clearance under EIA notification dated 14.09.2006

for construction of a housing project namely “Opera Garden” at Vill. Kishanpura,

Zirakpur, Tehsil Derabassi, Distt. Mohali. The project is covered under category 8

(a) of the Schedule appended to the said notification. The details of the project as

given in Form 1 and 1A and other documents are as under:

o The total land area of the project is 35,882.90 sqm and the total built up

area will be 84,375.50 sq. m.

o The cost of the project is Rs. 110 crores.

o The total water requirement for the project will be 350 KL/day, out of

which 259 KL/day will be met through own tubewell and remaining 91

KL/day will be met through recycling of treated wastewater.

o The total wastewater generation from the project will be 350 KL/day,

which will be treated in a STP to be installed within the project premises.

The project proponent has proposed to use 91 KL/day of treated

wastewater for flushing purpose, 40 KL/day will be used for irrigation of

green area and remaining 149 KL/day will be discharged to sewer in

summer season. In winter season, 91 KL/day of treated wastewater will be

used for flushing purpose, 11 KL/day will be used for irrigation of green

area and remaining 178 KL/day will be discharged to sewer. In rainy

season, 91 KL/day of treated wastewater will be used for flushing purpose

and remaining 189 KL/day will be discharged to sewer.

o The total green area to be developed will be 2710 sqm.

o The total quantity of solid waste generation will be 1036 kg/day, which will

be segregated at source as biodegradable and non-biodegradable

components as per the Municipal Solid Waste (Management & Handling)

Rules, 2000. The biodegradable waste would be sent to the approved site.

The non-biodegradable and recyclable waste will be sold to recyclers.

o The total load of electricity required for group housing will be 2800 KW

which will be taken from the PSPCL. There is a proposal to install DG sets

for stand-by arrangement.

o The e-waste generated will be stored in an isolated room and will be sold

to the manufacturers.

o Used oil to be generated from the DG sets will be managed & handled as

per the provisions of the Hazardous Wastes (Management, Handling &

Transboundary Movement) Rules, 2008.

Zirakpur, by M/s Motia Township (P) Ltd.

M/s Motia Township (P) Ltd. was granted environmental

clearance vide letter no. 3005 dated 23.09.2014 for construction of a housing

project namely “Motia Oasis” in an area of 33873.39 sqm having total built up

area 37885.02 sqm in the revenue estate, Zirakpur, Tehsil Derabassi, Distt. S.A.S.

Nagar.

Now, M/s Motia Township (P) Ltd. has applied for obtaining

the Environmental Clearance under EIA notification dated 14.09.2006 for

expansion of a group housing project namely “Motia Oasis” at Zirakpur. The

project is covered under category 8 (a) of the Schedule appended to the said

notification. The details of the project as given in Form 1 and 1A and other

documents are as under:

o The total land area of the project after expansion is 33,873.39 sqm and the

total built up area will be 69,854.87 sq. m.

o The cost of the project is Rs. 120 crores.

o The total water requirement for the project after expansion will be 412

KL/day, out of which 305 KL/day will be met through own tubewell and

remaining 107 KL/day will be met through recycling of treated wastewater.

o The total wastewater generation from the project will be 412 KL/day,

which will be treated in a STP to be installed within the project premises.

The project proponent has proposed to use 107 KL/day of treated

wastewater for flushing purpose, 28 KL/day will be used for irrigation of

green area and remaining 195 KL/day will be discharged to MC sewer in

summer season. In winter season, 107 KL/day of treated wastewater will

be used for flushing purpose, 8 KL/day will be used for irrigation of green

area and remaining 215 KL/day will be discharged to MC sewer. In rainy

season, 107 KL/day of treated wastewater will be used for flushing purpose

and remaining 223 KL/day will be discharged to MC sewer.

o Green belt will be developed in an area of 5107 sqm.

o The total quantity of solid waste generation will be 1220 kg/day, which will

M/s Dynasty Buildwell (P) Ltd. was granted environmental

clearance by MoEF vide letter no. 37 dated 16.09.2010 for construction of a residential

complex namely “Paras Panorama” having 14 blocks (G+6 floors) with 2 bedroom

flats (262) & 3 bed rooms (304) and a club house, on a plot area of 47,396.84

sqm having total built up area 1,19,629.36 sqm in the revenue estate of Tehsil

Kharar, Distt. S.A.S. Nagar.

