DEFENDANT SKYWAY CAPITAL MARKETS, LLC’s UNOPPOSED MOTION

FOR EXTENSION OF TIME TO RESPOND TO COMPLAINT

Defendant Skyway Capital Markets, LLC, a Florida limited liability company

(“Skyway”), through undersigned counsel, hereby moves the Court to extend Skyway’s deadline

to respond to the Complaint by forty-five (45 days), to and through May 22, 2020. In support,

Skyway states:

1. Plaintiff Q3 Investments Recovery Vehicle, LLC, a Florida limited liability

company (“Plaintiff”), initiated this action on March 12, 2020, naming Skyway Capital Markets,

LLC as a defendant.

2. Skyway was subsequently served with the complaint on March 18, 2020, making

its response due on April 7, 2020.

3. In light of the scope and duration of the events alleged in the Complaint, and the

numerous different individuals and entities alleged to be involved, Skyway submits that

additional time is required for it to adequately respond.

4. In addition, due to the challenges presented by the ongoing COVID-19

(coronavirus) pandemic, as well as Hillsborough County’s “COVID-19 - Safer at Home” order in

effect since March 28, 2020, leading to critical measures to limit workplace access and

interaction, Skyway has requested, and Plaintiff has agreed to, a 45-day extension of time until

May 22, 2020, for Skyway to respond to the Complaint.

5. The requested extension will allow Skyway adequate time to investigate and

address the allegations contained within the Complaint. In particular, Skyway believes in good

faith that viable legal and equitable arguments and defenses exist, and accordingly requests the

additional time in order to investigate and develop them.

6. No other defendant has entered a notice of appearance.

7. No parties will suffer prejudice if this request for extension of time is granted. In

contrast, Skyway would be prejudiced in having to respond to the lengthy complaint without

adequate time to develop its arguments and defenses.

8. This motion is submitted in good faith and not for the purpose of unreasonable

delay.

9. Pursuant to Thirteenth Circuit Local Rule 3.7, undersigned counsel has conferred

with Paul B. Thanasides, counsel for the Plaintiff, who has represented that the Plaintiff does not

oppose the relief requested herein.

WHEREFORE, Defendant Skyway respectfully requests that this Court enter the

attached order extending Skyway’s deadline to respond to the Complaint by 45 days, through

and including May 22, 2020, and grant any other relief that is just and proper.