Now, M/s Dynasty Buildwell (P) Ltd. has applied for obtaining

the Environmental Clearance under EIA notification dated 14.09.2006 for revision

of the housing project namely “Paras Panorama” in the revenue estate of Tehsil

Kharar, Distt. S.A.S. Nagar. The project is covered under category 8 (a) of the

Schedule appended to the said notification. The details of the project as given in

Form 1 and 1A and other documents are as under:

o The total land area of the project after revision will be 47,394 sqm and the

total built up area will be 1,02,998 sq. m having 725 no. of flats and 16 no.

of shops & booths.

o The total water requirement for the project will be 491 KL/day, out of

which 364 KL/day will be met through own tubewell and remaining 127

KL/day will be met through recycling of treated wastewater.

o The total wastewater generation from the project will be 491 KL/day,

which will be treated in a STP to be installed within the project premises.

The project proponent has proposed to use 127 KL/day of treated

wastewater for flushing purpose, 45 KL/day will be used for irrigation of

green area and remaining 221 KL/day will be discharged to sewer in

summer season. In winter season, 127 KL/day of treated wastewater will

be used for flushing purpose, 12 KL/day will be used for irrigation of green

area and remaining 254 KL/day will be discharged to sewer. In rainy

season, 127 KL/day of treated wastewater will be used for flushing purpose

and remaining 266 KL/day will be discharged to sewer.

o The total quantity of solid waste generation will be 1456 kg/day, which will

be segregated at source as biodegradable and non-biodegradable

components as per the Municipal Solid Waste (Management & Handling)

Rules, 2000. The biodegradable waste would be sent to the approved site.

The non-biodegradable and recyclable waste will be sold to recyclers.

o The total load of electricity required for group housing will be 4100 KW

which will be taken from the PSPCL. There is a proposal to install DG sets

for stand-by arrangement.

o The e-waste generated will be stored in an isolated room and will be sold

to the manufacturers.

o Used oil to be generated from the DG sets will be managed & handled as

per the provisions of the Hazardous Wastes (Management, Handling &

Item No.104.10: Application for obtaining Environmental Clearance under EIA notification dated 14.09.2006 for construction of "Central University of Punjab" in the revenue estate of Central University of Punjab, Badal Road, Village Ghudda, Bathinda, Punjab.

The facts of the case are as under:

1. Central University of Punjab has applied vide letter dated 13.10.2014 for

obtaining Environmental Clearance as required under EIA notification dated

14.09.2006 for construction of their Project namely “Central University of

Punjab" at Badal Road, Village Ghudda, Bathinda, Punjab". The project is

covered under Category 8 (b) Township & Area Development Project (Built

up area > 1,50,000 sqm) of the schedule appended to the said notification.

2. The case was considered by the SEAC in its 102nd meeting on 17.10.2014,

which was attended by the following on behalf of the project proponent:

i) Col. Jagdev Kartar Singh (Retd.), OSD of the promoter

company

ii) Sh. Sandeep Garg of M/s ECO Laboratories & Consultants Pvt.

Ltd. of the promoter company

A perusal of the application and presentation made by Sh.

Sandeep Garg, Environmental Consultant of the promoter company reveal,

the salient features of the project as under:-

The total plot area is 2021741.07 sqm having total built up area 11,

47,583.62 sqm. The layout plan has been approved by Department of

Town & Country Planning vide Letter No. 5526 CTP(Pb) SB-129 dated

18-09-2014.

The land has been transferred by Deputy Commissioner, Bathinda, vide

Memo No. 2440 and 2439/DRA Dated 21.11.12 in the name of central

university of Punjab. The permission for change of land use has been

granted by Department of Town & Country Planning. Punjab vide Memo

No.3437 CTP(Pb)/SP 432(B) Dt. Bathinda 20.06.2014.

Total domestic water demand for the project will be 5332 KLD, out of

which 3964 KLD will be met through canal water supply and 1368 KLD

will be met through flushing.

The total wastewater generation from the project is 4266 KLD, which

will be treated in a STP of 5 MLD capacity within the project premises.

In summer season, 1678 KLD will be used for horticulture demand and

remaining 1134 KLD will be disposed off in 22 acre of Green area to be

developed under Karnal Technology. In winter season, 366 KLD will be

used for horticulture demand and remaining 2446 KLD will be disposed

off in 22 acre of Green area to be developed under Karnal Technology.

In winter season, 152 KLD will be used for horticulture demand and

remaining 2660 KLD will be disposed off in 22 acre of Green area to be

developed under Karnal Technology. Green area of 305177.41 sqm is

available with the University.

The permission for water demand of 1.5 cusecs has been obtained from

DC, Bathinda vide letter no. 8364-68 dated 20.09.2012.

The total quantity of solid waste to be generated from the proposed

project has been estimated as 11.1 MT/day, The solid waste will be

segregated to biodegradable and non-biodegradable waste and will be

managed as per MSW Rules, 2000. Biodegradable waste shall be

disposed-off/treated by using mechanical composter. The recyclable

inorganic waste shall be sold to local resellers. Separate area is

earmarked for handling biodegradable waste including segregation and

mechanical composting. The sludge from the sewage treatment plant

will be used as manure in green area inside the university.

The e-waste is handled and managed as per the E-waste (Management

& Handling) Rules, 2011.

The total load of electricity required for proposed project is 1900 KW

which will be supplied by PSPCL. The project proponent has proposed

to install 5 D.G sets are proposed 2 of 600 KVA, 2 of 200 KVA and 1 of

320 KVA with inbuilt acoustic enclosure for backup power supply.

Sh. Sandeep Garg informed that they have been hired as

Environmental Consultants by the university on 12.12.2013. However,

as the requisite permissions, for applying to SEIAA, Punjab for obtaining

the environmental clearance, were under process therefore, the case

could not be applied earlier but to save time, monitoring and collection

of baseline data has already been carried out for the period from April,

2014 to June, 2014.

In view of the above, Col. Jagdev Kartar Singh of the

promoter company requested the SEAC to allow it to use the baseline

data and monitoring report for preparing the EIA report so as to save

time.

After detailed deliberations in the matter, it was decided to

allow the project proponent to use the monitoring reports and the

baseline data, thus prepared, to finalize EIA report after incorporating

the TOR's to be issued by the SEAC. The SEAC categorized this project

as category B-1 and finalised and issued the "Terms of Reference" to

the project proponent vide letter 3264 dated 31.10.2014 for preparation

of the draft Rapid EIA report.

3. Now, the University vide letter no. CUPB/CC/114/EIA/4233 dated

25.11.2014 has submitted the EIA study report.

The case is placed before the SEAC for consideration.

Item no.104.11: Application for obtaining Environmental Clearance under EIA notification dated 14.09.2006 for expansion of an Integrated Residential Township namely "Chandigarh Extension" in the revenue estate of Village Kansal, Rani Majra, Dhode Majra, Rasoolpur in Mullanpur (LPA), District Mohali by M/s Omaxe Chandigarh Extension Developers Pvt. Ltd.

The facts of the case are as under:

1. M/s Omaxe Chandigarh Extension Developers Pvt. Ltd. (Project Promoter)

was granted environmental clearance vide letter 1230 dated 06.02.2014

for the development of an Integrated Residential Township namely

"Chandigarh Extension" in an area of 461.675 acres (consisting of 2719

plots, EWS in 23.94 acres, commercial area in 17.02 acres, public building

in 21.79 acres and green area of 45.31 acres) in the revenue estate of

Village Kansal, Rani Majra, Dhode Majra, Rasoolpur, Parol, Bharounjian,

Salamatpur, Bhagar Majra, District Mohali.

2. The project promoter has now applied for obtaining the Environmental

Clearance under EIA notification dated 14.09.2006 for expansion of the

project in the revenue estate of Village Kansal, Rani Majra, Dhode Majra,

Rasoolpur in Mullanpur (LPA), District Mohali. The project is covered under

category 8 (b) of the Schedule appended to the said notification.

3 The Ministry of Environment & Forests, Northern Regional Office,

Chandigarh vide letter no. 5499 dated 18.06.2014 has sent the compliance

report of the existing project of the promoter company, wherein, it has

been concluded that the project proponent has been trying its best to

comply most of the environmental safeguards during construction phase in

the existing project and has assured to comply the remaining conditions

satisfactorily in future as well. The Ministry of Environment & Forests,

Chandigarh has further mentioned that the project for environmental

clearance for proposed expansion from existing plot area of 461.675 acres

to 577.576 acres be considered on merits.

4. The case was considered by the SEAC in its 97th meeting held on

28.07.2014, and decided to categorize this project as category B-1 and

finalized "Terms of Reference". It was also decided that the project

proponent will also submit the following documents alongwith final rapid

EIA report:

(i) Permission of CGWA for abstraction of groundwater.

(i) NOC from the nearest Airports Authority of India regarding allowable

height.

As decided, the ToRs were conveyed to the project proponent

vide letter no. 2479 dated 14.08.2014 and project proponent was also

requested to submit the above noted documents.

5. Now, the project proponent vide letter dated 27.11.2014 has submitted the

Rapid EIA report. However, the project proponent has not submitted the

following documents:

Item No. 104.13: Application for Environmental Clearance under EIA notification dated 14.09.2006 for developing a residential complex namely “Trishla City” in the revenue estate of Village Nabha Sahib, Tehsil Derabassi, SAS Nagar, Punjab by M/s Trishla Buildtech Pvt. Ltd.

The facts of the case are as under:

The case of M/s Trishla Buildtech Pvt. Ltd., for developing a

residential complex namely “Trishla City” in the revenue estate of Village Nabha

Sahib, Tehsil Derabassi, SAS Nagar, Punjab was considered by the SEIAA in its

44th meeting of SEIAA held on 04.02.2013, wherein, the Authority decided that:

a. To grant environmental clearance under EIA Notification dated

14.9.2006 to the project proponent in light of Office Memorandum

dated 12.12.2012 of the Ministry of Environment & Forests, New Delhi

for the construction of 497 dwelling units having total built up area of

1,02,974 sqm, in an area of 51,709.46 sqm, in the name of 'Trishla City'

in the revenue estate of Village Nabha Sahib, Tehsil Derabassi, District

SAS Nagar, subject to certain conditions.

b. To send the case to the Govt. of Punjab, Department of Science,

Technology & Environment for initiating action under the Environment

(Protection) Act, 1986 against the project proponent/responsible

persons of the promoter company for starting the construction of the

project without obtaining environmental clearance under EIA

notification dated 14.09.2006.

As decided, the environmental clearance was granted to the

project proponent vide letter no. 831 dated 14.02.2013.

Also, the Govt. of Punjab, Deptt. of Science, Technology &

Environment was requested vide letter no. 842 dated 14.02.2013 to initiate action

against the project proponent / responsible persons of the promoter company

under the provisions of the Environment (Protection) Act, 1986 for starting the

construction work of the project without obtaining environmental clearance from

State Level Environment Impact Assessment Authority as required under the EIA

notification no. 1533 (E) dated 14.9.2006.

Thereafter, the Govt. vide Memo No. 203686/1 dated 16.04.2014

has requested the Member Secretary (SEIAA) to get the clarification from the

Govt. of India, MoEF, New Delhi, giving full facts of the case, about what action is

required to be initiated by the Govt. as mentioned at para 5 (i) of the Office

Memorandum dated 12.12.2012 and environmental clearance granted to the

project proponent.

However, the Director, Northern Regional Office, MoEF, Chandigarh

was already requested vide letter No. 16131 dated 08.04.2013 to apprise as to

what procedure is to be adopted for the project proposals, where the project

proponents submit the resolution alongwith application mentioning that the

violations will not be repeated in future, in view of Office Memorandum dated

12.12.2012 of Ministry of Environment & Forests, New Delhi.

Thereafter, the OM dated 12.12.2012 was considered in the 2nd

combined meeting of SEIAA & SEAC dated 06.05.2013, wherein, Sh. Surinder

Kumar, Director, Ministry of Environment & Forests informed that the

SEIAA/SEAC should follow the procedure as mentioned in the Office

Memorandum dated 12.12.2012 of the Ministry of Environment & Forests while

processing the cases of the projects, which have violated the provisions of EIA

notification dated 14.09.2006 by starting construction activities of the project

without obtaining environmental clearance.

After discussions, the members of SEIAA and SEAC decided that in

future, all the cases, where the violation of EIA notification dated 14.09.2006 is

observed due to start of construction activities without obtaining environmental

clearance under the said notification, will be processed as per the procedure

mentioned in the Office Memorandum dated 12.12.2012 irrespective of the fact

that whether the project proponent has submitted a resolution alongwith

application mentioning that the violations are unintentional and will not be

repeated in future or not.

The above noted decision of the 2nd combined meeting of SEIAA &

SEAC held on 06.05.2013 and clarification given by representative of MoEF

during the meeting was conveyed to the Govt. of Punjab, Deptt. of Science,

Technology & Environment, Chandigarh vide letter no. 23103 dated 20.05.2014.

Now, the Govt. of Punjab, Deptt. of Science, Technology &

Environment vide Memo No. 10/29/2013-STE(4)/315586/1 dated 23.09.2014

(received on 14.10.2014) has informed that now the Govt. of India, MoEF, New

Delhi vide notification No. S.O. 638 (E) dated 28.02.2014 has empowered SEIAA

to initiate action u/s 19 (a) of the Environment (Protection) Act,1986, at its own.

The Govt. has also informed that the project proponent has assured not to violate

any of the provisions of the EIA notification dated 14.09.2006 in future. The Govt.

has remanded the case to SEIAA for reconsideration of its decision dated

14.02.2013 and pass a fresh order in light of the notification dated 28.02.2014.

The case was considered by the SEIAA in its 73rd meeting held on

31.10.2014, which was attended by Sh. Harish Gupta, M.D. of the promoter

company.

Sh. Harish Gupta, M.D. of the promoter company submitted that:

(ii) Initially it was planned to develop and construct a multi-storey

housing project having built-up area 12300 sqm and plans were

sent to M.C. Zirakpur for approval. Considering the self

certification scheme for approval of plans and because the built

up area of the project was below 20,000 sqm, the development

& construction activities were started at site.

(iii) Later-on, M.C. Zirakpur vide letter No. 2776 dated 09.08.2011

returned our plans and advised to make some changes as per

building bye-laws. Accordingly, the construction activity was

stopped immediately and project proposal was revised and re-

submitted to M.C. Zirakpur. The revised proposal was having

area more than 20,000 sqm as such, the revised project required

environmental clearance. The revised plan was sanctioned by

M.C. Zirakpur on 25.01.2012 and application for obtaining

environmental clearance was filed before SEIAA thereafter.

(iv) Construction and development activity was re-started only after

environmental clearance was granted by SEIAA, Punjab.

(v) They have not violated the provisions of EIA notification dated

14.09.2006 as construction activity was initiated without

environmental clearance when the proposed built up area was

less than 20,000 sqm and in that case no environmental

clearance was required.

He submitted a written representation dated 30.10.2014 narrating

the above stated facts and attached the following documents:

(i) A copy of initial layout plan having area 12,300 sqm.

(ii) Copy of letter no. 2776 dated 09.08.2011 issued by M.C. Zirakpur

(iii) Copy of sanction letter no. 151 dated 25.01.2012 and approved revised

layout map issued by M.C. Zirakpur.

(iv) Copy of letter dated 20.01.2012 regarding submission of revised layout

maps to M.C. Zirakpur.

He further stated that they were not fully aware of the requirements

of SEIAA/SEAC at the time of previous presentations and requested to consider

his request regarding exemption from initiating legal action sympathetically.

After deliberations, the SEIAA decided to send the request made by

the project proponent to SEAC for recommendations in the matter.

The matter was considered by the SEAC in its 103rd meeting held

on 18.11.2014, which was attended by Sh. Harish Gupta, M.D. of the promoter

company.

The SEAC observed that the project proponent is required to

submit the clarification from M.C. stating that the earlier layout plan submitted to

them for approval, on which the observations were conveyed vide letter dated

09.08.2011, was having built up area less than 20,000 sqm before his request is

considered.

After deliberations, the SEAC decided to ask the project proponent

to submit the above noted document and defer the case till the project

proponent submits the same.

The decision of the case has been conveyed to the project

proponent vide letter no. 3499 dated 17.11.2014.

Now, the project proponent vide letter dated 28.11.2014 has

submitted a copy of letter No. 3160 dated 28.11.2014 issued by the M.C.

Zirakpur, addressed to M/s Trishla Buildtech Pvt. Ltd., wherein it has been

mentioned that the maps which were returned by M.C. Zirakpur vide letter no.

2776 dated 09.08.2011 having proposed area 1.773 acres and total constructed

area demanded was 14,360.0372 sqm and the FAR was 1:2 against the Govt.

policy of 1:1.75 and more high density flats were proposed whereas at that time

the area was covered under medium density and proposal was not fulfilling with

the conditions of Master Plan, hence the maps were returned back for necessary

changes. However, lateron more area was added in the scheme and same was

approved by M.C.

The case is placed before the SEAC for consideration.
